Ms. B. Russel was present and assisted me during the visit. The program currently operates with a Four-Star Child-Care License that was issued on July 9th, 2024. The last Annual Compliance Visit was conducted on November 27th, 2024. \ Upon arrival at home, I was greeted by the provider, who was present with four children. The children were observed enjoying free play, outside time, lunch and quiet time. During today’s visit, a full assessment of applicable Child Care Requirements was conducted. I monitored indoor and outdoor spaces. In the home the playroom space is the primary care area and includes a variety of age-appropriate toys and materials. The provider’s license and parental information were posted on a bulletin board right outside the door of the play area. The provider’s file, professional development plan, EPR plan and all enrolled children’s files, outdoor inspections, and fire drill reports were reviewed. Transportation requirements were observed as well for two vehicles. The center's compliance history was reviewed with the operator. The program’s compliance history was ninety five percent (95%) as of 11/13/25. Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. The NC Secretary of State website was reviewed on (11/13/25) BUSY B'S Child Care LLC, was listed current-active. The last fire drill was conducted on 10/16/25. The last shelter and lock down drills were on 9/19/25. The outdoor inspection was done on 11/6/25. Four violations were cited during today’s visit. The providers had a chance to ask questions to ensure staying in compliance. Violation Number Comment Rule 701 All indoor and outdoor areas used by the children were not kept clean, orderly, and free of items which are potentially hazardous to children including removal of items a child can swallow; the removal of loose nails or screws and splinters on inside; and use of outdoor equipment that is too hot to touch. Some of the outdoor area was not free of items which are potentially hazardous to children. .1719(a)(1)&(17) 1404 Medication remaining after the course of treatment is completed, after authorization is withdrawn. or after authorization has expired, was not returned to the parent/guardian. Any medication not retrieved by parent/guardian within 72 hours of completion of treatment, or withdrawal of authorization, was not discarded. Parents did not sign a statement acknowledging the receipt and explanation of the plan. On or before 11-27-25, I must receive a written, dated, and signed compliance letter that describes accurately and in detail how and when the violations were corrected. Potentially hazardous items including but not limited to, power tools, nails, chemicals, propane stoves, lawn mowers, and gasoline or kerosene whether or not intended for use by children, shall be stored in locked areas, removed from the premises, or otherwise inaccessible to children. This includes the removal of items that a child can swallow. I observed three children involved in different free play activities upon arrival. The temporary license was issued to this family child care home on 12/5/23 and expires on 6/5/24. The Verification of Required Information for Operator and Additional Caregiver form was completed during today's visit (this form was emailed to the provider). The fire drill and outdoor play inspection will be completed this month. Mrs. Russell has not completed the EPR training at this time (once completed she will begin completing the shelter-in-place or lockdown drill quarterly). Once this training has been completed, she will get all necessary information in the portal and prepare the facilities ready to go kit. The provider has not been approved for transportation at this time but is thinking about it for the future. RATED LICENSE INFORMATION I briefly discussed with Mrs. Russell the rated license process. I also briefly talked with Mrs. Russell regarding the Environmental Rating Scale Assessment, and provider stated that she may be interested in having this completed. I did review the Rated License Request Form with her during today's visit and informed her that if she is interested I would need the form back initialed and signed by April 4th so that I could send NCRLAP a request to have the assessment completed. I did discuss the FCCERS-R book with Mrs. Russell and informed her that she would need to get this book to assist her in preparing for the assessment. Lastly, I informed her to begin working on her reflective self-study (this was emailed). This would need to be completed by the end of April 2024. TECHNICAL ASSISTANCE I discussed in detail with Mrs. Russell the following information: *Emergency Preparedness and Response (EPR)-Again the provider has not completed this training as of yet but once completed you must be complete the template within four months of receiving the training (please read below): 10A NCAC 09 .1714 EMERGENCY PREPAREDNESS AND RESPONSE (b) Existing family child care home operators (operator or operators) shall complete the Emergency Preparedness and Response in Child Care training. Within one year of the effective date of a new license, the operator of a new family child care home shall have completed the Emergency Preparedness and Response in Child Care training. When the trained staff member leaves employment, the family child care home shall ensure that another staff member completes the required training within four months of the vacancy. Documentation of completion of the training shall be maintained in the operator's personnel file. (c) Upon completion of the Emergency Preparedness and Response in Child Care training, the operator shall develop the Emergency Preparedness and Response Plan. The Emergency Preparedness and Response Plan means a written plan that addresses how a child care facility will respond to both natural and man-made disasters, such as fire, tornado, flood, power failures, chemical spills, bomb threats, earthquakes, blizzards, nuclear disaster, or a dangerous person in the vicinity, to ensure the safety and protection of the children and additional caregivers. This plan shall be on a template provided by the Division available at https://rmp.nc.gov/portal/# completed within four months of completion of the Emergency Preparedness and Response in Child Care training, and available for review *Annual in-service training hours are due by 12/5/24. I would recommend that you complete your training three months prior to the above date. CAPACITY INCREASE UPDATE: An increase in capacity requires a new permit be issued. FCCH Operators interested in an increase in their capacity will need to provide a written request to their consultant with verification there are no local zoning ordinances or homeowner association bylaws/covenants that prohibit the increase. Also, according to the Department of Insurance (DOI), an increase in capacity will affect the residential occupancy group for a FCCH. Currently a family child care home meets a R3 (residential three) occupancy as defined in the NC Building Codes. We have learned that increasing the capacity using option two or three in statute would change the residential occupancy from an R3 to a R4 (residential four) occupancy. To assist FCCH Operators with their decision about an increased capacity, DOI has provided the following guidance for transitioning from an R3 to an R4 occupancy. The requirements include but are not limited to the following: 1) Building permit (application submitted at local inspection office) 2) Building Inspection and Fire Inspection (building inspection form will be revised to include FCCH) 3) Fire Alarm System that will notify a professional offsite monitoring service (acceptable alternate method would be a Honeywell Home System, ADT Security, SimpliSafe, CPI Security and Brinks Home, etc.) 4) Carbon Monoxide Detectors 5) Portable Fire Extinguishers (type 2-A: 10-B-C) placed every forty (40 ft) feet within the child care area. 6) Minimum of two means of egress (exits) required (this does not include windows), one exit is required to be a ramp or the exit must be at grade. 