Your program currently operates with a four-star license May 2, 2020, earning seven points in the education component, two points in the program standards component (completed self-study and self-assessment using FCCRS) and one quality point by all infant capacity restricted to no more than two children under one year of age. The allegations are as follows: There are allegations of violations of childcare requirements. Ms. Misty Smith, Owner assisted me during today’s visit and responded to allegations. Ms. Smith was not present when the incident occurred due to a medical appointment and she a qualified substitute in place. Ms. Smith arrived back at the FCCH after the incident but before the parent arrived approximately between 4:10 pm- 4:20 pm. On June 3, 2026, at approximately between 3:45 p.m.- 4:00 p.m., a teacher was transitioning three children two preschool-aged children (ages three and four) and one infant (11 months) from the indoor environment to the outdoor play area. The teacher allowed the two older children to walk down the fours steps ahead of her while she held the infant’s hand and assisted the infant down the stairs. As the group descended the steps, the four-year-old child stopped abruptly. This caused the teacher to momentarily lose balance as she attempted to avoid tripping. At this point, the group was on the last step, transitioning to ground level. A parent was approaching the entrance to pick up her children, and during the sudden stop, the infant’s face made contact with the side of the stair. The approaching parent quickly reached forward, lifting the infant to help steady the teacher and prevent a fall. Misty Smith, FCCH Owner, returned to the outdoor area as staff and the parent were ensuring that all individuals were safe. The parent, who is also the owner’s adult daughter, entered the FCCH to retrieve a cool compress. The infant presented with no broken skin; a small area above the right cheekbone and below the eye appeared lightly reddened. The owner and teacher observed the infant and provided comfort. The parent later departed with her two children approximately 4:23 p.m. as reflected on the sign out sheet, leaving the infant in care. Upon the other parent’s arrival, the owner and teacher explained the incident. The parent declined further discussion, raised her voice toward the owner, and exited the facility. The teacher had begun completing the incident report immediately after the event; however, it had not been finalized before the parent arrived. The owner attempted to contact the parent later that day to check on the infant’s condition and to inform her that the incident report had been completed. The parent did not answer phone calls, and the owner sent a text message requesting a return call when convenient. Based on the interviews and observations conducted, the allegation of allegations of violations of childcare requirements was unsubstantiated. One violation was observed during today's. Violation Number Comment Rule 1847 A child care operator did not notify the Division of any new child care providers, as defined in G.S. 110-90.2(a)(2), who were hired or moved into the child care facility within five business days. Misty Smith, Owner did not update the ABCMS roster with herself as the owner with a current qualification letter. Criminal background unit provided technical support by phone during today's visit to give instructions of what must be done to update the roster. G.S. 110-90.2 & .2703(r) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. The violation documented must be corrected immediately. On or before June 23, 2026, I must receive a written, dated, and signed compliance letter that describes accurately and in detail how and when the violations were corrected. Please be aware that any information submitted by you is considered legal documentation. If it is determined the information provided in the letter is not true, this may be considered falsification of information. If sufficient information is not received by the due date, a follow-up visit will be conducted. Avoid escalating tension. • If the parent doesn’t respond to follow up, document the times and methods of contact, and any response or lack thereof.
