I also monitored for compliance of child care requirements for an increase in capacity permit change. You, Annette Samuels, Owner/Operator, assisted me with the visit today. The Secretary of State website was checked on October 29, 2025, and your business Phenomenal Kids Child Care Services LLC, is active and in good standing. If any changes to the corporation need to be made or you decide to sell your business, then you must notify me, Tiffani Sims, at least thirty days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location, or inherited. The facility currently operates with a four-star rated license issued on July 12, 2024, The program's license restrictions include the following: maximum of 5 preschool children at any time, children in care on ground level only, daytime care, second shift, and fireplace/woodstove not used during operating hours. You stated you have six (6) children enrolled and one (1) child was present during the monitoring visit today. I observed the children present during indoor free play, lunch, and naptime The last annual compliance visit was conducted November 7, 2024. No children were enrolled on 2nd shift or third shift. You visited each indoor and outdoor space with me. A checklist was used to note the requirements I monitored today. Age-appropriate toys and materials were available. Fire/Emergency Drills/Playground Inspections: A fire drill was completed on October 10, 2025, and recorded at 3:45pm. The last monthly outdoor inspection was completed on October 10, 2025. A Shelter-in-Place or Lock Down Emergency drill was completed on September 15, 2025, at 3:20pm and recorded. The fire extinguisher was fully charged and is located on top of the shelf in the childcare room. Lunch was observed and consisted of meat lovers' pizza, carrots, bananas, and milk. Records Reviewed: Two (2) children’s records were reviewed during today’s visit. Your file was reviewed during the visit today. Program’s files were reviewed. You were given an opportunity to ask questions. At the completion of the visit, this visit summary was printed, reviewed, and a copy was left with you. Increase Capacity Monitoring: On October 3, 2025, you submitted a request to increase your capacity to ten (10) children on 1st shift and 2nd shift. A zoning letter was received prior to today’s visit. A walkthrough was completed to verify compliance with all requirements for an increase in capacity. Fire Extinguisher: A 2A:10B:C fire extinguisher was observed within forty (40) feet of travel distance from each room and areas used by children. The fire extinguisher is located on top of bookcase shelf in the child care room. Carbon Monoxide Alarms/Detectors: I reviewed the documentation from Guardian Protection for the carbon monoxide detectors that are hardwired with a battery backup and were installed on September 25, 2025. One carbon monoxide detector is located on the ceiling in the childcare room where the children sleep. Smoke Detectors: I reviewed documentation from Guardian Protection for one of the smoke alarm detectors that was installed on September 25, 2025. Two electric smoke alarm detectors with a battery backup are in the end of the hall next to the childcare room. Another electric smoke alarm detector with a battery backup is located at the top of the stairs. Childcare at the family childcare home is provided on the same level of exit discharge. Emergency Preparedness and Response Plan (EPR Plan): I reviewed your current EPR Plan dated November 7, 2024, for the required information. I discussed with you that a permit could not be issued during the visit today. I reminded you that you are not allowed to enroll new children to increase your capacity until your new permit has been issued from the Raleigh office. I asked if you had any questions and you stated no. The following violations were observed during today’s visit. Violation Number Comment Rule 930 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years from the date of issuance). The family child care operator’s criminal background check qualifying letter expired on September 8, 2025. G.S. 110-90.2 & .2703(n) & (o) 1847 A childcare operator did not notify the Division of any new childcare providers, as defined in G.S. 110-90.2(a)(2), who were hired or moved into the childcare facility within five business days. As of November 4, 2025, the family childcare home had not completed the requirements for establishing the family childcare home’s ABCMS Portal account and linking the operator and all household members to the ABCMS Portal. G.S. 110-90.2 & .2703(r) The following Technical Assistance regarding the violations observed during today’s visit was provided: -Provider Access to ABCMS •North Carolina Child Care Providers can obtain access to the Provider Access to ABCMS after completing the Moodle training and completing the form afterward. Once you are logged in, you can access codes to allow your staff and applicants to create a connecting application to link themselves to your facility. The links include helpful documents to assist you. I accessed the ABCMS Portal on October 29, 2025, and your staff roster was not available for review. You stated that ABCMS Portal account has been restricted and you are working on fixing this issue. You also stated that you will be received technical assistance from, Tina Williams, Child Care Connections of Cleveland County, to help with this issue. I suggested that you contact the NCID Unit with the number they provided in the email for technical assistance. I also suggested that you contact the Criminal Background Unit for technical assistance. The contact information is 919.814.6401 or by email at DHHS.CBC.Unit@dhhs.nc.gov. -Criminal Background Check/Qualifying Letter: We discussed that criminal background checks must be completed every five years. I suggested putting a reminder in your personnel file and schedule an appointment at least one to two months ahead of time to get the fingerprinting process completed so the qualifying letter does not expire. I also suggested using the Operator’s file checklist to help with keeping up with due dates of specific documentation. Compliance History: You must maintain at least 75% Compliance History for each 18-month period as required. Prior to today’s visit your compliance history was 100 percent (100 %). Please note any violations cited during future visits will negatively impact your compliance history. Repeated violations or violations left unresolved may lead to administrative action. Compliance Letter: You must correct the violations found during today's visit immediately. Please send me a letter verifying compliance by November 18, 2025. Please include in that letter each violation number and explain in detail how you corrected each violation and what plan will be implemented to prevent these violations from occurring again. Consultation: -Child Care Rule Effective January 1, 2024 Lead Testing Through Clean Classrooms for Carolina Kids Results: I discussed with you the results of the lead testing from the Clean Classrooms for Carolina Kids. Your facility’s lead water testing was last completed and reported on April 13, 2024. The Clean Classrooms for Carolina Kids™ team determined that Phenomenal Kids Child Care Services LLC was exempt on Aprill 22, 2024 from asbestos and lead based paint inspection requirements. No additional action is required by the facility. . -QRIS Moderation For more information on the new QRIS system, please visit the DCDEE website, homepage click the What’s new Tab and click onto the QRIS System link. I discussed with you the three different pathways available through the new QRIS System and the resources available for review on the DCDEE website. Information was discussed included the following: the Continuous Quality Improvement Plan for each staff and the program, Enhanced Education standards for the different staff positions, Family and Community Engagement Standards, curriculum, and approved Early Childhood Formative Assessments. I reviewed this information with Mrs. Howell, Administrator, and completed a QRIS Modernization: Pathways to the Stars document to determine which QRIS Pathway you chose for your facility. At this time the facility has not determined which QRIS Pathway they will choose. I asked you to let me know by November 13, 2025. I observed in Space #1 and Space #2 the naptime environment and found that a safe environment and supervision met current child care requirements. -On-going Trainings: Please visit Moodle on the DCDEE website to obtain necessary on-going training hours as required annually. -Updating DCDEE WORKS Account: We discussed updating and/or creating an account on the DCDEE WORKS portal for staff’s education to be evaluated for the upcoming Pathways to the Stars process. An updated DCDEE WORKS account is required for all staff to process the education standard for your program. I suggested reviewing currently enrolled children’s files to ensure accurate records are kept. On-Going Trainings Reminders/Training Records: We discussed creating a calendar as a reminder for when upcoming trainings needs to be completed. I also suggested using and logging completed trainings on the on-going record and highlighting when trainings will need to be renewed to ensure required trainings do not expire. The period for background check qualification renewals was revised from three years to five years. 2. The provisional qualification period was reduced to forty-five days.
