Your program currently operates with a Three-Star license effective 6/23/2021. Restrictions include daytime and overnight care; maximum of 5 preschool age children at any time; fireplace/woodstove not in use during operating hours. Tracy Tate is the sole proprietor of the licensed family child care home. The program’s compliance history was 97% prior to today’s visit. All programs are required to maintain at least 75% compliance. Today, the following items were monitored: • Supervision • Capacity • CPR / First Aid • ITS-SIDS • CBC Qualification • General Health • Administering of Medication • Storage of Hazardous Products • Storage of Medication • General Safety • General License Requirements • Program Records • License Posted • Fire Safety • Sanitation The license was observed, and the restrictions were found in compliance. Individuals living in the home were discussed and are recorded on the Verification of Required Information for Operator and Additional Caregiver form. Be reminded that everyone living in the home must have criminal record checks conducted every five (5) years. You may go to the Division of Child Development & Early Education's website at https://ncchildcare.ncdhhs.gov and complete this process six (6) months prior to the expiration date on your qualifying letter. A Verification of Required Information for Operator and Additional Caregivers form was completed during the visit for the operator and additional caregiver. A walk-through of the home was completed today. Indoor and outdoor areas were observed. We tested the smoke detector during today’s visit, and it worked. Capacity was monitored as indicated on the attached worksheet. Supervision was adequate during the visit. I observed staff/child interactions today. I observed children in free play activities and lunch. Limited monitoring of staff files was conducted for the purpose of reviewing training regarding CPR/First Aid, EPR, ITS-SIDS, and Criminal Background Checks. No medications were observed nor reported. Storage hazardous items were monitored today. A playground inspection was recorded on 6/3/2026. A fire drill was recorded on 6/3/2026. A lock down drill at the facility was recorded on 6/3/2026. There are two (2) pets inside the home and all vaccinations, and parent acknowledgement forms were monitored. The program does not currently provide transportation since. The following violations were cited during today’s visit: Violation Number Comment Rule 1847 A child care operator did not notify the Division of any new child care providers, as defined in G.S. 110-90.2(a)(2), who were hired or moved into the child care facility within five business days. The facility roster did not have the current qualifying letters linked to the roster. The qualifying letters linked had expired. The provider and her husband did have current qualifying letters. G.S. 110-90.2 & .2703(r) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. This visit was conducted with Ms. Tracy Tate, Operator. Ms. Melinda Lescar is traveling with me today and she will be Ms. Tate's new child care consultant. Ms. Lescar will make an appointment to discuss the new Rated License in the future. This program currently operates with a Three Star license. Restrictions include daytime and overnight, max 5 preschoolers, fireplace not in use during day care hours. The license was posted and the restrictions were being followed. The NC Secretary of State website was reviewed on 10/31/2025. The program’s compliance history was 98% prior to today’s visit. Programs are required to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. I have observed indoor and outdoor areas today. Ms. Tate is following her capacity and enrollment restrictions and the license is posted. She was visually supervising the children during the visit. During the visit I observed children playing with toys and interacting with the caregiver. A fire drill was documented on 11-0-3-2025. A shelter in place drill was documented on 09-02-2025. An outdoor inspection was documented on 10-02-2025. I observed program records and posted items today. I observed staff and children’s records today according to DCDEE procedures. I observed the storage of hazardous items and cleaning supplies. I observed both the storage of medications and the administration of medication paperwork. This program provides transportation. During today’s visit, I monitored one vehicle(s) for the following: • Emergency information • Permission to transport • Transportation logs • First aid kits and fire extinguishers • Condition of the vehicle(s) • Paperwork concerning vehicle compliance with NC Law I have asked Ms. Tate who lives in this home and have recorded her answer on the Verification of Required Information Form with her signature. I documented the following violations during today’s visit: Violation Number Comment Rule 1409 Operator did not provide a physically safe and healthy indoor and outdoor environment that meets the developmental needs of the children in care. There was a protruding nail on the playground within reach of children. This visit was conducted by Turkessha Casterlow, childcare consultant and Pam Hauser, Licensing Supervisor with Tracy Tate, operator. Your