Ms. B. Oakley assisted me during the visit. Your program currently operates with a four-star license issued 5/31/23. The center's compliance history was reviewed with the operator. The program’s compliance history was one hundred percent (100%) as of 5/14/25. Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. A full assessment and walk-through of the facility was completed today. The following was observed: license posted, and restrictions followed, summary of law posted, attendance taken daily, emergency medical care plan posted, activity plans posted, daily schedule posted, menus posted, allergies posted, storage of hazardous materials and substances, ITS-SIDS, CPR/First Aid, and training completed as required, and Criminal Record Checks completed as required. I also observed children in the indoor learning environment. Children throughout the facility were participating in centers, quiet time, lunch, transitions, and personal care routines. The caregivers were interacting and meeting the developmental needs for each of the children. I reviewed all new staff files during today’s visit. A Staff and Training Worksheet was e-mailed to Ms. Oakley prior to today’s visit. I received the Staff and Training Worksheet and reviewed it for compliance before today’s visit. A sampling of Children’s files (ten percent of enrollment) was reviewed today. Emergency drill log: Shelter and lock down drills on 3/5/25. Fire drill: 5/5/25. Fire Inspection: 2/6/25. Sanitation Inspection: 10/1/24. The last documented outdoor checklist was on 5/5/25. A checklist was used to note the requirements I monitored today. One violation was observed. Violation Number Comment Rule 1043 All staff records, except financial records, were not made available for review. One staff member came to help out from the other facility and she did not have her file for review. G.S. 110-91( 9) The violation(s) documented must be corrected immediately. On or before 5-28-25, I must receive a written, dated, and signed compliance letter that describes accurately and in detail how and when the violations were corrected. Also, please provide information regarding how the facility will maintain compliance in the future. Please be aware that any information submitted by you is considered legal documentation. Ms. Oakley assisted me with the visit today. Currently this facility operates with a Three -star license that was issued 11-26-18. The center's compliance history was reviewed with the operator. The program’s compliance history was 99 % as of 11/1/23. The license was posted, and the restrictions were in compliance. A walk-through of the facility was completed today, all indoor and outdoor areas were monitored. I observed children in the indoor learning environment and found supervision and staff/child ratios to be in compliance. Children throughout the facility were participating in group time, free play in activity areas, and personal care routines. The caregivers were interacting and meeting the developmental needs for each of the children. Fire (2/15/23) and sanitation (10/13/23) inspections remain current. The last fire drill was conducted on 10/11/23. Shelter and lock down drills are due by 9/28/23. The outdoor check list is due by 10/11/23. I reviewed two newly hired staff members files. Four violations were cited during today’s visit; The provider did ask questions about the topics below to ensure the facility stays in compliance. Technical assistance was also provided for the violations cited during today’s visit. Violation Number Comment Rule 1032 Child care providers and uncompensated providers who are not substitute providers or volunteers, including the director did not have a medical report on file prior to employment that was signed by a health care professional and/ or the medical report was older than 12 months.One newly hired staff member has a medical report prior to employment however the medical report was not within the last 12 months.The satff member started on 6/7/23 and the medical report was dated 10/22/21. 10A NCAC 09 .0701(a) 1033 On or before the first day of work, all staff, including the director and individuals who volunteer more than once per week did not provide results indicating that they were free of active TB and/or TB test or screening was older than 12 months. One newly hired staff member had a TB test prior to employment however the TB test was older than 12 months. Storage areas shall be kept clean. Laundry that is not clean shall be handled and stored separately from clean laundry using separate containers that are made clean in between uses and kept in good repair. (b) Toxic substances, which include corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled shall be kept in the original container or in another labeled container, used according to the manufacturer's instructions, and stored in a locked storage room or cabinet when not in use. Locked storage rooms and cabinets shall include those