The director, Talaya Carter, assisted me with today’s visit. Later the Executive Director, Kim Knight, joined us for the QRIS Discussion. We conducted a walk-through of the indoor and outdoor learning environments. I observed groups of children engaged in free play or large group activities in their classrooms or playing in the outdoor learning environment. I also observed infant rest time. RATED LICENSE STATUS The program operates with a 5-star rated license issued on 7/5/17. They received 6 points in Program Standards, 6 points in staff education and one quality point through the programmatic pathway of having a staff benefit package and an infrastructure for parent involvement. INSPECTIONS The last sanitation inspection was conducted 4/9/25. The last fire inspection was conducted on 7/8/25. The last documented fire drill was conducted on 10/10/25. The last documented shelter-in-place or lockdown drill was conducted on 8/18/25. The last documented playground inspection was conducted on 10/1/25. The status of the owners, Creative Schools Inc., is listed as current and active on the NC Secretary of State website. Limited monitoring of childcare requirements was assessed during today’s visit. I reviewed 2 new staff files and confirmed that all staff have current CPR, First Aid, and ITS SIDS certificates, as required. The program does not transport children or enroll school-aged children; therefore, these requirements were not assessed. During today’s visit we also discussed the QRIS Pathway options and began developing a timeline for when the center will be ready to complete their new rated license. Talaya stated that the center is planning to pursue Pathway 3. They have an NAEYC meeting scheduled for later this week. Kim stated that she wants the center to also prepare for an Environment Rating Scale visit, as a back-up plan. We discussed that they would need to start soon with the accreditation process, so they are able to transition to their new license near the end of 2026. The following violation was observed and recorded during today’s visit. Violation Number Comment Rule 721 All equipment and furnishings were not in good repair. There was a torn crib mattress with exposed foam and a vinyl child's sofa with small tears around the arm edges. G.S. 110-91(6); .0601(b) The violation was corrected during today's visit so a compliance letter is not required. COMPLIANCE HISTORY Prior to today’s visit, the program’s compliance history was 91%. According to NC General Statute 110-90 (4) (d) all facilities must maintain a compliance history of at least seventy-five percent (75%) for the past 18 months. TECHNICAL ASSISTANCE During today’s visit I observed a torn crib mattress in an infant room and a vinyl child’s sofa has a few splits and tears around the edges. Furnishings should be maintained so they are easily cleaned to meet sanitation requirements. The mattress was replaced and the sofa was removed from the classroom during today’s visit. CONSULTATION All childcare facilities are required to test their drinking and cooking water for led every three years. Your water was last tested, 10/25/23. For more information, you should contact Clean Water for Carolina Kids. Contact www.cleanwaterforcarolinakids.org for more information. In addition, childcare facilities are now required to test for lead and asbestos hazards in their buildings. This center is determined to be exempt from testing for lead-based paint and asbestos. Additional information can be found in the RaiseNC newsletter sent on December 7, 2023. Training in all the required health and safety topics must be completed at least every 5 years. It may be time for your staff to complete this training again. Health and Safety training is available, at no charge, on the DCDEE website, in Moodle. There is a link to this training on Moodle. Upon arrival, I was greeted by the center director, Talaya Carter. We discussed the nature of the visit, and she accompanied me on a walk-through of the classrooms. After we had completed the walk through, I observed approximately 20 minutes in the classroom named in the report. I observed no concerns with staff interactions or discipline techniques during my observation. Prior to today’s visit I discussed the incident noted in the report with the director. Talaya said that a parent had contacted her with a concern that a child enrolled in the classroom for four-year-old children was handled roughly by a classroom teacher. During today’s visit, I watched video footage of the incident. There was no sound in the video, so I had to rely on the staff member’s body language and what could be observed. The child took a floor cube and placed it on a table and then climbed on top of the table. Immediately, the teacher saw what the child had done, and she quickly walked to the table, picked the child up and firmly placed the child in a seated position on the floor. She knelt down and appeared to be speaking to the child for a few seconds. The child then got up and walked across the room and stood on a step stool, near the classroom sink. He stood for a few seconds and then returned to play. The teacher remained standing, in the area where she had picked up the child, with her hands on her hips and looking in the direction of the child who had been on the table. Based on the body language, the teacher appeared to be frustrated and abruptly removed the child from the table top without any other attempt to redirect the child