Sarah Olevsky, director, accompanied me during a walk-through of the facility. During the visit, I discussed the allegations with Ms. Olevsky and additional staff members. Limited monitoring of child care requirements occurred during today’s visit. Violation Number Comment Rule 904 A child was handled in a rough way, including shaking, pushing, shoving, pinching, slapping, biting, kicking, or spanking. On 8/22/25, a staff member pulled a four-year-old child aggressively by the child’s lower leg/ankle, resulting in a fracture to the child’s lower shinbone/ankle. .1803(a)(1) 1810 There was a substantiation of child maltreatment. On January 6, 2026, the Division substantiated child maltreatment regarding a child sustaining a physical injury. The facility had an appointment with Hannah Myers, REHS Environmental Health Consultant, and I met her at the facility. Sarah Olevsky, center director, Matt White, Xanadu on-site construction supervisor and Hannah Myers, REHS Environmental Health Consultant, participated in discussions today. KinderCare purchased an existing center in 2023 and began renovations in 2024. This center currently cares for children ages zero through five years of age. During today’s visit limited monitoring of general safety for the indoor and outdoor environments were monitored. Renovation Information/Concerns related to playgrounds, fencing, evacuation routes: A playground renovation was completed in October 2024, the renovation included new structures, surfacing, borders and fencing. As of today, I have not received any ASTM paperwork, this paperwork must be provided to me to approve the surfacing on the playgrounds. Remember to keep all the instructions for stationery and portable equipment. Fencing was removed around the air conditioning units; the units are surrounded by holly bushes. Holly bushes are toxic plants. **Children are not to have access to air conditioning unit OR toxic plants, a new fence to block these items MUST be installed to make them inaccessible per Child Care requirements. Until the air-conditioning units and toxic plants are inaccessible to children, this area may NOT be used. The new fencing runs from the right front edge of the building down and around the entire outdoor play area and up the left side of the building connecting to the front left side of the building. There is still a fence installed creating two separate playgrounds. While walking from one side of the building to the other we realized it would be difficult for an evacuation crib from the infant room to be pushed through this area to evacuate and get to the parking lot (evacuation meeting point). Prior to the new fencing staff could enter the parking during evacuations. When the fencing was installed, the garden area was removed, leaving unlevel dirt. With the new fencing, you walk on a section of the sidewalk, turn left and there is no sidewalk, just dirt where garden used to be, then there is a concrete pad at the toddler classroom next to the exit door. Mr. White informed me the fence was installed by the fencing company per KinderCare specs for the project. Mr. White said there is nothing in the KinderCare blueprints to connect the sidewalks or to install a gate along the sidewalk for the cribs to go through. Environmental Health Inspection: The kitchen has been “gutted” in preparation for renovations. Ms. Byers reviewed the renovation plan and what is needed for the facility to maintain compliance during the renovation. During the renovation the facility is catering meals. Catered meals need to be pre-plated prior to arrival or can be brought to the classrooms with a prep counter and sink to plate meals at the center. During the renovation only disposable products (forks, spoons, plates, cups) are being used. As a reminder the annual Environmental Health Inspection is due by 01/17/2025. Remember to submit the approved inspection form to me within 7 business days. The following violations of childcare requirements were cited during today’s visit. Violation Number Comment Rule 823 Toxic plants were accessible to children. Due to the removal of fencing in one area and extensions of fencing in another holly trees and berries are now accessible to the enrolled children. .0604(l) 828 Air conditioning units were accessible or did not have a guard to keep objects from being thrown into the unit. The fencing around the air conditioning units was removed and not replaced leaving the units accessible. .0604 (m) Violations of childcare requirements were cited during today’s visit and require a letter of corrective action. The letter is due to me within 14 days, January 13th, 2025. Please list your facility name, license number and item number and state how it was corrected and how you will keep in compliance going forward. Technical Assistance: The air conditioning units on the left side of the building are required to be fenced in per 10A NCAC 09 .0604 SAFETY REQUIREMENTS FOR CHILD CARE CENTERS (m) Air conditioning units shall be located so that they are not accessible to children or shall be fitted with a mesh guard to prevent objects from being thrown into them. Children should not be able to access air conditioning units because their fingers, hands, may get into the opening, or they can