This visit was conducted with Ms. Linda Smith, Administrator. This program currently operates with a Four Star license. Restrictions include daytime care only, children under 2.5 years not cared for downstairs, meets enhanced ratios, children under 2.5 years in rooms with direct exits. The license was posted and the restrictions were being followed. The NC Secretary of State website was reviewed on 05-06-2024. The program’s compliance history was 92% prior to today’s visit. Programs are required to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. I have observed indoor and outdoor areas today. I monitored staff/child ratios and space capacity today, as is indicated on the attached worksheet. I observed proper supervision of children. During the visit I observed children playing with toys, eating and taking a nap. The last annual compliance visit was conducted on 05-17-2024. The last sanitation inspection was conducted on 11-22-2023. The last fire inspection was conducted on 07-11-2023. A fire drill was documented on 04-30-2024. A shelter in place drill was documented on 03-28-2024. An outdoor inspection was documented on 04-25-2024. I observed program records and posted items today. I observed staff and children’s records today according to DCDEE procedures. I observed the storage of hazardous items and cleaning supplies. I observed both the storage of medications and the administration of medication paperwork. This program does not provide transportation. I documented the following violations during today’s visit: Violation Number Comment Rule 125 Daily records of arrival and departure times for children enrolled at the center were not maintained as children arrive and depart and/or were not made available for review. One child had not been signed in in space 6 and one child was not signed in in space 2. 10A NCAC 09 .0302(d)(4) 445 For children under three years of age, developmentally appropriate toys and activities were not provided as outlined in Rule. There were not enough blocks in the block center in space 5 for three children to play. There were not three different types of materials for children to play with in the book area of space 5. There was no paper in the art center and no markers in the book center of space 2, however these were added during the visit. .0510 (e ) (1)(A-G) 1301 Center did not maintain a record of daily attendance. Attendance had not been taken in space 1. GS 110-91(9) I have asked Ms. Smith to send me written documentation by May 20, 2024 indicating that the violations that were documented today have been corrected. I have asked her to include the center name and license number in her documentation, each violation number and how each was corrected, and to both sign and date the document. The document may be mailed or emailed to me at the address below. I have reminded Ms. Smith that if the documentation indicates that corrections have been made when they have not, this may be considered falsification of information and an Administrative Action may be recommended. In addition, repeated violations, continued non-compliance, or failure to submit the compliance letter prior to the date indicated in this visit summary could lead to the recommendation of an Administrative Action. Additional monitoring visits may be conducted during the year to monitor compliance with applicable childcare requirements. I provided the following Technical Assistance during today’s visit: The art center must be added to space 5 when the majority of children turn 2.5 years in the classroom on May 18, 2024. Consultation: The center staff will send home athlete’s foot medicine that a parent brought and signed for diaper changing. The ERS book states that blocks that interlock do not count for blocks, but are manipulatives. The staff will order blocks for the block area in space 5. All of the blocks that were available today for the area were interlocking blocks, or there were not enough present for three children to play and build a substantial structure. I suggested that the teacher obtain more chapter books, or books for older children, for the book area in the school age classroom. I have reviewed this visit summary with Ms. Smith at the conclusion of the visit and a copy was given to her. This visit was conducted with Ms. Linda Smith, Administrator. This program currently operates with a Four Star license. Restrictions include daytime care only, children under 2.5 years are not cared for in rooms downstairs, meets enhanced ratios, children under 2.5 in rooms with direct exits only. The license was posted and the restrictions were being followed. The program’s compliance history was 89% prior to today’s visit. Programs are required to achieve and maintain an eighteen-month compliance history score of at least 75%. I have observed indoor and outdoor areas today. I monitored staff/child ratios and space capacity today, as is indicated on the attached worksheet. I observed proper supervision of children. During the visit, the children were napping and playing with toys. Today, the following items were monitored: • Supervision • Capacity • CPR / First Aid • SIDS training • Criminal Background Checks • General health • Administration of medication • Storage of hazardous products • Storage of medication • General