When I arrived, I was greeted by director Sue Young, owner and center staff. I arrived at the program at 8:50am. Prior to my arrival you were notified that there was a gas leak incident that occurred in the area the night before, and the gas company had turned off the gas at the facility following the incident. All children were being dismissed upon my arrival. A technician arrived and restored the gas during pick up. There is an allegation of violations of childcare requirements related to inappropriate discipline. A report submitted information to DCDEE, and you also reported the information. As you also reported the information the allegation is confirmed. I received a phone call from Ms. Young, director, on December 12th, 2025, informing me of the following. • The assistant director was conducting a tour with a potential family/ enrollment tour the parent gasped because she didn’t like what she saw in a classroom. • According to the director/staff interview (documented on the employee write up), the incident account involved two students and the teacher. The partner/witness thought the teacher grabbed one of the children by the shirt and touched the forehead of the other child to move them back. • The director stated the teacher’s actions were inappropriate as well as not in accordance with Goddards’ standards or procedures. • The staff person was terminated following the facility’s internal investigation. • The teacher took responsibility for her actions, called parents to make them aware of her termination. • There are cameras present at the facility, but they only show hallways and outside. There are no cameras in the classrooms. During the visit I conducted in –person interviews and one phone interview. There were two staff in the classroom during the incident, a teacher and a floater. The teacher has been terminated. The floater was interviewed by phone today. She stated that she was covering a break and was in the room with the classroom teacher during the incident. She was singing “head, shoulders, knees and toes” with the children while the teacher changed diapers. There was one child that was not participating and instead was being disruptive by putting their feet on the wall/kicking the wall. She stated she continued singing with the children and did not redirect the child and the behavior continued. When the teacher finished changing diapers, she sat down, grabbed the child by the arm and pulled them over and sat them in a chair next to her chair. Another child observed this and ran over to the child. It appeared that the teacher put her fingers on the child’s forehead and pushed the child away and asked them to return to their seat. While the situation has already been addressed based on interviews with staff, the allegation regarding inappropriate discipline was substantiated. The following violation was cited during today’s visit. Violation Number Comment Rule 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. A teacher grabbed a child by the arm and sat them down beside her. She then put two fingers on another child's forehead and pushed and told that child to go sit down. G.S. 110-91(10) Technical Assistance: Discipline: Appropriate discipline was discussed with the owner/administrator. Each child must be attended to in a nurturing and appropriate manner, and in keeping with the child’s developmental needs. Children respond well when they receive descriptive praise/ attention for behaviors that the caregiver/teacher wants to see again. It is best if caregivers/teachers are sincere and enthusiastic when using descriptive praise. Discipline is best received when it includes positive guidance, redirection, and setting clear-cut limits that foster the child’s ability to become self-disciplined. In order to respond effectively when children display challenging behavior, it is beneficial for caregivers/teachers to understand typical social and emotional development and behaviors. Discipline is an ongoing process to help children develop inner control so they can manage their own behavior in a socially approved manner. The allegations are as follows: MONITORING The allegations from the report were discussed and the findings are below: ALLEGATION #1: There is a concern related to staff qualifications. Allegation #2: There is concern that the staff/child ratios are not being followed in the early morning and late afternoon. Allegation #3: There is a concern related to sanitation and health. Parents were not informed that their children were exposed to communicable illness. Upon arrival at the facility today, I was greeted by administrative staff. I informed administrators Susan and Erica that I would be doing a walk through to document enrollment and the number of children present and staff in all open classrooms. I documented nine open classrooms. At 7:28 am there were ten classroom staff, two administrators and the cook present and 25 children from infant through preschool age five years old. Three additional staff arrived by 8:30am. During my walk-through director Ms. Jina arrived, and we sat in the staff lounge and discussed the allegations listed above. All classrooms open with enrollment this morning were in compliance with staff/child ratio Due to the complaint allegations, I interviewed two classroom staff, and one administrator. We discussed staff qualifications, staff/child ratios, contagious and communicable illness, staff special training requirements. During the discussion about staff qualifications, I was informed of the following: Information from the complaint stated the facility used substitutes from a temp agency to cover classrooms. I was told that the facility owner utilizes a temp company called Elite Education that sends temps/substitutes to the facility when staffing is needed and work with center staff. These individuals come with a medical, completed TB test and CBC background check only. A violation was cited because these individuals should have a complete substitute file per requirements including but not limited to an application, health questionnaire, TB, medical, CBC, recognizing and responding to child abuse maltreatment training, sign off on the shaken baby and abusive head trauma policy, First Aid/CPR, ITS-SIDS training, and reviewed the EMC and EPR plan. During the visit today RW, a center floater was working in infant room #140, the former assigned staff person no longer employed, and the center has not hired a new teacher yet. The floater has not yet obtained her ITS-SIDS training. Ms. Tuck, assistant director was assigned to and was working in the classroom with R.W. but stepped out of the room without obtaining coverage leaving R.W. alone. I observed this during the visit today and a violation of childcare requirements was cited. When staff/child ratios were discussed/observed all staff knew what their ratio requirements were based on the ages of the children. They knew they must follow state requirements. I heard the walkie-talkie in the staff lounge go off and teachers stated they are currently at their state ratio and when the next child arrives it would put the classroom over. The director left our meeting and either moved staff or shifted children to accommodate the arrival of additional children. There was no indication that the number of teachers to the number of children was not in compliance with staff/child ratios, this information was