Currently, this facility operates with a Five-Star license issued on May 24, 2019. The center's last annual compliance visit was completed on January 21, 2026. The last sanitation inspection was completed May 14, 2026, earning a superior classification and four (4) demerits. The last satisfactory fire inspection was completed on September 16, 2025. J. Wharton, Lead Teacher, and Nicole Baker, NC PreK Coordinator, were present and available to assist. The staff was notified of the reason for my visit. Eleven (11) children were present. Children were observed in free choice activities. Staff interacted with children in a positive manner. A walk-through of the facility was conducted. The permit restrictions on the center's license were reviewed and observed in compliance. FINDINGS/OBSERVATIONS: The required components for a complaint visit were monitored. Classroom observations were conducted and program records were monitored. A self-report incident was reported via phone from the district staff on May 18, 2026. The detailed report was received via email on May 19, 2026. A parent notified the teacher on Monday, May 18, 2026, that her child had stated another child pushed him down during a field trip. The parent stated the push caused the child to fall on his arm. The parent further stated she took her child to the doctor and they found fluid on his arm and that he needed to wear a sling. When asked, staff stated that children were supervised the entire trip. A staff member stated the child indicated as the pusher, was with her during the trip due to the fact the child likes to wonder. Staff stated they did not observe the child being pushed. However, prior to departure, the child with the accident reported to one of the teachers that he fell during the field trip. The teacher asked if he was ok and the child stated “yes”. Teachers stated the child did not show any signs of injury. They further stated the child was physically active as normal and was put on the bus to go home for the weekend. The child was observed during the visit. It appears the child no longer requires the sling. The teachers stated instructions were followed for the required care while he was in the sling. They further stated he wore the sling for about a week. An incident report, statements, and other documentation were received from the facility prior to today’s visit. Based off the information provided and observations, there were no violations of child requirements, and the self-report is unsubstantiated. The following violation of child care requirements were documented during the visit. Violation Number Comment Rule 104 Center has not passed required sanitation inspection and received an approved or superior rating. The center received a provisional inspection on May 12, 2026. However a superior rating was received on the re-inspection on May 14, 2026. 10A NCAC 09 .0304(b) The violation was corrected during the visit because re-inspection for sanitation had been conducted and observed with a superior classification. Currently, this facility operates with a Five-Star license issued May 24, 2019. The center's last annual compliance visit was completed on January 29, 2025. A checklist was used to note the requirements monitored during the visit. The last sanitation inspection was completed today November 10, 2025, earning a superior classification and six (6) demerits. The last satisfactory fire inspection was completed on September 16, 2025. Nicole Baker, NC PreK Coordinator, was present and available to assist. Eleven (11) children were present. Children were observed in teacher directed activities, daily routine activities, and preparing for lunch. Staff interacted with children in a positive manner. Fire drills, lockdown/shelter in place were current. Playground inspections were not current. The following violations of child care requirements were documented during the visit. Violation Number Comment Rule 807 A safe indoor and outdoor environment was not provided for the children. A safe outdoor environment was not provided for the children in care. Two benches on the playground are rusted posing risk for a child getting, cut, scraped or snagged. 10A NCAC 09 .0601(a) 859 Monthly playground inspections were not completed and/or they were not completed by an individual trained in playground safety requirements. Monthly playground inspections were not completed for the months of November and December 2025. .0605(q) 1035 Child care providers, including the director, uncompensated providers, substitute providers, and volunteers did not have the required Emergency Information Form on file on or before the first day of work, which included all the required information and/or the information on the form was not updated as changes occur and at least annually. A substitute provider did not have an updated Emergency Information form on file. .0701(a) 1061 One staff member had not completed training in playground safety. No staff has completed the playground safety training. .1102(e) The following violations must be corrected immediately. The letter must describe, in detail, specifically how each violation has been corrected and any supporting documents. Children records reviewed, were in compliance. New staff and ten percent (10%) or more of existent staff files were monitored. Staff records reviewed were not in compliance. A substitute staff member did not have an updated emergency information form on file for review. This was corrected during the visit when the staff member updated the form. CRIMINAL BACKGROUND APPLICATIONS: A New feature links criminal background applications to facilities. The training has been completed, and the roster was generated. However, some staff