A checklist was used to note the requirements I monitored today. During the visit the Administrator/Owner Ms. V. McMillan accompanied me on the walk- through of the facility and assisted with the visit. This program currently operates with a four-star license issued April 29, 2019. I monitored the indoor and outdoor environments for compliance with child care requirements. Staff/child ratios, supervision, use of space and capacity were monitored for compliance. The permit, sanitation, evacuation, safe arrival, and departure procedures, first aid chart, menus, activity plans, daily schedules, emergency care plan, emergency telephone numbers, staff records, summary of NC Child Care Law, were all posted at the time of the visit. The storage of medication and hazardous products was also monitored for compliance. The staff and children’s records were also reviewed today. Files for new staff were monitored with a random selection of returning staff members. Prior to the visit I received your staff and training worksheets. Your signature on these forms will serve as verification that the information provided is accurate. A random selection of children’s files was reviewed, and the children’s record worksheet was completed. During the visit, the infants/toddlers were observed playing with toys with two staff members. The preschool children were observed playing outside on the playground. The lunch menu met the meal pattern requirements. Your last fire drill was completed 8/26/25 and your last monthly outdoor playground inspection was dated 9/10/25. Your last EPR drill was a shelter-in-place completed 6/25/25. I reminded you that an EPR drill must be completed every three months and keep all paperwork on file for review. Your last fire inspection was dated 2/25/25. Your last sanitation inspection was completed 12/28/24 with a superior rating. Please contact Environmental Health and your local fire inspector within 30 days of the due date to request an inspection to be completed. Once your inspections have been completed, mail or email them to me. I recommend that you place your due dates on a calendar or spreadsheet to help you maintain compliance. The two vans used to transport children inspection expires on 10/31/25 and 8/31/26. Your insurance for both vans expires 3/17/26. The violations documented were corrected during today’s visit. Violation Number Comment Rule 1033 On or before the first day of work, all staff, including the director and individuals who volunteer more than once per week did not provide results indicating that they were free of active TB and/or TB test or screening was older than 12 months. One staff member did not have a negative TB test on file prior to her employment date of 6/24/24. .0701(a) 1044 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years for the date of issuance). One staff member's qualifying letter expired 8/4/25 and the new qualifying letter on file was dated 8/8/25. G.S. 110-90.2(b) & .2703(n)&(o) 1792 Staff did not model appropriate eating behaviors by consuming food or beverages that meet the nutritional requirements specified in the Meal Patterns for Children in Child Care Programs in the presence of children in care. In space #1, I observed a staff member's water bottle with a red liquid in it that did not model appropriate nutritional behaviors. .0901(i) 1897 The child care administrator and all staff did not complete the Recognizing and Responding to Suspicions of Child Maltreatment training within 90 days of employment. One staff member with a employment date of 3/5/24 did not complete the training within the first 90 days of employment as required. .1102(g) Childcare licensing requirements are established to ensure a safe and healthy childcare environment. Therefore, it is important for you to be knowledgeable of all of the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the childcare law and rules. Technical assistance regarding the following items were reviewed with you today. I reminded you the health and safety trainings have been relocated from Pro-Solutions to Moodle on the DCDEE website and they are free of charge. I discussed various other training resources, including those online and in-person. Remember continuing professional development training provides you and your staff with the knowledge and skills needed to provide a quality child care program. Please be reminded the health and safety training courses are required to be completed every five years. CBC Provider Portal Technical Assistance & Notification to the Division of New Hires or Residents Technical Assistance Guidance As stated in G.S. 110-90.2 & .2703(r) child care operators are to notify the Division of any new child care providers working who were hired or moved into the child care facility within five business days. The process of notifying the Division has changed and is now captured in ABCMS. This change has been in effect since February 2024. Effective immediately, you will need to obtain a Business NCID and complete Provider Portal training in Moodle at https://www.dcdee.moodle.nc.gov/course/view.php?id=119. No action is needed on your part if you have completed the reference training and are currently using the ABCMS Provider Portal to update information regarding new hires or residents. Once the training has been completed and access has been given, you must verify your facility roster to ensure current staff are noted on the roster. This information should be updated in ABCMS in an ongoing basis as staff members are hired and when their employment is terminated. This satisfies the requirement to notify the Division of new child care providers working who were hired or moved into the child care facility within five business days. During today’s visit I completed a walk-through of the facility with Ms. V. McMillian Owner/Administrator who also assisted with today’s visit. The group size, supervision, ratio, capacity and approved space were in compliance. The restrictions, license and emergency care plan were posted. First Aid/CPR, storage of hazardous materials and the NC Child Care Summary of the Law was posted. I monitored the program requirements, furnishings and equipment, outdoor area, and medications. The theme of the lesson plans were on the alphabet, listening skills, shapes, and sharing. The infants were observed during tummy time with two staff members in the classroom. The preschool children were observed playing in activity areas in their classrooms and later playing outside on the playground. The lunch menu was posted and consisted of fish filet with cheese slice, corn, bun, broccoli, and milk for today. The program currently operates with a four-star license issued April 29, 2019. During the visit I reminded you to make sure