collaborated by the interviews with staff . Daily sign in/out sheets for the weeks of July 29th- August 9th, 2024, were reviewed. Based on the number of children and staff present in each classroom there were no times when staff: child ratios were not in compliance. We discussed concerns related to sanitation and health regarding child illness/communicable illness. I was shown a logbook of children that were sent home on any given day due to illness. After interviewing staff and reviewing the log book there was no indication of a communicable disease. There was only one child that was out for more than three days but there was no indication of what she was out with. The child had been out previously with fever due to teething. I reviewed the facility’s sick policy that references fever and diarrhea and when children can return (24 hours after no symptoms or medication). The policy also lists a doctor’s note is required for return. Any information provided to DCDEE, whether through complaints, interviews, corrective actions, compliance letters, etc., should be factual and accurate. ALLEGATION RESOLUTION Based on the information received today and my observations, the allegation related to staff qualifications was SUBTANTIATED. Based on the information received today and my observations, the allegation regarding staff/child ratio not being followed in the early morning and late afternoon was UNSUBTANTIATED. Parents were not informed that their children were exposed to communicable illness was UNSUBTANTIATED. The following violations of childcare requirements were cited during today’s visit. (omit posting for centers located in a residence) An enrolled infants schedule was not followed and parent/director correspondence noted that the number of bottles provided and the schedule of times for feedings were not followed because bottles were sent home or times documented in the app were not every three hours as documented on the schedule. 10A NCAC 09 .0902(a) 1043 All staff records, except financial records, were not made available for review. Elite Education temp service is utilized by the facility and a temp last covered at the facility on 8/15/2024. The agency has only been providing a medical, TB test, and CBC qualification letter. They should meet substitute requirements and have the following available for review: application (which includes date of birth, education, training and experience), TB, Health questionnaire, emergency information form, CBC qualification, orientation, EMC review, first aid/CPR, ITS-SIDS, sign off of shaken baby and abusive head trauma policy, training on recognizing and responding to child abuse maltreatment, informed of EPR plan. G.S. 110-91( 9) 1831 At least one child care provider, who has completed ITS-SIDS training was not present in the infant room, while children were in care. On 08/16/2024 RW was left alone in the classroom for infants when ET stepped out of the room and went to the directors office. RW does not have ITS-SIDS training. .01102 (f) Violations of childcare requirements were cited today, and require a letter of corrective action by August 28th, 2024, stating how you came into compliance and how you will keep in compliance going forward. TECHNICAL ASSISTANCE: 1.Infant-Toddler Safe Sleep and SIDS Reduction Training (ITS/SIDS): Although the cause of many sudden infant deaths may not be known, researchers believe that some infants develop in a manner that makes it challenging for them to be aroused or to breathe when they experience a life-threatening challenge during sleep. Use of safe sleep policies, continued education of parents/guardians, expanded training efforts for childcare professionals, statewide regulations and mandates, and increased monitoring and observation of infants while they are sleeping are critical to reduce the risk of sudden infant death syndrome in childcare. All staff working with infants must complete the Infant/Toddler Safe Sleep and SIDS Risk Reduction Training developed by the NC Healthy Start Foundation and administered by the North Carolina Child Care Health and Safety Resource Center for the Division of Child Development and Early Education for caregivers of children ages 12 months and younger. Although the training shall be completed within two months of an individual assuming responsibilities in the infant room and the administrator shall complete ITS-SIDS training within 90 days of employment; always, one childcare provider who has completed ITS-SIDS training shall be present in the infant room while children are in care. A certificate of each staff member's completion of this course shall be maintained in the staff member's file in the center. Recommend that a list of staff with current ITS-SIDS be placed in the classrooms for infants for easy reference when Administrators are moving staff to different classrooms. When parents complete/or update a feeding schedule staff in the classroom should review the information. Feeding schedules are in place so staff working with infants know when and how to feed the children in care. If assistance is needed due to feeding issues, staff should be able to get help from the administrative staff. Today I was informed that the feeding of a particular child was not being completed as per documented on the feeding schedule. The director showed me correspondence with a specific parent of an enrolled child that was not being fed as she had documented. If an infant did not show an interest in feeding/eating notes should be added to the new Goddard family app, dry erase board. In addition, if an infant typically has 3 bottles and only takes one parents should be notified because this is not the normal feeding pattern and there may be a reason, the child is not feeling well, etc. and parents should be aware before the end of the day that their child has not been taking bottles/food. Kimberly Serio, center director accompanied me during a walk-through of the facility. During the visit, I discussed the allegations Ms. Serio, Mona Chaddha, owner and additional staff members. Limited monitoring of child care requirements occurred during today’s visit. Violation Number Comment Rule 303 Children were not adequately supervised at all times. On March 4, 2024, a one-year-old child received a serious injury to the arm and staff were unaware of how the injury occurred. On April 24, 2024, two staff members left a one-year-old child unsupervised for five (5) minutes and on numerous occasions staff were unaware that a one-year-old child was bitten by other children in care. .1801(a)(1-5) 852 Incident reports were not completed each time a child was injured, it did not include all the information required in rule, it was not signed by the parent and/or it was not maintained in the child's file. Staff failed to complete an incident report after a child received a serious injury at the center. .0802 (e) 853 Incident logs were not completed and maintained as required. A serious injury requiring medical attention was not added to the incident log. .0802(g)(1-6) 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. A staff member pulled and scratched four-year-old children on the arm and spoke about children in a demeaning manner. G.S. 110-91(10) 904 Child was handled roughly. On March 27, 2024, a staff member pushed a four-year-old child to the floor. .1803(a)(1) 907 Discipline was related to food, rest or toileting.
