The director, Samantha Smith, assisted me with today’s visit. We conducted a walk-through of the indoor and outdoor learning environments. It was nap time so observed groups of children who were resting on my cot. I also observed infant meal time and rest time. RATED LICENSE STATUS The program operates with a 5-star rated license issued on 1/20/22. They received 6 points in program standards, 7 points in staff Education and 1 Quality Point through the programmatic option of having enhanced policies and an infrastructure of parent involvement. During today’s visit we discussed the new QRIS pathways and you were given an opportunity to ask questions. You stated that you planned to pursue Pathway 3. They are submitting information in their portal and are actively working towards NAEYC Accreditation. INSPECTIONS The last sanitation inspection was conducted on 9/18/25. The last fire inspection was conducted on 8/8/24. The last documented fire drill was conducted on 1/14/26. The last documented shelter-in-place or lockdown drill was conducted on 12/20/25. The last documented playground inspection was conducted on 1/12/26. The status of the owners, Kindercare Education, LLC., is listed as current and active on the NC Secretary of State website. Limited monitoring of childcare requirements was assessed during today’s visit. I reviewed emergency medications, 3 new staff files and confirmed that all staff have current CPR, First Aid, and ITS SIDS certificates, as required. The program does not transport children or enroll school-aged children; therefore, these requirements were not assessed. The following violations were observed and recorded during today’s visit. Violation Number Comment Rule 106 Operator has not scheduled and obtained a fire inspection within 12 months of the previous inspection. Operator did not submit the original approved report to DCDEE within one week of the inspection visit on a form provided by the Division. The last approved fire inspection was completed 8/8/24. 10A NCAC 09 .0304(a) 1898 Staff did not complete the health and safety training within one year of employment. Six staff members had not completed this training within the required period of time. .1102(a) The above violations must be corrected immediately. By 3/5/26 please email me a signed letter of compliance. Before the letter is sent, all violations should be corrected; please contact me if additional time is needed to correct a specific violation. Include the following in your letter: facility ID number, list the item number describing how and when the violations were corrected and tell me how you plan to maintain compliance in the future with each item. If you prefer to mail your letter, you may send it to 2201 Mail Service Center Raleigh, NC 27699-2201 If the compliance action letter is not received by the due date another visit to the center may be made and additional violations may be added. COMPLIANCE HISTORY Prior to today’s visit, the program’s compliance history was 93%. According to NC General Statute 110-90 (4) (d) all facilities must maintain a compliance history of at least seventy-five percent (75%) for the past 18 months. TECHNICAL ASSISTANCE The last approved fire inspection was conducted in August 2024. Today, I observed records indicating that the inspector had visited 3 times over the last year and they were unable to approve the inspection. Fire inspections should be completed annually and are essential to ensuring the basic safety of your facility. Please contact your fire inspector, after ensuring that all deficient areas are corrected, and schedule that fire inspection as soon as possible. Health and Safety trainings were developed to help all staff employed at the center to have a basic understanding of sanitation and health-related requirements. Five of your staff members did not complete this required training within their first year of employment and another did not renew their training after 5 years. All staff should complete this training within the next two weeks. CONSULTATION All childcare facilities are required to test their drinking and cooking water for led every three years. Your water was last tested, 4/4/24. For more information, you should contact Clean Water for Carolina Kids. Contact www.cleanwaterforcarolinakids.org for more information. In addition, childcare facilities are now required to test for lead and asbestos hazards in their buildings. This center is determined to be exempt from testing for lead-based paint and asbestos. Training in all the required health and safety topics must be completed at least every 5 years. It may be time for your staff to complete this training again. Health and Safety training is available, at no charge, on the DCDEE website, in Moodle. There is a link to this training on Moodle. Medication Administration is also a required health and safety training topic. This training is available through Moodle as a separate training. This documentation was reviewed with you and a copy of the visit summary documentation was given to you at