are being linked to the facility. This information should be updated in ABCMS on an ongoing basis as staff members are hired and when their employment is terminated. This satisfies the requirement to notify the Division of new child care providers working who were hired or moved into the child care facility within five business days. Please note, the hard copy of the Change of Information form will no longer be needed or accepted. Should you need assistance please contact the Criminal Background Check Unit at 1-800-859-0829 and someone will assist you. CLEAN WATER FOR US KIDS: The Clean Water for Carolina Kids status is “analysis complete”. The status for lead base paint is “Waiting for On-Site Visit” and the status for asbestos is “survey review by RTI”. This information was verified in the clean water for US kids facility data. STAR RATED LICENSE (SRL/QRIS): Prior to today’s visit an overview of section .3200 of the child care rules was provided to Mrs. Baker. Each of the following pathway options were discussed: Program Assessment Pathway, Classroom and Instructional Quality Pathway, and Accreditation and Head Start Pathway. The facility is considering Program Assessment Pathway 1. A copy of the conversation overview was left with Mrs. Baker. I encourage you to use the resources discussed during the visit. Currently, this facility operates with a Three-Star license issued on May 24, 2019. The center's last annual compliance visit was completed on February 14, 2024. A checklist was used to note the requirements I monitored today. The last sanitation inspection was completed on September 23, 2024, earning a “Superior” classification and “4” demerits. The last satisfactory fire inspection was completed on September 5, 2024, and was approved for day time care. S. McMannen, Principal and N. Baker, PreK coordinator, were onsite during the visit. M. Barnes, the Lead Teacher, was present and available to assist. Thirteen(13) children were present during the visit. Children were observed completing daily routine activities, free choice activities, and teacher directed activities. Staff interacted with children in a positive manner. This facility has the NCPreK program. Limited requirements were monitored during the visit. Public school transportation is provided for the children in care. The following violations of child care requirements were documented during the visit. Public school offsite records forms for transportation, staff and children was incomplete or not available for review. G.S. 110-91( 9) 1899 Health and safety training topics were not included as part of on-going training within five years of completing the previous health and safety training topics. Staff records reviewed were not in compliance. Health and safety trainings were not available for review for one staff member. To maintain compliance, you should print and use the staff checklist as a guide, create a to do list or document on a calendar to ensure compliance of trainings within the correct time frame. All staff records not reviewed should be monitored to ensure compliance for the same information. PUBLIC SCHOOL OFFSITE FORMS: Offsite forms should be available for review to ensure compliance is met with documentation that is not onsite. The transportation and children offsite forms did not have a signature. When asked, M. Barnes stated health records were offsite. However, the staff offsite form was not available for review. Any documentation offsite should be noted on the staff and training worksheet. NCPrek Requirements: Today during the visit, the NCPreK requirements for substitutes were reviewed with Ms. Baker. CRIMNIAL BACKGROUND APPLICATIONS: A New feature links criminal background applications to facilities. North Carolina child care administrators can now view and edit their facility’s staff roster in ABCMS, the DCDEE’s criminal background check system. Provider Access to ABCMS allows administrators to: • See the real-time background check status of staff members. • Run a printable report of the staff roster to assist with compliance visits. • See new background check applicants and add to staff roster. To get started, complete the ABCMS Child Care Provider Portal Training in Moodle—a video tutorial followed by a few questions. CLEAN WATER FOR US KIDS: The Clean Water for Carolina Kids program is expanding to the Clean Classrooms for Carolina Kids program. This is a legislatively mandated effort to address lead and asbestos hazards in North Carolina public schools, licensed child care centers, and licensed family child care homes. Participation allows facilities to meet all rule requirements for identified lead and asbestos hazards, as required by law. In the Clean Water for Carolina Kids facility data, status for lead water shows the sample kit has been mailed to the facility. Lead based paint and asbestos status shows the enrollment has been started however, there are no results for the three. You should ensure all steps are completed to determine if an assessment is needed for lead based paint, asbestos and to receive results after completion of water samples. STAR RATED LICENSE (SRL): Hold harmless has been extended until the new QRIS is implemented (SB 425). This means that no child care facilities in cohort one will have a rated license assessment unless they voluntarily want to. Also, cohort two do not need to start a preparation year. More information will be forthcoming. QRIS: GET READY FOR THE 3s (ECERS-3, ITERS-3, FCCERS-3): The DCDEE and the North Carolina Rated License Assessment Project (NCRLAP) are collaboratively working on preparations for the transition to the ECERS-3, ITERS-3, and FCCERS-3 that starts February 1, 2025. Don't worry! Visit the