program currently operates with a three-star license. Restrictions include first, second and third shifts, maximum 5 preschool children at any time and fireplace/woodstove not used during operating hours. The license was observed, and the restrictions were found in compliance. Tracy Tate is the sole proprietor of the licensed family child care home. The program’s compliance history was 99% prior to today’s visit. All programs are required to maintain at least 75% compliance. A walk-through of the home was completed today. Indoor and outdoor areas were observed. We tested the smoke detector during today’s visit, and it worked. Capacity was monitored as indicated on the attached worksheet. Supervision was adequate during the visit. I observed staff/child interactions today. I observed children engaged in developmentally appropriate activities, feeding, and interaction with children and children. I observed materials and activities that were available to the children in the spaces used for childcare. The children were served rice with chicken, green peas, peaches and applesauce, whole wheat bread and milk. The last annual compliance visit was conducted on November 29, 2023. A Verification of Required Information for Operator and Additional Caregivers form was completed during the visit for the operator and additional caregiver. A FCCH and Centers Located in a Residence Operator’s Statement of Responsibility form was reviewed and signed during the visit. We discussed owner status of this facility. Individuals living in the home were discussed and are recorded on the Verification of Required Information for Operator and Additional Caregiver form. Technical assistance discussed during today’s visit: • An individual over the age of 15, who resides in a family child care home, or a center located in a residence on a permanent or temporary basis, or those who had their 16th birthday after the initial licensing of a family child care home; did not complete and submit required forms within five business days. The provider's 16-year-old son who lives in the home and had not completed the criminal background check within five business days. Per the ABCMS system, the operator submitted the application to complete a criminal background check for her 16-year-old son on September 10, 2024, and due to the family member had not turned 16 years old at the time the application submitted was not completed. The operator submitted the application again on November 11, 2024. The ABCMS is reflecting the criminal background check is in process. After speaking with a representative from the criminal background check unit, it was determined the household member had not submitted their fingerprints to complete the process. During the visit the operator reached out to all parents of children who were present during today’s visit via text. Ms. Tate confirmed the parents would be picking up their children early today, so she can accompany her son to the sheriff’s office. I stated to Ms. Tate for future reference that CBC can be completed 6 months prior to expiration of the current qualifying letter. I stated to Ms. Tate I will reach via phone this afternoon regarding next steps. Ms. Tate did not agree with the violation regarding the updated EPR plan. Ms. Tate stated she had worked to go into the EPR portal and was unable to get in portal. I stated to Ms. Tate to reach out to me if she needs additional assistance. Additional Information/Consultation: • You must notify your consultant 30 days prior to changing the ownership status of your facility. Ms. Casterlow shared with with Ms. Tate there is an updated Summary of the Law on the Division website. During today’s visit, we reviewed the following transportation requirements with Ms. Tate. Ms. Tate is considering transporting children periodically to drop son off at public school. 10A NCAC 09 .1723 TRANSPORTATION REQUIREMENTS To assure the safety of children whenever they are transported, the operator, or any other transportation provider, shall: (1) ensure that vehicles used to transport children are free of hazards such as but not limited to, torn upholstery that allows children to remove the interior padding, broken windows, holes in the floor or roof, or tire treads of less than 2/32 of an inch; (2) ensure that vehicles used to transport children comply with all applicable State and federal laws and regulations; (3) ensure that vehicles are insured for liability as required by State laws governing transportation of passengers pursuant to G.S. 20-279.21; (4) ensure that vehicles used to transport children in snowy, icy, and other hazardous weather conditions are equipped with snow tires, or chains; (5) have written permission from a parent to transport his or her child and notify the parent when and where the child is to be transported, and the name of the transportation provider. Parents may give standing permission, valid for up to 12 months, for transport of children to and from the home; (6) ensure that all children are transferred to an individual who is indicated on the child's application for enrollment as specified in Rule .1721(a)(3) of this Section or as authorized by the parent; (7) load and unload children from curbside