Applicable childcare requirements were discussed with you, Dana Bowen, Lead Teacher/Administrator. During this visit I monitored all spaces approved for child care. I also observed children actively engaging with their assigned teacher and participating in various free-choice centers, including fine motor activities, books, blocks, and dramatic play. Other routine activities such as eating lunch, playing outside, and handwashing were also monitored. Positive and developmentally appropriate interactions between staff and children, staff/child ratios, and supervision were monitored throughout the visit. Their four-star rated license was posted and in compliance with all restrictions noted on the license. During this visit I monitored two (2) staff files, two (2) children files, and program files. Their last fire inspection was conducted on October 20, 2025. Their last sanitation inspection was conducted on September 18, 2025. Overall enrollment and attendance information were collected. The attached Space Capacity and Enrollment Worksheet reflect this information, along with the names of staff present and actively caring for children during this visit. At the conclusion of the visit, the visit summary was reviewed with you, and you were provided with an opportunity to ask questions, seek clarification, and request technical assistance. You were also provided with an electronic copy of this visit summary to keep for your records. Violation Number Comment Rule 812 Electrical outlets and power strips, not in use, which were located in space used by children did not have safety outlets or were not covered with safety plugs unless located behind furniture or equipment that cannot be moved by a child. Outlets on a power strip that were accessible to children were not covered. This was corrected during the visit when the power strip was placed so it was not accessible to the children. 10A NCAC 09 .0604(c) 1035 Child care providers, including the director, uncompensated providers, substitute providers, and volunteers did not have the required Emergency Information Form on file on or before the first day of work, which included all the required information and/or the information on the form was not updated as changes occur and at least annually. This was not completed as least annually for two staff. The staff members completed this during the visit and placed them in their file; therefore this was corrected during today's visit. .0701(a) 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. This was not renewed by the expiration date for one staff member. .1102(c) 1049 All staff did not successfully complete certification in CPR training appropriate to the age of the children in care. Verification of staff completion of the CPR course from an approved training organization was not in the staff file. This was not renewed by the expiration date for one staff member. .1102(d) 1311 Emergency medical care information was not on file in the center on the child's first day of attendance and/or was not updated as changes occurred or at least annually for each child. This was not completed at least annually for one child enrolled. .0802(c) 1325 Parent’s statement includes the child’s name and date of enrollment and the date the parent signed the statement. The enrollment date was not completed for two children enrolled. The enrollment date was added to the discipline statement for the two children during the visit; therefore, this was corrected during the visit. .1804(b) All violations should be corrected immediately. Three (3) out of the six (6) violations documented were corrected during this visit. A signed and dated letter of compliance must be submitted to me no later than June 2, 2026, for the violations that were not corrected during the visit. Failure to submit your compliance letter by the stated deadline or failure to contact me regarding a revised timeline may result in a follow-up visit, and violations may be cited. However, going forward the original approved fire inspection should be submitted to your assigned consultant within one (1) week of the inspection visit. Technical Assistance: CPR/FA certifications should remain current at all times. Keeping them up to date helps ensure staff are prepared to respond quickly and appropriately in case of an emergency. Dana Bowen, lead teacher, assisted me with the visit. Your program currently operates with a four-star license, issued February 2, 2025, earning 7 points in the education component, 2 points in the program standards component (meets enhanced space) and 1 quality point for meeting the programmatic option. The last fire inspection was completed 17, 2024 and was approved for daytime care only. The last sanitation inspection was completed on August 15, 2024 and was given a superior rating. Each indoor and outdoor space was monitored. Children were observed toileting and resting. The children bring lunch from home and each child has an opt out form on file. There was one violation today and it was corrected during the visit. Violation Number Comment Rule 716 All stationary equipment, more than 18 inches high, was not installed over protective surfacing. The surfacing at the end of the slide was not at least six inches deep. Surfacing was added to the area making it the appropriate depth. .0605(j) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. The facility was issued a Temporary License effective August 1, 2024 to February 1, 2025. Dana Bowen, Administrator/Lead Teacher, was present. She accompanied me as I monitored the indoor and outdoor spaces used for child care. The children observed today were interacting with assigned staff, eating morning snack, and playing outside. Staff and children were observed washing their hands after eating. Teachers adequately supervised children. All children had an Opt Out Form on file so, parents were responsible for providing all meals, snacks, and beverages. During the visit two (2) children’s files were monitored. All staff files were monitored on September 11, 2024. No new staff have been employed since that visit so I didn’t monitor staff files during