This is a 2nd annual compliance visit. The last annual compliance was completed July 7, 2023. Upon arrival you, Robin Smith, Administrator, assisted me with the visit. Farran Rhyne, child care consultant, accompanied me on the visit. During this visit, we followed up on the violations observed during the complaint visit made on June 20, 2024. We confirmed that enhanced staff child ratios were in compliance and that children under the age of 24 months were not grouped with children three years of age or older. A checklist was used to note the requirements I monitored today. Your program currently operates with a five star license effective September 22, 2017. The permit restrictions were in compliance including 1st shift, 2nd shift, 3rd shift, meets enhanced ratios and meets enhanced space. You are currently not offering 2nd or 3rd shift care, but plan to continue to offer evening shifts when needed. The Secretary of State website was checked on June 17, 2024, and your business It Takes An Entire Village, Inc., is active and in good standing. If any changes to the corporation need to be made or you decide to sell your business, then you must notify me, your consultant at least thirty days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location, or inherited. A walk-through of the facility was completed today, all indoor and outdoor areas were monitored. You conducted the walkthrough of the facility with us. We observed children in both the indoor and outdoor learning environments and found supervision and staff/child ratios in compliance. Children throughout the facility were participating in group story time, transitions and outdoor gross motor time. The caregivers were interacting and responsive to the children’s needs in a nurturing manner. The center's compliance history was at 96% prior to today’s visit. Child care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. A sample of five children’s files were reviewed. One new staff file was reviewed. A sample of two existing staff files were reviewed. The last monthly fire drill was practiced on 6/4/24. The last lockdown drill was practiced on 4/2/24. The last monthly playground inspection was completed on 6/3/24. The most recent lead water testing results were completed on February 16, 2021. Lead testing must be completed every three years. A superior sanitation classification was issued with six demerits. The most recent fire inspection for your facility was conducted on May 20, 2024. The facility was approved for day time and night time care. The following violation(s) were observed and discussed with you today: Violation Number Comment Rule 125 Daily records of arrival and departure times for children enrolled at the center were not maintained as children arrive and depart and/or were not made available for review. On 6/7/24 in space #3, three children were not signed out of care. On 6/10/24, in space #1, one child was not signed out of care. 10A NCAC 09 .0302(d)(4) 852 Incident reports were not completed each time a child was injured, it did not include all the information required in rule, it was not signed by the parent and/or it was not maintained in the child's file. An incident report completed on 6/10/24 did not have the time that the parent was contacted regarding the incident. .0802 (e) 853 Incident logs were not completed and maintained as required. There was no recorded incident log on file since July 2021. .0802(g)(1-6) 1824 The trained staff did not review the EPR Plan annually or when information in the plan changed to ensure all information was current. The last recorded review of the EPR plan was dated 8/26/16. .0607(e) The violation(s) documented must be corrected immediately. On or before July 8, 2024, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. If you email the compliance letter, it must be sent from the email address on file with DCDEE (this serves as your signature) and the following information must be included: name, position, facility name, and facility ID number. Please be aware any information submitted by you is considered legal documentation. If it is determined the information provided in the letter is not true, this may be considered falsification of information. If sufficient information is not received by the due date, a follow-up visit may be completed. The Division of Child Development may take administrative action against the license and/or impose civil penalties based on the failure of the operator to correct any documented violations within the established time period. I suggested that each assigned classroom teacher be responsible for making sure these records are completed in their individual classroom. 10A NCAC 09 .0302(d)(4) Item #852 Incident reports must contain all the required information in 10A NCAC 09.0802( e), including the time the parent is notified of the incident. We discussed that all information that is included on the incident report needs to be completed or noted as N/A in order to meet the rule requirement. Item #853 Incident Logs must be completed and maintained as required. 10A NCAC 09.08202(g)(1-6) We discussed that when an incident report is turned in, the report information should be recorded on the incident log. The incident report must then be maintained in the children’s file. Item #1824 The EPR plan must be reviewed, by the trained staff member, at least annually in the EPR portal. The trained staff member must review the plan and if no updates are needed, print the first page of the plan to verify the date of review. 