You, P. Lee, Administrator, were present and available to assist with today’s visit. Your program operates with a four-star license issued on August 7, 2018, earning 4 points in the education component, 6 points in the program standards component and 1 quality point for an administrator having completed a business training course of at least 30 clock hours. The last annual compliance visit was conducted on September 29, 2023. The sanitation inspection was completed on June 4, 2024, with a “Superior” classification “0” demerits. The fire inspection was completed on October 13, 2023, and the center was approved for daytime care only. The license was posted, and the restrictions were in compliance. Eighteen (18) children ages three (0) to seven (7) were present during the visit. A walk-through of the facility was completed today, all indoor and outdoor areas were monitored. I found supervision and staff/child ratios to be in compliance. Children throughout the facility were participating in the following activities: free play in activity areas, transitions, and personal care routines. Children were observed eating the following for lunch: ground beef, cheese, corn tortilla chips, lettuce/tomato and milk. The caregivers were interacting and meeting the developmental needs for each of the children. All transportation requirements were met. Any violations of the child care requirements observed today were discussed with you and documented in the visit summary report and reviewed with you at the conclusion of the visit. The following violations of the child care requirements were documented today: Violation Number Comment Rule 887 Caregivers did not document compliance with visually checking on sleeping infants aged 12 months or younger and/or the documents were not maintained for a minimum of one month. One child under twelve (12) months of age did not have current safe sleep checks available for review. The last day sleeps checks were completed for this child was August 30, 2024. .0606(g) Child care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. The last day sleeps checks were completed for this child was August 30, 2024. When asked, the teacher stated the child turns one- year old the following week. I reminded the teacher sleep checks must occur until the child turns one year old. CLEAN WATER FOR CAROLINA KIDS: According to the Clean Water for Us Kids website, you tested your water on April 12, 2024, you have completed the lead paint testing, and the information was uploaded on July 3, 2024, and your asbestos testing has been completed and the information was uploaded on July 2, 2024. According to the Clean Water For Carolina Kids, space number four (#4) tested positive for asbestos. You stated you had a conversation on July 10, 2024, and according to you, the inspector who tested for the asbestos, stated because the asbestos was located in the ceiling and out of the reach of children; the children did not need to be removed from the room. The inspector sent you a list of certified contractors to correct the issue. When asked if you were working with your Environmental Health Inspector you stated no. I may be in touch with you if there is any further information needed or information that I need to make you aware of. REMINDERS: FIRE INSPECTIONS: Your fire inspection is due prior to October 13, 2024. As a reminder the following child care rule is a requirement, and a violation will be written when a fire inspection is not submitted to your child care consultant within the time period stated below: 10A NCAC 09 .0304 ON-GOING REQUIREMENTS FOR A LICENSE (a)Each operator shall schedule and obtain a fire inspection within 12 months of the center's previous fire inspection. Including the Adjustments to the Appropriations Act (SB 357) which includes the $67.5 million for reduced compensation payments for first two quarters of FY 24-25 and the DHHS Agency Bill (Senate Bill 425) which includes the QRIS provisions: • QRIS modernization (3 new pathways to stars) is now approved (SB 425). • Hold harmless has been extended until the new QRIS is implemented (SB 425). Providers in Cohort 1 are not required to go any further with a rated license assessment unless they want to, and providers in Cohort 2 do not need to start their preparation year unless they want to. • SB 425 does mean that programs currently accredited through the approved accrediting bodies can move to a 3- or 5-star license if they are not already at this star level. Providers will need to submit a request to their consultant and provide a copy of their accreditation certificate for processing. • SB 425 also requires that we move to the ERS-3 versions for ECCERS. ITERS and FCCERS, effective February 1, 2025. The purpose of today’s unannounced visit was to obtain information regarding alleged violations of child care requirements related to children’s hygiene and transportation. You, Pamela Lee, Administrator, were present when I arrived and were notified of the purpose of the visit. I reviewed the allegation with you, and you were given the opportunity to provide additional information. I conducted observations in all rooms used to care for enrolled children, monitored the vehicle you use to provide transportation and reviewed files of children who are transported. The allegations are as follows: Children’s hygiene is not attended to, and children were not evaluated for injury following a vehicle accident. Staff/child ratio, group size, supervision, use of licensed space, space capacity, license restrictions, and the outdoor environment were