the end of the visit. Upon arrival, I was greeted by the center director, Samantha Smith, and we conducted a general walk through of the indoor and outdoor learning environments. I observed groups of children engaged in free play in their classrooms or on the playground. I also observed infant meal time. RATED LICENSE STATUS The program operates with a 5-star rated license issued on 1/20/22. They received 6 points in program standards, 7 points in staff education and one quality point through the programmatic option of having a staff benefit package and an infrastructure of parent involvement. The program’s “held harmless status” has been extended until the new QRIS is implemented. This means that rated license visits will not be processed until the new rated license process is completed unless the program requests to proceed with a new rated license. All staff should be registered and have their education assessed through WORKS. Best practice recommends that this be completed as a part of new employee orientation and then updated as staff education changes. INSPECTIONS The last sanitation inspection was completed on 12/30/24. The last fire inspection was completed 8/2/24. The last documented fire drill was conducted 1/9/25. The last documented lock down or shelter-in-place drill was conducted 6/12/25. The last documented playground inspection was conducted 6/30/25. MONITORING During this visit a full assessment of Child Care Requirements was conducted. The facility was assessed using items noted on the Annual Compliance for Centers checklist. The status of the owner, Everbrook Academy, LLC is listed as current and active on the NC Secretary of State’s website. Staff on-going training was assessed from 8/1/24 – 7/31/25. The following violations were observed and recorded during today’s visit: Violation Number Comment Rule 847 Parent's medication authorization did not include required information. One child's epi-pen did not have a medication authorization form. Teachers in a classroom were unable to locate a child's epi-pen during today's visit. 10A NCAC 09 .0803(4)(6-9) 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. Two staff members did not have current First Aid certification. .1102(c) 1049 All staff did not successfully complete certification in CPR training appropriate to the age of the children in care. Verification of staff completion of the CPR course from an approved training organization was not in the staff file. Two staff did not have current CPR certification. .1102(d) 1898 Staff did not complete the health and safety training within one year of employment. One staff member did not complete training in all the required topics within their first year of employment. .1102(a) The above violations must be corrected immediately. COMPLIANCE HISTORY Prior to today’s visit, the compliance history score for the center was 93%. TECHNICAL ASSISTANCE Emergency medications must be easily accessible should the child experience a medical emergency while they are at the center. During today’s visit, the teachers assigned in a classroom did not know where the child’s emergency medication was located. The center has designated areas in each space, but the medication was not stored in the area. As they were looking to locate the medication, I learned that the child recently transitioned into the classroom and there was confusion about if the medication had been moved from the child’s previous rooms. In addition, another child’s medication was moved, but the permission form and allergy care plan was not stored with the medication. There should be a designated person who routinely checks the medication and accompanying documents to ensure that they are current and compliant with child care requirements. Also, I recommend that emergency medication management be added to the classroom transition plans, to ensure that all staff are aware of the child’s emergency medical needs. Two staff members do not have current CPR and First Aid certification. This training is required for all staff within their first 90 days of employment and remain current, thereafter. This training should be scheduled prior to the expiration for all staff. One staff member, with a hire date of 5/17/24, had not completed training in all the required health and safety topics within their first year of employment. All staff need this training to ensure that they can respond appropriately to a variety of health and safety issues. . CONSULTATION Child Care facilities are required to test their drinking and cooking water for lead every three years. Your water was last tested for lead on 4/30/24. In addition, child care facilities are now required to test for lead and asbestos hazards in their buildings. The Clean Classrooms for Carolina Kids program is designed to identify and eliminate exposure to lead and asbestos hazards in building infrastructure, while providing child care facilities with the support needed to meet all rule requirements. The program is free and the first step is to watch one of the pre-enrollment