The center went through a change of ownership and was issued a temporary license April 2025 and was issued a 4-star, pathway 2-Classroom & instructional Quality license on 10-17-25. Today, was my first visit to the center under the new ownership. The center operates at 25 ft. inside, & ratios at in rule.3208 (b). My visit was conducted with Aimee, Director. A checklist was used to note the requirements monitored. The children were observed playing outside, participating in teacher-directed activities, preparing for lunch and taking. VERIFICATION OF RECORDS: *Last fire inspection=4-30-25 and the last sanitation inspection was on 9-16-25 (send me all inspections within 5 days of completion & remember these must be completed within 365 days). *EPR training was completed by Aimee on 12-10-20. The EPR was updated on 12-11-25. *The last playground inspection was on 3-20-26 by Aimee. Aimee completed playground safety training on 3-18-17. *The well water analysis will expire 3-31-28 and the last lead water test will expire 6-30-26. *The Secretary of State’s website was checked and FB & MV, Inc. was listed as current/active. Technical Assistance was offered how to correct the violations cited and how to maintain compliance. To maintain compliance with NC laws and rules regarding childcare operation, the following violations must be corrected immediately. Email a corrective action letter BY 4-28-26 to michelle.ezzell@dhhs.nc.gov A corrective action letter means you have corrected all the items of non-compliance and is a legal document. If I do not receive your letter within the established time, a return visit will be made, and additional violations may be documented. The Division of Child Development & Early Education may deny, suspend, terminate, or revoke any permit to operate (10A NCAC 09 .2000). Violation Number Comment Rule 812 Electrical outlets and power strips, not in use, which were located in space used by children did not have safety outlets or were not covered with safety plugs unless located behind furniture or equipment that cannot be moved by a child. In space three and seven, two (2) unused outlets were uncovered. 10A NCAC 09 .0604(c) 828 Air conditioning units were accessible or did not have a guard to keep objects from being thrown into the unit. The fence around the air conditioner units that’s located on the playground did not have a lock on the gate. .0604 (m) 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. Two five-gallon buckets of paint (to paint concrete) were not properly stored. They were on the deck leading to the playground and accessible to the children. .2820(b) 849 Leftover medicines were not returned to the parent after the course of treatment was completed, after authorization was withdrawn or after authorization had expired and/or medication was not discarded within 72 hours of completion of treatment or withdrawal of authorization. In space one, a child had Aveeno Sunscreen, the permission to administer medication form expired on March 31, 2026. .0803(12) 9999 15 A NCAC 18A-Locked storage rooms and cabinets shall include those which are unlocked with a combination lock, electronic or magnetic device, keypad, key, or equivalent locking device. Keys and electronic or magnetic unlocking devices shall be kept out of the reach of a child and shall not be stored in the lock. In space 5, classroom for infants. There was a plastic bag, gallon size ziploc bag and construction paper wrapped in plastic wrap. There was an unapproved lock on the cabinet. *****TECHNICAL ASSISTANCE/REMINDERS: ******* *Before today’s visit, I checked the ABCMS database. I reminded Aimee to add Diane once she starts working with the children and the owner to this roster. *****WALK-THRU****** *STORAGE OF HAZARDOUS ITEMS: Intentional planning of the environment ensures a safe environment has been created which prevents and reduces injuries to children. Items that require locked storage must be properly stored. This includes unlocked cabinets in classrooms as well as storing items such as paint cans outside and area outside where the mops and chemicals are stored. It is extremely important that staff take the required time to lock doors and store hazardous items properly. *APPROVED LOCKS: Approved locks include, lock and key, combination lock, magnetic lock or keypad lock. Approved locks are listed in your sanitation regulations. *ELECTRICAL OUTLETS: Approximately 2,400 children are injured annually by inserting objects into the slots of electrical outlets. For this reason, all electrical outlets, including those on power strips that are not in use, that are in areas accessible to children, must be protected with a safety plug or should be classified as a tamper-resistant electrical outlet. Consider adding a note near the outlets to serve as a reminder to re-cover the outlets. Review this with teachers during orientation as part of the observation of daily routines. *MEDICATIONS: Any medication on the premises must be labeled with the child’s name, be accompanied by a permission slip, filled out completely