monitored. The license and emergency care plan were posted. Fire drills, medication administration, and storage of hazardous products were also monitored. Additionally, I observed the indoor and outdoor space used by the children. Twenty-nine (29) children were observed in care ranging from ages five-month-olds) to four (4) years old. Children were observed playing in centers with developmentally appropriate materials, interacting with caregivers, and napping. The following violation was documented. Violation Number Comment Rule 1110 Vehicles used to transport children enrolled in the child care center did not comply with all applicable State and federal laws and regulations. On December 1, 2023, Ms. Gauthier received a failure to yield violation. .1002(b) Child care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Prior to making any changes to the corporation status, please contact me to discuss change of ownership procedures. The corporation status for your program must always remain Current and Active. Failure to comply may affect your child care license. STAFF INTERVIEW: Based on the observations completed in each classroom, the children’s faces were clean. There was no evidence of children with runny noses or with leftover food on their faces. You were interviewed regarding the allegations. You were given the opportunity to answer questions and express concerns. You stated that when children’s faces are dirty after a meal or if they have a runny nose the teachers clean the faces with wash clothes and hands are washed. When the children are outside and the faces need to be cleaned the staff have bags with baby wipes and tissues to clean hands and faces. Based on information received from you and my observations, the finding regarding the allegation of children’s hygiene is not attended to was unsubstantiated. When asked about the vehicle accident that occurred on December 1, 2023, you stated there was a minor accident while picking up school age from one of the elementary schools. Jessi Gauthier was the driver of the van (JFS-3927), and she called you immediately to inform you of the accident. You proceeded to call and notify the parents or legal guardians of each of the children. No parent or legal guardian expressed they wanted their child seen by a medical professional. The police report was reviewed, and Ms. Gauthier received a failure to yield violation. Based on information received from you and reviewing the police report the findings regarding the allegation of children were not evaluated for injury following a vehicle accident was found unsubstantiated. TECHNICAL ASSISTANCE: Childcare licensing requirements are established to ensure a safe and healthy childcare environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with the applicable laws and rules; always whether they have been monitored or specifically discussed with you in the past. The best way for you to ensure that you are meeting all requirements is to periodically review the childcare laws and rules on the Division of Child Development and Early Education’s website. TRANSPORTATION: In the event that there is another vehicle accident best practice is to notify your child care consultant of the accident and to send in the police report. Please review your transportation policies and procedures with all staff who drive the van to pick up children. RESOURCES: CHILD A CARE RULE CHANGES: The Child Care Commission adopted child care rule changes in January 2024. Changes relate to definitions; lead and asbestos for centers and family child care homes; building requirements for family child care homes; multi-unit child care centers; and criminal background checks. You, P. Lee, Administrator, were present and available to assist with today’s visit. Your program operates with a four-star license issued on August 7, 2018, earning 4 points in the education component, 6 points in the program standards component and 1 quality point for an administrator having completed a business training course of at least 30 clock hours. The last annual compliance visit was conducted on October 6, 2022. The sanitation inspection was completed on June 5, 2023, with a “Superior” classification “0” demerits. The fire inspection was completed on October 18, 2022, and the center was approved for daytime care only. The license was posted, and the restrictions were in compliance. Twenty-five (25) children ages three (0) to five (5) were present during the visit. A walk-through of the facility was completed today, all indoor and outdoor areas were monitored. I found supervision and staff/child ratios to be in compliance. Children throughout the facility were participating in the following activities: free play in activity areas, transitions, and personal care routines. Children were observed eating the following for breakfast, oatmeal, pineapple, and milk. The caregivers were interacting and meeting the developmental needs for each of the children. Any violations of the child care requirements observed today were discussed with you and documented in the visit summary report and reviewed with you at the conclusion of the visit. The following violations of the child care requirements were documented today: Violation Number Comment Rule 1032 Child care providers and uncompensated providers who are not substitute providers or volunteers, including the director did not have a medical report on file prior to employment that was signed by a health care professional and/ or the medical report was older than 12 months. You, P. Lee, Administrator, were present and