During the visit, I discussed the allegations with Laticha Young, director, Hiral Mehta, owner and an additional staff member. Limited monitoring of child care requirements occurred during today’s visit. The following violations were observed during today’s visit. Violation Number Comment Rule 853 Incident logs were not completed and maintained as required. Incident reports were not recorded on the incident long. .0802(g)(1-6) 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. A staff member made inappropriate comments to a child. A staff member yelled at another staff member while entering the classroom occupied by children. G.S. 110-91(10) 1043 All staff records, except financial records, were not made available for review. Files for former staff members that separated from employment within the past 12 months were not on the premises and available for review. G.S. 110-91( 9) 1756 Enhanced staff/child ratios and group sizes were not met. Upon arrival, I was greeted by the assistant director, Tracy Pederson. Laticha Young, director, arrived within fifteen minutes of my arrival. I explained the purpose of today’s visit before doing a walkthrough of the facility to document enrollment, conduct observations and staff interviews. Limited monitoring of childcare requirements was conducted during the visit. Staff/child ratios (allegation in the report), supervision, interactions, use of adequate/approved space, permit restrictions, were monitored. Supervision was a reporter concern due to staff being over ratio in classrooms. I discussed the allegations with the directors/owner, and six classroom staff. They were each given an opportunity to provide information surrounding the allegation. The allegation from the report was discussed and the findings are below: ALLEGATION #1: There is concern that the posted staff/child ratios is not being followed in the early morning hours. One provider was responsible for nine one-year-old children for an unknown amount of time. FINDINGS: According to the reporter, classes that care for one-year-olds have had ratio issues. When I read the allegation to the assistant director, she informed me that she was dealing with ratio issues in the one-year-old and infant rooms when I arrived. Two classrooms had one teacher each (a second teacher arrived shortly after I began to gather enrollment) and both were over by one and a child needed to be shifted to another classroom to put them in compliance. Conversation with the director and owner noted that the main reason for the issues was the arrival times of the enrolled children fluctuates based on parents’ schedules as well as staffing issues related to vacations, call outs, and tardiness. I watched the director utilizing The Goddard School software that manages classrooms when staff and children are signed in and the system will alert admin staff of the number of children and staff signed in to a specific classroom and will put a red X on the screen to make them aware that a specific classroom is out of ratio. But the only way this is known is if they are in the office on the computer which is not always the case, since they are moving and shifting and moving about the facility to keep classrooms in compliance. As staff arrived, I observed the director look at the classroom screen and immediately able to assign the teacher that signed in to the classrooms that need a second staff person based on age of the group and their ratios. Classroom staff who work with children age one yr old informed me that during the early morning hours (between 7am and 8:30am) arrival rush occurs in the classroom (First Steps) “opening classroom/homeroom that’s combined with pre toddler class. The classroom during that timeframe is typically over by one at the minimum (1:7) at most (1:10) before a co-teacher or additional staff arrives at 8am to split and open their own classroom. Ratio requirement for one-year-old’s is 1 :6. RESOLUTION: Based on the information documented during interviews regarding the allegation in this report concerning staff/child ratios, was substantiated and a follow-up visit will be conducted. The following violation of childcare requirements was documented during today’s visit. Violation Number Comment Rule 1756 Enhanced staff/child ratios and group sizes were not met. During today's visit the classroom for one year old's was out of ratio (1:7). Based on staff interviews at the minimum (1:7) and maximum (1:10) in the early morning hours. The ratio for one-year-olds is (1:6). 10A NCAC 09 .2818 A violation of childcare requirements was cited during today’s visit and requires a letter of corrective action by September 24th, 2024. Please provide the item number, how you came into compliance with the violation, the date of compliance and how you will keep in compliance going forward. TECHNICAL ASSISTANCE: Staff Child Ratio: A staff-to-child ratio is a measure of the number of children for whom each childcare provider is responsible. Because younger children need more direct one-on-one interaction, response, and supervision, staff-to-child ratios are lower for younger children than for older ones. Ratio and group size are two factors that are critical to a child’s health, safety, and development. Ratios and group sizes help ensure that a child gets enough one-on-one attention from an adult who is available to take care of each child’s unique needs. This responsive caregiving is extremely important to a child’s social and emotional development, physical well-being, and overall learning. We discussed the need for a staff meeting following this visit. The agenda of the meeting should cover ratios/ communication