You, Sarah Broome and Sarah Sandoval, Lead Teachers, assisted me with the visit. You provided me with applicable program and staff records for review. This facility currently operates with a Five Star rated license effective July 17, 2024, meeting daytime care only, enhanced space, enhanced ratios minus one child per group, and certified Developmental Day. This facility has earned seven points in program standards, seven points in staff education, and one quality point for 75% of lead teachers having a BA/BS or higher in ECE/CD. The license was posted, and the restrictions were in compliance. This facility currently uses Creative Curriculum for approved curriculum requirements. The program’s compliance history was 99 percent prior to today’s visit. The most recent sanitation inspection for your facility was conducted on January 8, 2026. A superior sanitation classification was issued with 2 demerits noted on the grade card. The most recent fire inspection for your facility was conducted on October 13, 2025, and this facility was approved for daytime care only. Limited monitoring was conducted. I observed children in both the indoor and outdoor learning environments and found supervision and staff/child ratios to be in compliance. Children throughout the facility were observed during lunch, free play activities indoors, gross motor activities outdoors, handwashing routines, and nap. Developmental day requirements were also monitored. You stated one new staff member was employed since your most recent annual compliance visit. One new staff record and applicable records for all staff were reviewed. All staff were listed on the ABCMS Provider Portal roster for this facility. The analysis date for the most recent lead water test for Love Memorial Elementary School was February 25, 2025. Lead water testing must be completed every three years. This website indicated “survey review by RTI” for required asbestos and lead-based paint testing for Love Memorial Elementary School. This website also indicated “enrollment started” for required asbestos and lead-based paint testing for Love Memorial Pre-K. I suggested that you or the individual responsible contact RTI to request an update on this facilities enrollment with required asbestos and lead based paint testing. The most recent monthly fire drill was conducted on February 25, 2026, at 1:00pm. The most recent quarterly lockdown/shelter-in-place drill was conducted on February 23, 2026, at 1:08pm. The most recent monthly playground inspection was completed on March 2, 2026, by Sarah Sandoval. The violation observed today was discussed with you and documented in the Visit Summary left with you at the conclusion of this visit. The following violation was observed: Violation Number Comment Rule 716 All stationary equipment, more than 18 inches high, was not installed over protective surfacing. On the playground for preschool children, outdoor space #1, three to four inches of surfacing material were observed in fall zone areas surrounding the composite structure. .0605(j) The violation documented above must be corrected immediately. On or before April 9, 2026, I must receive a written, dated, and signed compliance letter that describes accurately and in detail how and when the violations were corrected. Please be aware that any information submitted by you is considered legal documentation. If it is determined the information provided in the letter is not true, this may be considered falsification of information. If sufficient information is not received by the due date, a follow-up visit may be completed. Technical Assistance for the violation observed was provided on the following: Surfacing for Fall Zones- Six inches of mulch depth is required in the fall zone areas of equipment measuring eighteen inches or higher on your playground. Surfacing depth is determined based on the height of your equipment. Some areas of your playground contained at least six inches of mulch, however, the higher traffic areas were compacted to only three to four inches. I suggested that you till the mulch and rake to needed areas, purchasing additional mulch to meet compliance with six inches of protective surfacing. Consultation was provided on the following: -I suggested that you or the individual responsible contact RTI to request an update on this facilities enrollment with required asbestos and lead based paint testing. -You requested the space capacity for the outdoor learning environment, outdoor space #1, which is approved for 29 children at 100 square feet per child. This program currently operates with a Five star rated license, effective July 17, 2024. The program’s compliance history was 91 percent prior to today’s visit. The steps on the playground climbing structure contained areas of rust where the coating was deteriorating and was exposing the metal. The coating was separating from the equipment leaving exposed sharp edges in multiple areas on the steps. .0601(c) The violation observed was corrected during the visit. Technical Assistance regarding the violation observed: Playground equipment- The school’s maintenance department surrounded the climbing structure with caution tape during the visit and teachers were advised to keep children off of the climbing structure. The last day of school before Christmas break is December 20, 2024, and children will not return to school until January 8, 2025. You stated the steps have been ordered and received and you are waiting for an installation date with the playground structure company. I requested that you provide me with documentation and pictures of the repaired climbing structure steps once completed. 10A NCAC 09 .0601 SAFE ENVIRONMENT (c) Equipment and furnishings shall be sturdy, stable, and free of hazards that may injure children including sharp edges, lead based or peeling paint, rust, loose nails, splinters, protrusions (excluding nuts and bolts on sides of fences), and pinch and crush points. You, Sarah Broome and Sarah Sandoval, Lead Teachers, assisted me during the visit and provided me with applicable program, staff, and children’s records for review. This program currently operates with a Five star rated license, effective August 27, 2018. The program’s compliance history was 94 percent prior to today’s visit. Child care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. A checklist was used to note the requirements I monitored today, including NC Pre-K and Developmental Day requirements. The most recent sanitation inspection for your facility was conducted on October 4, 2023. A superior sanitation classification was issued with 6 demerits noted on the grade card. The most recent fire inspection for your facility was conducted on October 3, 2023. The violations observed today were discussed with you and documented in the Visit Summary left with you at the conclusion of this visit. The following violations were observed: Violation Number Comment Rule 114 A summary of the NC Child Care Law was not given to a parent of every child enrolled in the center. Records for two children enrolled on 8/21/2023 did not include an acknowledgement form for the NC Summary of the Law until 11/8/2023 and 11/14/2023. The acknowledgement form given to parents at the beginning of the school year did not include a statement of receipt for the NC Summary of the Law and the information contained in the NC Summary of the Law was not included in the parent handbook packet of information. GS 110-102 847 Parent's medication authorization did not include required information. The permission form for one child's Gentle Steps diaper rash cream did not include the amount to administer. 