available to assist with today’s visit. Your program operates with a four-star license issued on August 7, 2018, earning 4 points in the education component, 6 points in the program standards component and 1 quality point for an administrator having completed a business training course of at least 30 clock hours. The last annual compliance visit was conducted on October 6, 2022. The sanitation inspection was completed on June 5, 2023, with a “Superior” classification “0” demerits. The fire inspection was completed on October 18, 2022, and the center was approved for daytime care only. The license was posted, and the restrictions were in compliance. Twenty-five (25) children ages three (0) to five (5) were present during the visit. A walk-through of the facility was completed today, all indoor and outdoor areas were monitored. I found supervision and staff/child ratios to be in compliance. Children throughout the facility were participating in the following activities: free play in activity areas, transitions, and personal care routines. Children were observed eating the following for breakfast, oatmeal, pineapple, and milk. The caregivers were interacting and meeting the developmental needs for each of the children. Any violations of the child care requirements observed today were discussed with you and documented in the visit summary report and reviewed with you at the conclusion of the visit. The following violations of the child care requirements were documented today: Violation Number Comment Rule 1032 Child care providers and uncompensated providers who are not substitute providers or volunteers, including the director did not have a medical report on file prior to employment that was signed by a health care professional and/ or the medical report was older than 12 months. One staff member with a first day of employment of June 2, 2023, had a medical statement on file, however the health assessment did not state whether the staff member is emotionally and physically fit to care for children. 10A NCAC 09 .0701(a) 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. One staff member with the first day of employment of June 2, 2023, had a Basic Life Skills card from American Heart Association. Basic Life Skills does not meet the requirements for Adult and Pediatric First Aid. .1102(c) 1049 All staff did not successfully complete certification in CPR training appropriate to the age of the children in care. The registration expired on August 31, 2023. .1002(b) 1874 The Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy was not reviewed with new staff prior to providing care with children and/or a signed acknowledgement with all the required information was not maintained in the staff person's file. Two (2) new staff members did not have the policy on file prior to working with children. One with a hire date of November 29, 2022 had documentation of the policy dated December 1, 2022, and one staff member with the hire date of May, 1, 2023, had documentation of the policy dated May 2, 2023. .0608(d)(1-4) 1897 The child care administrator and all staff did not complete the Recognizing and Responding to Suspicions of Child Maltreatment training within 90 days of employment. One staff member with a hire date of October 20, 2022 had documentation of the training dated December 18, 2019, however this training was completed more than twelve months prior the hire date. Another staff member with the hire date of May 25, 2023, had documentation of the training dated December 20, 2019, however this training was completed more than twelve months prior the hire date. .1102(g) Child care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. The violation(s) documented must be corrected immediately. On or before October 12, 2023, I must receive a written, dated, and signed compliance letter that describes accurately and in detail how and when the violations were corrected. We discussed the employee had completed the training prior to you hiring her, however credit can not be given, because the training was completed more than twelve (12) months prior the hire date. Submit a report even if no children are attending your child care center or your child care center has closed. This will ensure your center meets the reporting requirement and is not considered delinquent. FIRE INSPECTIONS: Your fire inspection is due prior to October 18, 2023. RESOURCES: EARLY CHILDHOOD EQUIVALENCY EXAM NOW ON DCDEE MOODLE: The North Carolina Early Childhood Equivalency Exam is a new pathway option comparable to a NC Early Childhood Credential. Applicants who achieve a score of 80% or higher on the NC Early Childhood Equivalency Exam earn the new North Carolina Early Childhood Equivalency Certificate. This certificate is equivalent to a North Carolina Early Childhood Credential and will qualify the individual to be a lead teacher in an early childhood classroom. To take the exam, go to DCDEE Moodle and select Early Childhood Professional Development/Child Care and Development Fund (CCDF)/North Carolina Early Childhood Equivalency Exam: https://www.dcdee.moodle.nc.gov/login/index.php NEW SANITATION RULES: DCDEE and the Department of Public Health have received feedback from child care programs that additional guidance would be helpful in implementing the child care sanitation rules that the Public Health Commission readopted effective July 1, 2023. Until then, DPH and DCDEE will work together to make sure NC child care centers have the necessary training, technical assistance, and operational support needed to meet the new requirements.
