V. Weston, administrator, was present and assisted with the visit. Currently, this center operates with a Five-Star license issued on June 18, 2019, earning seven (7) points in the Education Component, six (6) points in the Program Component and one (1) Quality point. The last annual compliance visit was conducted on January 23, 2024. The last sanitation inspection was completed December 18, 2024, earning a Superior rating. The last fire inspection was completed February 7, 2024, and the facility was approved for care on first shift only. The program continues to offer transportation, therefore these requirements were monitored and found to be in compliance. Children were observed participating in free choice center play, outdoor play, infant tummy time and a gingerbread snowman decorating activity. Observed interactions between teachers and children were nurturing in nature. A violation of child care requirements was documented. Violation Number Comment Rule 721 All equipment and furnishings were not in good repair. Anchors were beginning to protrude on the black borders around play equipment on the playgrounds to the right of the entrance. G.S. 110-91(6); .0601(b) COMPLIANCE HISTORY Prior to today’s visit your compliance history was 98% over an eighteen (18) month period. FACILITY PROFILE This facility is owned by ABC Adventures, Inc. I informed you that the corporation listed as owner of this facility is documented as current and active in the Secretary of State Database and is required to remain so per child care rules. I reviewed contact information for the owner and the facility with you, V. Weston, and you confirmed that the information listed with DCDEE remains correct. NC PRE-K NC Pre-K requirements were monitored today and found to be in compliance. The program operates 8am to 2:30pm. Creative curriculum is used to create activity plans. Children developmental assessments were completed within the first six (6) months of this instructional year. The long-term substitute in the classroom is listed on the NC Pre-K plan website and continues to meet requirements. STAFF & CHILDREN RECORDS I monitored all new staff records and ten (10) percent of remaining staff records. They were found to be in compliance. CHILDREN RECORDS I also monitored ten (10) percent or more of children’s records. They were found to be in compliance. OUTDOOR PLAY AREAS & EQUIPMENT While monitoring the playground to the right of the entrance I observed a protruding anchor securing the black border around one of the swing sets. Protruding anchors were also observed securing the black border around the climbing structure on the larger playground to the right of the entrance. that Prior to the conclusion of the visit you secured the secured flush with border. This violation was documented as corrected during the visit. TECHNICAL ASSISTANCE & REMINDERS Be sure to re-post child handwashing signs near sinks used by children when moved for decorating or rearranging purposes. Licensing fee invoices were emailed last month. Ensure that your email address remains current and once received that the payment is made online, on the Division website, by December 31, 2024. Please be reminded that failure to pay the license fee is a violation of General Statutes 110-90(1a) and will result in a penalty assessment, accrued interest, and issuance of an Administrative Action. The reporting period for child care immunizations is open. Reporting for 2024-2025 has been extended due to Hurricane Helene. Children were given a grace period from requirements until November 30, 2024, and reports will be accepted until January 15, 2025. You stated that you have already completed and submitted your program’s immunization report. The Clean Water for Carolina Kids program has expanded to the Clean Classrooms for Carolina Kids program. This is a legislatively mandated effort to address lead and asbestos hazards in North Carolina public schools, licensed child care centers, and licensed family child care homes. Participation allows facilities to meet all rule requirements for identified lead and asbestos hazards, as required by law. Rules 10A NCAC 41C .1001 through .1007 require all programs to be free of lead and asbestos hazards. RTI is coordinating all the lead in water, paint and asbestos testing and remediation. Currently operating child care facilities are required to test for lead in paint and asbestos once unless the consultant notes a concern during a visit and refers the program to environmental health. After reviewing the website, I noted that your program has completed your second round of lead water testing and is not again until May 2027. The program is listed as “Survey Review by RTI” regarding the lead paint and asbestos testing. Child care licensing requirements are established to ensure a safe and healthy child care environment. It is your responsibility to maintain compliance with all applicable laws and rules. The best way to do so is to periodically review the child care laws and rules. Upon arrival, C. Allen, assistant administrator, was present at the facility and assisted. The allegation of the report was reviewed with you, and you were given the opportunity to respond and ask questions. The following child requirements were monitored: supervision, permit restrictions, staff/child ratios, and adequate/approved space. A short walkthrough was completed today. Permit restrictions for this facility include first shift care only, enhanced ratios and enhanced space compliance were met. Children were observed napping, engaging in quite activities and screen time for school aged children. Observed interactions between teachers and children were nurturing in nature. No violations of child care requirements were documented today. Violation Number Comment Rule 125 Daily records of arrival and departure times for children enrolled at the center were not maintained as children arrive and depart and/or were not made available for review. Arrival times for a school-age child was not documented as it occurred on March 13th. 10A NCAC 09 .0302(d)(4) The violations documented above must be corrected immediately. A signed and dated letter of compliance can be mailed or emailed to me and must be received by April 17, 2024. If mailing, you must submit two (2) signed and dated copies. My mailing and email addresses are noted at the bottom. The letter of compliance must detail how it was corrected. Please be aware that any written information you submit regarding the correction of the violation is legal documentation. Therefore, it is important that all submitted information is accurate and truthful. If it is determined that submitted information was inaccurate or willfully falsified, an Administrative Action, including Revocation of the facility’s license could be issued. ALLEGATIONS There was a concern regarding staff allegedly not knowing the whereabouts of a child when the parent came to pick-up. FINDINGS Upon my arrival groups in each classroom were napping or resting and each space was maintaining appropriate staff/child ratios. I spoke with you and staff directly involved with an incident that occurred on March 13th where a parent was concerned about where their child was upon pick-up. When a parent arrived to pick up her two (2) children she stopped at the classroom for infants first (space #1). While gathering the child and their belongings the staff person asked her if her oldest child was there as she did not see them get off the bus. The parent replied that the child should be there. The staff person told mom to check the child’s classroom since the child was school-aged and mom said she would. However, mom walked out of the classroom for infants and went toward the entrance to leave which is the opposite direction of the classroom for school-aged children (space #3). This staff person works in space #3 with school-aged children but moves to space #1 with infants around 4:30pm. She informed me that the school bus usually arrives around 2:45pm-3pm but arrived around 3:30pm that day. Therefore, she and her co-teacher gave the children who were present a snack and split up so that group could go outside. When the 3:30pm group came in S. Harris gave them a snack and sent them outside with C. DiFranco as they finished. Both staff members noted that mom typically picks up around 4:45pm. Mom drove to the child’s school and called the police after seeing it was closed. A police officer arrived at the center to verify that the child was on-premise and spoke with the staff person that originally spoke to the mom and the child. However, the staff person called mom prior to the police arrival at the center to tell her the child had been at the center. Mom then arrived, shortly after the police, and picked the child up from the center. Staff noted that she did not appear distressed or upset when she left the center to go to her child’s school or after picking up her oldest child at the center. The staff who works in space #3 noted that the child in question was in the classroom with other children who were dropped off by the school bus. Both staff noted that the outdoor child checklist was not complete for the group of children who arrived on the late school bus until well after the incident. It was also noted that the child was not checked in on the app at the time that the mom arrived around 4:45pm. Staff must be assigned to a classroom in the app in order to access the check in/out feature. You informed me that the director met with the staff person regarding only offering information on children present in the classroom they are working in at the time, which they can verify. Staff also said they were told that whoever documents the attendance must sign the child in and out on the app. Based on the information received, and my observations, the allegation regarding staff not knowing the whereabouts of a child when the parent arrived to pick up is not substantiated. OUTDOOR PLAY AREAS & EQUIPMENT A large hole was observed in the ground of the school age play area. The hole poses a tripping hazard for children and adults. You had staff fill the hole with sand so it was level before the visit ended. Therefore, this was corrected during the visit. ENVIRONMENTAL RATING SCALES You were reminded that this facility is in cohort two related to resuming the environmental rating scales (ERS). This means that the preparation year for your facility began July 1, 2024, through June 30, 2025. The assessment year begins July 1, 2025, through June 30, 2026, and the program must complete the ERS process during that year. Please visit the North Carolina Rated License Assessment Project (NCRLAP) website for informational webinars related to the current process and infographics with information on activities to complete during the preparation year (ncrlap.org). Ensure that all new and current staff have submitted all education to DCDEE WORKS for evaluation prior to completing the ERS. You may also complete an ERS assessment prior to your reassessment year and only use the scores if they are acceptable to you. TECHNICAL ASSISTANCE & REMINDERS Technical assistance discussed regarding ensuring that parent acknowledgement they received the infant safe sleep policy always includes the child’s enrollment date, first day of enrollment, child name and date given to parent. Continue to review your program’s EPR plan through the appropriate website every January. Replacement child handwashing signs were left with you to be posted near sinks used by children for reference. The NC Commission for Public Health adopted and approved the amended rule regarding lead water testing effective October 1, 2019. The rule requires all licensed child care centers to test all drinking water faucets and food preparation sinks for lead contamination once every three years. If a child care center finds elevated concentrations of lead in the center’s water, they will be required to take immediate action. You stated you are in the process of completing your second round of testing. Child care licensing requirements are established to ensure a safe and healthy child care environment.
