During the visit, I discussed the information with you, Jennifer Fequiere, Administrator, and an additional staff member. You and the staff member had an opportunity to ask questions, state perceptions of the situation and provide pertinent information in response to the reported incident. Video footage of the incident was reviewed. Based on the information obtained, the following was determined. On April 15, 2026, a staff member grabbed the arm of a four year old child in an attempt to pull her back into line. The staff member apologized to the child upon seeing that the child was crying. You reported that the staff member notified the parent at the time of pick-up that the child was injured when grabbed by the arm. On April 16, 2026, the staff member notified you of the incident and was instructed to complete an incident report. The staff member returned to the classroom along with a second staff member for additional support. Later in the same day, you, the staff member, the parent, and the child met together to discuss the incident. The child’s parent confirmed that there were no visible marks or bruises on the child's arm. Following the meeting, the staff member was placed on suspended leave and asked to leave the facility. On April 17, 2026, the staff member submitted her resignation letter effectively immediately. You reported that you have spoken with all staff members individually to discuss appropriate discipline and caregiver stress. A staff meeting is scheduled for May 7, 2026, to review the facility’s discipline policy and have a group discussion on how to support employees with caregiver stressors in the classroom. A walkthrough of the facility was conducted and staff were observed interacting and meeting the developmental needs for each of the children. A limited monitoring of child care requirements was completed. The following violation was confirmed during today’s visit. Violation Number Comment Rule 904 A child was handled in a rough way, including shaking, pushing, shoving, pinching, slapping, biting, kicking, or spanking. On April 15, 2026 at 1:44pm, in space #8, a staff member grabbed the arm of a four year old in an attempt to pull her back into line. .1803(a)(1) The program’s compliance history was 99 percent prior to today's visit. You must maintain at least 75% Compliance History for each 18-month period as required by G.S. 110-90(4)(c). Please note any violations cited today and during future visits will negatively impact your compliance history. Repeated violations or violations left unresolved may lead to administrative action. A compliance letter was provided during today’s visit to address how the documented violation was corrected and steps for maintaining on-going compliance. Technical Assistance was provided on the following: No child may be handled roughly in any way, including grabbing a child by the arm. I affirmed the plan to review the discipline policy with all staff to ensure appropriate understanding during the upcoming staff meeting. I suggested that this information be reviewed on an annual basis with all staff. I also suggested that you review with staff the need to ask for assistance when children’s challenging behaviors are causing disruption within the classroom. A follow-up visit may be conducted in the near future to monitor compliance with child care requirements. The visit was conducted with you, Jennifer Fequiere, Administrator. This program currently operates with a Four star license issued on April 19, 2023. The permit restrictions include 1st shift, enhanced ratios and children under 2 ½ in rooms with direct exits only. Your program was also monitored for compliance with implementing an approved curriculum as required for all four and five star licensed facilities where four-year -old children are enrolled. The last annual compliance visit was conducted December 16, 2024. The most recent sanitation inspection for your facility was conducted on July 15, 2025. A superior sanitation classification was issued with four demerits noted on the grade card. The most recent approved fire inspection for your facility was conducted on November 3, 2025 for daytime care only. The most recent monthly fire drill was conducted on November 24, 2025. The most recent quarterly shelter-in-place drill was conducted on November 6, 2025. The facilities EPR Plan was reviewed on May 12, 2025. The most recent monthly playground inspection was completed on November 5, 2025. The center's compliance history was reviewed with the operator. The program’s compliance history was 97 percent as of November 26, 2025. The NC Secretary of State website was reviewed on November 26, 2025 and Grace Community Church of McDowell County was listed as current-active. The facilities contact information was reviewed and confirmed with you. You visited each indoor and outdoor space with me. A walk-through of the facility was completed today, all indoor and outdoor areas were monitored. I observed children in the indoor learning environment and found supervision and staff/child ratios to be in compliance. Children throughout the facility were participating in free play activities indoors, handwashing routines, lunch, and rest time. Infants in space #1 were engaged in feeding and napping. Sleep checks were completed, recorded, and maintained as required. The caregivers were interacting and meeting the developmental needs for each of the children. A checklist was used to note the requirements I monitored today. The analysis date for the most recent lead water test was May 30, 2024. Lead testing must be completed every three years. This website also indicated “enrollment started” for required asbestos and lead-based paint testing. You provided me with applicable program, staff, and children’s records for review. Upon arrival, the purpose of today’s visit was reviewed with you, Jennifer Fequiere, Administrator. Your program currently operates with a four star license effective April 19, 2023. The permit restrictions were in compliance including 1st shift, meets enhanced ratios, and children under 2 ½ in rooms with direct exits only. The Secretary of State website was checked on July 12, 2024, and your business Grace Community Church of McDowell County, is active and in good standing. If any changes to the corporation need to be made or you decide to sell your business, then you must notify me, your consultant at least thirty days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location, or inherited. Any violation(s) documented may impact the compliance history score. Seven new staff have been hired since the annual compliance visit on January 3, 2024. Limited monitoring of staff files was conducted for the purpose of reviewing training regarding CPR/First Aid, EPR, Playground Safety, ITS-SIDS, Special Training including Health and Safety Training and Criminal Background Checks. The most recent lead water testing results were completed on May 30, 2024. Lead testing must be completed every three years. The most recent sanitation inspection for your facility was conducted on December 5, 2023. A supervisor sanitation classification was issued with no demerits. The most recent fire inspection for your facility was conducted on January 3, 2024. The facility was approved for day time care. The following violation(s) were observed today: Violation Number Comment Rule 849 Leftover medicines were not returned to the parent after the course of treatment was completed, after authorization was withdrawn or after authorization had expired and/or medication was not discarded within 72 hours of completion of treatment or withdrawal of authorization. In Space #1, there was a tube of Boudreaux's Butt Paste that had an authorization that expired 7/9/24. .0803(12) The violation(s) documented must be corrected immediately. On or before August 6, 2024, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. If it is determined the information provided in the letter is not true, this may be considered falsification of information. The Division of Child Development may take administrative action against the license and/or impose civil penalties based on the failure of the operator to correct any documented violations within the established time period. Areas discussed included: Item #849 Medicines, creams or topical ointments must be returned to the parent or discarded after the authorization has expired. If the medication is still being used, a new permission form must be signed. We discussed that the Boudreaux’s Butt Paste will need to be sent home with the child or the parent will need to sign a new form. You have plans to discuss that with the parent later today. Consultation or other topics discussed today: We discussed that a staff and training worksheet can be updated as information changes for staff members. This will allow you to have an up to date worksheet available at any time. Hold harmless has been extended until the new QRIS system is implemented. Programs still have the option to choose to voluntarily complete the star rated license reassessment if they so desire. Per 10A NCAC 09.0304, The operator shall submit the original of the approved annual fire inspection report to the Division within one week of the inspection visit on the form provided by the Division. If the fire inspection report is not submitted to your Child Care Consultant within one week after the fire inspection is conducted, a violation will be cited during the facilities next monitoring visit. Lead & Asbestos Testing The Clean Classrooms for Carolina Kids Program is providing free facility-wide testing and inspections without any out-of-pocket cost to child care centers and public schools. Facilities that have not yet enrolled should complete the online process by November 1, 2024. Due to the volume of testing and inspections, completion of the online enrollment process in the program is considered temporary compliance with the testing and inspection requirement. You must enroll in both sections including lead based paint and asbestos testing to comply with the rule requirements.
