Ms. Jackie Simmons, Assistant Director, was present during today's visit. She stated the director, Amanda Chavis, was not present. The program currently operates with a 5 star license issued April 12, 2022. License restrictions include daytime care, 2nd shift, and meets enhanced space. Staff/child ratio, group size, supervision, use of licensed space, space capacity, license restrictions, and the outdoor environment were monitored. The license and emergency care plan were posted. Fire drills, medication administration, and storage of hazardous products were also monitored. I visited all the indoor and outdoor spaces. All children were observed engaged in unstructured, outdoor free play, using their large muscle groups to run, jump, climb and explore. Staff were actively moving about the outdoor areas assisting with the children. Some children picked fresh vegetables from the garden. REQUIRED INSPECTIONS Your last sanitation inspection was dated July 22, 2025. Your last fire inspection was completed on February 13, 2026 The Emergency Drill Log was reviewed during today’s visit. Ms. Simmons stated there are no new employees at the facility since the Annual Compliance visit conducted February 12, 2026. Three items of non-compliance with child care requirements were observed and documented. Each were thoroughly reviewed with Ms. Simmons. Violation Number Comment Rule 526 Menus for all meals and snacks were not current or posted where easily seen by parents and cook. The menu posted in the front lobby was dated May 22-2026. A menu posted in space #2 was dated June 8-June 12. 10A NCAC 09 .0901(b) 620 All walls and ceilings including doors and windows were not kept clean, free of visible fungal growth, and in good repair. Peeling paint was observed on the door in Space #1 (classroom used for 3 and 4 year old children). 15A NCAC 18A .2825(a) 716 All stationary equipment, more than 18 inches high, was not installed over protective surfacing. The loft area on playground #4, used by school-age children, did not have protective surfacing. .0605(j) The violations documented must be corrected immediately. On or before July 6, 2026, I must receive a compliance letter that describes accurately and in detail, how and when the violations were corrected. If it is determined the information provided in the letter is not true, this may be considered falsification of information. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all the applicable laws and rules at all times. Technical assistance regarding the violations cited was offered. -The critical height of the loft climber/slide combo on the playground used by school-age children measured more than 5 feet but less than 7 feet; therefore, 6 inches of mulch is needed for the protective surfacing. The protective surfacing must also extend 6 feet around the equipment and slides. If you are unable to come into compliance with adding the protective surfacing by the compliance date, you will need to make the climber inaccessible to the children until the mulch is added. -All painted surfaces in child care areas must be maintained in good repair and free from peeling, chipping, or flaking paint. The peeling paint creates a potential health and safety hazard for children. -Menus that were posted throughout the facility were not current. Make sure to replace old menus on the final operating day of each month or week and check each classroom that has a posted menu to make sure a current one is posted. Reminder: Make sure to update your ABCMS Provider Portal when staff receive updated criminal record qualification letters. By having their WORKS account updated, this will make smoother transition to the Pathways of your choosing. Amanda Chavis, Administrator, accompanied me during a walk-through of the facility. I spoke with Ms. Chavis and Chrystal McColskey, Owner, and informed them of the purpose of the visit. I observed a copy of the administrative action, cover letter, and CAP posted as required. I also reminded Ms. Chavis the information must remain posted until notice from the division. Limited monitoring of child care requirements occurred during today’s visit. Limited monitoring of child care requirements occurred during today’s visit. I monitored supervision of children, discipline, nurture, or care of children, staff/child ratio, group size, license capacity, permit restrictions. I reviewed a copy of the staff training worksheet and verified valid CPR training, First Aid training, ITS-SIDS training, and criminal background check qualification letters for all current staff members. The following violations were observed and/or confirmed during today’s visit. Violation Number Comment Rule 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. At least one staff member did not complete the first aid training in the required timeframe. .1102(c) 1049 All staff did not successfully complete certification in CPR training appropriate to the age of the children in care. Verification of staff completion of the CPR course from an approved training organization was not in the staff file. At least one staff member had not completed the CPR training in the appropriate timeframe. .1102(d) All violations documented above must be corrected immediately. A written, dated, and signed letter of compliance must be submitted to me within one week, by September 9, 2025, describing how and when the violations were corrected and how compliance will be maintained in the future. The letter of compliance should be emailed to me at the information below. I monitored for compliance with the CAP as follows: 1. The child care operator shall maintain compliance at all times with all applicable child care requirements, including but not limited to, the following: • North Carolina Genera Statue 110-91(10) regarding the care and treatment of children • Child Care Rules 10A NCAC 09 .1803 regarding discipline 2. Within one (1) week after this Notice is received, Amanda Chavis, Administrator, shall contact Amanda Lovette, Robeson County Partnership, (910) 738-6767 ext. 297, alovette@rcpartnership4children.org, to arrange for training that will address positive guidance, behavior management, and discipline of children. Training was completed on July 17, 2025. 