The facilities last annual compliance visit was conducted on September 13th, 2023. A checklist was used to note the requirements I monitored today. The center currently operates with a 5- star license, operating at 30sq. ft. inside, & enhanced ratios and space. My visit was conducted with owner/ Ms. Patel and Ashley Harvell/ director. The children were observed participating in teacher directed & free play activities today both inside and outside. During the walkthrough to obtain enrollment and conduct my observations. I monitored for required posted documents (license/restrictions, EMC plan, sanitation, ITS-SIDS policy/poster, first aid and CPR poster, no smoking posting), interactions between staff and children, discipline, supervision, group sizes, space capacity, program requirements, EPR, equipment, furnishings, and medication requirements. This facility does not provide transportation to the enrolled children. All transportation is provided by the parents of the enrolled children. A review of seventeen children’s files was conducted and one violation of childcare requirements was cited. An incomplete review of staff files was conducted and due to the disorganization or incomplete staff files following the review of just two staff files I ended my visit and informed the owner and director that a return visit in the near future would need to be conducted to do a staff file review of all staff and to please per requirements make a health file for each staff person and reorganize and make sure all staff files are complete with all training certificates for review upon my return. A violation of childcare requirements for staff files were cited today for first aid and CPR training as well as the medical information not being separated from the main file. VERIFICATION OF RECORDS: *Last fire inspection= 11/21/2023- and approved for daytime care *Sanitation inspection= 4/19/2024- 25 demerits and a provisional status. A re-inspection was conducted on 4/26/2024- 15 demerits and a superior rating. *On September 10th, 2024, I reviewed the NC Secretary of State’s website and observed Krishav Inc. owner of the facility (The Learning Experience) listed as current-active. • The following violation were cited during today’s visit. Violation Number Comment Rule 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. All staff that took training with G. Person in July 2022 expired in July 2024 and did not renew training. .1102(c) 1049 All staff did not successfully complete certification in CPR training appropriate to the age of the children in care. Verification of staff completion of the CPR course from an approved training organization was not in the staff file. All staff that took training with G. Person in July 2022 expired in July 2024 and did not renew training. .1102(d) 1320 Children's records that include an application for enrollment, medical and immunization records, and permission to seek emergency medical care was not on file for each child. Review of seventeen children files found three files whose medicals were either not available or incomplete. GS 110-91(1);.0302(d)(2); .0304(g) 1890 Each staff member did not have the required medical report, proof of tuberculosis test or screening and/or completed health questionnaire in a medical file, maintained separately from the staff member's individual personnel file. Staff medical information was not filed separate from the main file. .0701(d) 9995 A violation was found for which there is no item number. Per Sanitation rule: 15A NCAC 18A .2806 FOOD STORAGE AND PROTECTION (a) Once pre-packaged food has been opened, the food shall be stored in clean, resealable bags or containers made of plastic or glass that are tightly covered and manufactured for the purpose of food storage. walkthrough of the kitchen pantry found open Ritz crackers and boxed mashed potatoes open and taped shut instead of being in approved containers following opening. Technical assistance/reminders: • During today’s visit I requested that you go classroom to classroom and update the ratio sheets as some were difficult to read because they were light in color as well as the age group listed (ex. youngest child was 2 but the chart said 3) for the room was not correct. • A sanitation violation was cited today for the storage of food in the kitchen, per sanitation rule any and all open packaging must be stored in a sealed container following opening. This container can be a Ziploc bag, or a glass/plastic container with a lid that seals the contents in the container. • A follow-up discussion was had regarding ABCMS criminal record requirement. If you have not done so please re-watch the training video and follow the steps with your business NCID username and password and link staff to your facility so you will have access to their CBC letters. Violations of childcare requirements were cited during today’s visit and require a letter of corrective action by September 20th, 2024. Please document the facility name, ID#, item #, how you corrected the violation and how you will keep in compliance going forward. The facilities last annual compliance visit was conducted on September 13th, 2023. A checklist was used to note the requirements I monitored today. The center currently operates with a 5- star license, operating at 30sq. ft. inside, & enhanced ratios and space. My visit was conducted with Julie Stone, co-director, Ashley Harvell, new co-director and