Maria Hagans, Owner/Caregiver, was present during the visit. You were informed of the purpose of my visit. The allegation was reviewed with you. Five (5) children were present during the visit. However, enrollment was not completed. Children were observed napping. The caregiver monitored children while they were napping to ensure the safety of the children. The permit restrictions on the family child care home license were reviewed and monitored today. The facility was in compliance with the permit restrictions. FINDINGS/OBSERVATIONS: The required components for a complaint visit were monitored. Observations were completed. When asked if there have been any recent parent complaints, Ms. Hagans stated no. The report received stated concern that the children do not go outside when weather permits. When asked, Ms. Hagans stated she has not taken the children out for several reasons. She stated one because of the traffic that comes through the community. The home sits close to the street which causes concern for the safety of the children. Ms. Hagans further stated there is a garbage dumpster directly across the street that keeps nets, wasps, and bees which also has been concerns for the safety of the children. During monitoring visits, the front yard has always been monitored for outdoor environment. Ms. Hagans has stated on prior monitoring visits the children are taken to the park, or they have equipment that is taken outside and or stored in the container outside for large gross motor skills. However, Ms. Hagans stated she has not taken the children to the park due to limited space for safety car seats in her vehicle used to transport the children. Also, she stated she was told by a previous consultant she could not take the children to the backyard due to stomps. The backyard and side yard were observed. Based off the information provided, the complaint was substantiated. The following violation of child care requirements were documented. Violation Number Comment Rule 501 Children did not have the opportunity for outside play each day that weather conditions permit. Children haven't had the opportunity for outside play when weather conditions permit. G.S.110-91(2)(i) & .1718(a)(1) The following violation must be corrected immediately. The letter must describe, in detail, specifically how each violation has been corrected and any supporting documents. You can mail or email me with verification of compliance regarding the violations that were documented. If you choose to mail, two signed and dated copies must be sent and received by September 4, 2025. Please be aware that any written information submitted by you regarding correction of the violations documented during today's visit is legal documentation. TECHNICAL ASSISTANCE: During the visit, we discussed ensuring the children go outside. Considering the safety of the children due to traffic and the dumpster, I informed you that the yard space on side of the house is a great place for the children to play outside. To maintain compliance, children should have a minimum of one hour of outside play each day that weather conditions permit. ADMINSTRATIVE ACTION: Substantiated complaint visits may warrant administrative actions. If a decision is made to issue an Administrative Action, you will receive information in the mail. This facility operates with a Three Star License issued September 11, 2018. The last annual compliance visit was completed June 8, 2023. A checklist was used to note the requirements monitored during the visit. M. Hagans, Owner/Operator was present and available to assist. Six (6) children ages one (1) year to (4) four years of age were present during the visit. The children were observed during eating lunch and preparing for nap. Diapering and handwashing were also observed. The caregiver interacted with the children in a positive manner. A walkthrough of the facility was completed. This family child care home is licensed to serve eight (8) children. A current occupation permit dated May 14, 20234 and a current fire inspection dated May 13, 2024 was observed. Fire drills, shelter in place/lockdown drills, and playground inspections were all current. You stated you do provide transportation. This program is owned and operated by Maria Hagans, Sole Proprietor. The following violation of child care requirements were documented. Violation Number Comment Rule 102 Number of preschool children exceeded five children, including the provider's own preschool children. Six children ages one to four was observed during the visit. GS 110-91(7)(b) 923 Operator did not keep records of monthly fire drills, quarterly lockdown or shelter-in-place drills, incident reports, incident logs, accurate attendance, emergency numbers, emergency preparedness and response plan, field trip/transportation permission, pet vaccinations records and/or playground inspections monthly outdoor safety checks for a minimum of one year. Playground inspections was observed incomplete. The last inspection was completed in January 2024. .1721 (e)(7) 1103 For each child being transported, the operator or other transportation provider did not have identifying information, including the child's name, photograph, emergency contact information, and a copy of the emergency medical care information form required by Rule .1721(a )(3) in the vehicle whenever children were transported. The vehicle used to transport children front two tires did not pass the penny inspection. .1723(13) The above violations must be corrected immediately. TECHNICAL ASSISTANCE AND CONSULTATION: CAREGIVER & CHILDREN RECORDS: Verification of required information for operator form was received and information was verified in compliance. Children records were monitored and verified in compliance. PLAYGROUND INSPECTIONS: Inspections for the outdoor environment should be completed and documented monthly. The last inspections observed completed was January 2024. To ensure compliance, you should create a to do list or document on calendar as a reminder to complete the inspection. CAPACITY: The number of preschool children present exceeded the number of children allowed. You are licensed to care for eight children total but no more than five preschool children at any time. You are currently submitting proper documentation to change your capacity. You should not care for more than five preschool children until your new capacity is approved and you receive your updated license. TRANSPORTATION: You should comply with all applicable state and federal laws and regulations concerning vehicles and the transportation of passengers. The front two tires on the vehicle used to transport children were not in compliance with the penny check. To ensure compliance with transportation, you should do a vehicle check daily. SANITATION RULES: Children’s Environmental Health has newly readopted child care sanitation rules effective July 1, 2023. You should review new sanitation rules on our website to ensure compliance. CLEAN WATER FOR US KIDS: The Clean Water for Carolina Kids program is expanding to the Clean Classrooms for Carolina Kids program. This is a legislatively mandated effort to address lead and asbestos hazards in North Carolina public schools, licensed child care centers, and licensed family child care homes. Participation allows facilities to meet all rule requirements for identified lead and asbestos hazards, as required by law. Rules 10A NCAC 41C .1001 through .1007 require all programs to be free of lead and asbestos hazards. RTI is coordinating all the lead in water, paint and asbestos testing and remediation. There are webinars that child care providers can watch to get instructions. Go to https://www.cleanwaterforuskids.org/en/carolina/ for more information. Currently operating child care facilities are required to test for lead in paint and asbestos once unless the consultant notes a concern during a visit and refers the program to environmental health. All existing licensed programs must complete the application summary for their program regarding lead paint and asbestos. If the application has not been completed, it should be done immediately. Rule 15A NCAC 18A .2816 requires currently operating child care centers to test water initially and every three years. Most of you have completed your initial testing and now it is time for your three-year retest. STAR RATED LICENSE (SRL): The hold harmless legislation was extended and signed into law on Monday June 12th, 2023. This legislation allows facilities to remain at their current star level without a reassessment until June 30, 2024, and when reassessed it reduces the education evaluation requirements for lead teachers from 75% to 50% until June of 2026. To prepare for the reassessment process, DCDEE has developed a cohort system. There are three cohorts, and each includes a preparation year and a reassessment year. Your facility is on cohort one.
