The Annual Compliance Monitoring Checklist was used to note requirements monitored today. Today’s visit was conducted with Ms. Lisa Matthews, Family Service Worker. Ms. Austin, Center Manager, was not on site. The NC Secretary of State website was reviewed prior to today’s visit and the owner, Southeastern Community Action Partnership, Inc., was listed as current and active. The ABCMS Provider Portal was reviewed prior to today’s visit and a current roster is available for review. This facility currently operates with a 5-star rated license issued August 1, 2022. Restrictions include 1st shift, meet enhanced ratios and meets enhanced space. They are applying for a 5-star license via Pathway #3- Accreditation and Head Start. I was unaccompanied as I completed a general walk-through of the facility. Upon my arrival, two groups of preschool children were in the multipurpose room practicing for their end of the year program. Children were adequately supervised. I observed another group of children on the outdoor learning environment. Teachers responded to the children in a positive manner. Today's lunch consisted of taco soup, cornbread, sliced apples, and milk. REQUIRED INSPECTIONS: A sanitation inspection was completed on May 29, 2025, with 0 demerits and a Superior classification. A fire inspection was completed on February 24, 2026. You are approved for daytime care only. The Emergency Drill Log & Report form was monitored during today’s visit. I reviewed all staff files and completed the staff and training worksheet during today's visit. I reviewed four children's files and completed the children's records form during today's visit. I observed four violations of child care requirements. Each were thoroughly reviewed with Ms. Matthews. Violation Number Comment Rule 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. First Aid training expired in 2/2026 for one staff and another staff had no verification on file showing completion of required first aid training. .1102(c) 1049 All staff did not successfully complete certification in CPR training appropriate to the age of the children in care. Verification of staff completion of the CPR course from an approved training organization was not in the staff file. CPR training expired for one staff in 2/2026 and one staff did not have verification on file showing completion of required CPR training. .1102(d) 1874 The Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy was not reviewed with new staff prior to providing care with children and/or a signed acknowledgement with all the required information was not maintained in the staff person's file. One staff's shaken baby syndrome and abusive head trauma policy was not signed. .0608(d)(1-4) 1898 Staff did not complete the health and safety training within one year of employment. One staff is missing 1 topic to complete the training requirements. One staff is missing 5 topics and 1 staff did not have verification of completing the health and safety training. See Health and Safety Training records in files. .1102(a) Child care programs must be in compliance with applicable child care requirements at all times. The violations must be corrected immediately. You must send me a compliance letter, addressing the individual violations and how they were corrected. The compliance letter must be received by me no later than May 5, 2026. You can email the compliance letter to:Miriam.Byrd@dhhs.nc.gov. Please be aware any information submitted by you is legal documentation. If it is determined the information provided in the letter is not true, this may be considered falsification of information. If sufficient information is not received by the due date, a follow-up visit will be conducted. You are required to maintain compliance with all applicable child care rules and regulations at all times. NC GS 110- 90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past 18 months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action. Reminder-Child care licensing requirements are established to ensure a safe and healthy child care environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the child care law and rules. You can access the on-line version of the Child Care Rule Book, as well as a hard copy of the rules. I recommend that you visit the Division of Child Development's website (www.ncchildcare.nc.gov) on a regular basis to find out what's new in childcare. You could also find any needed Child Care forms by going on the web site and clicking on the "Provider" tab and then clicking on the "Provider Documents" tab. Technical assistance- A review of the files indicated that all required documentation must be maintained on file to very compliance with established regulations and standards. If the information is not in the file I can not verify that it's been completed in the required timeframe. It is recommended that records be regularly reviewed and updated to ensure all required components are complete, accurate, and readily accessible for verification purposes. Please review the completed staff and training worksheet left during the visit in order to identify and verify violations that were noted. Rated License Information: This facility operates as a Head Start program and currently is a Head Start grantee. This facility meets Head Start ratios. The following documents were obtained prior to today's visit: *Application for Assessment for a Rated License For Centers- you have the wrong ID # on the form submitted. A new application was left during today's visit. Please sign and return to me along with your compliance letter by 5-5-2026. *Classroom Staff to Child Ratio for Accreditation of Head Start form *Pathway 3- Request to Use Accreditation and Head Start Licensure Pathway to Earn a Star Rated License form The Pathway 3- Accreditation and Head Start Star Level Assessment for Child Care Centers form was left during today's visit. The allegations are as follows: There are concerns that there are violations of child care requirements regarding discipline. The areas used by children were observed. Staff/child ratio, group size, supervision, use of licensed space, space capacity, license restrictions were monitored. The license and emergency care plan were posted. I observed thirty-five (35) children napping during the visit. Enrollment information was not gathered but all classrooms were in compliance with staff/child ratio, group size, and supervision. Ms. Pamela Austin, Interim Director, made a self-report to DCDEE on October 2, 2025, stated, after receiving a call from a parent and reviewing video footage, a teacher pushed a chair (4 yo child in the chair) back against the table several time, but on the third time the