or help him get off the table. I also reviewed the center’s discipline policy and the file for the staff member named in the report. The teacher began employment at the center on 5/22/25. In her file was a signed copy of the orientation report and a document, signed on 5/22/25, indicating that the center’s policies, which included the discipline policy, were reviewed with the staff member and the orientation topics, required within the first two weeks of employment were documented as completed on 5/22/2. I was unable to discuss the matter with the staff member named in the report because she is no longer employed at the center. I also observed the classroom named in the report for approximately 25 minutes. There was a substitute working in the classroom today. When I began the observation, the teacher was doing a group activity with a few children on the carpet. As the children completed their activity, they chose an activity center and left the carpet area to play. The teacher was seen frequently scanning the room and gently redirecting the children, as needed. She gave reminders of classroom rules and assisted a few children in helping them find an activity for children who were indecisive. She gave a five-minute warning for the children before it was time to clean up and when lunch arrived, she guided the children in cleaning up their areas, washing their hands and going to the table for lunch. I ended the observation as the teacher was serving the food to the children. RESOLUTION This allegation regarding supervision, and a staff member roughly handling a child was UNSUBSTANTIATED. The allegation regarding staff not adhering to appropriate discipline practices was SUBSTANTIATED because it did appear that the teacher responded with frustration and abruptly removed the child from the table. The following violation was observed and recorded during today’s visit. Violation Number Comment Rule 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. A teacher responded to a child abruptly and with frustration. G.S. 110-91(10) A follow-up visit is required due to the nature of the violation, so the compliance letter is not required. COMPLIANCE HISTORY Prior to today’s visit, the compliance history score for the center was 92%. According to NC General Statute 110-90 (4) (d) all facilities must maintain a compliance history of at least seventy-five percent (75%) for the past 18 months. TECHNICAL ASSISTANCE New employees should be monitored closely. It may be preferable to have new employees to work with a more seasoned employee until the new employee learns the center routines and center administrators have opportunities to observe the teacher’s practice and are comfortable with them taking the lead in a classroom. I encourage you to continue the practice of routinely reviewing the center’s discipline policy with all center staff and encouraging classroom staff to request assistance or classroom coverage, when they need to take a break CONSULTATION The substantiation of any allegation may result in an Administrative Action, up to and including revocation of the license, being issued to the program. I advise conducting routine checks in the classrooms to ensure that staff are following center procedures and using the center-provided resources to keep medications secured. The classroom for infants had no activity plan posted. The director explained that she had new staff in the classroom and the activity plan had not been completed. Current activity plans should be posted in every classroom. I recommend routinely checking that current activity plans are posted and during classroom observations monitoring to see that activity plans are being followed. Two children’s allergy care plans expired in September 2024, one child’s emergency medication expired in July 2024 and one child’s medication authorization form expired in September 2024. COMPLIANCE HISTORY Prior to today’s visit, the program’s compliance history was 93%. TECHNICAL ASSISTANCE During our walk through I observed diaper creams stored in two unlocked cabinets. One of the classrooms had a child lock on the cabinet, which is an unapproved locking mechanism. To avoid children being exposed to potentially hazardous materials, all topical medications should be stored at least five feet above the ground or in locked storage. The director instructed the teachers to store all medications in the lock boxes provided for each room. I advise conducting routine checks in the classrooms to ensure that staff are following center procedures and using the center-provided resources to keep medications secured. The classroom for infants had no activity plan posted. The director explained that she had new staff in the classroom and the activity plan had not been completed. Current activity plans should be posted in every classroom. I recommend routinely checking that current activity plans are posted and during classroom observations monitoring to see that activity plans are being followed. Two children’s allergy care plans expired in September 2024, one child’s emergency medication expired in July 2024 and one child’s medication authorization form expired in September 2024. Proper record keeping is crucial when administering medication. I advise retraining staff on medication administration, and periodically checking classroom medication for compliance. As a reminder, the allergy care plans are valid for one year but the medication authorization forms for emergency