safety • General license requirements • Program records • License posted • Fire safety • Sanitation Limited monitoring of staff files was conducted in accordance with DCDEE procedures for the purpose of reviewing CPR and First Aid, EPR, SIDS training, Health and Safety trainings and Criminal Background Checks. The storage and administration of medications was monitored. Medication authorization was monitored. The storage of hazardous items was monitored. A fire drill was documented on 10-30-2023. A shelter in place drill was documented on 10-30-2023. An outdoor inspection was documented on 10-30-2023. This program does not provide transportation. The following violations were documented during this visit: Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. One staff did not have the lesson plan posted. GS 110-91(12); .0508(a) 849 Leftover medicines were not returned to the parent after the course of treatment was completed, after authorization was withdrawn or after authorization had expired and/or medication was not discarded within 72 hours of completion of treatment or withdrawal of authorization. There was one tube of Aquafor diaper cream for one child that did not have a permission slip. .0803(12) I have asked Ms. Smith to send me written documentation by November 16, 2023 indicating that the violations that were documented today have been corrected. I have asked her to include the center name and license number in her documentation, each violation number and how each was corrected, and to both sign and date the document. The document may be mailed or emailed to me at the address below. I have reminded Ms. Smith that if the documentation indicates that corrections have been made when they have not, this may be considered falsification of information and an Administrative Action may be recommended. Today I provided Technical Assistance in the following areas: I have suggested that diaper creams with a child’s name written in permanent pen have a piece of clear tape over the name to keep it from smearing/erasing. Name of Operation: KIDZ COMMUNITY CHILDCARE Facility ID: 85000091 Consultant: KELLY HEALY Operation Type: Center Case Number: 0723-112L Visit Date: 7/26/2023 Number Present: 9 Completed Date: 7/26/2023 Age: From 6 To 10 Total Minutes: 195 Time In: 12:00 PM Time Out: 03:15 PM Time In: Time Out: List to Use: Center Type Of Visit: Complaint Visit Announced/Unannounced: Unannounced An unannounced visit was made to this center today to address allegations in a complaint received by the Raleigh office. This visit was conducted with Ms. Linda Smith, Administrator and Ms. Christy Johnson, Director. The complaint allegations are as follows: There is a concern related to sanitation and health in the classroom for school-age children. There is a concern of inadequate supervision. School-age children were not supervised while they waited outside for the bus. I have observed the school age group of children today. They were eating lunch and laying down during the visit. The children were being properly supervised during the visit. Concerning the first part of the complaint, the director and the teacher in the classroom stated that there was a school age child attending the child care that was having bathroom accidents. They stated that the child would sometimes tell the teacher that she had soiled clothes and sometimes she would not. They stated that if they noticed that the child was soiled indicated by her clothes or behavior, they changed her immediately. They stated that on one day, the child was soiled and they put pants on the child and called the mother to tell her. The mother stated that she would send another family member to the center with panties and pants. Ms. Johnson reported that the family member came immediately and center staff changed the child into clean clothes. Ms. Johnson reported that she suggested that the mother take the child to the doctor to learn possible solutions to the bathroom accidents situation. Technical Assistance – I have told Ms. Johnson that the center must have a variety of clean clothes available at the center in a variety of sizes in case a child becomes soiled and needs a change of clothes while in care. Ms. Johnson and the staff person in the classroom reported that on one occasion, the child came to the teacher and said she had a bathroom accident. The child asked for help in the bathroom and the teacher reported that when she helped the child in the bathroom, she saw a bruise on the child that made her suspect child abuse. The teacher stated that she reported the mark to the office and the administrator came to the bathroom in the classroom and saw the bruise as well. When Ms. Johnson arrived at work that morning, she stated that she also saw the bruise and she immediately called the Department of Social Services and made a report. Ms. Smith stated that she witnessed Ms. Johnson make the report to DSS. The teacher in the classroom stated that she did not witness the administrator or director make the report, however, the director told her that she had called DSS and made the report. Technical Assistance – I have talked to Ms. Smith, Ms. Johnson, Ms. Sigley and Ms. Eldridge about the mandatory reporting law as listed below and stated that they must report suspected