which are unlocked with a combination lock, electronic or magnetic device, keypad, key, or equivalent locking device. Keys and electronic or magnetic unlocking devices shall be kept out of the reach of a child and shall not be stored in the lock. Toxic substances shall be stored below or separate from medications and food. Any other product that is labeled "keep out of reach of children" and does not have any other warnings on the label shall be kept inaccessible to children when not in use, but is not required to be kept in locked storage. For the purpose of Paragraphs (b), (c), and (d) of this Rule, a product shall be considered inaccessible to children when stored on a shelf or in an unlocked cabinet that is mounted a minimum vertical distance of five feet above the finished floor. 10A NCAC 09 .1724 SAFE SLEEP PRACTICES (a) Each operator licensed to care for infants aged 12 months or younger shall develop, adopt, and comply with a written safe sleep policy that: (1) specifies that the operator shall place infants aged 12 months or younger on their backs for sleeping, unless: (A) for an infant aged six months or less, the operator receives a written waiver of this requirement from a health care professional; or (B) for an infant older than six months, the operator receives a written waiver of this requirement from a health care professional, or a parent or a legal guardian; (2) specifies that infants aged 12 months or younger shall be placed in a crib, bassinet or play pen, mat, or cot with a firm padded surface when sleeping; (3) specifies no pillows, wedges or other positioners, pillow-like toys, blankets, toys, bumper pads, quilts, sheepskins, loose bedding, towels and washcloths, or other objects may be placed in a crib with a sleeping infant aged 12 months or younger; SECTION .0600 - SAFETY REQUIREMENTS FOR CHILD CARE CENTERS 10A NCAC 09 .0601 SAFE ENVIRONMENT (a) A safe indoor and outdoor environment shall be provided for the children in care in accordance with rules in this Section. (b) All equipment and furnishings shall be in good repair. All commercially manufactured equipment and furnishings shall be assembled and installed according to procedures specified by the manufacturer. For equipment and furnishings purchased after September 1, 2017, the manufacturer's instructions shall be kept on file or electronically accessible, if available. (c) Equipment and furnishings shall be sturdy, stable, and free of hazards that may injure children including sharp edges, lead based or peeling paint, rust, loose nails, splinters, protrusions (excluding nuts and bolts on sides of fences), and pinch and crush points. 10A NCAC 09 .1801 SUPERVISION IN CHILD CARE CENTERS (b) For groups of children aged two years or older, the staff/child ratio during nap time shall comply with the requirements of this Chapter if at least one person remains in the room, all children are visible to that person, and the total number of required staff are on the premises and within calling distance of the rooms occupied by children. 10A NCAC 09 .2818 ENHANCED STAFF/CHILD RATIOS FOR A RATED LICENSE FOR CHILD CARE CENTERS (a) This Rule shall apply to evaluating the staff/child ratios and maximum group sizes for a rated license for child care centers. (b) The center shall comply with the following staff/child ratios and maximum group sizes. SECTION .0700 STAFF QUALIFICATIONS 10A NCAC 09 .0701 HEALTH STANDARDS FOR CHILD CARE PROVIDERS, SUBSTITUTE PROVIDERS, VOLUNTEERS, AND UNCOMPENSATED PROVIDERS Medical Report A statement signed by a health care professional that indicates that the person is emotionally and physically fit to care for children. Prior to employment. When submitted, the medical statement shall not be older than 12 months. Tuberculin (TB) Test or Screening The results indicating the individual is free of active tuberculosis shall be obtained within the 12 months prior to the date of employment. On or before first day of work. 10A NCAC 09 .1102 HEALTH AND SAFETY TRAINING REQUIREMENTS Responding to Suspicions of Child Maltreatment training within 90 days of employment. This training shall count toward requirements set forth in Rule .1103 of this Section. Recognizing and Responding to Suspicions of Child Maltreatment training is available at https://www.preventchildabusenc.org/services/trainings-and-professional-development/rrcourse. A certificate of each staff member's completion of this course shall be maintained in the staff member's file in the center. 