3. Within two (2) weeks after the required discipline training is completed, Ms. Chavis shall review and revise the facility’s discipline policies and procedures to incorporate strategies learned in the training. The policies and procedures should describe, in detail, the steps the facility will take to ensure appropriate discipline of children. The policies and procedures shall include, but not be limited to, the following: August 11, 2025, discipline policy was received. August 21, 2025, Ms. McColskey was informed revisions were needed to the discipline policy. August 28, 2025, the revised discipline policy was received. During a visit on September 2, 2025, Ms. McColskey was informed revisions were needed to the discipline policy. 4. Within one (1) week after this Notice is received, Ms. Chavis shall develop a written plan for routine observations and evaluations of each staff member to ensure compliance with child care requirements and facility policies/procedures regarding discipline. Documentation of the observations shall include the date, time, and location of each observation, the name and signature of the person(s) observed, the signature of the observer, a summary of each observation, the observer’s feedback/guidance to the staff members, and the staff member’s response. August 11, 2025, observations/evaluation policy was received. August 21, 2025, Ms. McColskey was informed revisions were needed to the observation/evaluation policy. August 28, 2025, the revised observation/evaluation policy was received. During a visit on September 2, 2025, Ms. McColskey was informed revisions were needed to the observation/evaluation policy. 5. Within two (2) weeks after notification from the Division that the facility’s policies and procedures regarding discipline and plan for observation and evaluation have been met, Ms. Chavis shall conduct a mandatory staff meeting to review the approved policies/procedures/plans. Documentation of the staff meeting shall be an attendance roster with the printed and signed names of each participant and include the date, time, agenda, and minutes of the meeting. All documentation shall be maintained in the center files for review by representatives of the Division of Child Development and Early Education upon request. Policies have not been approved. The Annual Compliance Monitoring Checklist for Child care Centers was used today to note requirements that were monitored. The program operates with a 4-star rated license issued April 12, 2022 earning 7 points for education standards, 2 points for program standards, and one quality point for complying with a programmatic option. License restrictions include: 1st and 2nd shift and meets enhanced space requirements. Today’s visit was conducted with Ms. Amanda Chavis, Administrator. The LCC is listed as current and active in the NC Secretary of State website. The indoor and outdoor areas were monitored. Staff/child ratios, group size, capacity, use of space, and supervision were observed. I observed children playing in various activity centers, teacher lead activities, and outdoor play. Developmentally age-appropriate materials were used. Positive and nurturing communication occurred as teachers interacted with children. A sanitation inspection was completed 12/5/2023 with 29 demerits and a Provisional status. A re-inspection was completed on 12-12-2023 with 9 demerits and a Superior rating. A fire inspection was completed on February 6, 2024. The inspection report was not obtained within seven days of the initial inspection. This is a violation; however, corrected during the visit. The Emergency Drill log was reviewed during today’s visit. Prior to today’s visit the staff and training worksheet was obtained. A review of the information was completed. Three staff files were monitored during today's visit. I reviewed eight children records during today's visit. The children’s records form was completed during the visit. Two violations of child care requirements were observed and documented. Both were corrected during the visit; therefore, a compliance letter of corrections is not required. Computer-generated report was printed at the conclusion of today's visit. Violation Number Comment Rule 106 Operator has not scheduled and obtained a fire inspection within 12 months of the previous inspection. Operator did not submit the original approved report to DCDEE within one week of the inspection visit on a form provided by the Division. A fire inspection was completed on February 6, 2024. The inspection form was not obtained until March 21, 2024. 10A NCAC 09 .0304(a) 705 Equipment and furnishings were not sturdy, stable and free of hazards. A child-size play equipment in space #5 had two, springy prongs exposed. The piece of equipment was removed from the space. .0601(c) You are required to maintain compliance with all applicable child care rules and regulations at all times. NC GS 110- 90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past 18 months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action. Child care licensing requirements were established to ensure a safe and healthy child care environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the child care law and rules. I explained that you have access to the on-line version of the Child Care Rule Book, as well as a hard copy of the rules. I recommend that you visit the Division of Child Development's website (www.ncchildcare.nc.gov) on a regular basis to find out