Upon arrival I spoke with the director, Stephanie Barber, and discussed the purpose of my visit. The director and teachers were given the opportunity to respond to the allegations made. I conducted an unassisted walkthrough of the facility. Today there were 39 children present ages 0-5 years. ALLEGATIONS: There are allegations of violations of child care requirements. OBSERVATION: Today I monitored classrooms in the center for nurture and care and sanitation practices. Teachers were engaging with children and moving around the classroom. The concern was that a 14-month-old child had one diaper change and was wet from crying and urine when parents picked the child up. The reporter stated that teachers were sitting around on their cell phones and not paying attention to the children. When speaking to the director regarding the complaint reported, the director stated that the child did have more than one diaper change because this was the first day of the child’s attendance and they could not find her diapers. They used another child’s diaper to change the diaper, and her diapers were found later on in the day. Today I asked the director to see the cameras for 12/4/25. I reviewed about 40 minutes of footage at different times a day. I interviewed the infant teacher and current toddler teacher to ask about how they document diaper changes. The infant teacher stated that she hand writes diaper changes and gives them to the parents at the end of the day. I did see the teacher recording the diaper changes. The toddler teacher stated that she does not record diaper changes. After watching the cameras at different times of the day, the footage showed the toddler class and the infants combined with two teachers. There were nine (9) children in the room. One of the teachers walked out of the room to get something at 11:20 am and left the other teacher out of ratio. The toddlers’ diapers were being changed at 8:30 am. Infants were being changed on a regular basis. The toddlers did not receive a diaper change again until 1:30 pm. During lunch time one teacher was washing the children’s hands and faces with one wash cloth. She used the same washed cloth to wipe all the children’s faces and hands and then cleaned the table and chairs with it. Then proceeded to go back to another child and use the same wash cloth to wash another child’s face and hands. There was no hand washing at a sink with running water and soap before or after lunch or after changing a diaper. After lunch was served to the children, they were picked up and placed on their cots. One teacher was seen on camera lifting a child up by the child’s arm and that same teacher in a hurried but aggressive motion placed the child down on the cot. I could not see on camera if there were any children being placed in their cribs with bottles. I did not see any teachers using their cell phones on camera at the times I viewed them. CONCLUSION: Based on footage on camera, and interview with the director, staff and observations made, the allegation of diapers not being changed is Substantiated. The allegation of teachers being on cell phones is Unsubstantiated. The allegation of infants being in cribs with bottles is Unsubstantiated. The following violations were cited during today's visit. Violation Number Comment Rule 315 When combining age groups, the staff/child ratios for the youngest child in the group was not maintained for the entire group. The infant classroom had nine children present during today's visit. One teacher left the infant classroom leaving second teacher out of ratio. .0713(a)(1) 401 Diapers were not changed whenever they were soiled or wet and/or were changed on a shift basis. The toddlers in this classroom were not changed for five hours during the day. Diaper changes were completed at 8:30 am and were completed again at 1:30 pm. 10A NCAC 09 .0806(a) 608 Children did not wash their hands upon arrival at the center, after each visit to the toilet, before eating, before and after water activity play, after outside play, and after handling animals or animal cages. Children did not have their hands washed after a diaper change or before and after eating in the toddler class. 15A NCAC 18A .2803(c) 904 A child was handled in a rough way, including shaking, pushing, shoving, pinching, slapping, biting, kicking, or spanking. A child was placed down on his mat in a aggressive manner. This same teacher picked up a child by one arm off the floor. .1803(a)(1) 9999 A violation was found for which there is no item number. A infant teacher used a wash cloth to wash all the children's hands and faces with the same wash cloth and used the same cloth to wash the tables and chairs. The above violation must be corrected immediately, and a letter sent to my office stating how the violation was corrected. Please include with the letter the item number cited any documentation to support the corrective actions taken. Your letter should be received by my office on or before 5:00 pm December 24, 2025. The letter of correction can be emailed to me at rena.mccaffrey@dhhs.nc.gov. Technical Assistance: Today we discussed that diapers must be changed within a two-hour period or as needed. This action should be documented