Upon arrival I was greeted by Ms. S. Owens shared the reason for the visit and she was able to assist me with today’s visit. Your program currently operates with a three (3) star FCCH License. The License was posted with restrictions to first (1st) shift care, children on ground level only, maximin of five (5) preschool children at any time, serves no more than two (2) infants under one (1) year. The following items were monitored today: Supervision, Capacity, CPR and/or ITS SIDS Training, First Aid, CRC Completed, General Health, Storage and Administration of Medication, Storage of Hazardous Materials, General Safety, Discipline, Adequate and Approved Space, General Licensing Requirements, Program Records, License Posted, and Fire Safety. Inspections: All inspections were monitored. Ownership: The facility owner any changes to the ownership need to be made, you must notify your consultant at least thirty (30) days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location or inherited. •The last fire drill was conducted on 10/2/24. •The last emergency drill was conducted on 9/2/24. •The last playground inspection was conducted on 10/21/24. •The EPR manual was updated to add new Consultants information. •Incident reports and incident report logs were current. Union County does not require fire or sanitation inspections after initial approval. Learning Environment: I observed children in the indoor learning environment and found supervision and staff/child ratios to be in compliance. Children were observed interacting with each other, while they participated in free choice center play. They also were engaged in art activities with Ms. Owens. Outdoor Learning Environment: The outdoor learning environment was monitored was in compliance. Program Records: I reviewed all the required records. Staff Records: The "Verification of Required Information for Operator and Additional Staff" and the “Operator’s Statement of Responsibility” were completed during today’s visit. •The provider was last certified in first aid on 5/10/23 and CPR on 5/10/23. •The provider received ITS-SIDS training on 5/16/23 and expires on 5/16/26. •We reviewed all Qualifying letters for applicable members of the household and they were in compliance. Children’s Records: There are three (3) enrolled in this center. There were three (3) children in attendance today. Today I reviewed all the children’s files. Two (2) of the three (3) children did not have Shaken Baby Syndrome/Abusive Head Trauma policy reviewed by parents/guardians on file. Nutrition: The facility was in/out of compliance during today’s visit with Child Care Meal Pattern Requirements. The lunch menu consisted of baked beans, broccoli, mango, whole grain rice and the option of milk or water. Transportation: This facility does not provide transportation but a vehicle is on site for emergency purposes. Weapons: Your facility reported that they were in compliance during today’s visit with Child Care Requirements regarding firearms. One (1) violation was observed today. The violation is below. Violation Number Comment Rule 2031 Operator did not provide a copy of the shaken baby syndrome and abusive head trauma policy to parents at time of enrollment, and / or within fourteen days of a changes to the policy. Two children's files did not show a reviewed and signed copy of the shaken baby syndrome and abusive head trauma policy. .1726(b)&(c) On or before 11/4/24 I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. Please be aware any information submitted by you is legal documentation. If it is determined the information provided in the letter is not true, this may be considered falsification of information. If sufficient information is not received by the due date, a follow-up visit will be conducted. The program’s compliance history was ninety-nine (99%) percent prior to today’s visit. The compliance history could be impacted after today’s visit. Based on Child Care Rule 10A NCAC 09 Section .2200, the Division of Child Development and Early Education may take administrative action against the license and/or impose civil penalties based on the failure of the operator to correct any documented violations within the established time period. If you state in your letter that corrections have been made when they have not, it will be considered falsification of information. At the completion of the visit, this visit summary was printed, reviewed, and a copy was left with you. We jointly reviewed the visit summary and documentation of my findings and violations with you, I encouraged to ask any questions and you did not have any. Rated License •Hold Harmless has been extended until the new QRIS is implemented (SB 425). Providers in Cohort #1 (number one) are not required to go any further with a rated license assessment unless they want to, and providers in Cohort #2 (number two) do not need to start their preparation year unless they want to. Upon request, a childcare facility may be awarded a star-rated license based on accreditation from a national childhood education accreditation organization provided the facility maintains its accreditation and remains in good standing. •Use this time for staff to update their information in the WORKS database. Technical Assistance • Today, Ms. Owens asked about increasing her capacity as a Family Child Care Home. I shared this information with her. As part of the budget bill, NC General Statute 110-86(2) defining family child care homes (FCCH) and NC General Statute 110-91(7)(b) regarding FCCH capacity was revised. The new capacity options in statute are as follows:"A family childcare home is allowed to provide care for one of the following groups of children, including the operator's own preschool-age children and excluding the operator's own school-age children up to 13 years of age: o A maximum of eight children, with no more than five children who are from birth to 5 years of age, plus three school-age children. o A maximum of three children from birth to 24 months of age, plus three children from 2 to 5 years of age and three school-age children up to 13 years of age, for a total of nine children. o A maximum of 10 children if all children are older than 24 months of age. • A change in capacity requires a new permit be issued. FCCH Operators interested in an increase in their capacity will need to provide a written request to their consultant with verification there are no local zoning ordinances or homeowner association bylaws/covenants that prohibit the increase. In addition to local ordinances, the Division is working with the Department of Insurance to determine if an increase in capacity will affect the residential occupancy group for a FCCH which may require additional code requirements be met. •I also shared with her a grant resources involving the Blue Cross and Blue Shield Foundation which serves Family Child Care Licensed Homes. •I will also provide her with information about opening a Center, and reminded her that a pre-licensing workshop should be taken and not expired before she can complete the Pre-Licensing process. •Lead in Water/Paint and Asbestos - FCCH must complete testing by January 1, 2025 o Rule 15A NCAC 18A .2816 requires currently operating child care centers to test water initially and every three years. Family child care homes are required to test water for lead once. Child care rule 10A NCAC 09 .1725(a) for FCCH, to assure the health of children through proper sanitation, the family child care home operator shall: (2) collect and submit samples of water from each water outlet used for drinking or food preparation for lead analysis to the local health department or a laboratory certified to analyze for lead in drinking water by the North Carolina State Laboratory of Public Health. Results of the analysis shall be on file in the home. water samples shall be collected by the operator and tested within 12 months of the effective date of this Rule. o DCDEE encourages you to utilize the Clean Classrooms for Children’s program. You can take the pre-enrollment webinars which is available at www.cleanwaterforUSkids.org/carolina then enroll – At www.cleanwaterforUSkids.org/carolina completing the enrollment surveys for three program sections: 1) lead in water, 2) lead-based paint, and 3) asbestos. Keep mindful that once you evaluate and potential hazards and receive results if there are recommendations and/or water mitigation support is needed they will provide direction in how to mitigate and ways to fund said mitigation.