with the parent/guardian’s signature and date. Set a reminder to review/update medications in each classroom. Use of written parent/guardian consent (permission) forms for each medication must be current. Ask staff to check the permission slips weekly to verify the permission slips are current. *****************SESSION LAW 2025-36: *************************** During my walk-thru today I was informed the center implemented session law 2025-36 without notifying me or LeAnne Simpkins, Lead Consultant. This law has not yet been added to child care rules and programs should notify consultants of the desire to meet the group sizes in this law. Staff/child ratios were posted showing the enhanced ratios for rule .3208 (b) Aimee printed this document from DCDEE’s website. INFANTS: The staff/child group size for this classroom is 2:10 -Rule .3208 (b). Session Law 2025-36 allows for a maximum group size of 15, provided space, materials, and staff are available. The classroom for infants (space 5) has a maximum capacity of 21. There were twelve (12) infants enrolled with three (3) staff members. Today, there were 12 infants and 1 toddler present. The toddler was visiting from the classroom for toddlers (space 6). We discussed how busy infants and toddlers are and both of these classrooms are very busy. I reminded staff to stay within arm’s reach of a child self-feeding in a highchair. One staff member was changing diapers, another was on the floor with several babies, another was in a rocking chair holding a baby. There was not a separate space for non-mobile babies to be separated from crawler/walkers. I suggest trying to rearrange the classroom to allow additional toys and additional floor space. There are 12 cribs, three are evacuation cribs. There are cubbies for each infant’s belongings and the room in the refrigerator (although it was full). I talked with the director and Ms. Diane (the owner’s mother) about hiring a 4th staff member for this classroom. Ms. Diane said she was going to talk to the owner about hiring a 4th staff member for the infant room. TODDLER CLASSROOM: The staff/child group size for this classroom is 2:12-Rule .3208 (b). Session Law 2025-36 allows for a maximum group size of 18, provided space, materials, staff are available. The classroom for toddlers (space 6) has a maximum capacity of 21 with eighteen (18) toddlers enrolled with three (3) staff members. Today only 2 staff were present and 1 was a substitute with eleven (11) toddlers present. I talked with Aimee and the teachers talked about where additional cots go and how they fit eighteen (18) when all children are present. I facetimed my supervisor, Michele Remington, for her opinion and to allow Aimee an opportunity to ask her questions. During the conversation, it appears that sixteen (16) cots will be the maximum amount the room can accommodate and keep the fire evacuation pathway clear (to the back door). The classroom has enough space for 18 cubbies, and there were ample amount of toys. Michele Remington and I explained to Aimee that she/they have not done anything wrong, however DCDEE is still working on implementation of the law, and it has not been put into Child Care Rules yet. M. Remington explained she will send this information to DCDEE for review. We explained to Aimee not to enroll any additional children in either classroom until further notice. Aimee agreed and I discussed my concerned with “staff burn-out”. Ms. Diane stated she would help in the classrooms if needed. She currently has a current TB test and CBC qualifying letter. I explained before she can assist in the classrooms she must have a completed file at the center. Aimee stated she will look on DCDEE’s website and download the volunteer checklist and create a file for her. I spoke with Aimee, Director and asked her not to enroll anymore infants and toddlers (space 5 and 6). Aimee agreed and stated in May 2026, five (5) toddlers will be turning two-years old, and they can transition to classroom three (3). This will change the enrollment from 18 to 13 toddlers. A temporary license was issued April 16, 2025 through October 16, 2025. The facility was approved to care for 115 children on first shift only. Upon arrival, I was greeted by the assistant director, Pam O’Neal. The director was in the kitchen preparing lunch. I monitored six classrooms for staff/child ratios, group sizes, capacity, supervision, discipline, interactions, postings, materials, health and safety and sanitation requirements. As we visited classrooms I confirmed that you are currently following minimum space requirements and enhanced ratios. You are following capacity guidelines for 25 sq. ft. per child. We reviewed staff/child ratio group size changes for infants and toddlers. The same ratios are in place, 1:5 for infants and 1:6 for one year old children. The group sizes for infants increased to 15 infants and the group sizes for one year old children increased to 18. Children were observed playing outside, having group circle time dancing to music, playing with table top toys, and exploring