Upon arrival I was greeted by Ms. L. I shared the reason for the visit. She assisted me with today’s visit. This facility operates as a G.S. 110-106 holding a Notice of Compliance with the restrictions of first (1st) shift care and children in care on ground level only the compliance history percentage prior to this visit was one hundred (100%) percent. I monitored the following items today: supervision, staff/child ratio, space capacity, licensed spaces, staff and children’s records, health, safety, and program records. The following items were monitored: Staff/Child Ratio, Supervision, Specialized Trainings, Emergency Medical Care Plan, Storage of Hazardous Substances and Storage of Medication, and General Safety. The following items above were found in/out of compliance. The following inspections are below, Sanitation and Fire Inspection visits remain the same since the last visit. •Last fire drill was conducted on 3/2/26. •Last Shelter in Place/Lockdown Drill was conducted 3/2/26. •Last Playground Inspection was conducted on 3/2/26. The children were observed in the room that serves four year olds (4) participating in free play and table top activities. They were getting ready to transition to their age assigned classrooms. Program Records: We reviewed all the required records and all were in compliance. Staff Records: The staff-training worksheets were completed before the visit. There was one (1) new staff file to monitor. Medication: Medication was monitored and one medication form was not updated within the six month (6) time frame. This was corrected by the parent during the visit. Weapons: Today you reported that your facility was in compliance with childcare requirements regarding firearms. Nutrition: The facility does not participate in the nutrition program and all children bring lunch from home. Transportation: Transportation is not provided. Two (2) violations were observed today and both were corrected during the visit. No further action is required. The violations are as follows: Violation Number Comment Rule 1033 On or before the first day of work, all staff, including the director and individuals who volunteer more than once per week did not provide results indicating that they were free of active TB and/or TB test or screening was older than 12 months. Staff member K.A.C. did not have, on file, a TB test stating they were free of active TB. .0701(a) 1882 Medication authorization, giving the caregiver standing authorization did not meet the specifications in rule. A child did not have an updated form giving standing permission to give perscribed medication. .0803(6)(a-i); .0803(7)(a-g); .0803(8)(a-d) Child care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent (75%). Any violation (s) documented may impact the compliance history score. The center's compliance history was reviewed with the operator. The compliance history could be impacted after today’s visit. Based on Child Care Rule 10A NCAC 09 Section .2200, the Division of Child Development and Early Education may take administrative action against the license and/or impose civil penalties based on the failure of the operator to correct any documented violations within the established time period. If you state in your letter that corrections have been made when they have not, it will be considered falsification of information. Technical Assistance •As stated in G.S. 110-90.2 & .2703(r) child care operators are to notify the Division of any new child care providers working who were hired within five business days. The process of notifying the Division has changed and is now captured in ABCMS. This change has been in effect since February 2024. The facility has all of their current employees updated and qualified in the system. Today we reviewed how to remove an “expired” letter from the system. •Today we discussed the importance of the ABCMS system and even if a new employee has a physical qualifying letter, to check it against the most updated information in the ABCMS system. •A new staff member did complete all the steps to verify they did not have active TB but the correct form was not in the file, the employee was able to present the form electronically, it was printed and added to the file. Tracie Meyer Carpenter assisted me on today’s visit. Upon arrival the Ms. Ami Leech, Administrator greeted us and I introduced Ms. Carpenter and explained the reason for our visit. She explained that today was a teacher workday and we stated that the visit would still need to be conducted and a follow up visit may occur when children return. The center currently operates with a Notice of Complaince, issued on 10/19/2021. The restrictions include daytime care only and children in care on ground level only, capacity of 101 and an age range of 0-12 years old. We used the Child Care Center Item Number Listing (DCD 0357) as a basic monitoring tool to assess compliance with all applicable child care requirements pertinent to this facility and the Annual Compliance Monitoring Checklist for Child Care Centers. Ownership: Creative Care LLC status on the NC Secretary of State website was listed as current/active as of 8/4/2011. If any changes to the corporation need to be made or the church is incorporated, you must notify your consultant at least thirty (30) days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location or inherited. Inspections: All inspections were completed within the required time frames and are documented on the Annual Complaince worksheet attached to today’s visit. Ms. Leech companied us today on the walk-through of the facility and on the outdoor learning environment of both playground areas. Indoor Learning Environment: Of the seven (7) classrooms in the main building, six were in operation during today’s visit. The one other classroom is now designated as a therapy/work room. During today’s observation, staff were in their classroom and/or taking CPR. Outdoor Learning Environment: The outdoor area had two playgrounds and on the larger of the two playgrounds was a grassy area with some fence concerns at the far end of the playground. The smaller playground, where children were playing, had mulch in the fall zones of the permanent