The entire home is licensed for child care and must meet the applicable child care requirements. Although you designated space to be used for child care in a specified section of your home, the license is issued for the entire location. Any monitoring visit conducted may include spaces other than those you designated for child care. Upon arrival, you were not present. A lady, whom you stated provides cleaning services for you, was present. She allowed me to enter the residence. I asked her to contact you to notify you of my presence at your residence. She spoke with you and told you I was present. I also called you and spoke with you to notify you of the purpose of my visit. When asked, you stated I could begin reviewing facility records that were in a file box and notebook on a child sized table in the room you have designated for child care. I began reviewing records before you arrived. You arrived shortly afterwards and remained at the residence for the duration of the visit. During the visit, J.Parks, arrived and remained at the residence for the duration of the visit. Both you and Mr. Parks are listed as members of the LLC that owns Heavenly Hands. The LLC is: Heavenly Hands Home Childcare LLC. According to the NC Secretary of State’s website, this LLC is current and active. Ensure the LLC remains current and active. No children were present today. When asked, no children are currently enrolled. You stated you are planning to begin enrolling children after January 1, 2026. We discussed operating legally and not being regulated if you decided to terminate the family child care home license. We reviewed the definition of a child care arrangement. Continue to keep me updated on the operational status of your family child care home. Please contact me when you enroll a child. Your program currently operates with a Probationary License that is effective through December 9, 2025. We reviewed the Rated License today and completed the applicable forms to process the rated license based on the previous points and star rated license you were operating with prior to the issuance of the Probationary License. The last annual compliance visit was conducted on September 7, 2023. The following violation was documented and verified as corrected during the visit. You do not have to submit a compliance letter addressing the correction of the violation since it was corrected during the visit. Violation Number Comment Rule 904 Documentation of the operator’s emergency medical care plan to follow in the event of a child medical emergency, was not on file and available for review. The Operator's emergency medical care plan was not on file nor available for review. .1713 Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4)(d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. The violation documented today may affect this facility’s compliance history score. OWNER/FACILITY PROFILE INFORMATION: This facility is owned by Heavenly Hands Home Childcare LLC. You and Mr. Parks are the two members of the LLC. According to the NC Secretary of State’s website, this LLC is current and active. Ensure the LLC remains current and active. HOUSEHOLD MEMBERS: The following people reside in the home: C.Sharp, son, B.Coley, son, and R.Butler, daughter. Both C.Sharp and R.Butler have currently criminal background check qualification letters on file. Mr. Parks, part owner of the LLC, has a currently criminal background check qualification letter. All applicable criminal background check qualification letters were on file and reviewed today. TECHNICAL ASSISTANCE/CONSULTATION: EMERGENCY MEDICAL CARE PLAN: When asked, you were not sure where your Emergency Medical Care Plan was located. We both checked your posted items/forms. You looked through the file box and a notebook for a copy of your developed Emergency Medical Care Plan. I showed you what the Emergency Medical Care Plan looked like by accessing the FCCH Provider Documents and Forms via the Division of Child Development and Early Education’s website. I printed a blank copy of the form and gave it to you today. You completed the form during the visit; therefore, the violation documented was verified as corrected during the visit. Moving forward, ensure all required information is posted and available for review. It was discussed to review what you have posted and use the FCCH Program Records Checklist as a guide to ensure all applicable information is completed, on file or posted, and available for review. ON-GOING TRAINING REQUIREMENTS: We reviewed what training you have recently completed. We discussed that you now are required to complete at least 8 hours of on-going training per year since you have obtained an associate’s degree in applied science. We discussed ensuring you complete all required ongoing training hours before June 1st of each year since that is when the Probationary License was issued. You have completed seven (7) ongoing training hours thus far. WORKS INFORMATION: I asked that you submit your most current official transcripts to DCDEE’s Workforce Education Unit so that your most current education can be evaluated. We also