materials. Teachers were interacting with the children as they played and had group time. I monitored the outdoor play areas during today’s visit. The areas need more shade so the materials children use won’t be sitting in direct sunlight. The materials and equipment that are in direct sunlight gets very hot. Right before the children go outside to play, check seats, slides, handlebars and any surface a child can touch to be sure it isn’t too hot for them to use. If you have to lift your hand quickly, it is too hot for the children to use. It only takes a couple of seconds to cause second and third degree burns. While outside, you asked about water play. You can provide water play within the fenced in outdoor play area. You specifically asked about using a tarp with a sprinkler but you were concerned about the water pooling on the tarp. It is okay as long as the water can flow off of the tarp or it is a small amount. Water that collects can create an unsafe environment for children. Slip and slides, sprinklers, and spray bottles may be used for water play. We also discussed using the back grassy area behind the fenced in play area for water play. You can have these types activities outside the fenced area but each child is required to have permission to be outside of the fenced area. Outdoor inspections and fire drills were completed as required. I reviewed 6 staff files. Four of the staff were listed on the staff and training worksheets. Two of the staff were not listed on the staff and training worksheets. Both staff members have been employed for less than two weeks. I reviewed twenty children’s records today. A children’s records checklist was reviewed and left with you to show files reviewed. Reminder: When a child has a medical action plan, it must be attached to the child’s application. Permission to administer is totally different than the medical action plan. You printed a copy of the permission form during today’s visit. Continue working on adding staff to ABCMS. A temporary license was issued effective April 16, 2025 through October 16, 2025. The center is licensed for 115 children aged 0-12 years old on first shift only. I explained that I would visit three classrooms today. A classroom for infants, a classroom for toddlers and one classroom for preschool age children 2-5 years old. I explained that I would review three children’s records, one file from each classroom monitored. I explained that I would review the staff files for the teachers in the classrooms monitored along with the administrator’s files. I verified attendance records, fire drills, outdoor inspections, incident reports/incident logs, and the menu. The menu met the requirements for the meal patterns for children and was current. The last fire drill was conducted 5/30/25 at 9:30am. A shelter in place drill was conducted 3/5/2025. A lock down drill or shelter in place drill will need to be conducted by June 5, 2025. The incident reports were filed in a notebook with the log at the front of the file. The temporary license, emergency telephone numbers, emergency medical care plan, menu, safe arrival and departure procedures and the NC Summary of the Law were posted. Space 5: Classroom for infants-Two teachers present with eleven children ages 0-1 year old. The maximum group size when infants are in care is no more than 10. It is important to maintain staff/child ratios and group sizes from open to close daily so supervision is provided and children are kept safe. It is hard to maintain applicable childcare requirements when there are more children present than is allowed. The teacher in the classroom stated she notified the administrative staff. Diaper creams were found to have appropriate documentation from parents. The activity plan was posted along with staff/child ratios, safe sleep poster and safe sleep policy. Two refrigerators were located in the classroom for infants. The refrigerator closest to the wall needs a thermometer to show that the temperature is 45 degrees or less. Safe sleep checks were completed and documented every 15 minutes for infants under one year old. Feeding schedules were posted on the wall in the classroom by the refrigerators. Space 6: Classroom for toddlers: Two teachers present with 11 children that were one to two years old. The maximum group size when one year old children are in care is 12. All applicable child care requirements were in compliance. Space 3: Classroom for 2 and 3 year old children: Two teachers were present with eighteen children ages 2 to 3 years old. Outdoor play areas: No concerns with the outdoor play area during today’s visit. Pam was busy cleaning out the storage building and had items stacked under a shelter that was covered with plastic. She plans to move the items today during her lunch break. Children were observed playing outside today. Reminder to check the temperature of surfaces before children go outside to play. Just because it isn’t hot outside, surfaces that are in direct sunlight can be very hot. The dark colored mulch on the side play can also be too hot