as it occurs so parents can see it. Documentation can be done by hand written forms or on “Bright Wheel: which this facility uses. Children can develop rashes when they are not changed after a bowel movement or urinating. A crying infant is an indicator of the child needing attention. This could be an indicator that the child needs to be fed, changed, is sick or just needs a hug. Staff should be responding to the infants’ needs because they cannot verbalize what they need. When lifting a child up teachers should always use two hands and never pick them up with one hand. This can cause the child’s elbow to pop out from being lifted improperly. While teachers find themselves rushing to get everyone taken care of during lunch and preparing for naptime. It is very important to be gentle when laying a child down on their mat/cot as to not scare them. Teachers should also encourage children to lay down on their own. Remember that children are not required to sleep. They are required to have rest time or quiet play during rest time. Handwashing is very important to keep germs from being spread around. Handwashing must be completed before and after eating times, messy play, diapering, when they enter a room, and before and after water play. Using a baby wipe to clean a child’s hands is a temporary method. Children must have their hands washed at a sink with running water, soap and a paper towel. When cleaning and disinfecting a table teachers should always use a clean paper towel to wipe the table and not use a wash cloth because they can harbor bacteria and can spread germs. You were provided with an opportunity to ask questions regarding childcare requirements. We discussed the items of noncompliance and the rationale of the rules. Corrective Action is required to promote a safe and healthy environment for children and to reduce the recurrence of noncompliance with childcare requirements. Please be aware that any information obtained during the investigation and any violations determined may be included in future Administrative Action. Completion of Immediate Corrective Action does not prohibit the Division from taking further action; however, successful completion of the items will be considered when determining appropriate case closure. This facility currently operates with a Five-Star Child Care License that was issued on July 13, 2022. The last Sanitation Inspection was completed on January 30, 2025, and received a “Superior” classification with thirteen (13) demerits. The last Fire Inspection was conducted on June 24, 2025, and the facility was approved for daytime care only. The last Fire Drill was conducted on October 20, 2025. The last Lock Down/ Shelter-in-Place was on August 27, 2025. The last Playground Inspection was conducted on October 20, 2025. Upon arrival, I was greeted by the director, Stephanie Barber. I stated the purpose of my visit and was assisted on a walkthrough where attendance was documented, and observations made. The children were observed participating in indoor free play. The infants were having tummy time and napping. Today, a partial assessment of applicable child care requirements was conducted, which included license posted, permit restrictions, supervision, staff/child ratio, qualified criminal background checks, staff training and general safety. The following violations were cited, and technical assistance was offered. Violation Number Comment Rule 721 All equipment and furnishings were not in good repair. Upon arrival I spoke with the new director, Christopher Moore, and discussed the purpose of my visit. The director and teachers were given the opportunity to respond to the allegations made. I conducted an assisted walkthrough of the facility along with the director. A partial assessment of child care requirements was monitored on this date. Allegation #1 Supervision: There is a concern for lack of supervision in the classroom. Observation: Today I monitored all classrooms in the center for supervision. Teachers were engaging with children and moving around the classroom. The concern was for a child that was injured in the two's classroom on 6/30/25 and the teacher could not explain the injury. When speaking to the director regarding the parent’s concern, the director and teacher stated that they always complete visual checks when children arrive and depart each day for any injuries or marks. An incident was not documented or given to the parent because the child did not have an injury that day. The director also stated that the parents are notified on "Bright Wheel" anything that occurs out of the unusual. This is a communication App that the facility uses daily. Conclusion: Based on interviews with the director, staff and observations made, this allegation is Unsubstantiated. Allegation #2 Staff to child ratios: Observation: There is a concern that classrooms are being combined and there is one (1) teacher overseeing an infant classroom of five (5) and toddler classroom of eight (8). Today I reviewed weekly attendance sheets for two months and staff in attendance on random days were chosen. All staff requirements were complying. However, during today’s visit the infant classroom and the toddlers’ classrooms