10A NCAC 09.0607(e ) Rated License: Resuming Star Rated License Reassessment Information: As a reminder your facility is in cohort 1 for resuming the star rated license reassessment. Your child care program’s prep year began on July 1, 2023, through June 30, 2024. Your child care program’s reassessment year will begin on July 1, 2024, through June 30, 2025. Education Points and Program Standards will be assessed once the Environment Rating Scale has been completed. We discussed the Rated License Assessment Request Review Form and the scheduling process for your Rating Scale Assessment. We discussed ordering the Environment Rating Scale soon. You have five classrooms. Two classrooms are for infants and toddlers and three classrooms are for preschoolers. One of the classrooms for preschool age children also offers care for school-aged children. We recommended that you visit www.ncrlap.org for supplemental materials for preparing for the Environment Rating Scale Assessment. NCRLAP also offers trainings for staff. Consultation or other topics discussed today: Per 10A NCAC 09.0304, The operator shall submit the original of the approved annual fire inspection report to the Division within one week of the inspection visit on the form provided by the Division. If the fire inspection report is not submitted to your Child Care Consultant within one week after the fire inspection is conducted, a violation will be cited during the facilities next monitoring visit. Lead & Asbestos Testing The Clean Classrooms for Carolina Kids Program is providing free facility-wide testing and inspections without any out-of-pocket cost to child care centers and public schools. You, Robin Smith, administrator assisted with the visit. The Secretary of State website was checked on June 19, 2024 and your business It Takes An Entire Village, Inc., is still active and in good standing. If any changes to the corporation need to be made or you decide to sell your business, then you must notify your consultant at least thirty days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location, or inherited. On June 19, 2024, the following allegations were received. There are concerns that appropriate ratios are not maintained. There are concerns that a staff person uses a harsh, rude tone with the children, parents and staff, and curses inside the building. This does not promote a nurturing/caring environment. A walk through of the facility and entire premises was completed. Children were observed during play in activity centers, group story time and outdoor playtime. The caregivers were interacting and responsive to the children’s needs in a nurturing manner. Staff/child ratios were not in compliance in space #5. The allegations were discussed with you and three staff members. You and staff members had an opportunity to ask questions, state perceptions of the situation and provide pertinent information in response to the allegation. I reviewed attendance records, arrival and departure records and staff timecards. Based on the walk through of the facility, staff/child ratios were observed out of compliance, therefore the allegation for “Appropriate ratios are not maintained” was confirmed, therefore substantiated. Based on my observations today and staff interviews the allegation for “A staff person uses a harsh, rude tone with the children, parents and staff, and curses inside the building. This does not promote a nurturing/caring environment” was unconfirmed, therefore unsubstantiated. The following violations were observed today. Violation Number Comment Rule 318 Children between 12 and 24 months of age were grouped with children 3 years of age or older. In space #5, a one year old child was being cared for with children three and four years of age. 10A NCAC 09 .0713(a)(6) 1756 Enhanced staff/child ratios and group sizes were not met. In space #5, one staff member was caring for seven children between the ages of one and four years old. 10A NCAC 09 .2818 The violation(s) documented must be corrected immediately. On or before July 4, 2024, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. If you email the compliance letter, it must be sent from the email address on file with DCDEE (this serves as your signature) and the following information must be included: name, position, facility name, and facility ID number. Please be aware any information submitted by you is considered legal documentation. If it is determined the information provided in the letter is not true, this may be considered falsification of information. If sufficient information is not received by the due date, a follow-up visit may be completed. The Division of Child Development may take administrative action against the license and/or impose civil penalties based on the failure of the operator to correct any documented violations within the established time period. Item #1765 Staff/Child Ratios: I reviewed the enhanced staff/child ratios requirements with you per 10A NCAC 09.2818. We discussed that when children are visiting from one classroom space to another, staff must consider the enhanced staff/child ratios and maintain the ratios for the youngest child in the group. Item #318 Age Groupings: Per 10A NCAC 09.713(a)(6), children between the ages of 12 months and 24 months must not be grouped with children three years of age and older except in the first and last operating hour of the day. We discussed that when children are visiting from one classroom space to another, staff must consider staff/child ratios as well as the age of the children in the group. Nurturing/caring Environment: Per G.S. 110-91(10), Each operator or staff member shall attend to any child in a nurturing and appropriate manner, and in keeping with the child's developmental needs Staff must interact with children in care in a nurturing way. In addition to words used, we discussed tone and volume of staff when interacting with children.
