Your family childcare home currently operates with a 4-star license issued November 22, 2019. The facility’s last annual compliance visit was conducted on July 22, 2025. The family child care home’s compliance history was reviewed with the operator. The program’s compliance history was ninety-nine (99%) percent as of June 25, 2026. Restrictions on the permit include 1st, 2nd, and 3rd shift care, a maximum of five (5) preschool children cared for at any time, children in care on ground level only, no more than 2 children less than age one, and no dogs allowed on premises during operating hours. You, Paula Juarbe, were present and available for consultation during the visit. Five (5) children between the ages of one (1) and three (3) are enrolled and two (2) were present. All spaces used by the children, indoors and outdoors, were monitored. Ms. Juarbe has a room set up exclusively for childcare. Upon arrival at your facility, you and the children were in the outdoor childcare space. While in the outdoor space the children played with cars, trucks, and tracks. The children transitioned to the indoor space and routine handwashing procedures were observed. You sang songs as the children washed their hands and assisted them with handwashing steps. You prepared lunch which consisted of ham, green beans, apples, wheat bread, and milk. After lunch the children had rest/nap time. Routine toileting, handwashing, food service and mat spacing were monitored, and requirements were met. Today all children’s files were monitored. Health and safety trainings and the facility’s safe sleep policy were monitored, and requirements were met. Currently no infants were enrolled; therefore, safe sleep checks were not monitored. Today you reported that you are currently not providing transportation. Today, you completed a copy of the FCCH Operator’s Statements of Responsibility and the Verification of Required Information for Operator and Additional Caregivers Form. You are required to complete ten (10) ongoing training hours per year, and you have completed 13.5. You 3.5 on-going training hours that may count towards your next year on-going training requirements. Violation Number Comment Rule 925 Signed and dated statement which attests that a copy of the discipline policy was given to and discussed with a parent/guardian of each child prior to enrollment was not on file in the home. The license was posted, and the restrictions were in compliance. A walk-through of your facility was completed today; all indoor and outdoor areas were monitored. Four (4) children between ages one (1) and three (3) are enrolled and four (4) were present today. The indoor space was a safe environment, and a variety of activities were available for the children. All children were adequately supervised. Appropriate toys and materials were observed in this area. The childcare space is located in a room adjacent to the kitchen and dining room. The bathroom is close proximity to the childcare space. Upon arrival at your facility, three (3) children were seated at a table eating breakfast and you were seated at a table feeding one (1) child breakfast which consisted of oatmeal, oranges, and milk. After breakfast, the children transitioned to free play activities which consisted of magnetic tiles, large wooden puzzles, large legos, and matching eggs with shapes in a carton. You interacted with the children as they played. As you changed a child’s diaper, diapering procedures were monitored, and requirements were met. You played music and the children danced. Food service, toileting, and handwashing procedures were monitored and found to be in compliance. The outdoor space had a variety of gross motor equipment which included riding cars and trucks, push cars, push toys, a small basketball goal, and balls. Other equipment included sand and water tables, a small playhouse, picnic table, tool play desk, art easels, large legos, large connecting blocks, tables, and chairs. A large shade structure is also in the outdoor space. The facility’s Shaken Baby and Abusive Head Trauma and Safe Sleep Policies were reviewed, and requirements were met. Today, you reported that you currently are not providing transportation. Family Child Care Home Capacity Guidance On October 27, 2023, DCDEE shared information regarding the budget bill which included revisions to NC General Statute 110-86(2) defining family child care homes (FCCH) and NC General Statute 110-91(7)(b) regarding FCCH capacity. The new capacity options in statute are as follows: A family child care home is allowed to provide care for one of the following groups of children, including the operator's own preschool-age children and excluding the operator's own school-age children up to 13 years of age: 1. A maximum of eight children, with no more than five children who are from birth to 5 years of age, plus three school-age children. 