were swapped. Infants were in space 3B, and the toddlers were in space 3A. The director stated the classrooms were moved this morning. In space 3B there are no handwashing sinks. Today I observed the video from 8:30 to 9:00 am and there were two staff members in the classroom with seven infants. One teacher walked over to the toddler space where the diaper changing tables and handwashing sinks are located. This left the other 6 infants with one staff member. Infant classrooms are required by sanitation to have two sinks for handwashing and diaper changing. Conclusion: Based on an interview with the director, attendance sheets for the months of May and June and staff hours monitored this allegation is Substantiated. The following violations were cited, and technical assistance was offered. Violation Number Comment Rule 301 Minimum staff/child ratios and group sizes for the number and ages of children in care were not met. The infant classroom was over ratio this morning at 8:45 when the teacher walked over to the toddler classroom to change a diaper, leaving one teacher in the class with six infants. Technical Assistance: Today I discussed with the director that Infant classrooms are required to have two sinks in them for handwashing and diaper changes. The classroom that the infants are in currently does not have a diaper changing table or sinks in it. The teachers must walk over to the toddler classroom to change diapers and wash their hands. Unless there are three teachers in the class they will continue to be out of ratio. The director stated that they will move the infants back to space 3A. For today the director has placed a third staff member in that classroom. I have left a preservice form for the new director today to be completed and returned to me as soon as possible. The last Annual Compliance visit was conducted on June 18, 2024. The North Carolina Department of Secretary corporation status was checked for this facility “Cradles 2 Crayons Development Center LLC.” on June 17, 2024, and was found to be current and active. Upon arrival I was greeted by the assistant administrator, Heather Barber. I stated my purpose for this visit and was assisted on a walkthrough of the facility where observations were made, and attendance was recorded. The children were engaged in free play in centers. The playground area was equipped with toys, sandbox, airplane bouncer, and playhouses. A checklist was used to note the requirements I monitored today. During today's visit, I completed a full assessment of applicable Child Care Requirements; license posted, restrictions maintained, staff/child ratio and adequate approved space, transportation, and program records. The facility currently operates with a Five-Star Center License that was issued on July 13, 2022. The last Sanitation Inspection was completed on January 30, 2025, and received a “Superior” classification with thirteen (13) demerits. The last Fire Inspection was completed on June 10, 2024, and was approved for daytime care only. The last Fire Drill was conducted on April 25, 2025. The last Lockdown Drill was conducted on March 7, 2025. The last Playground Inspection was conducted on April 24, 2025. North Carolina General Statute 110-90(4)(d) requires all child care centers to maintain a compliance history of at least seventy-five percent (75%) for the past eighteen months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the Department’s issuance of a provisional license or other administrative action against the center’s license. Your compliance history as of May 9, 2025, is 87%. Children’s Records and Staff and Training worksheets were reviewed per DCDEE Procedures. Today five (5) children’s files were monitored. Storage of hazardous items was monitored, and medications. No children were on medication at this time. This program had completed a water testing through “Clean Classrooms for Carolina Kids” on May 15, 2024. Today I monitored a 2010 Ford E350 Econoline Wagon, 15 passenger van with tag number PMY-6286 expiring in September 2024. This vehicle is insured through Allstate Insurance and is good through September 11, 2025. All four tire treads were checked and found to be in good condition. There was a mounted fire extinguisher and updated first aid kit in the front compartment of the van. The seats and seatbelts were also checked for safety purposes. When in use, emergency forms with children’s photos accompany the driver and a vehicle roster is checked daily. The director stated that this vehicle is only used during the school year for transporting children. NOTE: Effective April 1, 2022. The driver shall, (1) be 21 years old or a licensed bus driver. (2) have a valid driver's license of the type required under North Carolina Motor Vehicle Law for the vehicle being driven or comparable license from the state in which the driver resides; and (3) have no convictions of Driving While Impaired (DWI) or any other impaired driving offense within the previous three years. During today’s visit the following violations were cited and technical assistance was offered. Violation Number Comment Rule 807 A safe indoor and outdoor environment was not provided for the children. Located in the hallway by the bathrooms there was a leak in the ceiling that needs repaired and the ceiling tile needs to be replaced. 