this visit. All center program records were also monitored. It is the center’s responsibility to review all files for completeness. Overall attendance and enrollment were collected today. The attached space, capacity and enrollment worksheet reflects the enrollment and attendance information along with the staff that were present and caring for children today. At the completion of the visit, the Visit Summary was reviewed with Ms. Bowen and a computerized copy was given to her. Violation Number Comment Rule 1321 Medical exam or health assessment record was not on file before or within 30 days after admission. This was not on file for one child enrolled. GS110-91(1) The violation/s documented above must be corrected immediately. The school will be closed on November 28 and 29 for the Thanksgiving Holiday so, a signed and dated letter of compliance must be submitted no later than December 2, 2024, stating that all violation/s have been corrected. The process of notifying the Division has changed and is now captured in ABCMS. This change has been in effect since February 2024. BENSON Operation Type: Center Case Number: Visit Date: 11/14/2024 Number Present: 14 Completed Date: 11/14/2024 Age: From 3 To 5 Total Minutes: 120 Time In: 09:00 AM Time Out: 11:00 AM Time In: Time Out: List to Use: Center Type Of Visit: Temp Time Period Announced/Unannounced: Unannounced The purpose of today's visit was to monitor compliance with applicable child care requirements pertinent to the second Temporary Time Period Visit. The facility was issued a Temporary License effective August 1, 2024 to February 1, 2025. Dana Bowen, Administrator/Lead Teacher, was present. She accompanied me as I monitored the indoor and outdoor spaces used for child care. The children observed today were interacting with assigned staff, eating morning snack, and playing outside. Staff and children were observed washing their hands after eating. Teachers adequately supervised children. All children had an Opt Out Form on file so, parents were responsible for providing all meals, snacks, and beverages. During the visit two (2) children’s files were monitored. All staff files were monitored on September 11, 2024. No new staff have been employed since that visit so I didn’t monitor staff files during this visit. All center program records were also monitored. It is the center’s responsibility to review all files for completeness. Overall attendance and enrollment were collected today. The attached space, capacity and enrollment worksheet reflects the enrollment and attendance information along with the staff that were present and caring for children today. At the completion of the visit, the Visit Summary was reviewed with Ms. Bowen and a computerized copy was given to her. Violation Number Comment Rule 1321 Medical exam or health assessment record was not on file before or within 30 days after admission. This was not on file for one child enrolled. GS110-91(1) The violation/s documented above must be corrected immediately. The school will be closed on November 28 and 29 for the Thanksgiving Holiday so, a signed and dated letter of compliance must be submitted no later than December 2, 2024, stating that all violation/s have been corrected. The letter can be emailed to me at leisa.benson@dhhs.nc.gov. If you state in the compliance letter that corrections have been made when they have not, this will be considered falsification of information. If you cannot meet the requirements by December 2, 2024, you must contact me with a purposed timeline of the corrections. In some cases, this timeline may be extended. You are required to always maintain compliance with all applicable child care rules and regulations. NC GS 110-90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past eighteen (18) months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action. Violations cited during today’s visit, may negatively affect your compliance score. As of today’s, visit your compliance history is 99%. Rated License: I reviewed the rated license requirements with you during the Temporary Time Period Visit conducted on September 9, 2024 and during today’s visit. Because of the upcoming holidays and school breaks you felt this would not be a good time to have the ERS Assessment. I discussed with you that once you receive your star rated license you can apply for a higher star license at any time. I also discussed with you that when I process your rated license application, I will use the education information that is in WORKS at that time so, it is important that all staff check their WORKS account to ensure that their education information is current. Technical Assistance: CBC Provider Portal As stated in G.S. 110-90.2 & .2703(r) child care operators are to notify the Division of any new child care providers working who were hired or moved into the child care facility within five business days. The process of notifying the Division has changed and is now captured in ABCMS. This change has been in effect since February 2024. Effective immediately, you will need to obtain a Business NCID and complete Provider Portal training in Moodle at https://www.dcdee.moodle.nc.gov/course/view.php?id=119. No action is needed on your part if you have completed the reference training and are currently using the ABCMS Provider Portal to update information regarding new hires or residents. Once the training has been completed and access has been given, you must verify your facility roster to ensure current staff are noted on the roster. This information should be updated in ABCMS in an ongoing basis as staff members are hired and when their employment is terminated. This satisfies the requirement to notify the Division of new child care providers working who were hired or moved into the child care facility within five business days. The compliance of this rule will be monitored during your next visit. Please note, the hard copy of the Change of Information form will no longer be needed or accepted. Required In-service training hours for staff were discussed with you along with how to calculate in-service training hours. All