The visit summary was reviewed with the provider, Mrs. LaShawn Bagley and a copy was given to her at the conclusion of the visit. Upon arrival, I was greeted by Mrs. Bagley. I completed a general walk through of the indoor and outdoor environment. There were five (5) preschool children present during the visit. The children were observed watching a program on television upon arrival. The provider did turn off the television and the children engaged in free play. Administrative Action: This family child care home is currently on an Administrative Action. This was not posted and available for review upon arrival. Prior to me leaving Mrs. Bagley did post the Administrative Action, Cover letter and Corrective Action Plan. This was visible to parents and visitors near the entrance. The program’s compliance history was 81% prior to today's visit. INSPECTIONS *The last annual compliance visit was conducted on April 16, 2024. *The last fire drill was documented completed on 2/14/25, the shelter-in-place drill was last completed on 1/10/25 and the last documented outdoor inspection was conducted 3/2025. DESIGNATED CHILDREN’S SPACE In the children’s space, is upon entering the home. The bedroom to the right is a space where the children rest during rest time. The bathroom is located before you reach the kitchen to the left. All activities take place in the child care space. The children are prevented access to the upstairs level of the home by a closed gate. *The outdoor play area is fenced next to the providers home. *The provider informed me of the following: -There are no infants enrolled. -Medication is not being administered to any of the children. -Transportation is not provided at this time. -There have not been any incident/accident reports written. During this visit, a full assessment of Child Care Requirements was conducted. A checklist was used to note the requirements monitored today. The following violations were observed, documented and technical assistance regarding maintaining compliance was offered. Violation Number Comment Rule 543 Screen time was not prohibited for children under the age of three. The operator did not offer alternative activities for children under the age of three years. Upon arrival there where children under three years of age watching a program on the television. .1718(c) 910 Copy of each child's health assessment, including the operator's own preschool child(ren), was not on file within 30 days of enrollment. This was not available for review in two children files during today's visit. I informed the provider, LaShawn Bagley, of the purpose of my visit upon arrival. Ms. Bagley was caring for 8 preschool age children. They were playing in the primary child care space. My supervisor, Kaye Adkins, accompanied me today. Ms. Bagley’s grandmother, Ms. Johnson, arrived a short time later to assist Ms. Bagley. Ms. Johnson told me she helps out time to time. Ms. Bagley’s mother stopped by for a short time. A therapist was also present. I observed the children playing with the toys and materials accessible to them. Ms. Bagley told me she did not have children enrolled in the second shift. Ms. Bagley did not know the full names of the children. it took an hour for me to get the names of the 6 children from Ms. Bagley. She could never tell me the names of two children other than one child’s first initial of the first name and the other child’s nickname. There were files for 5 children only. There were no attendance records except for three children for the week of September 2. Ms. Bagley did not have the well water test completed. She paid the fee for the bacterial analysis on 11/12/2024, but nothing else has been done. D. Tucker has the criminal record qualification letter on file. He was qualified on 11/5/2024. I observed the following violations. Violation Number Comment Rule 102 Number of preschool children exceeded five children, including the provider's own preschool children. "The provider was caring for eight (8) preschool age children during today's visit. She is licensed to care for no more than five (5) preschool age children at any given time. This is a repeat violation" GS 110-91(7)(b) 801 Bacteriological analysis indicating the water is free of bacteria had not been performed on a sample of water from each well used for the children's water supply every two years. Results were not kept on file in the home. "On 11/12/2024, the provider paid a fee to have the water analysis to be completed. However, water sample has not been taken, and the water analysis test has not been completed. Ms. Bagley told me she has not reached out to the agency conducting the analysis. This is a repeat violation." 10A NCAC 09 .1725(a)(1) 919 Accurate records were not maintained for all staff and children. "There were nine (9) children enrolled. There were files for only five children. This is a repeat violation." G.S. 110-91(9) 921 Operator did not maintain accurate daily attendance records including documentation of arrival and departure for all children in care, including the operator's own preschool children. "There were no attendance records maintained for today nor the prior two months. This is a repeat violation." .1721(e)(6) 1940 Hazardous cleaning supplies and other items that might be poisonous e.g. toxic plants, were not out of reach or in locked storage when children were in care. "A spray bottle of Bathroom Cleaner for Mildew was within children's reach on a low shelf located in the primary child care space." .1719(a)(6) The above violations must be corrected immediately. I must receive a compliance letter or statement in writing by 12/3/2025 for the above violations. In the compliance letter, include the following: 1.Your Facility ID# and Facility Name. 2.Violation item numbers. 3.Explain in detail what you did to correct each violation item. Falsification: If you state in your letter that corrections have been made when they have not, this will be considered falsification of information. This may result in an Administrative Action. Willful noncompliance and repeat violations may result in an Administrative Action. Compliance: Child care operators are required to maintain compliance with all applicable child care requirements at all times. GS 110-90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past 18 months. Failure to do so may result in the issuance of a provisional license or other administrative action. Your compliance history score before today’s visit was 80%. Technical assistance >As a licensed provider, you cannot care for more than five (5) preschool children at any given time. In addition, you may care for three (3) school age children. Provider’s own preschool child counts toward the limit of 5 preschool children you are allowed to care for. >A file is required for each child who attend your home. Use the File checklist as a guide to ensure you have all the required records. Staying organized may help you maintain