The last annual compliance visit was conducted on April 16, 2024. Two additional visits were conducted in between the annual compliance visit and today’s visit. This facility operates with a 5 star license issued January 17, 2025. The facility is approved for children ages 0-12 years old on first and second shifts. The facility follows reduced ratios and enhanced space at 35 sq. ft. per child inside and 100 sq. ft. per child outside. Upon arrival, I was greeted by a staff member who called Keisha Sanders by phone. Keisha Sanders, executive director, arrived a little later. I verified that the 5-star license, NC Summary of the Law, safe arrival and departure procedures, emergency telephone numbers, menu and first aid chart were posted. I observed children playing outside, riding tricycles, playing basketball and exploring. Teachers were observed moving about the outdoor play area, interacting with the children as they played. Teachers were observed consoling children that were facing challenges. Other children were building a tall tower with large blocks. Portable materials were present for the children to use. I monitored five classrooms for applicable childcare requirements. One classroom was stated not to be used except when school agers were out of school. (space 104) No concerns with staff/child ratios, group sizes, capacity, supervision, discipline, interactions, materials, activities, postings and health and safety. Safe sleep checks were current along with feeding schedules for infants under 15 months old. Children were observed engaged in age-appropriate activities. The children appeared to happy in the routine of the classrooms. Teachers smiled often, assisted children with problem solving, extended language and praised children when they accomplished something. The facility uses Frog Street curriculum. Some children were having lunch which consisted of meatballs, bread, corn, broccoli and milk. Younger children were exploring materials and being consoled by the teacher. Fire drills and outdoor inspections were completed as required. The last fire drill was conducted 2/28/25. Emergency drills were completed as required. The last lockdown drill was conducted 2/28/25. The EPR plan was current and the ready to go file was ready to go and current. The last outdoor inspection was completed March 7, 2025. Ten children’s records were reviewed today. A children’s records checklist was provided to show files reviewed. All staff files were reviewed to verify current criminal background check letters, current CPR and First aid training, current ITS-SIDS trainings, health and safety trainings or on-going training, updated health questionnaires and date the EPR plan and EMC plan were reviewed annually. Transportation is not provided at this facility. Medication: No emergency medications. No diaper creams. Attendance: Current and maintained electronically in the Himama application and in paper form. Each month is stapled together and stored. Lead water test: 7/16/24-Update every 3 years. Lead paint and asbestos registration: Registered 3/11/25. Violation Number Comment Rule 1044 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years for the date of issuance). One staff member did not have the five year re-check completed before the expiration date of the qualifying letter. A report was received by the agency on April 3, 2024. ALLEGATIONS There is a concern of inadequate supervision. There is a concern that the administrator is not on the premises for the required number of hours. ALLEGATION #1 There is a concern of inadequate supervision. OBSERVATIONS AND DISCUSSIONS -Upon arrival I was greeted by a preschool aged child. The teacher was vacuuming the foyer/hallway area around the corner. The teacher poked her head around the corner and greeted me. I explained the reason for my visit. The teacher let another teacher know I was there. At one point the teacher who was vacuuming walked down the hallway to put away the vacuum leaving the child at a table by the front door. -During the first part of my visit the child was looking at books and helping staff with other duties. She was in the foyer/hallway which not in an approved space for care. The area is used by the facility for special activities such as special guests (book readings) and graduation. RESOLUTION Based on my observations this allegation has been determined to be SUBSTANTIATED. ALLEGATION #2 There is a concern that the administrator is not on the premises for the required number of hours. -Upon arrival I determined there was not an administrator present. The teacher explained that there is usually an administrator present, but they had not arrived yet. The teacher explained that Brenda was typically there at 7:30am and leaves around 12 or 1pm. There are two Brendas employed and they are admin staff. -Later in the visit the director arrived after a brief phone call. I discussed the allegation with Keisha Sanders and she stated that they have three administrators on staff. Today was not a usual day because one administrator was out on vacation, one was out sick, and she was coming in later today. RESOLUTION Based on my observations, discussions with the center director and classroom staff this