throw objects into the fan and if running debris may come back and hit the child/ren. • 10A NCAC 09 .0604 SAFETY REQUIREMENTS FOR CHILD CARE CENTERS (l) Toxic plants shall be inaccessible to children. A list of toxic plants may be found on the Division's website at http://ncchildcare.nc.gov/pdf_forms/form16b_bb.pdf • Recommend that the area on the right side of the building where landscaping was removed additional concrete/sidewalk so there is a sidewalk the length of the building. This will make pushing cribs easier and allow all classrooms to access the gate to the parking lot. • Please provide the paperwork documenting the age range for the permanently installed play equipment in the outdoor play environment. • Please provide the ASTM paperwork for the pour in place rubberized surfacing in the outdoor play environment. This is the facilities first annual compliance visit since the change of ownership and received a temporary license on October 23rd, 2023. A checklist was used to note the requirements I monitored today. The center currently operates with a 5- star license, operating at 30sq. ft. inside, & enhanced ratios and space issued on April 24th, 2024. My visit was conducted with you, Sarah Olevsky, Director, and new assistant director Janet Wokasch and center staff. I arrived at the center at 8:50 am I monitored for required posted documents (permit/restrictions, EMC, posters, interactions between staff and children, discipline, supervision, group sizes, space capacity, program requirements, equipment, kitchen and furnishing requirements and children’s records. Program records and staff records will be reviewed at a follow-up visit. Transportation was not monitored all pickup and drop off is done by the parents of the enrolled children. Since the facility was purchased by KinderCare Education LLC the facility both inside and out is going through renovations/updates and changes. All inspections will be updated, and rooms will be remeasured for square footages. Wonderful changes are in the works for the facility. VERIFICATION OF RECORDS: *Last fire inspection= 1/26/2024 and approved for daytime care only. *Sanitation inspection= 1/11/2024- 17 demerits and a provisional rating and a re-inspection on 1/18/2024 with 2 demerits and a superior rating *Compliance history prior to today’s visit 94% * Fire drill- 8/2/2024 @ 10am and took 2 m 7 sec (every month) * Shelter in place- 6/11/2024- (every three months) * Playground Inspection- 9/11/2024 * KinderCare Education LLC owner of Mitchell Mill Rd. KinderCare is current/active in the NC Secretary of State website as of 9/17/2024. * clean water for Carolina kids requirement- water was completed 4/1/2024 and an asbestos inspection and report was completed on 4/17/2024 and as of 3/29/2024 the facility was exempt from the lead paint testing. Paperwork attached *Two items of non-compliance were observed today and need a corrective action response. Violation Number Comment Rule 843 A drug or medicine was administered after its expiration date. A child with allergies whose Benadryl is part of the action plan had expired June of 2024 and requires replacement by the parent. 10A NCAC 09 .0803(1)(d) 844 Prescribed medicine was not in original labeled container or accompanied by signed and dated written instructions from prescribing physician or health care professional. A child's epi-pen was in a bag with an action plan but not in the original packaging with prescription. .0803(2)(a) Violations of childcare requirements were cited during your visit and require a letter of corrective action by September 30th, 2024. Please include on your letter your facility name, and ID# along with the item number and how you came into compliance and plan on keeping in compliance going forward. thank you Technical Assistance: - Please contact me once all the construction, painting, and playground is completed and I will make another appointment with you to re-measure classrooms for square footages. - All staff should have a workforce education account and a letter of file showing their current education. - Medication violations were cited during today’s visit regarding medication expiration and medication in original packaging. Please make sure the expiration date is written someplace visible so teachers can keep track of it. When staff accept medication from parents make sure they do not accept it without it being in its original packaging and if it is prescription meds to make sure the prescription is on the box. - The director should have watched the training video for ABCMS- criminal records and followed the requirements to create an account and link the staff letters to the center. New feature links criminal background applications to facility North Carolina child care administrators can now view and edit their facility’s staff roster in ABCMS, the DCDEE’s criminal background check system. Provider Access to ABCMS allows administrators to: • See the real-time background check status of staff members. • Run a printable report of the staff roster to assist with compliance visits. • See new background check applicants and add to staff roster. To get started, complete the ABCMS Child Care Provider Portal Training in Moodle—a video tutorial followed by a few questions. - 2024 