structure but the was not enough mulch where the children exit the slide again this year. Transportation: Ms. Leech stated that currently the program does not currently provide transportation for the licensed program but does for the Elementary School programming. I explained that if they do wish to provide transportation for the children in the licensed program in the future, they must contact me in order to have the vehicle monitored and as a courtesy have a review of the Child Care Transportation requirements. Since the non-licensed Academy does transport we provided updates to Transportation for the program’s information: In order to be in requirements with state and federal law if your facility is using a vehicle weighing less than 26,001 pounds that is designed for 16 or more passengers, including the driver, the driver must have a class C commercial driver’s license with a passenger endorsement. Official NCDMV: Commercial Driver License (ncdot.gov). The number of children in the vehicle is not relevant; it is based on how many passengers the vehicle is designed for. Child care facilities need a DOT # if they are using a vehicle designed for transporting 9 (including the driver) whether they travel out of state (would need a USDOT#) or within the state (NCDOT#). Here is a link that providers can access to determine if they need a DOT# and can register for one. https://www.fmcsa.dot.gov/registration/do-i-need-usdot-number. With NCDOT# registration there is a fee of $180 is charged every year, per driver, an audit is conducted per DOT, that monitors the following: A special inspection sticker (that goes at the back of each bus), a medical card and clearance for each driver, work history, and driving history. Staff Records: The Staff and Training Worksheets were completed for all staff. All new staff files were reviewed and a random sample of at least ten percent of existing staff files were reviewed. Please see the staff/training worksheet to determine which files. Children Records: A random sample of ten percent of files were selected to review. 10 % of childrens files were reviewed, see Children’s Records worksheet. Program Records: We reviewed all the required records. We observed the current Notice of Complaince, Summary of the Child Care Law poster (dated January 2021), Monthly Fire Drill Log & Quarterly Shelter-in-place/Lock down drill Log, Safe Pick-up, and Delivery Procedures that are the same as what is in the facility handbook, Emergency Medical Care Plan (with all staff listed who preform listed duties), Emergency Phone Numbers (recommended – by telephone) Weekly menu for meals and snacks posted where it can be seen by parents and food preparation staff, Tobacco Free Environment/Campus restriction poster/sticker posted at main entrance and we reminded you that if there is only ever one staff person left on site the emergency contact person for this situation information must be posted on the parent board. Nutrition: The facility families have chosen to OPT OUT of the food programming therefore we reviewed the facilities responsibility to ensure that every child has a snack and lunch if they do not bring one in. Weapons: Your facility reported that they were in compliance during today’s visit with Child Care Requirements regarding firearms. The following violations were observed today: Violation Number Comment Rule 847 Parent's medication authorization did not include required information. Of the four children that had medication on site one child did not have a permission form completed and the other child's permission form had just been signed by parent with no information on when or how to administer medication (See children's worksheets). 10A NCAC 09 .0803(4)(6-9) 1034 All staff, including the director, did not have an annual health questionnaire on file following the initial medical statement. Six staff files were monitored, and one staff person did not have the required annual health questionnaire (see staff and training worksheet. .0701(a) 1035 Child care providers, including the director, uncompensated providers, substitute providers, and volunteers did not have the required Emergency Information Form on file on or before the first day of work, which included all the required information and/or the information on the form was not updated as changes occur and at least annually. Six staff files were reviewed, and one staff file did not have current emergency information (see staff and training worksheets). .0701(a) 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. Six staff files were monitored and two staff did not have certifications for First Aid. .1102(c) 1049 All staff did not successfully complete certification in CPR training appropriate to the age of the children in care. Verification of staff completion of the CPR course from an approved training organization was not in the staff file. Six staff files were monitored and two staff did not have certifications for CPR. .1102(d) 1867 The depth of the loose surfacing was not based on critical height of the equipment. At the bottom of the slide in Playground #2 there was mulch, but the depth of surfacing material did not meet the required 6 inches. .0605(k)(1-4) 1890 Each staff member did not have the required medical report, proof of tuberculosis test or screening and/or completed health questionnaire in a medical file, maintained separately from the staff member's individual personnel file. Six staff files were monitored, and one staff did not have their medical report maintained separately. .0701(d) Today the violations, that were not corrected during the visit, must be corrected immediately. Please submit a letter of correction for the violations by no later than November 21, 2023. Ensure that your letter includes the Facility Name, ID number, Date of Visit, Violation number, how you corrected the violation and how you will prevent it from re-occurring. Compliance History: North Carolina General Statute 110-90(4)(d) requires all child care facilities to maintain a compliance history of at least seventy-five percent (75%) for the past 18 months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action against the facility's license.
