Currently, this facility operates with a Three-Star license issued on August 10, 2017. The center's last annual compliance visit was completed on February 15, 2023. A checklist was used to note the requirements I monitored during the visit. The last sanitation inspection was completed on August 24, 2023, earning a “Superior” classification and “6” demerits. The last satisfactory fire inspection was completed on July 31, 2023, and was approved for day time care. K. Dew, Owner/Operator was present and available to assist. Thirty-three (33) children aged zero (0) to five (5) years old were present. Children were observed in free choice play, teacher directed activities, toileting, handwashing, and eating lunch. All staff interacted with children in a positive manner. You stated you do not provide transportation. The center is owned by K&R of Nashville, Inc. This corporation was found to have a Current/Active Status under the NC Secretary of State website. The following violations of child care requirements were documented. Violation Number Comment Rule 812 Electrical outlets and power strips, not in use, which were located in space used by children did not have safety outlets or were not covered with safety plugs unless located behind furniture or equipment that cannot be moved by a child. Electrical outlets and power strips not in use in space 1 and space 5 was not covered with safety plugs. 10A NCAC 09 .0604(c) 847 Parent's medication authorization did not include required information. Two forms in space #1 did not have the parents signature authorizing staff to apply diaper cream. 10A NCAC 09 .0803(4)(6-9) The above violations must be corrected immediately. The letter must describe, in detail, specifically how each violation has been corrected and any supporting documents. You can mail or email me verification of compliance regarding the violations that were documented. If you choose to mail, two signed and dated copies must be sent and received by February 8, 2024. The best way for you to make sure that you are meeting all requirements is to periodically review the child care law and rules. Compliance History: Prior to today's visit, this facility has maintained an 18-month compliance score of 95%. TECHNICAL ASSISTANCE AND CONSULTATION: CHILDREN AND STAFF RECORDS: Ten percent (10%) or more of children’s records were monitored. Children records reviewed, were in compliance. Ten percent (10%) or more of existent staff files were monitored. Staff records reviewed were in compliance. ELECTRICAL OUTLETS: Outlets not in use should be covered with a safety plug. To ensure the safety of the children, I would encourage you to delegate staff members to walk the building in the morning and evening to complete an outlet check. Teachers should also complete an outlet check throughout the day. This was corrected during the visit when staff covered the outlets. PERMISSION TO ADMINISTER: A permission to administer form should be completed and signed by parents to apply diaper cream and or ointment. To ensure compliance, staff should make sure forms and signatures are completed before parent leave cream. SANITATION TRAINING ANNOUNCEMENT: Children’s Environmental Health has newly readopted child care sanitation rules effective July 1, 2023. You should review new sanitation rules on our website to ensure compliance. STAR RATED LICENSE (SRL): The hold harmless legislation was extended and signed into law on Monday June 12th, 2023. This legislation allows facilities to remain at their current star level without a reassessment until June 30, 2024, and when reassessed it reduces the education evaluation requirements for lead teachers from 75% to 50% until June of 2026. To prepare for the reassessment process, DCDEE has developed a cohort system. There are three cohorts, and each includes a preparation year and a reassessment year. Your facility is in cohort one and this is your preparation year. More information will be received as cohort approaches. EARLY CHILDHOOD EQUIVALENCY EXAM: The North Carolina Early Childhood Equivalency Exam is a new pathway option comparable to a NC Early Childhood Credential. Applicants who achieve a score of 80% or higher on the NC Early Childhood Equivalency Exam earn the new North Carolina Early Childhood Equivalency Certificate. This certificate is equivalent to a North Carolina Early Childhood Credential and will qualify the individual to be a lead teacher in an early childhood classroom. To take the exam, go to DCDEE Moodle and select Early Childhood Professional Development/Child Care and Development Fund (CCDF)/North Carolina Early Childhood Equivalency Exam. Name of Operation: A NEW DAY CHILD CARE Facility ID: 64000362 Consultant: FELICIA FAISON Operation Type: Center Case Number: 1223-174L Visit Date: 12/20/2023 Number Present: 31 Completed Date: 12/20/2023 Age: From 0 To 4 Total Minutes: 245 Time In: 01:00 PM Time Out: 05:05 PM Time In: Time Out: List to Use: Center Type Of Visit: Complaint Visit Announced/Unannounced: Unannounced The purpose of today’s unannounced visit was to investigate a complaint report alleging violations of child care requirements regarding age-appropriate activities. Upon arrival, K. Dew, administrator, was present at the facility. The allegation of the report was reviewed with you, and you were given the opportunity to respond and ask questions. The following child requirements were monitored: supervision, permit restrictions, staff/child ratios, adequate/approved space, and age-appropriate activities. Permit restrictions for this facility include first shift care only and enhanced space which were in compliance. This facility is owned by K&R OF NASHVILLE, INC. The corporation is listed as current and active in the North Carolina Secretary of State