or in a safe, off-street area, out of the flow of traffic, so that they are protected from all traffic hazards; (8) ensure that all children regardless of age or location in the vehicle shall be restrained with an individual seat belt or child safety seat appropriate to the child's age or weight in accordance with G.S. 20-135.2A located at http://www.buckleupnc.org/occupant-restraint-laws/seat-belt-law-summary/. Only one person shall occupy each seat belt or child safety seat; (9) be at least 21 years old, and have a valid driver's license of the type required under the North Carolina Motor Vehicle Law for the vehicle being driven, or comparable license from the state in which the driver resides, and no convictions of Driving While Impaired (DWI), or any other impaired driving offense, within the last three years; (10) ensure that each child is seated in a manufacturer's designated area. No child shall ride in the load carrying area or floor of a vehicle; (11) have a First Aid kit and fire extinguisher located in the vehicle used to transport children; (12) never leave children in a vehicle unattended by an adult; (13) have identifying information in the vehicle about each child being transported, including the child's name, photograph, emergency contact information, and a copy of the emergency medical care information form required by Rule .1721(a)(3) of this Section; and (14) have a functioning cellular telephone or other functioning two-way voice communication device with them for use in an emergency. The transportation provider shall not use cellular telephones or other functioning two-way communication devices except in the case of an emergency and only when the vehicle is parked in a safe location; and (15) conduct off-premise activities as follows: (a) before the operator walks children off premises for play or outings, the parent of each child shall give written permission for the child to participate in such activities; (b) parents may provide a written statement giving standing permission which may be valid for up to 12 months for participation in off premise activities that occur on a regular basis; and (c) each time the children are taken off premises, the operator shall take identifying information about each child including the child's name, photograph, emergency contact information, a copy of the emergency medical care information form required by 10A NCAC 09 .1721(a)(3) of this Section. Parents may give standing permission, valid for up to 12 months, for transport of children to and from the home; (6) ensure that all children are transferred to an individual who is indicated on the child's application for enrollment as specified in Rule .1721(a)(3) of this Section or as authorized by the parent; (7) load and unload children from curbside or in a safe, off-street area, out of the flow of traffic, so that they are protected from all traffic hazards; (8) ensure that all children regardless of age or location in the vehicle shall be restrained with an individual seat belt or child safety seat appropriate to the child's age or weight in accordance with G.S. 20-135.2A located at http://www.buckleupnc.org/occupant-restraint-laws/seat-belt-law-summary/. Only one person shall occupy each seat belt or child safety seat; (9) be at least 21 years old, and have a valid driver's license of the type required under the North Carolina Motor Vehicle Law for the vehicle being driven, or comparable license from the state in which the driver resides, and no convictions of Driving While Impaired (DWI), or any other impaired driving offense, within the last three years; (10) ensure that each child is seated in a manufacturer's designated area. No child shall ride in the load carrying area or floor of a vehicle; (11) have a First Aid kit and fire extinguisher located in the vehicle used to transport children; (12) never leave children in a vehicle unattended by an adult; (13) have identifying information in the vehicle about each child being transported, including the child's name, photograph, emergency contact information, and a copy of the emergency medical care information form required by Rule .1721(a)(3) of this Section; and (14) have a functioning cellular telephone or other functioning two-way voice communication device with them for use in an emergency. The transportation provider shall not use cellular telephones or other functioning two-way communication devices except in the case of an emergency and only when the vehicle is parked in a safe location; and (15) conduct off-premise activities as follows: (a) before the operator walks children off premises for play or outings, the parent of each child shall give written permission for the child to participate in such activities; (b) parents may provide a written statement giving standing permission which may be valid for up to 12 months for participation in off premise activities that occur on a regular basis; and (c) each time the children are taken off premises, the operator shall take identifying information about each child including the child's name, photograph, emergency contact information, a copy of the emergency medical care information form required by 10A NCAC 09 .1721(a)(3) of this Section.