allegation has been determined to be UNDETERMINED until further investigation. The following violation was observed or documented. Violation Number Comment Rule 303 Children were not adequately supervised at all times. A teacher left a child unsupervised while vacuuming and then walked down the hall leaving the child up front in the foyer area. .1801(a)(1-5) TECHNICAL ASSISTANCE -Keisha Sanders and I discussed at length administrator hours requirements. She explained that there are three admin staff. Brenda Sanders and Brenda Smith work 7:30am-1pm and she come in around 10-11am and works until close (5:30pm) or later. I explained that based on their capacity, which is 90, an administrator must be onsite for 30 hours per week. I explained that the first and last hour of the day, she can assigned a staff member that meets the requirements to act as the administrator or person in charge. Rule states: One person who meets the requirements for a child care administrator or lead teacher as set forth in G.S. 110-91(8) shall be on site during the center's operating hours, except that a person who is at least 18 years old with at least a high school diploma or its equivalent and who has a minimum of one year's experience working with children in a child care center may be on duty at the beginning or end of the operating day provided that: (1) no more than 10 children are present; (2) the staff person has worked in that center for three months; and Effective January 1, 2024: (3) the staff person has completed the orientation training required in Rule .1101 of this Section. -I explained that she needs to fill out an additional legal designee form to include lead teachers that may need to step in as the administrator. -I stated that she needs to assign a person so the center knows who will be responsible for administrative duties such as answering the phones, tracking ratios, helping parents ect. I told her I would discuss potential violations with my supervisor. -Because of the nature of the violation cited a follow up visit will be conducted in the near future. -Supervision: I explained to Ms. Sanders what I observed upon my arrival. She immediately discussed the concern with the teacher and reminded her that she must be able to see and hear the children at all times. The teacher said she understood. Upon arrival, I was greeted by a staff member. I completed a walk-through of the facility, with Brenda Smith. The director of operations, Keisha Sanders arrived shortly after my arrival. At the time of the visit, there were a total of 39 children present. The children were observed playing outside, participating in circle time, and the infants were enjoying tummy time. LICENSE STATUS Currently this center operates with five star license issued September 20, 2019. This facility is assigned to cohort two (2). Your prep year begins July 1, 2024 and your assessment year begins July 1, 2025. INSPECTIONS I reviewed all required inspections including fire drills, emergency drills, sanitation, fire inspection and outdoor inspections. A violation was cited for emergency drills. MONITORING During today’s visit, a full assessment was conducted, monitoring all space occupied by the children, including the outdoor play environment. All spaces were monitored for supervision, staff/child ratios, materials, equipment and required postings. A checklist was used to note the requirements I monitored today. I reviewed a selection of children files were reviewed. ANNUAL TRAINING The annual training year for this facility is January 1 through December 31. The following violations were observed or documented. Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. In the classroom for toddlers the lesson plan was not complete and was dated April 1st through 5th. GS 110-91(12); .0508(a) 1033 On or before the first day of work, all staff, including the director and individuals who volunteer more than once per week did not provide results indicating that they were free of active TB and/or TB test or screening was older than 12 months. One new employee did not have a current TB test completed and on file. .0701(a) The above violation MUST be corrected immediately. Please mail or email your letter of compliance by April 30, 2024. Any violations documented during visits to your program may have an impact on the total compliance history score and cause your score to drop below the mandated level. **Prior to today’s visit, the compliance history score for the center was 95%. Any violations cited during today's visit may affect this percentage. TECHNICAL ASSISTANCE **One child’s medication permission form was not complete. This child goes to elementary school and usually only comes in the summer months. I stated that these forms need to be updated before the children start for the summer. **Please make sure all classrooms have a current lesson plan. In the classroom for toddlers their lesson plan was not complete and dated April 1st-5th. The teacher completed the lesson during my visit. **One new staff member did not have their TB test on file. You stated that you thought she had a current TB but when you reviewed it you discovered it was over a year old. She had the test done and will get it read Friday.