webinars, which are available at www.cleanwaterforUSkids.org/carolina. The deadline to complete this testing expired on 5/31/25. Training in all the required health and safety topics must be completed at least every 5 years. It may be time for your staff to complete this training again. Health and Safety training is available, at no charge, on the DCDEE website, in Moodle. Medication Administration is also a required health and safety training topic. This training is available through Moodle but you must register separately for this training. A visit was conducted on 11/19/24. The center director, Samantha Smith, assisted me with today’s visit. Upon arrival, I conducted a walk through to check staff/child ratios. All rooms were in compliance with staff child ratios during today’s visit. During the visit conducted on 11/19/24, I requested staff time sheets and classroom attendance records to review from 11/4/24 – 11/18/24. I reviewed a sampling of these records and listed below are my findings: on 11/4/24, there appeared to be enough staff for the number of children present. On 11/12/24, there were two staff members, working in Twos and EPS 1 from 8:15-8:25 with 20-22 present. The staff/child ratios for this classroom are 1:9. In Preschool 1, PreK 1 and Jr. PreK there were 2 staff present from 7:45-8:25 with 21-31 children and from 8:25-8:43 there were 3 staff present with 33-35 children ranging in age from 3 – 5. The staff child ratio for these classrooms is 1:9 if three-year-old children are present and 1:10 if all children in attendance are four years old. On 11/14/24, there was one staff member working in Preschool 1, PreK 1 and Jr. PreK from 6:30 – 7:45 with 14 – 28 three to five- year -old children. In Toddlers 1 and Toddlers 2 there were two teachers present from 8:45 – 8:55 with 14 children. I asked Samantha if there were additional documents that could explain these findings, and she stated that there were no records except the ones that were previously given to me. She was not employed at the center, during these dates, so she was uncertain when the director arrived. One 11/18/24 in Preschool 1, PreK 1 and Jr. PreK there were two staff present from 7:45 -8:00 with total of 22 children and from 8:00 – 8:42 there were 3 staff present with a total of 32-25 children. I asked Samantha if there were additional documents that could explain these findings, and she stated that she knew that she helped in several classrooms, but she did not remember which rooms and her time in the classrooms was not documented. CONCLUSIONS Allegation 1 Based on staff interviews, observations and a review of records provided by the center it does appear that the program has failed to maintain required staff child ratios on multiple days, in multiple classrooms, therefore, this allegation is SUBSTANTIATED. Allegation 2 I was unable to determine that the administrative action was occasionally removed from the front entrance, therefore, this allegation is UNSUBSTANTIATED The following violations were observed and recorded during today’s visit. Violation Number Comment Rule 1756 Enhanced staff/child ratios and group sizes were not met. Over a three day period in November, there were multiple classrooms out of ratio, for periods of time in the early morning. 10A NCAC 09 .2818 Due to the nature of these violations, a follow-up visit is required, so a compliance letter is not required. COMPLIANCE HISTORY Prior to today’s visit, the program’s compliance history was 96%. TECHNICAL ASSISTANCE It is crucial that staff/child ratios are always maintained to ensure that children are properly supervised and receive good care in a safe environment. When classrooms are combined, the applicable staff/child ratios are based on the youngest children present in the group. To ensure that staff child ratios are maintained, staffing schedules should be adjusted to meet the needs of the center and/or extra staff should be hired so that staff/child ratios can be maintained throughout the day. If extra staffing is not available to maintain staff/child ratios then the center should limit their enrollment to prevent a recurrence of this violation and potentially put children at risk. ADMINISTRATIVE ACTION STATUS Corrective Action Plan Item 1: Center staff shall always maintain compliance with all applicable child care requirements. On a visit conducted on 11/19/24, it was determined that multiple classrooms were out of ratio, for periods of time, on three days in November 2024. Item 2: Within two weeks of the receipt of this Notice the center administrator shall revise staff child ratio procedures and submit them to the child care consultant for review. The initial draft of the revised procedures was submitted on 11/5/24.These were reviewed and I gave feedback regarding suggested revisions on 11/6/24. On 11/24/24 I received the Face-To-Name Sheet, a maximum notice sign and the compliance letter for your recent visit. During today’s visit, we discussed some formatting changes so that the content of the letter could satisfy the