2. A maximum of three children from birth to 24 months of age, plus three children from 2 to 5 years of age and three school-age children up to 13 years of age, for a total of nine children. 3. A maximum of 10 children if all children are older than 24 months of age. An increase in capacity requires a new permit be issued. FCCH Operators interested in an increase in their capacity will need to provide a written request to their consultant with verification there are no local zoning ordinances or homeowner association bylaws/covenants that prohibit the increase. Also, according to the Department of Insurance (DOI), an increase in capacity will affect the residential occupancy group for a FCCH. Currently a family child care home meets a R3 (residential three) occupancy as defined in the NC Building Codes. We have learned that increasing the capacity using option two or three in statute would change the residential occupancy from an R3 to an R4 (residential four) occupancy. To assist FCCH Operators with their decision about an increased capacity, DOI has provided the following guidance for transitioning from an R3 to an R4 occupancy. The requirements include but are not limited to the following: 1) Building permit (application submitted at local inspection office) 2) Building Inspection and Fire Inspection (building inspection form will be revised to include FCCH) 3) Fire Alarm System that will notify a professional offsite monitoring service (acceptable alternate method would be a Honeywell Home System, ADT Security, SimpliSafe, CPI Security and Brinks Home, etc.) 4) Carbon Monoxide Detectors 5) Portable Fire Extinguishers (type 2-A: 10-B-C) placed every forty (40 ft) feet within the child care area 6) Minimum of two means of egress (exits) required (this does not include windows), one exit is required to be a ramp, or the exit must be at grade 7) Exits must have lighting. 8) Interior walls and ceilings must be made of noncombustible material (ex: no plaster or gypsum wallboard or wood paneling). Food service, handwashing, and diaper changing routines were monitored, and requirements were met. Safe sleep checks were monitored and found to be in compliance. The outdoor space had a variety of gross motor equipment including riding cars and trucks, push cars, a basketball goal, hula hoops, and balls. Health and safety trainings were monitored, and requirements were met. Restrictions on the permit include 1st, 2nd, and 3rd shift care, a maximum of five (5) preschool children cared for at any time, children are cared for on the ground level only, no more than two (2) children less than age one (1), and no dogs allowed on the premises during FCCH operating hours. Due to travel time, I arrived at your facility at 9:15am. You, Paula Juarbe, were present and caring for the children. Six (6) children between the ages of zero (0) and five (5) are enrolled and six (6) were present. Upon arrival at your facility, you were caring for the children. One (1) child was eating breakfast which consisted of oatmeal, peaches, and milk. The other preschool children were engaged in a variety of free play activities including bristle blocks, puppets, lego animals, handwriting, and a musical stroller. An infant was on a mat for tummy time. The children transitioned from free play activities to morning snack which consisted of animal crackers, oranges, and water. Food service, handwashing, and diaper changing routines were monitored, and requirements were met. Safe sleep checks were monitored and found to be in compliance. The outdoor space had a variety of gross motor equipment including riding cars and trucks, push cars, a basketball goal, hula hoops, and balls. Other equipment included sand and water tables, a small playhouse, a dramatic play kitchen, picnic table, tool play desk, tables, and chairs. Today all children files were monitored. Health and safety trainings were monitored, and requirements were met. Today, you completed a copy of the FCCH Operator’s Statements of Responsibility and the Verification of Required Information for Operator and Additional Caregivers Form. You are required to complete ten (10) ongoing training hours per year, and you have completed 9.5. You have .5 hours that you must complete on or before August 11, 2023. Please include a copy of your certificate for the required training hours with your compliance letter. The Summary of the NC Child Care Law was located in a drawer under the diaper changing table. GS 110-102 2031 Operator did not provide a copy of the shaken baby syndrome and abusive head trauma policy to parents at time of enrollment, and / or within fourteen days of a changes to the policy. Two (2) out of six (6) children’s files did not have a copy of the shaken baby syndrome and abusive head trauma policy signed by parents indicating they received the policy. .1726(b)&(c) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent.