what's new in childcare. You could also find any needed Child Care forms by going on the web site and clicking on the "Provider" tab and then clicking on the "Provider Documents" tab. Health and Safety Trainings: Health and Safety training requirements were monitored. Technical assistance with the following was provided: During my monitoring of classroom environments, several children in space #5 showed signs of having difficulty with transitions; such as crying. Often times, the child needs a bit of warmth and affection from the caregiver to help them through this transition. Caregivers can hold, hug give a pat on the back, as well as the use of facial expressions, laughter, tone of voice or works of endearment and encouragement. Transition times are important and give many learning opportunities. Stressful transitions may include before or after mealtime, moving between indoor and outdoor activities, moving between individual and group activities, and getting ready for nap time. Transitions take a great deal of time each day and caregivers must plan for transition times. Caregivers can reduce challenging behaviors in the classroom by planning for transitions and intentionally teaching children what's expected of them during transition times. Having a plan for each transition during your day will ensure that you are planning for the children to succeed. You can learn more about Promoting Healthy Social Behaviors via www.vanderbilt.edu/csefel/ Rated License Assessments: The Division of Child Development and Early Education is starting the Rated License Assessment back to get programs current with their Rated License. You are in Cohort 3. Therefore, your Prep year will begin July 1, 2025 and will end June 30, 2026. During this 'Prep year', you need to make sure all full-time staff have completed the NCECC and their education information in WORKS is updated. This means submitting any certificates or an original transcript showing EDU coursework completed is in WORKS. If you are wanting the Environment Rating scales completed to earn more points in Program Standards, please take advantage of all the trainings they have on their website: ncrlap.org. Your Assessment year will begin July 1, 2026 and you must complete the Rated License Assessment by June 30, 2027. Violation Number Comment Rule 106 Operator has not scheduled and obtained a fire inspection within 12 months of the previous inspection. Operator did not submit the original approved report to DCDEE within one week of the inspection visit on a form provided by the Division. A fire inspection was completed on February 6, 2024. The inspection form was not obtained until March 21, 2024. 10A NCAC 09 .0304(a) 705 Equipment and furnishings were not sturdy, stable and free of hazards. A child-size play equipment in space #5 had two, springy prongs exposed. The piece of equipment was removed from the space. .0601(c) You are required to maintain compliance with all applicable child care rules and regulations at all times. NC GS 110- 90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past 18 months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action. Child care licensing requirements were established to ensure a safe and healthy child care environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the child care law and rules. I explained that you have access to the on-line version of the Child Care Rule Book, as well as a hard copy of the rules. I recommend that you visit the Division of Child Development's website (www.ncchildcare.nc.gov) on a regular basis to find out what's new in childcare. You could also find any needed Child Care forms by going on the web site and clicking on the "Provider" tab and then clicking on the "Provider Documents" tab. Health and Safety Trainings: Health and Safety training requirements were monitored. Technical assistance with the following was provided: During my monitoring of classroom environments, several children in space #5 showed signs of having difficulty with transitions; such as crying. Often times, the child needs a bit of warmth and affection from the caregiver to help them through this transition. Caregivers can hold, hug give a pat on the back, as well as the use of facial expressions, laughter, tone of voice or works of endearment and encouragement. Transition times are important and give many learning opportunities. Stressful transitions may include before or after mealtime, moving between indoor and outdoor activities, moving between individual and group activities, and getting ready for nap time. Transitions take a great deal of time each day and caregivers must plan for transition times. Caregivers can reduce challenging behaviors in the classroom by planning for transitions and intentionally teaching children what's expected of them during transition times. Having a plan for each transition during your day will ensure that you are planning for the children to succeed. You can learn more about Promoting Healthy Social Behaviors via www.vanderbilt.edu/csefel/ Rated License Assessments: The Division of Child Development and Early Education is starting the Rated License Assessment back to get programs current with their Rated License. You are in Cohort 3. Therefore, your Prep year will begin July 1, 2025 and will end June 30, 2026. During this 'Prep year', you need to make sure all full-time staff have completed the NCECC and their education information in WORKS is updated. This means submitting any certificates or an original transcript showing EDU coursework completed is in WORKS. If you are wanting the Environment Rating scales completed to earn more points in Program Standards, please take advantage of all the trainings they have on their website: ncrlap.org. Your Assessment year will begin July 1, 2026 and you must complete the Rated License Assessment by June 30, 2027.