Get ready for the 3s webpage to learn what's different and what you can do now to prepare. New resources have just been added. You'll find updated FAQs, fact sheets, credit hour trainings, outreach assessment opportunities and more to help you become familiar with these tools. Until February 1, 2025, NCRLAP will use the Revised editions for official environment rating scale assessments for a NC Star Rated License (for new licensees or upon request.) This center currently operates with a Five-Star Child Care Center License that was issued May 24, 2019 earning seven (7) points in Program Standards, seven (7) points in Education Standards and one (1) Quality Point. The last annual compliance visit was conducted March 2, 2023. The posted sanitation inspection was completed September 5, 2023 and a “Superior” rating was earned. The last fire inspection was completed October 3, 2023 and you were approved for daytime care only. S. McMannen/Principal was present onsite today. M. Barnes Lead Teacher was present and assisted with today's visit. M. Barnes, Lead Teacher, was present and notified of the purpose of my visit. A total of thirteen (13) children were present today ranging from ages four to five years old. Children were observed in large group activity, washing hands and toileting, and engaging in free choice activities and centers. The following violations were documented today: Violation Number Comment Rule 812 Electrical outlets and power strips, not in use, which were located in space used by children did not have safety outlets or were not covered with safety plugs unless located behind furniture or equipment that cannot be moved by a child. Electrical outlet was not covered with safety plug located in block center. 10A NCAC 09 .0604(c) Violations documented above must be corrected immediately. A signed and dated letter of compliance must be mailed to me by February 28, 2024 describing how and when the violations were corrected. PROGRAM RECORDS: Fire Drills/Emergency Drills, Fire inspection, Sanitation report, First Aid/CPR Poster, Playground Outdoor Inspections, EMC Plan and License were reviewed and current. ELECTRICAL OUTLET: Two electrical outlets were uncovered without plugs. We discussed making sure all electrical outlets are plugged at all times. Please refer to this section of the child care rules to review rule on Safe indoor environment. This was corrected during the visit. 10A NCAC 09 .0604 SAFETY REQUIREMENTS FOR CHILD CARE CENTERS DCDEE WORKS: New staff that has not had their education evaluated will need to create a WORKS account by accessing our website under the provider tab, then click DCDEE WORKS. Once account is created, staff should upload or submit original transcripts or certificates to the division for evaluation of their education. Existing staff who has completed additional college course work should also upload and or submit new transcripts. Staff should also apply for what position they want to be evaluated for. (teacher, lead teacher, group leader, etc.) If you need assistance or have any questions, you should contact our workforce education unit. NEW CRIMINAL BACKGROUND CHECK LEGISLATIVE CHANGES: The 2022-2023 Appropriations Bill (HB 103) signed by Governor Cooper on July 11, 2022, made two important changes to North Carolina General Statute 110-90-2 regarding child care Criminal Background Checks. • The period for background check qualification renewals was revised from three years to five years. • The provisional qualification period was reduced to forty-five days. The Division intends to implement these changes as soon as possible. An individual’s current Qualification Letter will be extended 2 years for the total of 5 years. New Qualification Letters will not be generated. Individuals with a Provisional Qualification Letter will receive a Qualification Letter on the 45th day. Letters are generated in the Criminal Background Check portal. HEALTH AND SAFETY TRAININGS: Health and safety trainings are due every five (5) years. If any staff completed trainings in 2017, trainings will be due this year, 2022. I encourage staff to be intentional and start completing trainings. Health and safety trainings are now on MOODLE. There are a couple of ways for a student to access the health and safety training. • The enrollment process and completion of course materials tend to work best with a windows laptop or desktop using Firefox, but other devices and Google Chrome should also work. • From the Moodle home page, students need to log-in with their NCID and password. The log-in is in the upper right corner of the screen. • After log-in, the student should scroll to the bottom of the page. In the ‘Search courses’ box, the student should type in the short name “Year 2023 CCDF” and then click go. The student should not register for prior year courses as they are no longer available. • After completing the course search for “Year 2023 CCDF”, the student should be able to register for the course. • Once registered, the student will then need to use the “ADDITIONAL DIRECTIONS” for step-by-step instructions. Should a student encounter an issue, we are requesting they report the CCDF 2023 course issue (i.e. they are unable to complete the course evaluation or receive a training certificate), to the North Carolina Child Care Health and Safety Resource Center using the following link https://healthychildcare.unc.edu/contact-us-form/. Should the student need additional guidance with accessing the training, please refer them to Amia Eaton, Training and Program Development Consultant, at Amia.Eaton@dhhs.nc.gov or by telephone at 919-814-6365. FLEXIBILITY IN POLICY AND REGULATORY REQUIREMENTS: All flexibilities expired October 15, 