discussed submitting Mr.Parks’ official transcripts and completing a WORKS account for him so that his education can be evaluated. When asked, he has a bachelor’s degree in criminal justice and an associate’s degree in social work. You can access the WORKS portal from DCDEE’s website and clicking on the “Services” tab then click on the “DCDEE WORKS” tab. You will see a link to access the WORKS portal. You must use your individual NCID and password to access your WORKS account. DCDEE MOODLE: You can access free approved training via DCDEE Moodle. You can access DCDEE Moodle from DCDEE’s website. Click on the “Services” tab then click on “DCDEE Moodle”. To access trainings, you have to log in using your individual NCID and password. You can complete the required Health and Safety trainings via DCDEE Moodle for free. You can also complete other approved training from DCDEE Moodle. You will need to complete the ABCMS Moodle training regarding how to set up an ABCMS roster to connect yours and your household member’s criminal background check qualification letters and Mr. Parks’ letter. ABCMS PORTAL: -As stated in G.S. 110-90.2 & .2703(r) child care operators are to notify the Division of any new child care providers working who were hired within five business days. -The process of notifying the Division has changed and is now captured in ABCMS. This change has been in effect since February 2024. Effective immediately, you will need to use the facility’s Business NCID and complete Provider Portal training in Moodle at https://www.dcdee.moodle.nc.gov/course/view.php?id=119. -Once the training has been completed and access has been given, you must verify your facility roster to ensure current staff/household members are noted on the roster. This information should be updated in ABCMS in an ongoing basis as staff members are hired and when their employment is terminated. This satisfies the requirement to notify the Division of new child care providers working who were hired or moved into the child care facility within five business days. Should you need assistance please contact the Criminal Background Check Unit at (919)814-8401 and someone will assist you. TRANSPORTATION: You stated you do not provide transportation. ITS-SIDS TRAINING: Ensure you complete the ITS-SIDS training on or before March 8, 2026. Mr. Parks is required to complete the training on or before November 2, 2026. We discussed going ahead and registering to complete an ITS-SIDS training soon. You can search for any Child Care Resource and Referral’s Professional Development Calendar to see when the next ITS-SIDS training is being offered. You can complete any training via any Child Care Resource and Referral Agency. Maintain certificates of completion on file for review. QRIS CONVERSATION TEMPLATE: During a future visit, more information will be discussed from Section .3200 of the child care requirements pertaining to the star rated license. We reviewed there are three (3) pathways for the star rated license that became effective July 1, 2025. You can review information regarding QRIS Modernization by accessing the “QRIS Modernization” tab under the “What’s New” tab from DCDEE’s website. RATED LICENSE ASSESSMENT: The required paperwork will be submitted and processed to take this facility back to a star rated license after operating with a Probationary License that is effective through December 9, 2025. The below pertains to the facility’s last rated license assessment: Program Standards: This facility currently meets all minimum licensing requirements. The Family Child Care Environment Rating Scale was completed June 2, 2022, and a score of 4.11 was earned. The application for a Two Component Star Rated License was reviewed and completed today. The Assessment for a Two Component Star Rated License was reviewed and signed today as well. Ms. Coley has previously provided written documentation and verification she has completed a three-month self-study and self-assessment using the FCCERS-R. According to this information, it appears this facility is eligible for 3 points in Program Standards. Education Standards: According to the information listed in WORKS, Ms. Coley earned LT equivalency and has completed an additional 33 semester hours in Early Childhood Education coursework. Ms. Coley currently has 24 years of verifiable ECE work experience. Ms. Coley has obtained an associate’s degree in applied science, but this information has not been verified via the Workforce Education Unit. Tina Jones, Child Care Consultant, accompanied me during today's visit. A household member accompanied us during the walk-through of the facility. During the visit, I discussed the allegations with Shuana Coley, operator, and two additional caregivers. I also provided the Summary Suspension and Summary Suspension Delivery Information form. Violation Number Comment Rule 407 Operator was not the person on-site, providing care to children. During today's visit, and other unknown dates, the operator was not the person on-site and providing care to children. GS 110-91(8) 720 Adequate supervision was not provided for children