all staff have sent their education to WORKS to be evaluated. The hold harmless has been extended until further notice at this time. Your last fire drill was completed 3/19/25, and your last monthly outdoor playground inspection was dated 2/28/25, a violation was documented. You stated your last EPR drill was a shelter-in-place completed 3/19/25 but you did not post the date on the form, a violation was documented. Today I reminded you that an EPR drill must be completed every three months and documentation kept on file for review. Violations documented were corrected during the visit. Upon arrival I was greeted by the owner’s daughter Ms. Shea, assistant administrator who accompanied me on the walk through and assisted with today’s visit. You stated you would call your mom and let her know I was present. I spoke with the Owner/Administrator Ms. McMillan on the phone, and you stated you would not be on site during today’s visit, and your daughter Ms. Shea could sign all documentation for you. I verified that Ms. Shea was on the legal designee form to sign any documentation in the absence of the Administrator. This program currently operates with a four-star license issued April 29, 2019. Please be reminded to have all staff’s education sent to WORKS to be evaluated. The hold harmless has been extended until further notice at this time. Please be reminded you may apply for your rated license at any time. I monitored the indoor and outdoor environments for compliance with child care requirements. Staff/child ratios, supervision, use of space and capacity were monitored for compliance. The lunch menu for today consisted of spaghetti, bread, salad, pineapple, and milk. Your last fire drill was completed 9/11/24 and your monthly playground inspection was dated 9/12/24. Your last EPR drill was a shelter-in-place dated 9/11/24. I reminded you an EPR drill must be completed every three months and to keep all documentation on file for review. You have one mini van and a larger van to transport children. The inspection on both vans expires on 10/25 and your insurance expires 3/17/25. Your last fire inspection was dated 1/31/24. Your last sanitation inspection was completed 6/17/24. Please contact Environmental Health and your local fire inspector within 30 days of the due date to request an inspection to be completed. Today we reviewed the forms that need to be updated yearly, and you stated you would usually have the staff update the yearly forms at the beginning of the new year. I suggest checking on qualifying letters for the expiration date, along with ITS-SIDS and CPR/FA. DHHS Memo on Funding and Enrollment Public schools and licensed child care facilities in North Carolina are eligible to participate in the funding mechanisms to cover the costs of testing for lead in water and inspecting for asbestos and lead-based paint hazards beyond the May1, 2024 deadline. Facilities that have not enrolled should complete the online process by November 1, 2024. The Clean Classrooms for Carolina Kids Program is providing free facility-wide testing and inspections without any out-of-pocket costs. Due to the volume of testing and inspections, completion of the online enrollment process in the program is considered temporary compliance with the testing and inspection requirement and will allow facilities to participate in the funding mechanisms. Required water testing for child care centers under Rule 15A NCAC 18A .2816 is not affected by the November 1 deadline. There are concerns: Children are not adequately supervised. Incident reports are not prepared as required. Upon arrival I was greeted by the Administrator/ Owner Ms. McMillan who assisted me with today’s visit. I explained there was a complaint, and I reviewed the allegations with you, and you were given the opportunity to ask questions and provide information. Child Care Consultant Tanya Herring accompanied me on today’s visit. A computer-generated document will be sent to you. During today’s visit I discussed the first allegation: I asked if she was she aware of any kind of incident that occurred on 8/6/24 in the toddler classroom and she stated yes a child that is learning to walk and not yet very stable on their feet yet pulled up on the gate in the classroom and fell hitting his cheek. You stated a boo boo report was completed, and the child’s parent signed the form. You stated the on 8/6/24 you had one staff member, and three children present in the classroom. You stated the staff member was supervising the children but could not get to the child in time before the fall. You stated the needs of the children are met daily and the staff interact with each individual child in their care and provide supervision. I spoke with the staff member about the incident that occurred on 8/6/24 and she stated she had another child in her arms and could not get to the child before he fell. The classroom is set up where the staff can visually see and hear all of the children and provide adequate supervision. I verified an incident did occur on 8/6/24 with a young child. Based on the conversations with the Owner/Administrator, staff members and observations today the incident was not due to lack of inadequate supervision, therefore the allegation of inadequate supervision is not substantiated. The child referenced in the complaint is no longer enrolled, but the older sibling is still enrolled at the facility. The second allegation: incident reports are not prepared as required. Today I spoke with you and a staff member about an incident that occurred on 7/30/24 in which a child had received ant bites, and you stated you did not complete a boo boo report for this. A violation was documented due to the staff member stating she had put Benadryl crème on the ant bites. Since a child had received ant bites, I reviewed your monthly playground inspections and you had not completed one since 3/19/24, therefore a violation was documented. I observed the playground where the toddlers play and did not observe any ants today. During the visit you provided the boo boo report for the incident in the toddler classroom on 8/6/24. You stated each classroom has a boo boo notebook and today you provided the notebook for the toddler classroom. I reviewed the notebook and observed the reports do not include all the information that is required in accordance with child care rules, therefore the allegation incident reports are not prepared as required is substantiated. During today’s visit I observed the classroom alleged in the allegation and there were two one year old children present with two staff members. The children were observed playing on the cushion area of the classroom with toys and they were being supervised by the staff members. Limited monitoring