corporation’s database. Children were observed napping, completing toileting and handwashing routines, and having snack. Interactions between teachers and children were nurturing in nature. The following violations of child care requirements were documented today. Violation Number Comment Rule 410 Each child did not have an opportunity to be outdoors daily, if weather conditions permitted. The children did not go outside daily when the weather permitted. Space #4 was scheduled to go outside at 3:30pm and space #2 at 3:45pm, however neither went outside despite weather conditions permitting. Any repeat of the violations documented during the visit may warrant some type of Administrative Action. ALLEGATIONS There was a concern regarding alleged violation of the child care requirement related to age-appropriate activity care-giving activities specifically providing outdoor play as weather permits. FINDINGS I reviewed and discussed the allegations with you, K. Dew and staff. You and staff have not received reports of concern from staff, parents, or community members regarding age-appropriate activities. I observed that while schedules in space #2 and #5 note outdoor play at 3:45 pm and 3:30pm respectively they did not go outside during the visit. Staff noted that they do not take children outside if it is “too cold,” when asked how it’s determined if it’s too cold, they look up the temperature or step outside to feel and if it’s too cold to them they do not go outside. One staff person stated if it is below 20 degrees or above 99 degrees there is no outdoor play. It was also confirmed that children have not been outside “lately” or “much” since the weather has gotten colder. However, weather permitting is determined by looking up the temperature and then comparing that and wind speed to the Child Care Weather chart which is used to determine if weather permits. Weather did permit for outdoor play as the temperature was 47 degrees with winds at 5 mph, which means conditions were in the “green” per the Child Care Weather Watch chart. I reviewed the Child Care Weather Watch chart with you and left a copy for your reference. The chart can be found under “Provider Documents” on the DCDEE website: https://ncchildcare.ncddhs.gov. We also discussed reminding parents to dress their children appropriately for the weather as they do go outside while in care when possible. It is also possible for parents to leave extra outer wear at the center for their child to use as they see fit. You noted that currently there is no information in the parent handbook regarding outdoor play requirements. However you plan to add the information, which would be best practice. If you do add to the parent handbook and/or staff policies/procedures ensure that parents and/or staff sign off, and date, that they have reviewed the new policy. Based on the information received, and my observations, the allegation regarding age-appropriate activities is substantiated related to outdoor play. Due to documentation of a substantiated allegation an Administrative Action may be issued to the child care center. Please review section .2200 of the Child Care Rules for detailed information related to Administrative Actions. TECHNICAL ASSISTANCE & REMINDERS Technical assistance given as we reviewed the requirement regarding activity schedules and plans for children and outdoor play in licensed child care which is noted in section .0508 of the Child Care Rules. We also reviewed the weather watch document which helps providers determine if weather permits outdoor play. While you do have an older version posted I left a more recent copy with you. If the weather does not permit, then a gross motor activity must be offered to replace outdoor play. You inquired about requirements when the air quality is considered unhealthy. I emailed guidance regarding requirements for outdoor play when air quality is poor. Depending on the color code children may still go outside for limited amounts of time if air quality is not green that day. Please refer to the air quality chart referenced in the email and found at https://airquality.climate.ncsu.edu/air-guide/aq-datasets/ or call 1-888-RU4NCAIR (1- 888-784-6224). Continue to ensure that staff place infants in their assigned cribs if they fall asleep in the infant swing. To remain in compliance with safe sleep requirements infants should not be allowed to sleep in swings even if they are adjusting to preschool cribs. While no violation was warranted, when staff in classrooms with children under the age of three (3) years use a tablet or laptop to play music, ensure that the screen is turned away from children if a video also plays. Child care rules require that any children under the age of three (3) do not participate in screen time. Hands on exploration and social interaction with caregivers and other children help in developing cognitive, language, motor and social emotional skills which are not promoted as well through screen time. The NC Commission for Public Health adopted and approved the amended rule regarding lead water testing effective October 1, 2019. The rule requires all licensed child care centers to test all drinking water faucets and food preparation sinks for lead contamination once every three years and take immediate action if elevated concentrations are found. You confirmed that you have already had the facility tested for lead in the water and are keeping the report on file for Environmental Health Services review. Licensing fee invoices were emailed December 1, 2023 and are due by December 31st. Please be reminded that failure to pay the license fee is a violation of General Statutes 110-90(1a) and will result in a penalty assessment, accrued interest, and issuance of an Administrative Action.
