    Name of Operation: BEAVERDAM ELEMENTARY Facility ID: 92003527 Consultant: ELIZABETH LESTER Operation Type: Center Case Number: 0226-082L Visit Date: 2/18/2026 Number Present: 14 Completed Date: 2/18/2026 Age: From 4 To 5 Total Minutes: 65 Time In: 10:55 AM Time Out: 12:00 PM Time In: Time Out: List to Use: Center Type Of Visit: Complaint Visit Announced/Unannounced: Unannounced The purpose of today’s visit is to investigate an allegation of non-compliance with the NC Child Care Requirements. A report was received by the agency on February 12, 2026 with additional information received 2/17/26. Upon arrival, I checked in at the main office. Mrs. Jessica Gill, Lead Teacher, assisted me with today’s visit. ALLEGATION There are allegations of violations of child care requirements pertaining to the nurture and care of a child. OBSERVATIONS AND DISCUSSIONS According to the reporter, a staff member did not attend to a child in a nurturing and appropriate manner. A child was lifted by their arm and pulled to a bean bag pillow. Prior to my visit I spoke to the reporter. The reporter stated that they were walking down the hallway and saw an Instructional Assistant (IA) pull a child by their right arm. The reporter stated that the IA then lifted the child by their right arm and moved the child to a pillow and placed the child on the pillow near a desk. I asked if the child’s feet left the floor and the reported answered “yes”. They also stated the Instructional Assistant was speaking to the child by they could not hear what she was saying, however by the tone of her body language, she appeared frustrated. The reporter immediately let the principle know what they saw. I discussed the allegation with Mrs. Gill, Lead Techer. She stated that she did not see the incident reported, however she is aware that there was an incident that may have occurred and it was reported to the principal. She explained that she was able to identify the child based on description. She stated that this child uses the beanbag chair as a place to regulate and regain control of their body and emotions. She also stated that the teacher involved with the incident was wearing a boot cast on her ankle and did not believe that she could have picked the child up. She also stated that there were four (4) adults in the room on the morning of the reported incident. I interviewed the second Instructional Assistant, Mrs. Hinton, assigned to this classroom and she also stated that she did not see the incident. She was not sure what time the reported incident happened, so she was not certain she was in the classroom. She explained that she has not had any concerns, and she stated that the children enjoy being with the other Instructional Assistant. I asked to speak to the principal and Mrs. Gill called up front and the Principal, Mrs. McCoy, came to the classroom and I was able to speak to her in an adject room. Mrs. McCoy explained she received a report from an employee that saw an inappropriate interaction between a student and an Instructional Assistant as described above. She stated that she interviewed the IA reported in the incident and the IA stated that “Yes I did pull him and yes I put him on the pillow, and it may not have been gentle”. Mrs. McCoy then spoke to the child and the child stated “He flew like a jet”. Mrs. McCoy also stated that she looked at the video from the hallway and saw the reporter walk down the hall and they were looking towards classrooms. They walked past the classroom, then backed up and continued to look in the window of the classroom. She also determined Mrs. Hinton had left the classroom shortly before the reported incident. The Instructional Assistant was placed on administrative leave pending further investigation. RESOLUTION Based on my discussions with the principal and the witness to the incident this allegation has been determined to be SUBSTANTIATED. The following violation was documented Violation Number Comment Rule 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. On February 10, 2026 it was determined that a child was not attended to in an appropriate manner by a staff member pulling a child by the arm to move them. G.S. 110-91(10) The above violation MUST be corrected immediately. Please mail or email your letter of compliance by March 4, 2026. The letter must address the violation and describe how the violation was corrected. Children cannot be pulled by their arms or legs to move them. If a child needs to be moved from a space, please move or guide them gently by standing in front of them, getting down on their level or holding their hand and say, “I am going to help you to the bean bag chair”. If you are feeling overwhelmed or it is a safety concern, please discuss the situation with your supervisor OR the Office of Early Learning.