2021, with the exception of the flexibilities related to the star rated license, sanitation, and fire inspections. This center currently operates with a Five-Star Child Care Center License that was issued May 24, 2019 earning seven (7) points in Program Standards, seven (7) points in Education Standards and one (1) Quality Point. The last annual compliance visit was conducted March 2, 2023. The posted sanitation inspection was completed September 5, 2023 and a “Superior” rating was earned. The last fire inspection was completed October 3, 2023 and you were approved for daytime care only. S. McMannen/Principal was present onsite today. M. Once account is created, staff should upload or submit original transcripts or certificates to the division for evaluation of their education. Existing staff who has completed additional college course work should also upload and or submit new transcripts. Staff should also apply for what position they want to be evaluated for. (teacher, lead teacher, group leader, etc.) If you need assistance or have any questions, you should contact our workforce education unit. NEW CRIMINAL BACKGROUND CHECK LEGISLATIVE CHANGES: The 2022-2023 Appropriations Bill (HB 103) signed by Governor Cooper on July 11, 2022, made two important changes to North Carolina General Statute 110-90-2 regarding child care Criminal Background Checks. • The period for background check qualification renewals was revised from three years to five years. • The provisional qualification period was reduced to forty-five days. The Division intends to implement these changes as soon as possible. An individual’s current Qualification Letter will be extended 2 years for the total of 5 years. New Qualification Letters will not be generated. Individuals with a Provisional Qualification Letter will receive a Qualification Letter on the 45th day. Letters are generated in the Criminal Background Check portal. HEALTH AND SAFETY TRAININGS: Health and safety trainings are due every five (5) years. If any staff completed trainings in 2017, trainings will be due this year, 2022. I encourage staff to be intentional and start completing trainings. Health and safety trainings are now on MOODLE. If a physician licensed to practice medicine in this State certifies that a required immunization is or may be detrimental to a person's health due to the presence of one of the contraindications adopted by the Commission, the person is not required to receive the specified immunization as long as the contraindication persists. This center currently operates with a Five-Star Child Care Center License that was issued May 24, 2019 earning seven (7) points in Program Standards, seven (7) points in Education Standards and one (1) Quality Point. The last annual compliance visit was conducted March 2, 2023. The posted sanitation inspection was completed September 5, 2023 and a “Superior” rating was earned. The last fire inspection was completed October 3, 2023 and you were approved for daytime care only. S. McMannen/Principal was present and assisted with today's visit. M. Barnes, Lead Teacher, was present and notified of the purpose of my visit. A total of thirteen (13) children were present today ranging from ages four to five years old. Children were observed in large group activity, washing hands and toileting, and engaging in free choice activities and centers. The following violations were documented today: Violation Number Comment Rule 812 Electrical outlets and power strips, not in use, which were located in space used by children did not have safety outlets or were not covered with safety plugs unless located behind furniture or equipment that cannot be moved by a child. Electrical outlets located on wall in transportation and library centers were not covered with plug covers while not in use. 10A NCAC 09 .0604(c) Violations documented above must be corrected immediately. A signed and dated letter of compliance must be mailed to me by November 16, 2023 describing how and when the violations were corrected. This two-week time frame is established to allow you time for submitting your compliance letter and is not intended to be used as a guide for correcting violations, as they should be corrected immediately. The letter of compliance should be mailed or emailed to me, Emily Hargrove, PO Box 1974, Henderson, NC 27536. The compliance letter must be submitted from the email address on file for your program. TECHNICAL ASSISTANCE AND CONSULTATION: Compliance History: Prior to today's visit, this facility has maintained an 18-month compliance score of 100%. PROGRAM RECORDS: Fire Drills/Emergency Drills, Fire inspection, Sanitation report, First Aid/CPR Poster, Playground Outdoor Inspections, EMC Plan and License were reviewed and current. SANITATION REPORT: Sanitation report is current however, you don't have a copy of the sanitation inspection report on file. You stated that the inspector stated that she would email you the report and you hadn't receive it yet. You called program coordinator during the visit and asked had she received the report. She stated that she would call and request it. The program coordinator called during the visit and informed me that she left a message with Environmental Health office. She stated she would email it to me as soon as she gets it. ELECTRICAL OUTLET: Two electrical outlets were uncovered without plugs. We discussed making sure all electrical outlets are plugged at all times. Please refer to this section of the child care rules to review rule on Safe indoor environment. This was corrected during the visit. 