stipulation of the corrective action plan. Once I receive these changes, you will be ready to implement your plan and then fulfill stipulation 3. Item 3: Within two weeks after notification from the Division that the stipulation has been met for the procedures related to staff/child ratios, you should plan a mandatory staff meeting for all center staff. During upcoming visits, I will monitor the stipulations outlined in the corrective action plan you provided. CONSULTATION The substantiation of any allegation may result in a more stringent Administrative Action, up to and including revocation of the license, being issued to the center. Upon arrival, I was greeted by the Administrative Assistant, Samantha Puryear. We discussed the nature of the visit and she requested a moment to use the restroom. I observed her go down the hall and move children to various classrooms. After waiting for her return for approximately 7 minutes, a parent let me into the classroom hallway and I found Samantha, still moving children to various rooms. I told her that she appeared to be very busy, and I was happy to conduct the walk through without her. She stated that she was available, but she was frequently called away. During the initial walk through, all classrooms were in ratio. Allegation #1: There are concerns that the posted staff/child ratio is not being followed. OBSERVATION Prior to today’s visit, I confirmed that the center is required to follow enhanced staff/child ratios to meet the requirements of their star-rated license. After the initial walk through, I saw numerous other children arriving and only one other staff member. Samantha and I chatted for a few minutes, and I requested to conduct another walk through. During the second walk through I observed two classrooms out of ratio. Classroom #4 had 10 two-year-old children with one staff member present. Samantha moved one of those children to classroom # 5. In Classroom # 4 there were 21 three and four-year-old children with two staff members present.The staff child ratios for three-year-old children is 1 staff to 10 children and the maximum group size for classrooms enrolling three-year-old children is 20. Samantha stated that the Pre-K teacher would arrive shortly. DISCUSSION I spoke with the director and the administrative assistant, and they both acknowledged that they are short staffed and have multiple teachers calling out and they have been out of ratio recently for short periods of time. I asked the administrative assistant to explain how they monitor ratios during drop off time and she stated that the teachers call her when they are out of ratio and when she is at the front desk, she monitors the classroom numbers as she is greeting the families. Today, the cook called out and she was preparing breakfast today. I asked the director what they do on days when they are short staffed. She stated that she calls other centers in the area to see if they can send someone to help. She said that frequently, extra help is not available. If staff can not be obtained from other centers, then administrators provide classroom coverage. I then asked what happens if the administrators are in the classroom and there is still not adequate coverage. She stated that previously they closed classrooms, but they are unable to do so now. RESOLUTION Based on staff interviews conducted and observations made during today’s visit, it was determined that two classrooms were not meeting enhanced staff/child ratios today and both administrators stated that they have been out of ratio, for short periods of time, over the last month. Therefore, this allegation is SUBSTANTIATED. The following violation was observed and recorded during today’s visit. Violation Number Comment Rule 1756 Enhanced staff/child ratios and group sizes were not met. Two classrooms were out of ratio today. Room #4 had 10 two-year-old children with one teacher present. TECHNICAL ASSISTANCE Adhering to staff/child ratios ensures that children are safe, and that staff are adequately able to supervise and interact with the children. A classroom must maintain staff/child ratios at all times. Center staff should notify the administrator when they reach the maximum number of children permitted, so that staff child ratios are maintained. If another child arrived before a 2nd staff member is present parents should be asked to wait until coverage can be provided. Keep in mind that staff/child ratios and maximum group sizes are based on the youngest child present in the classroom. CONSULTATION The substantiation of any allegation may result in an Administrative Action, up to and including revocation of the license, being issued to the program. INSPECTIONS The last sanitation inspection was conducted on 11/21/23. The last fire inspection was conducted on 8/2/24. The last fire drill was conducted on 7/30/24. The last emergency drill was conducted on 7/31/24. The last playground inspection was conducted on 7/15/24. MONITORING A full assessment was conducted, which included the following: program