medications are valid for 6 months. CONSULTATION All child care facilities are required to test their drinking and cooking water for led every three years. Your program’s water was last tested for lead on 10/25/23. In addition, child care facilities are now required to test for lead and asbestos hazards in their buildings. The director, Kimberly, assisted us with today’s visit. Our Time Limited Consultant, Ms. Vanessa, accompanied me during today’s visit. Upon arrival, you greeted me and welcomed me into your program. I observed nine (9) classrooms of children during today's visit. The children were observed having circle time and exploring their outdoor learning environment. The younger children were observed having one on one time with their teacher, napping, and having their bottles. RATED LICENSE STATUS The program operates with a 5-star rated license issued on 7/5/17. They received 6 points in program standards, 6 points in staff education and one quality point through the programmatic option of having a staff benefit package and an infrastructure of parent involvement. INSPECTIONS The last fire drill was conducted on 4/30/24. The last emergency drill was conducted on 2/29/24. The last playground inspection was conducted on 4/22/24. The last sanitation inspection was conducted on 10/20/23. The fire inspection was conducted on 5/25/23. The status of the owners, Creative Schools, Inc., is listed as current and active on the NC Secretary of State website. During this visit, a full assessment of Child Care Requirements was conducted. Also, I did not assess transportation requirements because the program does not transport children. The following violations were observed and recorded during today's visit. Violation Number Comment Rule 533 Human milk, formula and other bottled beverages including sippy cups, sent from child's home were not fully prepared, dated, and labeled for the appropriate child. A child in space #4 did not have a date on the bottle stored in the refrigerator. 15A NCAC 18A .2804(d) 807 A safe indoor and outdoor environment was not provided for the children. Bleach bottles in space #2, #4, #5, #6, #7, #8 and space #9 were not stored 5ft high out of the children's reach. 10A NCAC 09 .0601(a) In order to comply with the NC Laws & Rules, any violations cited today must be corrected immediately. TECHNICAL ASSISTANCE The following items were discussed to help you prevent a reoccurrence of the violations observed during today's visit. I would suggest making sure maintenance is measuring the baskets that hold the bleach solutions to ensure they are five feet or higher in each classroom. This is recommended so the bleach solutions are out of the reach of the children at all times. The director stated that an order will be put in to adjust all baskets that store the spray bottles. I would suggest that the teachers double check the children’s bottles to make sure they are labeled with the child’s name and the current date. I would also suggest that all sippy cups are disposed of once each meal is complete and not storing them in the refrigerator. CONSULTATION Some providers are experiencing delays in scheduling their fingerprinting appointments. Criminal record checks can be completed up to six months prior to the expiration date. We are encouraging all staff to begin their renewal process early to avoid lapses in their qualification. ANNUAL IN-SERVICE TRAINING The in-service hours were monitored for the annual year May 16, 2023 – May 14, 2024. ENVIRONMENT RATING SCALE REVIEW DOCUMENTATION Based on the ERS reports, I provided technical assistance on all items that are potential Child Care Requirement violations to assist you in making improvements in these areas to avoid violations in the future. ITERS Overall Average Score: 4.27 The items discussed today included: ITERS Item 6, Indicator 3.4-Greeting/departing- The teacher’s conversation did not have anything health and safety related. *We discussed making sure conversations is child friendly. ITERS Item 7, Indicator 3.1-Meals/Snacks: Water not being offered between meals to ensure each individual child’s needs are met. *We discussed making sure the children are being offered water throughout the day. ITERS Item 8, Indicator 3.2-Nap: Cots are to be at least 36 feet apart or have a sold barrier in between them. *We discussed making sure the mats are spread out, so they meet the 36 feet requirement. ITERS Item 9, Indicator 1.1-Diapering: The steps to diaper changing were not followed from the time diapering began to the end. *We discussed going over the diapering changing procedures with each teacher to ensure that the steps are followed at all times. ITERS Item 16, Indicator 3.2- Active physical play: Some space for outdoor physical play used by infants is not occupied when the weather permits. *We discussed making sure the employees understand when the children are not allowed to play outside, and they are required unless other stipulations may occur. ITERS Item 19, Indicator 3.3- Blocks: Blocks and accessories were not accessible for much of the day. *We discussed that center should be open and accessible to the children for majority of day. ITERS Item 30, Indicator 3.1-Free Play: Children are not able to have free play outdoors with the weather permitting. *We discussed making sure the teachers are aware of when the children are not allowed to play outdoors due to the weather. Children are required to go outside on a daily basis.