owner Ms. Jane Patel arrived during the visit. I asked and Ms. Jane Patel informed me that former director Ms. Latha is no longer employed as director of the facility effective May 31st, 2024. The children were observed participating in teacher directed & free play activities today both inside and outside. During the walkthrough to obtain enrollment and conduct my observations. I monitored for required posted documents, interactions between staff and children, discipline, supervision, group sizes, space capacity, program requirements, EPR, staff and infant feeding schedules and sleep charts, equipment, furnishings requirements. This facility does not provide transportation to the enrolled children. All transportation is provided by the parents of the enrolled children. VERIFICATION OF RECORDS: *Last fire inspection= 11/21/2023 *Sanitation inspection= * Fire drill 7/19/2024 * Lockdown 1/18/20 *Playground inspection- 7/24/2024 * EPR plan last updated 9/13/2023 * water testing- 8/25/2023 * lead paint and asbestos requirement has not yet been completed per review of the clean water for Carolina kids account. Once requirement is complete please send me the exemption email. • One violation of non-compliance was observed or cited during today’s visit. Violation Number Comment Rule 887 Caregivers did not document compliance with visually checking on sleeping infants aged 12 months or younger and/or the documents were not maintained for a minimum of one month. Review of sleep charts in both infant rooms found inconsistencies in completion, or documents were not available because they were discarded. .0606(g) *****CHILD CARE RULE AND LAW UPDATES***** • We talked briefly about legislation passing the QRIS-Session Law 2024-34 regarding accreditation and star rated licensure and that the commission will be meeting to put it into rule. I asked that you review the email sent back on December 12th, 2023, and review the new accreditation options for rated license that were approved. • A violation of childcare requirements was cited during today regarding infant safe sleep charts. Sleep charts per rule 10A NCAC 09 .0606 SAFE SLEEP PRACTICES (a) Each center licensed to care for infants aged 12 months or younger shall develop, adopt, and comply with a written safe sleep policy that: (1) specifies that caregivers shall place infants aged 12 months or younger on their backs for sleeping, unless: (A) for an infant aged six months or less, the center receives a written waiver of this requirement from a health care professional; or (B) for an infant older than six months, the center receives a written waiver of this requirement from a health care professional, or a parent or a legal guardian. (2) specifies no pillows, wedges or other positioners, pillow-like toys, blankets, toys, bumper pads, quilts, sheepskins, loose bedding, towels and washcloths, or other objects may be placed with a sleeping infant aged 12 months or younger. (3) specifies that children shall not be swaddled. (4) specifies that nothing shall be placed over the head or face of an infant aged 12 months or younger when the infant is laid down to sleep. (5) specifies that the temperature in the room where infants aged 12 months or younger are sleeping does not exceed 75° F; (6) specifies that caregivers shall visually check, in person, sleeping infants aged 12 months or younger at least every 15 minutes. (7) specifies how caregivers shall document compliance with visually checking on sleeping infants aged 12 months or younger. (8) specifies how the operator shall document compliance with visually checking on sleeping infants aged 12 months or younger; (9) specifies that pacifiers that attach to infant clothing shall not be used with sleeping infants; (10) specifies that infants aged 12 months or younger sleep alone in a crib, bassinet, play pen, mat, or cot; (11) specifies that infants aged 12 months or younger shall be prohibited from sleeping in sitting devices, including car safety seats, strollers, swings, and infant carriers. Infants that fall asleep in sitting devices shall be moved to a crib, bassinet, play pen, mat, or cot; and Effective January 1, 2024 Type of Child Record Rule .0606(c)Safe Sleep Policy In each child's file, for as long as the child is enrolled or For 1 year after the child is no longer enrolled * Criminal record requirement: Per requirements ABCMS is the system a childcare provider needs to utilize their NCID username and password, create an account and watch the training, once the account is created each staff member is to go into their individual account and associate themselves to the childcare center so all qualification letters can be associated to the facility. * conversation had regarding NC PreK and wake three school. I provided you with the wake county smart start contact information as well as the name and number of a childcare * A conversation was had concerning the clean water for Carolina Kids requirement. Your water testing was completed 8/25/2023 and due again by 8/25/2026 but still need to meet the lead paint and asbestos requirement now. I had you log into the website today and show you what you are required to do and to please send me the email upon receipt. A violation of childcare requirements was cited during today's visit and requires a letter of corrective action due August 7th, 2024 indicating how it was corrected and how you will keep in compliance going forward.