of the child care requirements occurred during today’s complaint visit. Today there was a total of 25 children present ranging from ages 0-11 years of age. Please send me a written statement describing how and when the above violation was corrected. The written statement must be received no later than August 28, 2024. Please note that if your letter is mailed, a hand written signature is required. As an alternative, compliance letters can now be submitted via email. I recommend emailing your letter to reduce the time needed to ensure my receipt of your information; however, if you do not have access to email, please ensure that your letter is mailed in a timely fashion and that you allow for any possible delays in the mail service. Please note that the two- week timeframe is established to allow time for submission of your letter, not for correcting the violations. All violations should be corrected immediately or as soon as possible. Please contact me if you have questions pertaining to your compliance letter or if you will not be able to meet the two-week timeframe for submission of your compliance letter. Remember you must log all incident reports into the incident log. Please be reminded you must complete a monthly playground inspections and check the playground daily prior to children going out to play on the playgrounds. A checklist was used to note the requirements I monitored today. During the visit the Administrator / Owner accompanied me on the walk through the facility and assisted with the visit. Today you stated you have 2 staff absent one in the 2-3 year old class and one in the preschool class. You stated you had to move one of the toddler teachers to the preschool classroom for today and you were assisting in the toddler classroom. You stated you had to move 3 of the three year old children to the preschool classroom for in order to maintain staff/child ratios. This is reflected on the children's enrollment worksheet. This program currently operates with a four-star license issued April 29. During the visit I reminded you to make sure all staff have sent their education to WORKS to be evaluated. During today’s visit we discussed the status of your rated license and at this time the hold harmless has been extended until June 2024. Your facility is in Cohort 2 and your prep year is 7/1/24-6/30/25 and your reassessment year is 7/1/25/-6/30/26. You stated when you were ready to apply for a rated license you would contact me. I monitored the indoor and outdoor environments for compliance with child care requirements. Staff/child ratios, supervision, use of space and capacity were monitored for compliance. The permit, sanitation, evacuation, safe arrival, and departure procedures, first aid chart, menus, activity plans, daily schedules, emergency care plan, emergency telephone numbers, staff records, summary of NC Child Care Law, were all posted at the time of the visit. The storage of medication and hazardous products was also monitored for compliance. The staff and children records were also reviewed today. Files for new staff were monitored with a random selection of returning staff members. Prior to the visit I received your staff and training worksheets. Your signature on these forms will serve as verification that the information provided is accurate. A random selection of children’s files was reviewed, and the children’s record worksheet was completed. During the visit, the children were observed playing in activity areas inside their classrooms and outside on the playground. Today the lesson plans had themes on fall activities, alphabet, and colors. The lunch menu consisted of chicken taquitos, mixed vegetables, corn, mandarin oranges, and milk. Your last fire drill was completed 8/24/23 and your last monthly outdoor playground inspection was dated 8/1/23.Your last EPR drill was a shelter-in-place dated 9/12/23. I reminded you that an EPR drill must be completed every three months and keep all paperwork on file for review. Your last fire inspection was dated 1/19/23. Your last sanitation inspection was completed 6/5/23 with a superior rating. Please contact Environmental Health and your local fire inspector within 30 days of the due date to request an inspection to be completed. Once your inspections have been completed mail or email them to me. I recommend that you place your due dates on a calendar or spreadsheet to help you maintain compliance. The Ford van and the Honda minivan used to transport children insurance expires May 2024 and the inspection expires for both on 10/31/23. Two violations were documented and corrected during the visit. Violation Number Comment Rule 1032 Child care providers and uncompensated providers who are not substitute providers or volunteers, including the director did not have a medical report on file prior to employment that was signed by a health care professional and/ or the medical report was older than 12 months. Two staff members with a hire date of 8/29/22 and 7/31/23 did not have a medical report on file prior to employment less than 12 months on file. Both staff currently have a medical report on file. 10A NCAC 09 .0701(a) 1033 On or before the first day of work, all staff, including the director and individuals who volunteer more than once per week did not provide results indicating that they were free of active TB and/or TB test or screening was older than 12 months. Two staff members with a hire date of 8/29/22 and 7/31/23 did not have a negative prior to employment. Both staff members currently have a negative TB test on file. .0701(a) Childcare licensing requirements are established to ensure a safe and healthy childcare environment. Therefore, it is important for you to be knowledgeable of all of the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the childcare law and rules. Technical assistance regarding the following items were reviewed with you today. All flexibilities expired, except for the flexibilities related to the star rated license. During today’s visit I reviewed with you information needed prior to an employee working in your childcare. Information needed: qualifying letter, negative TB test, and medical assistant completed prior to employment. You stated you understood and did not have any questions. I reminded you the health and safety trainings have been relocated from Pro-Solutions to Moodle on the DCDEE website and they are free of charge. I discussed various other training resources, including those online and in-person. Remember continuing professional development training provides you and your staff with the knowledge and skills needed to provide a quality child care program. Please be reminded the health and safety training courses are required to be completed every five years.