in-service training hours should be logged on the On-Going Training Documentation Form. I provided you with a copy during todays and copies of certificates should be kept in each staff’s file and available for review by a representative of DCDEE. Health and Safety training topics must be completed within the first year of employment and then within every five (5) years after. Documentation of the training must be kept on file for review. You should record the training on the Health and Safety Training Record Form. This form can be found on the DCDEE website. Health and Safety Training may be found on the DCDEE website using the Moodle platform. This program currently operates with a temporary license effective August 1, 2024, to February 1, 2025. Applicable childcare requirements were discussed with Dana Bowen, Administrator/Lead Teacher. This is a child care center located in a DPI. Two (2) classrooms were approved for child care. Currently they are only using one (1) classroom #129. I monitored the classroom and the playground. The children observed today, were interacting with assigned staff, playing in free choice areas such as fine motor materials, books, blocks, and dramatic play materials, eating morning snack, washing hands, and playing outside. Parents are responsible for providing all meals/snacks/beverages. All children had an Optout Form on file. During the visit three (3) staff files, including the administrator’s, and three (3) children’s files were reviewed. In addition, required center program records were also monitored. It is your responsibility to review all files to ensure they are complete and accurate. The following were also observed during today’s visit: staff/child ratios; CPR/FA; storage of hazardous products; adequate/approved space; posted license and permit restrictions. Overall attendance and enrollment were collected today. At the completion of the visit, I reviewed the Visit Summary with Mrs. Bowen and a computerized copy was given to her. Violation Number Comment Rule 1314 Emergency information did not name childs health care professional. The child's health care professional was not on file for three children enrolled. .0802(c)(2) 1325 Parent’s statement includes the child’s name and date of enrollment and the date the parent signed the statement. The enrollment date was not included on the statement for three children enrolled. .1804(b) The violation/s documented above must be corrected immediately. A signed and dated letter of compliance must be mailed to me by September 25, 2024, stating that all violations have been corrected. The letter can be emailed to me at leisa.benson@dhhs.nc.gov. If you state in the compliance letter that corrections have been made when they have not, this will be considered falsification of information. If you cannot meet the requirements by September 25, 2024, you must contact me immediately with a purposed timeline of the corrections. In some cases, this timeline may be extended. Rated License Assessment: In order to maintain subsidy payments at the end of the temporary time period, the facility must transition to a three to five star rated license. Education Standards: The education of the Administrator, Lead Teachers, Teachers, and Group Leaders will be assessed for points for the star rated license. It is imperative to submit official transcripts directly to DCDEE and have employees submit all other information using “WORKS” (Workforce online reporting and knowledge system). All staff education should be current before the fifth month of the temporary time period as a rated license will need to be processed before the end date of the temporary license. During the visit I verified in WORKS that the three (3) staff listed on the Staff and Training Worksheet were in WORKS; however, their education information was not current. I discussed with you that all staff should submit their most current education information to WORKS to be updated. Program Standards: The center may receive 2 points in program standards by meeting enhanced staff child ratios or enhanced space and by providing the required activity centers and supplemental centers. To receive more than 2 points in program standards, the facility will need to have an Environment Rating Scale (ERS) assessment and score at least a 4.0 on each of the scales. Be sure to visit www.ncrlap.org to familiarize you and your staff with the different assessments. Also, if you meet the requirements for a 4-5 star rated license and plan to provide care to 4 year old’s you will be required to have a curriculum that has been approved by DCDEE. You can review the approved curriculum by visit: https://ncchildcare.ncdhhs.gov/Read/nc-child-care-commission-approved-early-childhood-four-year-old-curricula-2018 Quality Bonus Point: While the facility may meet more than one possible quality point, the facility can only earn a maximum of one quality bonus point. Total points and Star Rated License Information: The total points received in both education and program standards and the quality bonus point will determine the star license issued to your center. To receive a three star license the facility must earn at least seven points. To receive a four star license the facility must earn at least ten points. To receive a five star license the facility must earn at least thirteen points. If you decide to apply for a star rated license you will need to complete the Initial Application for Assessment for a Two Through Five Star Rated License. If you decide to have the ERS assessment conducted, you will need to complete the Rated License Assessment Request Review. These forms were given to you during the visit. They should be completed and submitted to me by September 25, 2024. I also gave you a copy of the Quality Point Form for your review. Technical Assistance: You stated that you are in the process of hiring substitutes. You also stated that you would like to have volunteers. I reviewed the requirements for substitutes and volunteers. I also gave you a copy of the Volunteer File Checklist-Center and Substitute Staff File Checklist-Center to use as guides.