child abuse in all situations. It is best practice to document when any report is made and keep the documentation on file. 10A NCAC 09 .1729(c) The operator shall conduct 16 hours of orientation with all caregivers, prior to the individual caring for children, including substitute providers, volunteers, and uncompensated providers, who are providing care. The orientation shall include an overview of the following topics, specifically focusing on the operation of the facility: (1) recognizing, responding to, and reporting child abuse. This part of the complaint is unsubstantiated. I have observed the child’s file today. I have observed the staff person’s file today and the Documentation of Orientation states that 16 hours of orientation must be completed in the first two weeks of employment, including reporting child abuse. The form indicates that only 2.5 hours of training were completed on the first three topics, a violation of child care rules which is documented below. Concerning the second part of the complaint, I have spoken to staff and the director and administrator about supervision as children get on and off the bus. Staff report that the children are almost always dropped off at the door of the center and parents sign the child in and out of the child care at the door. One or two staff persons greet the children and escort them to their classrooms. All staff interviewed stated that the school children who arrive to take the bus to school come at 6:30am when the child care opens and that the bus arrives at 6:40am. All staff interviewed reported that the school children sit in a row of chairs inside the building at the entrance and that no children wait outside for the bus. All staff stated that when the bus arrives, the staff person stands in the door of the entrance and holds the door open for children, who walk to the bus and get on. The door of the bus is facing the door of the building and the staff can see the children get on the bus and can supervise children from the building to the bus door. Staff report that approximately six children took the bus to school each morning during the last school year. While staff can visually supervise the children getting on the bus, I expressed my concern that an adult was not standing closer to children to wave or attract the attention of a person who may be driving towards the children or towards the lower parking lot when the children are getting on the bus. Without measuring, I believe from observation that the distance from the building to the bus is between 30 and 40 feet. Ms. Smith and staff stated that this situation will be remedied in the new school year by having staff walk children from the building to the bus door and standing at the bus door while the children load the bus. I have reviewed the rules regarding supervision in 10A NC 09 .1801 with Ms. Smith and Ms. Johnson today. This part of the complaint is unsubstantiated. I have expressed concern to Ms. Smith and staff that school age children are waiting ten or more minutes with no activities while they are sitting in the chairs waiting for the bus. Staff stated that they could add activities like books, dry erase or chalk board, or art materials to the area. Ms. Sigley stated that if the bus is late, she takes the school age children to their classroom and they play until the bus arrives. Per staff report, I do not have any concerns about supervision or safety when children are getting off the bus in the afternoon at this time. Technical Assistance – I have told Ms. Johnson and Ms. Smith that best practice is to have parents come into the building and walk with their children to the child’s classroom to drop him or her off. It is best practice to have parents sign a child in and out in the classroom so that if they forget, the teacher can note when the child was dropped off. I stated that my concern with having parents come into the building and sign a drop-off form in the hallway is that this could be a future violation if a parent forgot or was in a hurry and did not sign the child in or out, because the teacher in the child’s class would not know if the child was signed in or out. In addition, I stated that no staff person should let a school age child go out of the building or begin to walk towards a school bus unless it is completely stopped with the stop sign and the arm out. The following violation was documented today: Violation Number Comment Rule 1045 New staff, who had contact with children, did not receive at least 16 hrs. orientation within first 6 weeks. On staff person only had 2.5 hours of training within the first two weeks of employment. .1101(a) This complaint is unsubstantiated. I have asked Ms. Johnson to send me written documentation by August 9, 2023 indicating that the violation that was documented today have been corrected. I have asked her to include the center name and license number in her documentation, each violation number and how each was corrected, and to both sign and date the document. The document may be mailed or emailed to me at the address below. I have reminded Ms. Johnson that if the documentation indicates that corrections have been made when they have not, this may be considered falsification of information and an Administrative Action may be recommended.