with staff (possible cordless phones or walkie talkies) as well as discussing tardiness or calling out and how that affects staffing and ratios. The last annual compliance visit was conducted on December 15th, 2023. On arrival, I was greeted by assistant Tracy Pederson and director Laticha Young arrived during the visit and center staff. LICENSE STATUS: This center currently operates with a five-star rated license issued and went through a change of ownership in 2022 and was in cohort #3. During today’s visit we talked about rated license and the approval of QRIS and the different approved accreditations. You informed me that you are in the process of being COGNIA accredited which is an approved accreditation in pathway #3 for rated license. We conducted a walk-through. Ms. Young, the director, accompanied me as we monitored the eight classrooms for enrollment, supervision and ratios. Children were observed participating in free play, center play, circle time indoors and today was splash day so children were observed in bathing suits, and some were outside running in sprinklers and participating in water play. The inspection included License and Permit Restrictions, Staff/Child Ratios, Supervision, Storage of Hazardous Items, Use of Approved Space, and Program Records. ANNUAL INSPECTIONS: *Sanitation inspection was conducted on 2/15/2024- 12 demerits and a provisional rating and again on 3/4/2024 with zero demerits and a superior rating. * Fire inspection was conducted on = 3/8/2023 and approved for daytime care only. A violation of childcare requirements was cited due to the inspection being overdue. A phone call to the city of Raleigh was made and a conversation was had with fire inspector Ferguson while I had the center owner make an online request per requirements for a fire inspection and inspector Ferguson arrived during my visit to conduct his inspection. * Fire drill= 6/12/2024 @ 10:40am and took 1m 1 sec (per requirements review of the fire drill log found a drill was not conducted in May 2024 and a violation was cited today) *Monthly Playground Inspection= 5/16/2024 *Lockdown drill was conducted on = 6/26/2024 @ 10:30am and took 2 mins * These must be conducted and recorded every 3 months. * As of July 11th, 2024, the facilities compliance history is 97% two violations of childcare requirements were cited during today’s visit. Violation Number Comment Rule 106 Operator has not scheduled and obtained a fire inspection within 12 months of the previous inspection. Operator did not submit the original approved report to DCDEE within one week of the inspection visit on a form provided by the Division. The last inspection completed was March 8th, 2023 and was not completed prior to expiration. Online appt. made by owner today and I made a phone call during the visit and an inspection was conducted today. 10A NCAC 09 .0304(a) 805 Fire drills were not practiced monthly and/or the drill record was incomplete. A fire drill was not completed in May 2024. .0604(t); .0302(d)(5) Violations of childcare requirements were cited and require a letter of corrective action by July 23rd, 2024. Please list the item number, how you corrected the violation and how you will keep in compliance going forward. Due to a violation being a fire inspection please provide a copy of the completed checklist with your letter. Thank you STAFF REMINDERS: Fire drills/emergency drills: Fire drills are required monthly. Document dates that you will conduct fire drills each month and have someone available for backup in case the person that usually conducts the fire drills isn’t present. Fire drills teach children what to do in case of a fire. If fire drills are not practiced monthly, it will affect the children’s safety if there is a fire. Emergency drills are conducted every 3 months. Document the dates you plan to conduct the emergency drills and have someone available for backup in case the person that usually conducts the emergency drills is not present. Fire inspection: A fire inspection is required every year and to be conducted each year prior to the expiration date of the inspection conducted the year before per requirements. 10A NCAC 09 .0304 ON-GOING REQUIREMENTS FOR A LICENSE (a) Each operator shall schedule and obtain a fire inspection within 12 months of the center's previous fire inspection. The operator shall notify the local fire inspector when it is time for the center's annual fire inspection. Effective January 1, 2024 shall submit the original of the approved annual fire inspection report to the Division within one week of the inspection visit on the form provided by the Division. Linking Criminal Background Checks – Staff need to log into the Criminal Background Check Portal on the DCDEE website and link to the facility license number. It is important to do this so staff at DCDEE can contact the center if a random criminal history check uncovers a staff member with a criminal charge or conviction working in a childcare facility. It is also a way for staff at the CBC Unit to keep you updated of the status of out-of-state checks if a new employee has a Provisional Qualification. Instructions on how to link to the facility was provided today. In the future, new staff need to link within five days of hire or transfer to your center. Review Criminal History Record Check Requirements for Child Care Centers in the NC Child Care Requirements 10A NCAC 09 .2703. New information on the Provider Portal for submitting the Change of Information from Jon Douglas in Criminal Record. The provider must sign up for the provider portal through ABCMS in order to submit the employee’s information. If they haven’t