teacher pushed with force that the child’s chest hit the table. Ms. Austin stated the child did not cry nor were there any marks or injuries to the child. The teacher admitted to doing this and said the child was “leaning back in the chair” so she did this to keep the child from falling. The teacher was sent home following review of the footage. During today’s visit, Ms. Austin was attending a meeting off-site. Ms. Washington, Center Manger, assisted me with today’s visit. She stated the teacher in question has not returned to the facility. I did not see the teacher during my walk-through of the classrooms. I reviewed the information the administrator reported during today’s visit with Ms. Washington as well as reviewed the video footage. On the video, I observed the teacher standing between two tables where children were participating in a group activity. A child approached the teacher, and the teacher slightly “kneed” the child in the stomach area twice, forcing the child to walk backwards as if to move them away. The teacher then grabbed the child’s shirt and walked the child back to their chair and sat her down. As the teacher turned her attention to another child, the child fell out of the chair but got up on their own. The teacher then told another child, who was at the end of table with their back turned, to turn around. The teacher then walked over to the other group of children at a second table. At that time the child in question got up out of her seat. At that point the video ends. Based on information received from Ms. Austin’s self-report and my observations, the finding regarding allegation of violation of discipline requirements is substantiated. Violation Number Comment Rule 904 A child was handled in a rough way, including shaking, pushing, shoving, pinching, slapping, biting, kicking, or spanking. .1803(a)(1) Child care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4)(d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violations documented may impact the compliance history score. The violation documented must be corrected immediately. On or before October 21, 2025, I must receive a signed and dated compliance letter that describes accurately and in detail, how and when the violation was corrected. A follow-up visit will be conducted in the near future to monitor compliance with discipline requirements. Technical assistance regarding discipline was provided during today’s visit: A violation was documented for failure to maintain compliance with discipline requirements. Violations of this nature directly impact the safety of the children while in your care. Hitting, spanking, or any physical punishment is never acceptable in licensed child care settings. Ensure staff handbooks and training materials clearly outline expectations and consequences. You also want to remind all staff they are legally required to report suspected abuse or neglect. I encourage you to provide ongoing training in developmentally appropriate behavior management strategies, support staff in managing their own stress and frustration, encourage the use of breaks, team support, and wellness resources. I also provided technical assistance regarding the importance of offering children opportunities for free choice throughout the day and avoiding long periods of required sitting at tables for structured activities. Child-initiated play supports independence, creativity, and developmental growth across all domains. Have staff allow children to move freely between centers during designated choice times. You want to limit required whole-group or table time to short, purposeful sessions such as small group activities or meals. She can provide support to licensed childcare centers to address challenging behaviors in young children. She stated Ms. Theresa Chavis, Administrator, was in a parent conference. LICENSE STATUS: This facility currently operates with a 5-star rated license issued August 1, 2022 by earning 7 points in Education Standards, 6 points in Program Standards and 1 point in Quality by meeting a programmatic option. Restrictions of 1st shift, meets enhanced ratios and meets enhanced space were in compliance. The NC Secretary of State website was reviewed and the childcare facility was listed as current and active. I was unaccompanied as I completed a general walk-through of the facility, which consisted of all classrooms, and the outdoor play areas. A total of 50 children were present during today’s visit. I observed the children participating in free choice play, teacher-directed art activity, and outside gross motor play. REQUIRED INSPECTIONS/DRILLS: The last annual compliance visit was completed May 9, 2024. The most recent annual fire inspection was completed on February 11, 2025. The most recent annual sanitation inspection was completed May 28, 2024 and received a Superior classification with 3 demerits. The last documented monthly fire drill was conducted on April 9, 2025, and the last documented quarterly lockdown drill/shelter-in-place drill was conducted on March 5, 2025. The last documented monthly playground inspection was completed on April 3, 2025. The staff and training worksheet was obtained during the visit. I reviewed three staff files and six children's files for compliance. Due to the facility bus being out of commission, the facility does not provide transportation at this time. The following items of non-compliance of childcare requirements were observed and documented during today’s visit: Violation Number Comment Rule 1068 On-going training documentation did not include all applicable information: subject matter, topic area in G.S. 110-91(11), name of training provider, date training was provided, number of hours of training, and name of staff. The annual compliance monitoring checklist for Child Care Centers was used to note requirements monitored today. Upon my arrival, I was greeted by a staff member. She stated Ms. Theresa Chavis, Administrator, was in a parent conference. LICENSE STATUS: This facility currently operates with a 5-star rated license issued August 1, 2022 by earning 7 points in Education Standards, 6 points in Program Standards and 1 point in Quality by meeting a programmatic option. Restrictions of 1st shift, meets enhanced ratios and meets enhanced space were in compliance. The NC Secretary of State website was reviewed and the childcare facility was listed as current and active. I was unaccompanied as I completed a general walk-through of the facility, which consisted of all classrooms, and the outdoor play areas. A total of 50 children were present during today’s visit. I observed the children participating in free choice play, teacher-directed art activity, and