10A NCAC 09 .0601(a) 1032 Child care providers and uncompensated providers who are not substitute providers or volunteers, including the director did not have a medical report on file prior to employment that was signed by a health care professional and/ or the medical report was older than 12 months. Ms. P. Sheets did not have a complete medical on file. 10A NCAC 09 .0701(a) 1320 Children's records that include an application for enrollment, medical and immunization records, and permission to seek emergency medical care was not on file for each child. One child did not have a medical that was complete. The top portion of the medical must be completed by the parent. GS 110-91(1);.0302(d)(2); .0304(g) 1792 Staff did not model appropriate eating behaviors by consuming food or beverages that meet the nutritional requirements specified in the Meal Patterns for Children in Child Care Programs in the presence of children in care. In space 5 there were two sodas inside an unlocked cabinet that teachers were drinking from. There were lunch bags as well. .0901(i) The above violations must be corrected immediately. A Corrective Action Letter must be drafted with the name of your facility, the facility identification number, and your signature. The letter must be received by my office on, or before 5:00 pm May 27, 2025. All children’s medicals must have the top portion completed by the parent. In space 5 there were two sodas in an open cabinet that children could reach. There was a lunch bag as well. Please be reminded that teachers should be making healthy choices when eating or drinking in front of young children and not leave drinks or lunch bags where children can access them. All staff medicals must have a doctor’s signature on them and be complete physical to work with children. Reminders: Today during my visit, you have many new staff members. Please make sure all staff have new ongoing in-service forms completed with hire date at the top and required hours needed. You and your staff were provided with an opportunity to ask questions regarding interpretation and implementation of all child care requirements. The North Carolina Department of Secretary corporation status was checked for this facility “Cradles 2 Crayons Development Center LLC.” on June 17, 2024, and was found to be current and active. Upon arrival I was greeted by the assistant administrator, Heather Barber. I stated my purpose for this visit and was assisted on a walkthrough of the facility where observations were made, and attendance was recorded. The children were engaged in free play in centers. The playground area was equipped with toys, sandbox, airplane bouncer, and playhouses. A checklist was used to note the requirements I monitored today. During today's visit, I completed a full assessment of applicable Child Care Requirements; license posted, restrictions maintained, staff/child ratio and adequate approved space, transportation, and program records. The facility currently operates with a Five-Star Center License that was issued on July 13, 2022. The last Sanitation Inspection was completed on January 30, 2025, and received a “Superior” classification with thirteen (13) demerits. The last Fire Inspection was completed on June 10, 2024, and was approved for daytime care only. The last Fire Drill was conducted on April 25, 2025. The last Lockdown Drill was conducted on March 7, 2025. The last Playground Inspection was conducted on April 24, 2025. North Carolina General Statute 110-90(4)(d) requires all child care centers to maintain a compliance history of at least seventy-five percent (75%) for the past eighteen months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the Department’s issuance of a provisional license or other administrative action against the center’s license. Your compliance history as of May 9, 2025, is 87%. Children’s Records and Staff and Training worksheets were reviewed per DCDEE Procedures. Today five (5) children’s files were monitored. Storage of hazardous items was monitored, and medications. No children were on medication at this time. This program had completed a water testing through “Clean Classrooms for Carolina Kids” on May 15, 2024. Today I monitored a 2010 Ford E350 Econoline Wagon, 15 passenger van with tag number PMY-6286 expiring in September 2024. This vehicle is insured through Allstate Insurance and is good through September 11, 2025. All four tire treads were checked and found to be in good condition. There was a mounted fire extinguisher and updated first aid kit in the front compartment of the van. The seats and seatbelts were also checked for safety purposes. When in use, emergency forms with children’s photos accompany the driver and a vehicle roster is checked daily. The director stated that this vehicle is only used during the school year for transporting children. NOTE: Effective April 1, 2022. The driver shall, (1) be 21 years old or a licensed bus driver. (2) have a valid driver's license of the type required under North Carolina Motor Vehicle Law for the vehicle being driven or comparable license from the state in which the driver resides; and (3) have no convictions of Driving While Impaired (DWI) or any other impaired driving offense within the previous three years. In the two year old classroom there were only five books in poor repair for the children to use. This classroom had 13 children enrolled. In the four and five year old classroom there were four cardboard blocks ripped and children could not use them to build. This is not enough for three children to build with in the block area. GS 110-91(12);10A NCAC 09 .0509(1) 540 An individual written feeding plan was not provided by child's parent or health care provider or was not followed and posted. (omit posting for centers located in a residence) There was no feeding schedule posted in the infant classroom. 