signed up, they will not be able to do the Change of Information electronically. They can send an email to dcdee_abcms_provider@dhhs.nc.gov with their facility information requesting to sign up. Once they are signed up, they can enter all their employees and have access to the employee qualification letters. This portal is new and started in January 2024. It might take some time. Time to Enroll Your Facility in the Clean Classrooms for Carolina Kids Program to Meet Rule Requirements Pre-Enrollment Webinars Planned: Register Now! As this is a legislatively mandated effort, facilities are required to meet rule requirements (NC 10A NCAC 41C.1001-1007, NC 154A NCAC 18A.2816). Clean Classrooms for Carolina KidsTM is designed to ensure facilities meet all requirements, receive direct support throughout the participation process, and have access to communication resources. Please sign up for a pre-enrollment webinar so we can begin your enrollment before the next phase of enrollment begins. Steps to participate are as follows: 1. Receive Results – Receive your results, recommendations, and water mitigation support, if needed. 5. Request Reimbursement - If you choose to conduct lead-based paint or asbestos mitigation, you can request reimbursement from NC DHHS. About Clean Classrooms for Carolina Kids TM Who is running this program? The North Carolina Department of Health and Human Services Division of Child Development and Early Education and RTI International, a nonprofit research institute, are partnering to help centers meet program requirements. Program funding lasts until Nov. 30, 2026. Why is this important? Exposure to lead and asbestos is a public health concern. Lead is a toxic metal with no safe level of exposure. Even at low levels of exposure, lead is associated with lifelong behavioral and cognitive deficits. Lead may be present in indoor environments including plumbing, faucet fixtures and solder, paint, dust and soil. Asbestos is a known cancer-causing agent and there is no documented safe level of asbestos exposure. Asbestos was commonly used in various building materials. When safely managed, these materials do not present a hazard. If a hazard is identified, what happens? The program will provide results and recommendations for mitigating hazards if any are found. Each program section operates differently. For lead in water, drinking and food preparation taps exceeding the state action level will receive free fixture replacement and certified filter installation, as needed. For lead-based paint or asbestos hazards, facilities will choose whether to restrict access to or mitigate any hazards, with full reimbursement available for childcare centers and up to 2/3 reimbursement for public schools for eligible expenses. What if I already participated in Clean Water for Carolina Kids? Childcare center water testing is required every 3 years, so it is time to retest again to meet requirements. If you’ve already participated in the second round of water testing through the Clean Water for Carolina Kids program, you still need to have your facility assessed for lead-based paint and asbestos and should sign up for the pre-enrollment webinar to learn how. What if my center is located within a school? Your associated school will receive an enrollment email from the North Carolina Department of Public Instruction at a similar time. It is important to work with your public-school counterparts during program participation as follows: 1. For water testing and mitigation, the school will enroll all taps including those serving childcare portions of the school facility. You should work with the school to ensure that your childcare center taps used for drinking and cooking are correctly labeled and the school can select which taps you use for childcare in their enrollment survey. The school is enrolling and collecting samples to avoid duplicating enrollment, sampling efforts, and on-site mitigation visits, as needed. 2. For lead-based paint and asbestos, even if you are in a school, the childcare center should enroll separately because you are eligible for 100% reimbursement for lead-based paint and asbestos mitigation if needed, while the school portion of your facility is only eligible for 2/3 reimbursement. Additionally, although in the same building, schools and childcare centers may have different on-site visit requirements. Thank you STAFF REMINDERS: Fire drills/emergency drills: Fire drills are required monthly. Document dates that you will conduct fire drills each month and have someone available for backup in case the person that usually conducts the fire drills isn’t present. Fire drills teach children what to do in case of a fire. If fire drills are not practiced monthly, it will affect the children’s safety if there is a fire. Emergency drills are conducted every 3 months. Document the dates you plan to conduct the emergency drills and have someone available for backup in case the person that usually conducts the emergency drills is not present. Fire inspection: A fire inspection is required every year and to be conducted each year prior to the expiration date of the inspection conducted the year before per requirements. 