10A NCAC 09 .0803(4)(6-9) 1830 Potential biocontaminants were not stored properly (locked storage, removed from premises, inaccessible to children, or covered plastic lined receptacle). Soiled pants in a plastic grocery bag was observed in a child's cubby accessible to children. .0604(v) 1834 Application did not have a medical action plan attached for any child with health care needs such as allergies, asthma, or other chronic conditions that require specialized health services. The child's application for two children enrolled on 8/21/2023 did not indicate that the child had a Medical Action Plan nor was the Medical Action Plan attached to child's applications. .0801(b) The violations documented above must be corrected immediately. Send me a letter of compliance describing in detail specifically how each violation was corrected and how compliance will be maintained in the future. Include the violation item number, statement of compliance, date of the visit and license ID number in the letter. I must receive your compliance statement by February 1, 2024. Please send your letter to Kristen.Mauney@dhhs.nc.gov. Failure to correct the violations and send the written statement by the due date may result in an unannounced follow-up visit being conducted or an administrative action may be recommended. Technical Assistance regarding the violations observed: Children’s Records- -Once the error regarding the Summary of the Law acknowledgment form was discovered, staff provided parents with a copy of the Summary of the Law and requested an acknowledgement form. I recommended that you use the Children’s File Checklist on the DCDEE website to ensure all applicable documents are on file within the required timeframe. A copy of the NC Summary of the Law must be given to the parent/guardian of each child prior to enrollment. We discussed reviewing the acknowledgement form at the beginning of each school year to ensure all information is included when a signature is required. Medication- -I recommended that you review all medication permission forms received from the parent prior to administering the medication to ensure all information required by rule is obtained. A parent may give a caregiver standing authorization for up to 12 months to apply over-the-counter, topical ointments, topical teething ointment or gel, insect repellents, lotions, creams, fluoridated toothpaste, and powders, such as sunscreen, diapering creams, baby lotion, and baby powder, to a child, when needed. The authorization shall be in writing and shall contain the child's name; the names of the authorized ointments, repellents, lotions, creams, fluoridated toothpaste, and powders; the criteria for the administration of the ointments, repellents, lotions, creams, fluoridated toothpaste, and powders; the manner in which the ointments, repellents, lotions, creams, fluoridated toothpaste, and powders shall be applied; the signature of the parent; the date the authorization was signed by the parent; and the length of time the authorization is valid, if less than 12 months. Biocontaminants- -We discussed appropriate storage of biocontaminants. The Lead Teacher moved the soil clothing to locked storage during the visit. In child care centers, biocontaminants shall be stored in locked areas; removed from the premises; inaccessible to children; or shall be disposed of in a covered, plastic lined receptacle. Medical Action Plan- -Children’s applications must have a medical action plan attached for any child with health care needs such as allergies, asthma, or other chronic conditions that require specialized health services. Rated License Assessment: To prepare for the reassessment process, DCDEE has developed a cohort system. There are three cohorts, and each includes a preparation year and a reassessment year. Your facility is in cohort one. The preparation year for cohort one began July 1, 2023. The reassessment year will be July 1, 2024, through June 30, 2025. An email was sent to you on July 7, 2023, with information and guidance to help you prepare. We reviewed the tasks and activities listed within this email during today’s visit. You stated you are interested in requesting the Environment Rating Scale during your preparation year. A copy of the Application for Assessment for a Two Component Star Rated License will be emailed to you following today’s visit. Education Points and Program Standards will be assessed once the Environment Rating Scale has been completed. We discussed the Rated License Assessment Request Review Form and the scheduling process for your Rating Scale Assessment. I recommended that you visit www.ncrlap.org for supplemental materials for preparing for the Environment Rating Scale Assessment. The health assessment shall include the following: (1) physical examination; (2) updated immunizations; (3) vision screening; (4) hearing screening; and (5) dental screening. (b) Site-level administrators shall review all health assessment results at the time of the child’s entry into the program to determine whether the assessment includes specific instructions for identified health needs that may require physical or occupational or other therapies to support the child’s development and learning goals. If a screening is marked as “uncooperative” or “unable to complete” due to the child being uncooperative then this requirement is not in compliance. Consultation: We discussed the following during the visit: -Guidance for ECERS-R including the cozy area, handwashing routines, and living things. -WORKS accounts and submitting education. -Non-administered emergency medications that have expired. -10A NCAC 09 .3005 CHILD HEALTH ASSESSMENTS (a) A health assessment shall be on file at the NC Pre-K site within 30 days after a child enters the NC Pre-K program and the assessment may be no more than 12 months old at the time of program entry. The health assessment shall include the following: (1) physical examination; (2) updated immunizations; (3) vision screening; (4) hearing screening; and (5) dental screening. (b) Site-level administrators shall review all health assessment results at the time of the child’s entry into the program to determine whether the assessment includes specific instructions for identified health needs that may require physical or occupational or other therapies to support the child’s development and learning goals. If a screening is marked as “uncooperative” or “unable to complete” due to the child being uncooperative then this requirement is not in compliance.