requirements, equipment and furnishings, staff/child ratios and supervision, medication, outdoor area and equipment, staff and children’s records. During today’s visit, we completed a walk-through of 10 spaces, including children’s classrooms, multi-purpose room, kitchen and outdoor learning environment. There was a total of 72 children present. We observed the children engaged in building structures in block center, puzzles, math learning activities, reading books, riding bikes. The infants were being feed, sleeping and having tummy time. The program does care for children under 12 months of age; therefore, those requirements were monitored during today’s visit. The program does not provide transportation; therefore, those requirements were not monitored during today’s visit. The NC Secretary of State website was reviewed on 8/1/24 and Everbrook Academy, LLC was listed as active and current. The following violations were observed and documented during today’s visit: Violation Number Comment Rule 1021 Individual responsible for a group of children did not meet the preservice requirements for a lead teacher or teacher. A coach from Soccer Shots was giving soccer lessons for 4 young preschool age children on the playground. 10A NCAC 09 .0710 (a-b) 1947 An individual on a provisional criminal background check status was not supervised by a staff person who was determined to be qualified. A staff with a provisional criminal background check, in the toddler classroom was providing care for 5 children unsupervised. G.S. 110-90.2(b) & .2703(f) The above violations must be corrected immediately. Child care programs are expected to maintain compliance with all child care requirements at all times. On or before August 16, 2024, I must receive a written, dated, and signed compliance letter that describes accurately and in detail how and when the violations were corrected. If sufficient information is not received by the due date, a follow-up visit will be conducted. Failure to do so may result in the issuance of a provisional license or other administrative action. Any violations documented during today’s visit may impact your compliance history and an updated score will be provided at your next visit. TECHNICAL ASSISTANCE Technical assistance was provided to you today in order to assist in regaining compliance and avoiding violations in the future on the following: -Upon hire, the administrator should review all preservice requirements to ensure compliance with child care laws. When reviewing criminal background qualifying letters, it was determined that there is one teacher with a provisional CRC. Any staff who receives a provisional approval is not to care for children alone. The staff member can be counted in the staff/child ratio. A teacher with a Provisional CRC was alone with a group of children during today’s visit. When this was brought to the attention of the director, the person was moved to another classroom so that she would be supervised and another teacher took over her classroom. -Any person providing service to children must meet all preservice and record-keeping requirements if they are left alone with children. The person providing soccer lessons for 4 children was observed alone in direct care of the children on the playground. Staff or administrator should always be with service provider while they are in contact with children unless the person meets all licensing requirements. Although the center did have CRC qualification letters on file for the ‘soccer shots’ person today, no other paperwork was available to determine if the person meet requirements. TRAINING AND COMPLIANCE REMINDERS To assist you in maintaining compliance with childcare requirements, the following reminders were discussed during today’s visit -Two staff member’s criminal qualifying letters will expire in September, please have staff renew criminal background by September 2024. -Three new staff members are approaching their 90-day deadline to obtain their CPR and First Aid certification. Please have the complete an approved CPR and First Aid training. RATED LICENSE REASSESSMENT At this time, your license remains in Hold Harmless Status, and you will continue to operate on the license previously issued. Once Rated License Assessments have resumed, your consultant will be in touch to discuss your next steps. Upon arrival at the facility, we were greeted by Rachel Ward, School Education Manager. Holli Hemby, Licensing Supervisor accompanied me on the visit and assisted with the monitoring of the program. The Fire Marshall arrived during our visit to conduct the center’s annual inspection. Later in the visit, the center director, Helen Lambeth arrived and took over assisting us with the visit. LICENSE STATUS The facility is in Hold-Harmless status for a 3-year Rated License. The program is operating with a 5-star license issued on 1/20/22. The program received 6 points in Program Standards, 7 points in Staff Education and 1 Quality point for having a Staff Benefit Package and an Infrastructure of Parent Involvement.