10A NCAC 09 .0604 SAFETY REQUIREMENTS FOR CHILD CARE CENTERS DCDEE WORKS: New staff that has not had their education evaluated will need to create a WORKS account by accessing our website under the provider tab, then click DCDEE WORKS. Once account is created, staff should upload or submit original transcripts or certificates to the division for evaluation of their education. Existing staff who has completed additional college course work should also upload and or submit new transcripts. Staff should also apply for what position they want to be evaluated for. (teacher, lead teacher, group leader, etc.) If you need assistance or have any questions, you should contact our workforce education unit. NEW CRIMINAL BACKGROUND CHECK LEGISLATIVE CHANGES: The 2022-2023 Appropriations Bill (HB 103) signed by Governor Cooper on July 11, 2022, made two important changes to North Carolina General Statute 110-90-2 regarding child care Criminal Background Checks. • The period for background check qualification renewals was revised from three years to five years. • The provisional qualification period was reduced to forty-five days. The Division intends to implement these changes as soon as possible. An individual’s current Qualification Letter will be extended 2 years for the total of 5 years. New Qualification Letters will not be generated. Individuals with a Provisional Qualification Letter will receive a Qualification Letter on the 45th day. Letters are generated in the Criminal Background Check portal. HEALTH AND SAFETY TRAININGS: Health and safety trainings are due every five (5) years. If any staff completed trainings in 2017, trainings will be due this year, 2022. I encourage staff to be intentional and start completing trainings. Health and safety trainings are now on MOODLE. There are a couple of ways for a student to access the health and safety training. • The enrollment process and completion of course materials tend to work best with a windows laptop or desktop using Firefox, but other devices and Google Chrome should also work. • From the Moodle home page, students need to log-in with their NCID and password. The log-in is in the upper right corner of the screen. • After log-in, the student should scroll to the bottom of the page. In the ‘Search courses’ box, the student should type in the short name “Year 2023 CCDF” and then click go. The student should not register for prior year courses as they are no longer available. • After completing the course search for “Year 2023 CCDF”, the student should be able to register for the course. • Once registered, the student will then need to use the “ADDITIONAL DIRECTIONS” for step-by-step instructions. Should a student encounter an issue, we are requesting they report the CCDF 2023 course issue (i.e. they are unable to complete the course evaluation or receive a training certificate), to the North Carolina Child Care Health and Safety Resource Center using the following link https://healthychildcare.unc.edu/contact-us-form/. N.C. Exemptions North Carolina law provides for two types of exemptions from required immunizations. They are medical and religious. Medical Exemption G.S.130A-156. Medical exemption. The Commission for Public Health shall adopt by rule medical contraindications to immunizations required by G.S. 130A-152. If a physician licensed to practice medicine in this State certifies that a required immunization is or may be detrimental to a person's health due to the presence of one of the contraindications adopted by the Commission, the person is not required to receive the specified immunization as long as the contraindication persists. The State Health Director may, upon request by a physician licensed to practice medicine in this State, grant a medical exemption to a required immunization for a contraindication not on the list adopted by the Commission. Medical exemptions can only be requested by a physician licensed to practice medicine in North Carolina. Religious Exemption G.S.130A-157. Religious exemption If the bona fide religious beliefs of an adult or the parent, guardian or person in loco parentis of a child are contrary to the immunization requirements contained in this Part, the adult or the child shall be exempt from the requirements. Upon submission of a written statement of the bona fide religious beliefs and opposition to the immunization requirements, the person may attend the college, university, school or facility without presenting a certificate of immunization. There is no form for requesting religious exemptions in North Carolina. To claim a religious exemption, the parent or person requesting the exemption must write a statement of their religious objection to immunization, including the name and date of birth of the person for whom the exemption is being requested. This statement would then be provided to schools, child care programs, camps, etc. in place of an immunization record. If a family is requesting a religious exemption for more than one child, a separate statement should be prepared for each child. Statements of religious objection to immunization do not need to be notarized, signed by a religious leader, or prepared by an attorney. They do not need to be submitted to the state for review or approval. Personal Belief 10A NCAC 41A .0403 Non-Religious Personal Belief No Exemption: Except as provided in G.S. 130A-156 and G.S. 130A-157, and 10A NCAC 41A .0404 and .0405, no child shall be exempt from the requirements of 10A NCAC 41 .0401; there is no exception to these requirements for the case of a personal belief or philosophy of a parent or guardian not founded upon a religious belief. FLEXIBILITY IN POLICY AND REGULATORY REQUIREMENTS: All flexibilities expired October 15, 2021, with the exception of the flexibilities related to the star rated license, sanitation, and fire inspections.
