Michelle O’Kelley, Child Care Consultant accompanied me during today’s visit. A. Randolph, Administrator, assisted me with today’s visit. Your program currently operates with a three -star license, issued 10/22/2019, earning 5 points in the education component, 2 points in the program standards component and 1 quality point for all lead teachers have an AAS or higher in ECE/CD. The last annual compliance visit was conducted on 10/9/23. The sanitation inspection was completed on 5/30/24 with a “Superior” classification. The last fire inspection was conducted 4/9/24. The center's compliance history was reviewed with the operator. The program’s compliance history was ninety-two percent as of 10/1/24. The NC Secretary of State website was reviewed on 10/1/24 and Oasis Learning Center was listed as current- active. A walk-through of the facility was completed today, all indoor and outdoor areas were monitored. Children throughout the center were engaged in free play and personal care routines. Developmentally appropriate toys were available on low-lying open shelves. Children playing with cars and trucks, looking at books, and interacting with their peers. The fenced outdoor space located behind the building was observed to have stationary climber, riding toys, water table, and balls for the children to engage in gross motor activities. Lunch was observed and provided by the parents. The following violations were documented: Violation Number Comment Rule 544 Screen time was offered to children under three years of age. Upon arrival, “Trolls” was playing on the television. There was a child two (2) years of age present in the room. .0510(f) 1044 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years for the date of issuance). Staff, Latilya Teele, qualification letter expired on June 26, 2024 and information for requalification was not submitted prior to the expiration. G.S. 110-90.2(b) & .2703(n)&(o) 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. One of two staff files reviewed, first aid card on file expired on 3/1/24. .1102(c) 1049 All staff did not successfully complete certification in CPR training appropriate to the age of the children in care. Verification of staff completion of the CPR course from an approved training organization was not in the staff file. One of two staff files reviewed, CPR card on file expired on 3/1/24. .1102(d) 1790 A statement acknowledging the parental decision to opt out of the supplemental food provided by the center was not signed by the parent and/or maintained on file at the center. A child enrolled on 11/2/22 during lunch was eating food provided by the parent. In review of the child’s file a nutrition opt-out form was not on file. .0901(d) 1851 The operator did not notify the parent of each child enrolled in writing of the smoking and tobacco restriction. In the child’s file reviewed written notification of smoking and tobacco restriction was not available for review today. .0604(j) As a licensed child care operator, it is your responsibility to be knowledgeable of the child care laws and rules and to maintain compliance with them. The NC General Statutes (Updated September 2020), Child Care Rules (Updated January 1, 2024), and the “What’s New” section of The Division of Child Development and Early Education (DCDEE) website, ncchildcare.ncdhhs.gov, are excellent resources to help you stay current with the child care requirements. The most current forms and documents needed for your licensed facility are available under the Provider tab. Many of them are now interactive so that you can type right into the form. Many of the forms needed for families are now offered in Spanish too. And of course, I am also available to assist you, should you have questions about the child care requirements. Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. The violation(s) documented must be corrected immediately. On or before 10/16/24, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. Please be aware any information submitted by you is legal documentation. If it is determined the information provided in the letter is not true, this may be considered falsification of information. If sufficient information is not received by the due date, a follow-up visit will be conducted. Background screenings are needed to provide a safe program environment, support children’s health and safety, and are important for preventing child maltreatment in early care and education programs. A CBC must be completed prior to employee hire and every five years thereafter. An expiration date is now listed on each Qualification Letter. Submissions can also be made six months before the expiration date listed on the current Qualification Letter. Staff, Latilya Teele, qualification letter expired on June 26, 2024 and information for requalification was not submitted prior to the expiration. This violation must be corrected within fifteen (15) days, by 10/17/24, and a copy of the qualification letter must be sent with the required compliance letter. We reviewed the use of the nutrition opt-out form. CPR/First Aid - Knowing what to do in an emergency medical situation can mean the difference between life or death. Being trained in CPR and first aid can be invaluable when someone is in serious medical distress. Therefore, it is so important that all staff working directly with children have current CPR and First Aid Certification. One(1) of two (2) staff files reviewed, first aid and CPR card on file expired on 3/1/24. You stated if it was not in her file then she must not have it. As we discussed, use your staff and training worksheet to keep up with dates. Smoking and Tobacco Policy- Maintaining accurate documentation at the child care center is important because it demonstrates compliance with the child care rules and ensures the health and safety of each child. Notification of your smoking and tobacco restriction must be in writing and given to each parent prior to enrollment. In the child’s file reviewed written notification of smoking and tobacco restriction was not available for review today. Review your children’s files on a regular basis to ensure all information is on file, as required. As we discussed, use the Children’s Record form that is already attached to your folders to periodically audit your files. Additional Comments: Provider Access to ABCMS - Beginning February 1, child care administrators can access the Automated Background Check Management System (ABCMS) This access will allow providers to: •See the real-time background check status of staff members. •Run a printable report of the staff roster to assist with compliance