Tenille Lowery, Investigations Consultant, conducted the visit and Miranda Gartner, Lead Investigations Consultant was available by teams and by phone for a portion of the visit. Tashaunda McAllister, assistant director, accompanied me during a walk-through of the facility I spoke with Ms. McAlllister and informed her of the purpose of the visit. I observed a copy of the administrative action, cover letter, and CAP posted as required. I also reminded Ms. McAllister the information must remain posted until October 10, 2026. Limited monitoring of child care requirements occurred during today’s visit. I reviewed a copy of the staff training worksheet and verified valid CPR training, First Aid training, ITS-SIDS training, and criminal background check qualification letters for all current staff members. The following violations were observed and/or confirmed during today’s visit. Violation Number Comment Rule 1043 All staff records, except financial records, were not made available for review. During the visit on 11/03/2025, a staff did not have a file available for review by DCDEE staff as required. G.S. 110-91( 9) Violations must be corrected immediately. Within one week 11/10/2025, you must submit documentation of the corrections you made and your plan to maintain compliance with the identified child care requirements to me at Miranda Gartner, Lead Investigations Consultant, 336-247-5428, Miranda.Gartner@dhhs.nc.gov, 1-919-715-1013. I monitored for compliance with the CAP as follows: Item 1: A violation was cited due to a staff member not having a file available for review on the premises as required. . Item 2: During the visit on 11/03/2025, a staff member stated they have Level 1 administrator qualifications. Per works and staff members report, they have submitted their information to the Division but have not received a qualifying letter for administrator at this time. More information will need to be gathered to determine if this CAP stipulation is met. Item 3: This has not yet been submitted. Item 4 This is due by November 4, 2025 Item 5 Ms. Mickens reached out to Ms. Benson on 10/22/2025 to schedule the training. No further information was available during the visit on 11/03/2025. Item 6 Ms. Mickens reached out to Ms. LaPorte on 10/22/2025 to schedule the training. The training is scheduled on 11/20/2025 from 3:00pm - 5:00pm, hosted at The Children's Courtyard center. Morgan Mickens, director, was on the premises and I reviewed the attached visit summary documentation with her at the end of today’s visit. A probationary license issued from 4/10/24 through 4/10/25. Restrictions on the permit include first and second shifts and meets enhanced ratios and enhanced space. The last Annual Compliance Visit was January 28, 2025. The last sanitation inspection was on January 6, 2025, earning a Superior rating with 2 demerits. The last Fire Inspection was February 25, 2025. The center compliance history is ninety-two percent (92%) as of June 4, 2025. The Secretary of State website was checked on June 4, 2025, and The Children’s Courtyard, INC. was current and active. Staff/child ratio, group size, supervision, use of licensed space, space capacity, license restrictions, and the outdoor environment were monitored. The license and emergency care plan were posted. Fire drills, medication administration, and storage of hazardous products were also monitored. The Staff and Training Worksheet was updated with four new staff who have been hired since my last visit. You visited each indoor and outdoor space with me. Children were observed in free play activities and teacher directed activities. The teachers were attending to the children in a nurturing and appropriate manner. Proper hand washing techniques were observed. Lunch consisted of turkey tacos, carrots, oranges and milk. The following violation was observed during today’s visit: Violation Number Comment Rule 1805 A child care operator did not notify the Division of any new child care providers, as defined in G.S. 110-90.2(a)(2), who were hired or moved into the child care facility within five business days. The ABCMS system roster did not reflect all of the current staff members. G.S. 110-90.2 & .2703(r) Child Care programs are expected to always achieve and maintain compliance and are required by NC GS 110-90(4)(d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. The violation(s) documented must be corrected immediately. On or before June 18, 2025, I must receive a written, dated, and signed compliance letter that describes accurately and in detail how and when the violations were corrected. As stated in G.S. 110-90.2 & .2703(r) child care operators are to notify the Division of any new child care providers working who were hired or moved into the child care facility within five business days. The process of notifying the Division has changed and is now captured in ABCMS. This change has been in effect since February 2024. Effective immediately, you will need to obtain a Business NCID and complete Provider Portal training in Moodle at https://www.dcdee.moodle.nc.gov/course/view.php?id=119. No action is needed on your part if you have completed the reference training and are currently using the ABCMS Provider Portal to update information regarding new hires or residents. Morgan Micken, interim director, and Vickie Bullock, interim assistant director, assisted me with today’s visit. The allegation are as follows: 1. There is a concern of inadequate supervision. A child was left in the classroom unsupervised for an unknown amount of time. 2. There is a concern related to sanitation and health. 3. There is a concern of an unsafe outdoor environment. Staff/child ratio, group size, supervision, use of licensed space, space capacity, license restrictions, and the outdoor environment were monitored. The license and emergency care plan were posted. Fire drills, medication administration, and storage of hazardous products were also monitored. The Center Space, Capacity, Staff/child Ratio was completed today during the complaint investigation case #: 0125-324L. There were 136 children ranging in age from three-months-old to five-years-old present during today’s visit. I interviewed the administrators and teachers regarding protocol for maintaining supervision requirements at all times of the day. During the interview process with five (5) teachers, it was determined that teachers use the face to name tracking tool daily. Teachers document the time each child arrives, the child’s age, and when the child leaves. They also document who picked up the child. The tool is designed to ensure that each child is always in the care of a teacher. The teachers’ names and their hours of arrival and departure are also located on the tool. During my review of the face to name tracking tool, I observed that the tracking tool completed on the day that the child was left in the classroom was incomplete. The teacher did not write down what time the child left her care and entered another teacher’s care. The teacher returned to the classroom, after she signed out the other children, to look for the missing child. He was not in the classroom. She called for him and he did not answer. She thought that he had been picked up and she left. Approximately 4 minutes went by, and another parent entered the classroom. She saw the missing child exit the bathroom. She brought the child to the reception desk administrator located in the entrance lobby. The child remained in the care and supervision of the reception desk administrator until his mother picked him up from the administrator. The administrator called V. Bullock, Interim Assistant Director, to tell her about the child being left alone in the bathroom. V. Bullock called the mother to let her know what had happened. V. Bullock was able to determine the amount of time that the child was left unsupervised by comparing the time that the other children were signed into the other classroom and the time that the parent brought the child up front. The difference was four (4) minutes. The allegation that a child was left in the classroom unsupervised was substantiated. I observed proper sanitation protocols in all the classrooms today. Children were observed washing hands and eating lunch. Diapers were checked every hour in the infant and toddler room and every two hours in the two-year-old age group and changed as needed. The bathrooms were clean and in good repair. The center requests a complete change of clothes for each child. This ensures that they can be changed or independently change themselves when they soil their clothing. The allegation that sanitation and health requirements were not being met was unsubstantiated. I observed the outdoor area and the playground safety checklist. There were no violations of child care requirements observed around the outdoor environment. The allegation that the environment was unsafe was unsubstantiated. One violation was documented: Violation Number Comment Rule 303 Children were not adequately supervised at all times. A child was left alone in the classroom bathroom of space #14 for approximately 4 minutes. .1801(a)(1-5) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4)(d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. Due to the nature of the violation cited during today’s visit, a follow-up visit is required. Children were observed in free play activities and teacher directed activities. The teachers were attending to the children in a nurturing and appropriate manner.