outside gross motor play. REQUIRED INSPECTIONS/DRILLS: The last annual compliance visit was completed May 9, 2024. The most recent annual fire inspection was completed on February 11, 2025. The most recent annual sanitation inspection was completed May 28, 2024 and received a Superior classification with 3 demerits. The last documented monthly fire drill was conducted on April 9, 2025, and the last documented quarterly lockdown drill/shelter-in-place drill was conducted on March 5, 2025. The last documented monthly playground inspection was completed on April 3, 2025. The staff and training worksheet was obtained during the visit. I reviewed three staff files and six children's files for compliance. Due to the facility bus being out of commission, the facility does not provide transportation at this time. The following items of non-compliance of childcare requirements were observed and documented during today’s visit: Violation Number Comment Rule 1068 On-going training documentation did not include all applicable information: subject matter, topic area in G.S. 110-91(11), name of training provider, date training was provided, number of hours of training, and name of staff. Two of the three staff files reviewed, did not have the on-going training documentation log on file. .1106(a) 1323 Each child was not immunized as per Article 6 of Chapter 130A and an immunization record was not on file before or within 30 days after admission. One child did not have immunization record on file. This was corrected during the visit when the immunization record was placed in the child's file. 10A NCAC 09 .0302(d)(2) 1874 The Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy was not reviewed with new staff prior to providing care with children and/or a signed acknowledgement with all the required information was not maintained in the staff person's file. One staff did not have a signed acknowledgement on file showing a review of the Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy. This was corrected during the visit when a signed copy of the policy was placed in the staff file. .0608(d)(1-4) All violations must be corrected immediately. A compliance letter is due to me within two weeks of today’s visit. By May 15, 2025, please send me a letter addressing how each violation was corrected. In your letter, be sure to include your facility name, facility ID number and each item number for the violation cited. You may submit the letter to me electronically at Miriam.Byrd@dhhs.nc.gov. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the child care law and rules. I reminded you visit the Division of Child Development's website (www.ncchildcare.nc.gov) on a regular basis to find out what's new in childcare. You could also find any needed Child Care forms by going on the web site and clicking on the "Provider" tab and then clicking on the "Provider Documents" tab. You are required to maintain compliance with all applicable child care rules and regulations at all times. NC GS 110- 90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past 18 months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action. Prior to today's visit, your current compliance history score is 99%. Technical assistance with staff files was provided during today's visit. Make sure all staff files have the On-going Training Documentation Log as well as the Health and Safety Training log. The files you are currently using have several sections that can be put to great use. You can a section for essential documents like application, resumes, and employment agreements. Another section can be for Criminal Background Qualification checks, and another section for training, etc... Several programs have also set up the staff files by using the numbering system that is on the staff and training worksheet. Based on the information obtained from the ABCMS website, I verified you completed your facility roster to ensure current staff are noted on the roster. This information should be updated in ABCMS in an ongoing basis as staff members are hired and when their employment is terminated. This satisfies the requirement to notify the Division of new child care providers working who were hired or moved into the child care facility within five business days. Rated License: The Child Care Commission has taken the next step in the journey to meet the North Carolina General Assembly’s mandate in Session Law 2024-34 to modernize the state’s Quality Rating and Improvement System, voting to adopt the Quality Rating Improvement System (QRIS) Modernization Proposed Rule Amendments and Adoptions. The QRIS rules will go to the Rules Review Commission (RRC) for review and approval as the next step of the rulemaking process. It is important to note that the new QRIS rules are not yet effective. However, the Division is preparing for a gradual transition to the new requirements. Resources, forms, and training will be provided to support you in preparing for new options to earn your Two- through Five-Star Rated License. All the newest information will be posted at QRIS Modernization and will also be provided through emails and Raise NC newsletters. Your program currently operates with a five star license, issued August 1, 2022 earning 7 points in education, 6 points in program (meeting enhanced space and ratios and an ERS score of 5.0 average with no room lower than a 4.0) and 1 quality point for offering a staff benefits package and infrastructure of parent involvement. Your program was also monitored for compliance with implementing an approved curriculum as required for all four and five star licensed facilities where four-year-old children are enrolled. The last annual compliance visit was conducted November 15, 2022. The last sanitation inspection was completed March 7, 2023, with a “Superior” classification. The last fire inspection was conducted January 31, 2023 and your facility was approved for daytime care only. The center's compliance history was reviewed with the operator. The program’s compliance history was 93% as of today. The NC Secretary of State website was reviewed today, and SOUTHEASTERN COMMUNITY ACTION PARTNERSHIP, INC. is listed as current- active. I visited each indoor and outdoor learning environment. Children were cared for in a nurturing and caring manner. The license restrictions were maintained and found in compliance. The children were observed in teacher directed activities, during centers, and playing outside on the playground. Lunch consisted of WG spaghetti noodles with meat sauce, string beans, apples and milk. The following violations were documented: Violation Number Comment Rule 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file.