7) Exits must having lighting. 8) Interior walls and ceilings must be made of noncombustible material (ex: no plaster or gypsum wallboard or wood paneling) Thank you for your assistance during today's visit. I did review the Rated License Request Form with her during today's visit and informed her that if she is interested I would need the form back initialed and signed by April 4th so that I could send NCRLAP a request to have the assessment completed. I did discuss the FCCERS-R book with Mrs. Russell and informed her that she would need to get this book to assist her in preparing for the assessment. Lastly, I informed her to begin working on her reflective self-study (this was emailed). This would need to be completed by the end of April 2024. Within one year of the effective date of a new license, the operator of a new family child care home shall have completed the Emergency Preparedness and Response in Child Care training. When the trained staff member leaves employment, the family child care home shall ensure that another staff member completes the required training within four months of the vacancy. Documentation of completion of the training shall be maintained in the operator's personnel file. (c) Upon completion of the Emergency Preparedness and Response in Child Care training, the operator shall develop the Emergency Preparedness and Response Plan. The Emergency Preparedness and Response Plan means a written plan that addresses how a child care facility will respond to both natural and man-made disasters, such as fire, tornado, flood, power failures, chemical spills, bomb threats, earthquakes, blizzards, nuclear disaster, or a dangerous person in the vicinity, to ensure the safety and protection of the children and additional caregivers. This plan shall be on a template provided by the Division available at https://rmp.nc.gov/portal/# completed within four months of completion of the Emergency Preparedness and Response in Child Care training, and available for review *Annual in-service training hours are due by 12/5/24. I would recommend that you complete your training three months prior to the above date. CAPACITY INCREASE UPDATE: An increase in capacity requires a new permit be issued. FCCH Operators interested in an increase in their capacity will need to provide a written request to their consultant with verification there are no local zoning ordinances or homeowner association bylaws/covenants that prohibit the increase. Also, according to the Department of Insurance (DOI), an increase in capacity will affect the residential occupancy group for a FCCH. Currently a family child care home meets a R3 (residential three) occupancy as defined in the NC Building Codes. We have learned that increasing the capacity using option two or three in statute would change the residential occupancy from an R3 to a R4 (residential four) occupancy. To assist FCCH Operators with their decision about an increased capacity, DOI has provided the following guidance for transitioning from an R3 to an R4 occupancy. The requirements include but are not limited to the following: 1) Building permit (application submitted at local inspection office) 2) Building Inspection and Fire Inspection (building inspection form will be revised to include FCCH) 3) Fire Alarm System that will notify a professional offsite monitoring service (acceptable alternate method would be a Honeywell Home System, ADT Security, SimpliSafe, CPI Security and Brinks Home, etc.) 4) Carbon Monoxide Detectors 5) Portable Fire Extinguishers (type 2-A: 10-B-C) placed every forty (40 ft) feet within the child care area. 6) Minimum of two means of egress (exits) required (this does not include windows), one exit is required to be a ramp or the exit must be at grade. 7) Exits must having lighting. 8) Interior walls and ceilings must be made of noncombustible material (ex: no plaster or gypsum wallboard or wood paneling) Thank you for your assistance during today's visit. The provider Mrs. Brenda Russell was present and assisted me during today's visit. I completed a general walk through of the daycare space, bathroom and outdoor play area. I observed three children involved in different free play activities upon arrival. The temporary license was issued to this family child care home on 12/5/23 and expires on 6/5/24. The Verification of Required Information for Operator and Additional Caregiver form was completed during today's visit (this form was emailed to the provider). The fire drill and outdoor play inspection will be completed this month. Mrs. Russell has not completed the EPR training at this time (once completed she will begin completing the shelter-in-place or lockdown drill quarterly). Once this training has been completed, she will get all necessary information in the portal and prepare the facilities ready to go kit. The provider has not been approved for transportation at this time but is thinking about it for the future. I informed her that before taking the children in any vehicle, to please contact me so I can make sure the vehicle is approved with all inspections and all necessary paperwork for transporting is available in the vehicle. The license was posted along with the NC Summary of the Law. A first aid reference sheet was available, and the daily schedule was posted. Attendance records have been maintained since opening. Keep this information on file for at least one year. The provider and children's records were reviewed during today's visit. The following violations were cited: Violation Number Comment Rule 910 Copy of each child's health assessment, including the operator's own preschool child(ren), was not on file within 30 days of enrollment. This was past 30 days from enrollment for two children currently enrolled in care. GS 110-91(1); 10A NCAC 09.1721(a)(1) 911 Copy of each child's immunization record, including the operator's own preschool child(ren), was not on file. This was past 30 days from enrollment for two children currently enrolled in care. GS 110-91(1); .1721(a)(2) 912 Written feeding schedule was not on file for each child under 15 months of age and/or was not updated regularly to reflect changes in the child's needs. This was not on file for review for on child under fifteen months. .1706(i) In order to comply with NC Child Care Laws and Rules any violation cited must be corrected IMMEDIATELY.