health and safety training; make sure staff complete their CCDF training as well as the medication in childcare training that is not in the CCDF bundle it is separate. The director, Ms. Hailey Pair was present and assisted me during the visit. I completed a general walk through of the indoor and outdoor play areas. I observed six classrooms with children actively involved with their caregivers in group time activities and circle time activities upon my arrival. The Temporary License was available for review along with the NC Summary of the Law, Safe Arrival and Departure procedures, Emergency Medical Care Plan, Emergency Numbers, Emergency Procedures, and a First Aid reference sheet. Attendance records were observed being maintained and available upon entering the classrooms. The temporary license was issued to this facility on October 20th, 2023 – April 23rd, 2024. * The fire drill was conducted on 1/8/2024@ 11:04am. * The last outdoor play inspection was conducted 1/9/2024 * The shelter in place drill was completed on 12/7/2023 @ 10:51 am. * The EPR plan was last updated 11/20/2023 with the current owner information, ID# and center name. * Sanitation inspection conducted 1/11/2024- 17 demerits and a provisional rating. A return visit will be conducted on 1/18/2024. I asked the director if there were additional employees hired since the first temporary time period visit. She informed me a floater and a teacher for the three-year-old classroom were new. These files were reviewed and documented on a staff and training worksheet. There was one violation cited today, a compliance letter is needed by January 27th, 2024, explaining how you corrected the violation and how you will keep in compliance going forward. Violation Number Comment Rule 1327 Accurate records were not maintained for all children. Review of randomly selected children's files found the one enrolled school-age child did not have a file available for review. G.S. 110-91(9) TECHNICAL ASSISTANCE: Before the temporary license expires the facility, director or KinderCare representative will need to contact the planning/zoning department for Wake County to request a building inspector to come out and complete the Building Inspectors Form for Change of Ownership/Continued Use. In addition, you will need to contact the Fire Inspector and Sanitation Inspector to come out to complete their inspections. I will need these completed inspections by the end of March. If inspections are not completed this will cause your facility to be issued a provisional license at the end of your Temporary License. I will need the facility policies (administrative, employee's and family handbook). Once received I will review and if I have any additional questions or concerns, I will contact the facility for clarity. *A question was asked during today’s visit concerning CDA and what the points are for education on the rated license chart. I will ask this question and provide the answer to the facility. REMINDERS: it is the center director's responsibility to assure that the center maintains compliance with all applicable minimum licensing requirements, including, but not limited to the following: 1) Minimum staff/child ratios, however, we recommend using whichever staff/child ratios that you wish to use at the end of your temporary license period, so that you do not have to dis-enroll children to meet ratios. 2) Please make sure to always maintain copies of all staff members CPR certification cards and First Aid Training verification on site at the center. 3) According to your license capacity, the center's administrator must be on site at the center, performing administrative duties, for a minimum of 30 hours per week. 4) There must be a lead teacher present in each classroom for children for a minimum of 2/3rds of your operating day. 5) Children under 2 1/2 must only be in classrooms that have a direct exit to the outside. RATED LICENSE: This facility was previously licensed as Buttons and Bows Childcare, #9255316. This program was in Hold-Harmless status for a 3-year Rated License Reassessment due to the COVID-19 Pandemic. The program was operating with a 5 Star and a total of 13 points. An ownership change occurred on October 20th, 2023. All points from the license issued to Buttons and Bows Childcare, #9255316 on April 23rd, 2024, can be carried forward if the facility chooses. Although the rated license results from Buttons and Bows is being used to issue this KinderCare facilities license the previous ID# is in cohort #1- planning period July 1st, 2023-June 30th, 2024, and the assessment period June 30th, 2024-July 1st, 2025. Hailey Pair, Director, accompanied me during a walk-through of the facility. During the visit, I discussed the allegations with Ms. Pair, Danielle Hartle-Brewer, Assistant Director, and additional staff members. Limited monitoring of child care requirements occurred during today’s visit. Violation Number Comment Rule 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. On December 1, 2023, a staff member in the infant classroom pushed a child back into their crib to get them to return to sleep. On several other occasions, this staff member tapped infants on their mouths, foreheads, and bottoms while verbally expressing frustration.