10A NCAC 09 .0902(a) 542 The written feeding plan was not modified as the child's needs changed. The parent did not sign the feeding plan. 10 NCAC 09 .0902(a) 604 Lavatories were not kept clean, in good repair and kept free of storage. A toilet was not in working order and there were two bolts on each side of the toilet that need to be cut down and caps placed over them. This classroom connects the two year old classroom and to the four year old classroom. 15A NCAC 18A .2818(a) 615 Beds, cots and mats were not in good repair, properly handled, stored, or clean and sanitized between users. Cots were in poor repair. The mesh part of the cots were worn. 15A NCAC 18A .2821(a) 705 Equipment and furnishings were not sturdy, stable and free of hazards. An airplane rocker outside had nails protruding out on them. This was corrected during my visit. There was a sand box that had no cover on it and had red ants inside of it. There was a four seat bouncer that had paint chipping off of it and was rusted in need of repair. .0601(c) 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. In the van inside of the first aid box was a small bottle of "red oil surgical dressing" that had two warnings on it. .2820(b) The above violations must be corrected immediately. A Corrective Action Letter must be drafted with the name of your facility, the facility identification number, and your signature. The letter must be received by my office on, or before 5:00 PM July 1, 2024. The letter should include each item’s number of noncompliance cited, describe how and when the violations were corrected. Technical Assistance: Today we discussed sandboxes must be covered to keep vermin and animals out of them. There were raised bolts on the airplane outside that were protruding out, but they were hammered down by the repair man while I was present. We talked about several resting cots that were very worn and the mesh had collapsed so children would not be above the floor level when sleeping in them. All lesson plans must be posted each week on Monday mornings for parents to read. All feeding schedules must be signed by the parent on the child’s enrollment day. The two-year-old classroom only had five (5) books that were in poor repair for a classroom of thirteen (13) enrolled students. There were several cardboard blocks that were in poor repair and not enough to make a set or children to build with. Toys and materials should be in good repair and checked daily for items that are broken. One toilet in the bathroom that two classrooms use was unable to flush and the bolts on the side of the toilet were raised and could harm a child. This left only one toilet for both classrooms to use. The van should be kept free of harmful products where children are present. You and your staff were provided with an opportunity to ask questions regarding interpretation and implementation of all child care requirements. Child care licensing rules and regulations are established to ensure a safe and healthy environment for children in care. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your program. It is your responsibility to always maintain compliance with all the applicable laws and rules. The best way for you to make sure that you are meeting all requirements is to periodically review the child care law and rules. I stated my purpose for this visit and was assisted on a walkthrough of the facility where observations were made, and attendance was recorded. The children were engaged in free play in centers. The playground area was equipped with riding toys, sandbox, airplane bouncer, and playhouses. A checklist was used to note the requirements I monitored today. During today's visit, I completed a full assessment of applicable Child Care Requirements; license posted, restrictions maintained, staff/child ratio and adequate approved space, transportation, and program records. The facility currently operates with a Five-Star Center License that was issued on July 13, 2022. The last Sanitation Inspection was completed on January 23, 2024, and received a “Superior” classification with eleven (11) demerits. The last Fire Inspection was completed on June 10, 2024, and was approved for daytime care only. The last Fire Drill was conducted on June 4, 2024. The last Lockdown Drill was conducted on April 9, 2024. The last Playground Inspection was conducted on June 5, 2024. North Carolina General Statute 110-90(4)(d) requires all child care centers to