in the Family Child Care Home. During today's visit, staff did not provide adequate supervision to the operator's four-year-old child. Throughout most of the visit, the child remained in the child's bedroom. .1711(a) 723 Tobacco products were not in locked storage. During today's visit, cigarettes were observed not in locked storage. .1719(a)(10) 724 Operator and / or staff were smoking, using e-cigarettes, smokeless tobacco or another product containing, made, or derived from tobacco during operating hours. Operator and/or staff were smoking cigarettes on the premises during operating hours. .1719( a)(10) 1007 Discipline was not appropriate for the child's age and development. A staff member placed a two-year-old child in timeout for five minutes. .1722(b) 1409 Operator did not provide a physically safe and healthy indoor and outdoor environment that meets the developmental needs of the children in care. During today's visit, children had access to marijuana and alcohol. 10A NCAC 09 .1719 (a) 1852 There was a substantiation of child maltreatment. Pursuant to its investigation, the Division has confirmed sufficient information to determine child maltreatment. 110-105.6(a) 1942 Children were not cared for in a smoke free and tobacco free environment. You, S. Coley, owner/operator, and your substitute, B. Darling were present today. A checklist was used to note the requirements I monitored today. The Operator’s Statement of Responsibility, and Verification of Required Information forms were completed during the visit. Currently, this family child care home operates with a Four- star License, issued August 1, 2022, earning six (6) points in the Education Component, three(3) points in the Program Component and one (1) Quality point for limiting the number of infants enrolled to no more than two. The last Annual Compliance Visit was completed on September 13, 2022. The last fire drill was completed on August 28, 2023. The last shelter-in-place/lockdown drill was completed on July 12, 2023. The last outdoor inspection was completed on August 28, 2023. No enrolled children were present today. You stated that you have one (1) preschool child enrolled on first shift and four (4) school-age children enrolled that attend before and after school. I observed the arrival and departure log. The program has maintained an 18-month compliance score of 88%. A copy of the compliance history was left with you. This facility is owned by Heavenly Hands Home Childcare LLC and is current and active as of today per the information reflected from the NC Secretary of State’s website. Continue to ensure this LLC remains current and active to ensure this business has a current owner. If the LLC is not in good standing with the NC Secretary of State, this could impact the child care license and some type of administrative action may be imposed. A copy of this computer- generated visit summary will be emailed to you. Due to technical issues, a one page visit summary was completed; however, all violations were reviewed with you at the conclusion of the visit. I used the Annual Compliance Monitoring Checklist for Family Child Care Homes and the Item Number Listing (DCD 0357) as a basic monitoring tool to assess compliance with all applicable child care requirements. A signed and dated letter of compliance must be mailed or emailed to me by September 21, 2023, describing how and when the violations were corrected. This two-week time frame is established to allow you time for submitting your compliance letter and is not intended to be used as a guide for correcting violations, as they should be corrected immediately. It is your responsibility to maintain compliance with the applicable laws and rules; always whether they have been monitored or specifically discussed with you in the past. The best way for you to ensure that you are meeting all requirements is to periodically review the childcare laws and rules on the Division of Child Development and Early Education’s website. PROGRAM RECORDS: We discussed that your majority of your violations pertain to paperwork and program requirements. We discussed you spending some time organizing your paperwork and file to ensure you maintain compliance with program records. I encouraged you to print the staff, children, substitute, and program records checklists from the Division's website and utilize those checklists to ensure timeframe requirements and compliance are maintained. The following violations were documented: -Orientation was completed with the substitute caregiver prior to providing care. -Proof of a negative TB test or screening was not provided by the substitute prior to providing care. -A Health Questionnaire was not completed for the substitute caregiver. -There was no documentation verifying that the EPR plan was reviewed with the substitute caregiver. -The substitute caregiver did not complete the required Recognizing and Responding to Suspicions of Child Maltreatment training. This training is required to be completed within 90 days of employment. -An activity with at least four different activities daily was not available for review.