10A NCAC 09 .0304 ON-GOING REQUIREMENTS FOR A LICENSE (a) Each operator shall schedule and obtain a fire inspection within 12 months of the center's previous fire inspection. The operator shall notify the local fire inspector when it is time for the center's annual fire inspection. Effective January 1, 2024 shall submit the original of the approved annual fire inspection report to the Division within one week of the inspection visit on the form provided by the Division. Linking Criminal Background Checks – Staff need to log into the Criminal Background Check Portal on the DCDEE website and link to the facility license number. It is important to do this so staff at DCDEE can contact the center if a random criminal history check uncovers a staff member with a criminal charge or conviction working in a childcare facility. It is also a way for staff at the CBC Unit to keep you updated of the status of out-of-state checks if a new employee has a Provisional Qualification. Instructions on how to link to the facility was provided today. In the future, new staff need to link within five days of hire or transfer to your center. Review Criminal History Record Check Requirements for Child Care Centers in the NC Child Care Requirements 10A NCAC 09 .2703. New information on the Provider Portal for submitting the Change of Information from Jon Douglas in Criminal Record. The provider must sign up for the provider portal through ABCMS in order to submit the employee’s information. If they haven’t signed up, they will not be able to do the Change of Information electronically. They can send an email to dcdee_abcms_provider@dhhs.nc.gov with their facility information requesting to sign up. Once they are signed up, they can enter all their employees and have access to the employee qualification letters. This portal is new and started in January 2024. It might take some time. Time to Enroll Your Facility in the Clean Classrooms for Carolina Kids Program to Meet Rule Requirements Pre-Enrollment Webinars Planned: Register Now! It’s time to enroll your facility in the Clean Classrooms for Carolina KidsTM program to identify and eliminate exposure to lead and asbestos hazards in building infrastructure. This program is an expansion of Clean Water for Carolina KidsTM, which previously tested all child care centers in the state for lead in water at drinking and food preparation taps. As this is a legislatively mandated effort, facilities are required to meet rule requirements (NC 10A NCAC 41C.1001-1007, NC 154A NCAC 18A.2816). Clean Classrooms for Carolina KidsTM is designed to ensure facilities meet all requirements, receive direct support throughout the participation process, and have access to communication resources. Please sign up for a pre-enrollment webinar so we can begin your enrollment before the next phase of enrollment begins. Steps to participate are as follows: 1. About Clean Classrooms for Carolina Kids TM Who is running this program? The North Carolina Department of Health and Human Services Division of Child Development and Early Education and RTI International, a nonprofit research institute, are partnering to help centers meet program requirements. Program funding lasts until Nov. 30, 2026. Why is this important? Exposure to lead and asbestos is a public health concern. Lead is a toxic metal with no safe level of exposure. Even at low levels of exposure, lead is associated with lifelong behavioral and cognitive deficits. Lead may be present in indoor environments including plumbing, faucet fixtures and solder, paint, dust and soil. Asbestos is a known cancer-causing agent and there is no documented safe level of asbestos exposure. Asbestos was commonly used in various building materials. When safely managed, these materials do not present a hazard. If a hazard is identified, what happens? The program will provide results and recommendations for mitigating hazards if any are found. Each program section operates differently. For lead in water, drinking and food preparation taps exceeding the state action level will receive free fixture replacement and certified filter installation, as needed. For lead-based paint or asbestos hazards, facilities will choose whether to restrict access to or mitigate any hazards, with full reimbursement available for childcare centers and up to 2/3 reimbursement for public schools for eligible expenses. What if I already participated in Clean Water for Carolina Kids? Childcare center water testing is required every 3 years, so it is time to retest again to meet requirements. If you’ve already participated in the second round of water testing through the Clean Water for Carolina Kids program, you still need to have your facility assessed for lead-based paint and asbestos and should sign up for the pre-enrollment webinar to learn how. What if my center is located within a school? Your associated school will receive an enrollment email from the North Carolina Department of Public Instruction at a similar time. It is important to work with your public-school counterparts during program participation as follows: 1. For water testing and mitigation, the school will enroll all taps including those serving childcare portions of the school facility. You should work with the school to ensure that your childcare center taps used for drinking and cooking are correctly labeled and the school can select which taps you use for childcare in their enrollment survey. The school is enrolling and collecting samples to avoid duplicating enrollment, sampling efforts, and on-site mitigation visits, as needed. 2. For lead-based paint and asbestos, even if you are in a school, the childcare center should enroll separately because you are eligible for 100% reimbursement for lead-based paint and asbestos mitigation if needed, while the school portion of your facility is only eligible for 2/3 reimbursement. Additionally, although in the same building, schools and childcare centers may have different on-site visit requirements. When possible, on-site visits will be performed together for the school and childcare center. Remaining questions?