for bare skin. Reminders: Inspections must be completed by July in order for the star rated license to be processed before the temporary license expires. The fire inspection was completed 4/30/2025. A copy of the inspection was received today. Seven staff files were reviewed during today’s visit. The health questionnaires will need to be updated soon. I verified that the agencies used for CPR and first aid training were not approved. (New Life CPR, International CPR Institute, National CPR Foundation) Seven staff members had a certificate from one of the above agencies. At least one person needs to be present with CPR and first aid training from an approved agency from open to close every day. A temporary license was issued effective April 16, 2025 through October 16, 2025. The center is licensed for 115 children aged 0-12 years old on first shift only. I explained that I would visit three classrooms today. A classroom for infants, a classroom for toddlers and one classroom for preschool age children 2-5 years old. I explained that I would review three children’s records, one file from each classroom monitored. I explained that I would review the staff files for the teachers in the classrooms monitored along with the administrator’s files. I verified attendance records, fire drills, outdoor inspections, incident reports/incident logs, and the menu. The menu met the requirements for the meal patterns for children and was current. The last fire drill was conducted 5/30/25 at 9:30am. A shelter in place drill was conducted 3/5/2025. A lock down drill or shelter in place drill will need to be conducted by June 5, 2025. The incident reports were filed in a notebook with the log at the front of the file. The temporary license, emergency telephone numbers, emergency medical care plan, menu, safe arrival and departure procedures and the NC Summary of the Law were posted. Space 5: Classroom for infants-Two teachers present with eleven children ages 0-1 year old. The maximum group size when infants are in care is no more than 10. It is important to maintain staff/child ratios and group sizes from open to close daily so supervision is provided and children are kept safe. It is hard to maintain applicable childcare requirements when there are more children present than is allowed. The teacher in the classroom stated she notified the administrative staff. Diaper creams were found to have appropriate documentation from parents. The activity plan was posted along with staff/child ratios, safe sleep poster and safe sleep policy. Two refrigerators were located in the classroom for infants. The refrigerator closest to the wall needs a thermometer to show that the temperature is 45 degrees or less. Safe sleep checks were completed and documented every 15 minutes for infants under one year old. Feeding schedules were posted on the wall in the classroom by the refrigerators. Space 6: Classroom for toddlers: Two teachers present with 11 children that were one to two years old. The maximum group size when one year old children are in care is 12. All applicable child care requirements were in compliance. Space 3: Classroom for 2 and 3 year old children: Two teachers were present with eighteen children ages 2 to 3 years old. Outdoor play areas: No concerns with the outdoor play area during today’s visit. Pam was busy cleaning out the storage building and had items stacked under a shelter that was covered with plastic. She plans to move the items today during her lunch break. Children were observed playing outside today. Reminder to check the temperature of surfaces before children go outside to play. Just because it isn’t hot outside, surfaces that are in direct sunlight can be very hot. The dark colored mulch on the side play can also be too hot for bare skin. Reminders: Inspections must be completed by July in order for the star rated license to be processed before the temporary license expires. The fire inspection was completed 4/30/2025. A copy of the inspection was received today. Seven staff files were reviewed during today’s visit. The health questionnaires will need to be updated soon. I verified that the agencies used for CPR and first aid training were not approved. (New Life CPR, International CPR Institute, National CPR Foundation) Seven staff members had a certificate from one of the above agencies. At least one person needs to be present with CPR and first aid training from an approved agency from open to close every day. All staff have 90 days from April 17, 2025 to complete CPR and first aid training through an approved agency. A document, 'Be a Smart Consumer of First Aid and CPR training' was emailed to you after the visit. I reviewed three children’s records. One child was missing the safe sleep policy. One child was missing the medical and immunization records. A copy of the records must be on file, parents cannot fill out the immunization form. One child was missing emergency contact information. All staff had CPR and first aid training through an unapproved agency that was completed through distance learning.