compliance. I discussed with Ms. Bagley a few methods of organizing the children's files and staff file. >Attendance record which includes the arrival and departure times of all children are required to be completed each day. One of the reasons this is important is that in the event first responders re called, they need to be able to sort/identify the children present especially if you are incapacitated. >It is your responsibility to be up to date and current on child are rules. Child Care Rulebook (Chapter 7) can be accessed by going to the DCDEE Website, https://ncchildcare.ncdhhs.gov/. Go to the Provider tab and hover over it. Click on Child Care Rules tab. >Additional Caregiver: Utilize the Checklist I provided for an additional caregiver, your grandmother, for records. >Well water bacterial analysis: You’d want to follow up with the town regarding the timeline for the bacteriological analysis. Reach out to me if you need to request for an extension if the town is not able to take the water sample and provide you the result by 12/3/2025. At the end of the visit, I provided Ms. Bagley an opportunity to ask questions regarding today's visit and interpretation and implementation of child care requirements. She could never tell me the names of two children other than one child’s first initial of the first name and the other child’s nickname. There were files for 5 children only. I informed the provider, Lashawn Bagley, of the purpose of my visit upon arrival. I observed 7 preschool age children resting in the primary child care space. Ms. Bagley told me the two of the children present today were newly enrolled children and that they attend periodically. Ms. Bagley telephoned the parent to pick up the children. They left a short time later. Toward the end of today’s visit, I heard faint voices of young children. The voices I heard seemed to come from an adjacent room which was “locked” with a sliding chain device at toward the top of the door. Ms. Bagley told me “That’s my cousin. He is upstairs.” She told me the cousin was 13 years old. I had Ms. Bagley open the door. I observed two preschool children, 3-year-old and a 4-year-old, playing with no adult present. There were 3 cots with covers in the room in the midst of storage boxes and household items. When I came out, Ms. Bagley closed the door and proceeded to “lock” it again with the children inside. I told her she must supervise those children. She opened the door. I asked Ms. Bagley why the children were in the room. Ms. Bagley stated the mother of the children asked her to keep them in the room when she dropped the children off, sometime before I arrived. There were no attendance records for me to review. Ms. Bagley told me her husband, D. Tucker whose CBC letter expired on 5/10/2024, was out of town and that he will be staying at his mother’s home across town when he returns. Ms. Bagley stated she understands her husband cannot be in her home and/or the premise of the home unless she has his qualification letter on file. During the visit, I observed Ms. Bagley’s husband, D. Tucker, come up the stairs to the front door to drop off their 5-year-old son. Ms. Bagley opened the door and turned them away. I informed the provider, Lashawn Bagley, of the purpose of my visit upon arrival. I observed 7 preschool age children resting in the primary child care space. Ms. Bagley told me the two of the children present today were newly enrolled children and that they attend periodically. Ms. Bagley telephoned the parent to pick up the children. They left a short time later. Toward the end of today’s visit, I heard faint voices of young children. The voices I heard seemed to come from an adjacent room which was “locked” with a sliding chain device at toward the top of the door. Ms. Bagley told me “That’s my cousin. He is upstairs.” She told me the cousin was 13 years old. I had Ms. Bagley open the door. I observed two preschool children, 3-year-old and a 4-year-old, playing with no adult present. There were 3 cots with covers in the room in the midst of storage boxes and household items. When I came out, Ms. Bagley closed the door and proceeded to “lock” it again with the children inside. I told her she must supervise those children. She opened the door. I asked Ms. Bagley why the children were in the room. Ms. Bagley stated the mother of the children asked her to keep them in the room when she dropped the children off, sometime before I arrived. There were no attendance records for me to review. Ms. Bagley told me her husband, D. Tucker whose CBC letter expired on 5/10/2024, was out of town and that he will be staying at his mother’s home across town when he returns. Ms. Bagley stated she understands her husband cannot be in her home and/or the premise of the home unless she has his qualification letter on file. During the visit, I observed Ms. Bagley’s husband, D. Tucker, come up the stairs to the front door to drop off their 5-year-old son. Ms. Bagley opened the door and turned them away. Upon arrival, I was invited in by the provider, Lashawn Bagley. She was supervising two children. Ms. Bagley had three children enrolled in first shift and three in second shift. I conducted a walk-through of the indoor and outdoor areas. I observed the children playing with the toys and materials accessible to them in the child care space, living room. Ms. Bagley told me she does not provide care for third shift and would like it removed from her license. She stated does not transport children. I observed the following violations and reviewed them with Ms. Bagley in detail and provided technical assistance. Violation Number Comment Rule 908 Health questionnaire was not completed annually. The last health questionnaire was completed on 3/22/2023. .1703(a)(1) 920 Records were not made available for review. CPR and First Aid training records were not available for review. G.S. 110-91(9) 1301 Operator did not complete the required number of on-going training hours as specified in rule. The provider did not complete any of the required on-going training hours. GS 110-91(11); 10A NCAC 09 .1705(b)(5) The violations documented above shall be corrected immediately. I must receive a compliance letter/statement from you by 4/30/2024. The current child care rules specifically state no blankets or other items can be used/placed with a sleeping infant aged 12 months or younger. 2.Weighted blankets or vests can potentially restrict a child’s movement; therefore, they are prohibited for use unless a therapist requests and approves the use. A therapist can only approve the use for children 13 months or older. 3.If the use of a weighted blanket or vest is something a facility wants to consider using, you’d need to contact me prior to use to ensure compliance with applicable requirements. Reminders >Conduct an emergency drill this month. >Well water analysis is due by 5/24/2024. >Take the Clean Water Webinar and have your well water tested for Lead.
