This facility currently operates with a Notice of Compliance that was issued on May 25, 2000. The last Sanitation Inspection was conducted on August 12, 2024, and received a “Superior” classification and received (12) demerits. The last Fire Inspection was conducted on September 9, 2024, and the facility was approved for daytime care only. The last Fire Drill was conducted on November 6, 2024. The last Lock Down/ Shelter-in-Place was on September 4, 2024. The last Playground inspection was conducted on November 6, 2024. Upon arrival, I was greeted by the director, Fran Greer. I stated the purpose of my visit and was assisted on a walk-through of the facility, where attendance was documented, and observations made. The children were observed playing in centers. Today, a partial assessment of applicable child care requirements was conducted, which included license posted, permit restrictions, supervision, staff/child ratio, qualified criminal background checks, staff training and general safety. The following violations were observed, and technical assistance was offered. The above violations must be corrected immediately. Violation Number Comment Rule 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. In space 4 a teachers purse was sitting on her chair and Clorox wipes were on the desk. .2820(b) 843 A drug or medicine was administered after its expiration date. A child in space 3 had an inhaler that expired on 2/2/24. 10A NCAC 09 .0803(1)(d) A Corrective Action Letter must be drafted with the name of your facility, the facility identification number, and your signature. The letter must be received by my office on, or before 5:00 pm December 2, 2024. The letter should include: Each item number of noncompliance cited. Describe how and when the violations were corrected. Please include accompanying documentation of compliance. The letter can be emailed to rena.mccaffrey@dhhs.nc.gov. If a compliance letter is not received to my office by 5:00 PM December 2, 2024, a return visit may be conducted to ensure the violations cited have been corrected or addressed. This facility currently operates with a Notice of Compliance that was issued on May 25, 2000. When I arrived at the facility, I was greeted by the director, Fran Greer. I discussed the allegation with the director. Ms. Greer assisted me during a walk-through of the facility and attendance was taken and observations made. The children were observed playing in centers and preparing for lunch. Limited monitoring was conducted during today's visit, permit restrictions, adequate/approved space, supervision, staff/child ratio, program records and sanitation and health practices. Allegation: There is a concern regarding supervision. Observation: During today’s visit I discussed the allegations with the director. The allegations surround an incident that occurred on the playground on April 2, 2024. Today I reviewed the attendance sheets from April 2, 2024. On that day there were 33 children enrolled, and 27 children were present in the group ranging in age from three (3) to five (5) years of age. There were three staff present with this age group that day. Today, I interviewed three staff members and the director. The director self-reported this incident to the Division of Child Development. According to the report a parent contacted her child’s teacher and stated that her child (5 year old) stated she had been inappropriately touched by another five (5) year old child while on the playground. The teacher contacted the director to report what the parent had advised and the director contacted both children’s parents on the evening of April 2, 2024. Today, I interviewed the director and two teachers while at the facility. The teachers stated that there is a third staff member who stays with the group until they get into ratio and then that person leaves around 3:30 leaving two staff with the remaining children. The teachers stated that they did see the two children playing together under the shelter but did not see them on the swings together. I asked the teachers where they position themselves on the playground when the children are playing. The two teachers stated they take chairs outside and sit by the adult sized swing to watch the children. They stated that this was where they sit so they can greet parents when the children are being picked up and to take children to the bathroom as needed. The teachers stated that none of the children advised them of what had happened while they were outside on the day of the incident. The teachers were unaware anything had happened until the parent reported it to them. I spoke with the Director regarding the staff member’s statement that they take chairs outside and sit and observe the children. Ms. Greer stated that she has reviewed their policy with them since this incident occurred. CONCLUSION: Based on information received from the staff and the director who self-reported this incident, this allegation is Substantiated. Violation Number Comment Rule 301 Minimum staff/child ratios and group sizes for the number and ages of children in care were not met. On April 2, 2024 the group size was 27 ages three to five years old in one group. This exceeds the capacity for children age three in a group which is 25. GS 110-91(7);.0713(a-d) 303 Children were not adequately supervised at all times. The teachers reported they sit and observe the children on the playground rather than moving about the area interacting with the children. .1801(a)(1-5) The above violations must be corrected immediately. A Corrective Action Letter must be drafted with the name of your facility, the facility identification number, and your signature. The letter must be received by my office on, or before April 22, 2024. The letter should include each item’s number of noncompliance cited, describe how and when the violations were corrected. Technical Assistance: Today we discussed that staff should be moving around in any area where children are present so they can always be seen and heard. Staff must not be stationary on the playground because they are responsible for every child’s safety at all times. Staff should take this outside time to engage children in nature and ask open-ended questions. Staff should be actively listening for inappropriate conversations that children may have and then redirect those conversations to more appropriate ones. Outdoor time should be not only an opportunity for children to engage in activities but to also interact with their teachers in play and observations of nature and discovery. Today I discussed with Ms. Greer that the overall group size cannot be more than 25 children in one group. You were provided with an opportunity to ask questions regarding interpretation and implementation of all child care requirements. Child care licensing rules and regulations are established to ensure a safe and healthy environment for children in care. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your program. It is your responsibility to always maintain compliance with all the applicable laws and rules. The best way for you to make sure that you are meeting all requirements is to periodically review the child care law and rules. The last Fire Inspection was conducted on September 5, 2023, and the facility was approved for daytime care only. The last Fire Drill was conducted on February 28, 2024. Upon arrival, I was greeted by Fran Greer, program director. I stated the purpose of my visit and was assisted on a walkthrough of the facility where attendance was recorded, and observations were made. The children were observed eating lunch and preparing for naptime. During today's visit, I completed a full assessment of applicable Child Care Requirements; license posted, restrictions maintained, staff/child ratio and adequate approved space. Program Records and Criminal Background Checks were also monitored. Today six children’s files were monitored and found to be in compliance. Staff files were also monitored and found to be in compliance. The following violations were cited and technical assistance regarding maintaining compliance was offered. Violation Number Comment Rule 718 Swings did not have surfacing that extends two times the length of the pivot point to the surface below beyond the external limits of the equipment. The swings did not have enough mulch coverage under them for two times the pivot point. .0605(m)(2) 721 All equipment and furnishings were not in good repair. The S-hooks on the swings were not closed. G.S. 110-91(6); .0601(b) 807 A safe indoor and outdoor environment was not provided for the children. On the small playground area there were exposed roots and raised nails on a picnic tables. 10A NCAC 09 .0601(a) 1811 Shelter-in-place or lockdown drills were not practiced every three months and/or drill record was incomplete. The lockdown was had not been conducted in the last three months. .0604(u);.0302(d)(8) 1867 The depth of the loose surfacing was not based on critical height of the equipment.