10A NCAC 09 .0608 PREVENTION OF SHAKEN BABY SYNDROME AND ABUSIVE HEAD TRAUMA existing staff members who provide care for children up to five years of age. Each child care center shall review the policy with new staff members prior to the individual providing care to children. The acknowledgement of this review shall contain: (1) the individual’s name; (2) the date the center’s policy was given and explained to the individual; (3) the individual’s signature; and (4) the date the individual signed the acknowledgment. The child care center shall retain the acknowledgement in the staff member’s file. Ms. Oakley assisted me with the visit today. Currently this facility operates with a Three -star license that was issued 11-26-18. The center's compliance history was reviewed with the operator. The program’s compliance history was 99 % as of 11/1/23. The license was posted, and the restrictions were in compliance. A walk-through of the facility was completed today, all indoor and outdoor areas were monitored. I observed children in the indoor learning environment and found supervision and staff/child ratios to be in compliance. Children throughout the facility were participating in group time, free play in activity areas, and personal care routines. The caregivers were interacting and meeting the developmental needs for each of the children. Fire (2/15/23) and sanitation (10/13/23) inspections remain current. The last fire drill was conducted on 10/11/23. Shelter and lock down drills are due by 9/28/23. The outdoor check list is due by 10/11/23. I reviewed two newly hired staff members files. Four violations were cited during today’s visit; The provider did ask questions about the topics below to ensure the facility stays in compliance. The program’s compliance history was 99 % as of 11/1/23. The license was posted, and the restrictions were in compliance. A walk-through of the facility was completed today, all indoor and outdoor areas were monitored. I observed children in the indoor learning environment and found supervision and staff/child ratios to be in compliance. Children throughout the facility were participating in group time, free play in activity areas, and personal care routines. The caregivers were interacting and meeting the developmental needs for each of the children. Fire (2/15/23) and sanitation (10/13/23) inspections remain current. The last fire drill was conducted on 10/11/23. Shelter and lock down drills are due by 9/28/23. The outdoor check list is due by 10/11/23. I reviewed two newly hired staff members files. Four violations were cited during today’s visit; The provider did ask questions about the topics below to ensure the facility stays in compliance. For the purpose of Paragraphs (b), (c), and (d) of this Rule, a product shall be considered inaccessible to children when stored on a shelf or in an unlocked cabinet that is mounted a minimum vertical distance of five feet above the finished floor. 10A NCAC 09 .1724 SAFE SLEEP PRACTICES (a) Each operator licensed to care for infants aged 12 months or younger shall develop, adopt, and comply with a written safe sleep policy that: (1) specifies that the operator shall place infants aged 12 months or younger on their backs for sleeping, unless: (A) for an infant aged six months or less, the operator receives a written waiver of this requirement from a health care professional; or (B) for an infant older than six months, the operator receives a written waiver of this requirement from a health care professional, or a parent or a legal guardian; (2) specifies that infants aged 12 months or younger shall be placed in a crib, bassinet or play pen, mat, or cot with a firm padded surface when sleeping; (3) specifies no pillows, wedges or other positioners, pillow-like toys, blankets, toys, bumper pads, quilts, sheepskins, loose bedding, towels and washcloths, or other objects may be placed in a crib with a sleeping infant aged 12 months or younger; SECTION .0600 - SAFETY REQUIREMENTS FOR CHILD CARE CENTERS 10A NCAC 09 .0601 SAFE ENVIRONMENT (a) A safe indoor and outdoor environment shall be provided for the children in care in accordance with rules in this Section. Ms. Oakley assisted me with the visit today. Currently this facility operates with a Three -star license that was issued 11-26-18. The center's compliance history was reviewed with the operator. The program’s compliance history was 99 % as of 11/1/23. The license was posted, and the restrictions were in compliance. A walk-through of the facility was completed today, all indoor and outdoor areas were monitored. I observed children in the indoor learning environment and found supervision and staff/child ratios to be in compliance. Children throughout the facility were participating in group time, free play in activity areas, and personal care routines. The caregivers were interacting and meeting the developmental needs for each of the children. Fire (2/15/23) and sanitation (10/13/23) inspections remain current. The last fire drill was conducted on 10/11/23. Shelter and lock down drills are due by 9/28/23. The outdoor check list is due by 10/11/23. I reviewed two newly hired staff members files. Four violations were cited during today’s visit; The provider did ask questions about the topics below to ensure the facility stays in compliance. Technical assistance was also provided for the violations cited during today’s visit.