visits. •See new background check applicants and add them to the staff roster. Access to the ABCMS requires the successful completion of a Moodle course consisting of a short video followed by a test. All staff must connect their CBC with your license number and the date this was completed listed on your Staff and Training Worksheet. Ms. Randolph, administrator assisted as needed with the visit. Your program currently operates with a three -star license, issued 10/22/2019. The last annual compliance visit was conducted 11/9/2022. The sanitation inspection was completed on 4/4/2023 with a “Superior” classification. The last fire inspection was conducted 3/2/2023 and your facility was approved for daytime care only. The center's compliance history was reviewed with the operator. The program’s compliance history was 93% as of 10/6/2023. The NC Secretary of State website was reviewed on 10/6/2023 and Oasis Learning Center was listed as current- active. Upon arrival the children were engaged in indoor freeplay. Developmentally appropriate toys were available on low-lying open shelves. After indoor freeplay the children transitioned to personal care routines and outdoor freeplay. The fenced in outdoor play area consisted of an assortment of balls, chairs, push/pull toys, and large umbrellas for shade. After outdoor freeplay the children transitioned to personal care routines to prepare for lunch. Lunch was observed and provided by the parents. Each child has a Nutrition Op-Out form on file. New Criminal Background Check Changes – Legislative changes approved on 7/11/2022 made two important changes to Criminal Background Checks required for child care professionals: 1. The period for background check qualification renewals was changed from every 3 years to every 5 years 2. The provisional qualification period was reduced to 45 days The Division intends to implement these changes as soon as possible. An individual’s current Qualification Letter (QL) will be extended 2 years for a total of 5 years. Updated letters will not be generated. Individuals with a Provisional Qualification Letter due to an out-of-state check will received a qualifying letter on the 45th day. Letters are generated in the CBC Portal. Annual Licensing Fee – Licensed facilities that have a current license (whether active or inactive) on October 1st of each year will receive an invoice for a licensing fee based on their licensed capacity. Ms. Randolph, administrator assisted as needed with the visit. Your program currently operates with a three -star license, issued 10/22/2019. The last annual compliance visit was conducted 11/9/2022. The sanitation inspection was completed on 4/4/2023 with a “Superior” classification. The last fire inspection was conducted 3/2/2023 and your facility was approved for daytime care only. The center's compliance history was reviewed with the operator. The program’s compliance history was 93% as of 10/6/2023. The NC Secretary of State website was reviewed on 10/6/2023 and Oasis Learning Center was listed as current- active. Upon arrival the children were engaged in indoor freeplay. Developmentally appropriate toys were available on low-lying open shelves. After indoor freeplay the children transitioned to personal care routines and outdoor freeplay. The fenced in outdoor play area consisted of an assortment of balls, chairs, push/pull toys, and large umbrellas for shade. After outdoor freeplay the children transitioned to personal care routines to prepare for lunch. Lunch was observed and provided by the parents. Each child has a Nutrition Op-Out form on file. The following violations were documented. Violation Number Comment Rule 842 A drug or medication was administered without written authorization and/or instructions from a child's parent or authorized health professional. Medical authorization was not available for review for an Epinephrine injection pen. 10A NCAC 09 .0803(1)(a & b) 1851 The operator did not notify the parent of each child enrolled in writing of the smoking and tobacco restriction. In two(2) out of two(2) files reviewed there was no documentation of notification. .0604(j) Child care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. The violation(s) documented must be corrected immediately. On or before 10/23/2023, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. Please be aware any information submitted by you is considered legal documentation. If it is determined the information provided in the letter is not true, this may be considered falsification of information. Parents must complete a medication authorization form upon delivering the medication to the child care facility. Today a valid medication authorization form was not available for an Epinephrine Injection pen. You removed the medication from the classroom space and stated the you will inform the parent to complete the form upon pickup. Create a plan and share it with your staff to ensure all medications received have the correct authorization form and it is completed properly before accepting it from the parent. Smoking and Tobacco Policy- Maintaining accurate documentation at the child care center is important because it demonstrates compliance with the child care rules and ensures the health and safety of each child. Notification of you smoking and tobacco restriction must be in writing and given to each parent prior to enrollment. In two(2) out of two(2) files reviewed written notification was not available for review today. Review your children’s files on a regular basis to ensure all information is on file, as required. As we discussed, use the Children’s Record form that is already attached to your folders to periodically audit your files. New Criminal Background Check Changes – Legislative changes approved on 7/11/2022 made two important changes to Criminal Background Checks required for child care professionals: 1. The period for background check qualification renewals was changed from every 3 years to every 5 years 2. The provisional qualification period was reduced to 45 days The Division intends to implement these changes as soon as possible. An individual’s current Qualification Letter (QL) will be extended 2 years for a total of 5 years. Updated letters will not be generated. Individuals with a Provisional Qualification Letter due to an out-of-state check will received a qualifying letter on the 45th day. Letters are generated in the CBC Portal. Annual Licensing Fee – Licensed facilities that have a current license (whether active or inactive) on October 1st of each year will receive an invoice for a licensing fee based on their licensed capacity.