maintain a compliance history of at least seventy-five percent (75%) for the past eighteen months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the Department’s issuance of a provisional license or other administrative action against the center’s license. Your compliance history as of June 17, 2024, is 94%. Children’s Records and Staff and Training worksheets were reviewed and found to be in compliance. Today six (6) children’s files were monitored and found to be in compliance. Storage of hazardous items was monitored, and medications, over-the-counter medicine and diaper creams were monitored. This program had completed a water testing through “Clean Classrooms for Carolina Kids” on May 15, 2024. They are still awaiting the results. Today I monitored a 2010 Ford E350 Econoline Wagon, 15 passenger van with tag number PMY-6286 expiring in September 2024. This vehicle is insured through Allstate Insurance and is good through September 11, 2024. All four tire treads were checked and found to be in good condition. There was a mounted fire extinguisher and updated first aid kit in the front compartment of the van. Seats and seatbelts were also checked for safety purposes. When in use, emergency forms with children’s photos accompany the driver and a vehicle roster is checked daily. The director stated that this vehicle is only used during the school year for transporting children. NOTE: The driver shall, effective April 1, 2022. (1) be 21 years old or a licensed bus driver. (2) have a valid driver's license of the type required under North Carolina Motor Vehicle Law for the vehicle being driven or comparable license from the state in which the driver resides; and (3) have no convictions of Driving While Impaired (DWI) or any other impaired driving offense within the previous three years. During today’s visit the following violations were cited and technical assistance was offered. Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. In the school age classroom there was not a current lesson plan up. GS 110-91(12); .0508(a) 432 The center did not have developmentally appropriate equipment and materials accessible daily. In the two year old classroom there were only five books in poor repair for the children to use. This classroom had 13 children enrolled. In the four and five year old classroom there were four cardboard blocks ripped and children could not use them to build. This is not enough for three children to build with in the block area. (omit posting for centers located in a residence) There was no feeding schedule posted in the infant classroom. 10A NCAC 09 .0902(a) 542 The written feeding plan was not modified as the child's needs changed. The parent did not sign the feeding plan. 10 NCAC 09 .0902(a) 604 Lavatories were not kept clean, in good repair and kept free of storage. A toilet was not in working order and there were two bolts on each side of the toilet that need to be cut down and caps placed over them. This classroom connects the two year old classroom and to the four year old classroom. 15A NCAC 18A .2818(a) 615 Beds, cots and mats were not in good repair, properly handled, stored, or clean and sanitized between users. Cots were in poor repair. The mesh part of the cots were worn. 15A NCAC 18A .2821(a) 705 Equipment and furnishings were not sturdy, stable and free of hazards. An airplane rocker outside had nails protruding out on them. This was corrected during my visit. There was a sand box that had no cover on it and had red ants inside of it. There was a four seat bouncer that had paint chipping off of it and was rusted in need of repair. .0601(c) 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. In the van inside of the first aid box was a small bottle of "red oil surgical dressing" that had two warnings on it. .2820(b) The above violations must be corrected immediately. A Corrective Action Letter must be drafted with the name of your facility, the facility identification number, and your signature. The letter must be received by my office on, or before 5:00 PM July 1, 2024. The letter should include each item’s number of noncompliance cited, describe how and when the violations were corrected. All lesson plans must be posted each week on Monday mornings for parents to read. All feeding schedules must be signed by the parent on the child’s enrollment day. The two-year-old classroom only had five (5) books that were in poor repair for a classroom of thirteen (13) enrolled students. There were several cardboard blocks that were in poor repair and not enough to make a set or children to build with. Toys and materials should be in good repair and checked daily for items that are broken. One toilet in the bathroom that two classrooms use was unable to flush and the bolts on the side of the toilet were raised and could harm a child. This left only one toilet for both classrooms to use. The van should be kept free of harmful products where children are present. You and your staff were provided with an opportunity to ask questions regarding interpretation and implementation of all child care requirements. Child care licensing rules and regulations are established to ensure a safe and healthy environment for children in care.
