A checklist was used to note the requirements I monitored today. This facility currently operates with Four Star license issued on March 20, 2020. Upon my arrival to the family child care home, I was greeted by Mr. Kelly. Five children, Mr. Kelly, and Mrs. Kelly were present. The children were eating breakfast and transition to go outside to play. All indoor and outdoor spaces used by the children were observed today. All required items were posted. Outdoor inspections were documented and current. Emergency drills were documented and current. A random selection of children files and all caregiver files were monitored during today’s visit. I received the FCCH and Centers Located in a Residence Verification of Required Information for Operator and Additional Caregivers Form and the Statements of Responsibility Form. Your signature on these forms serves as verification the information provided is accurate and complete. I monitored one vehicle the family child home uses to transport the children. There are no pets in the home. One (1) violation was cited during today’s visit. Violation Number Comment Rule 511 Operator did not successfully complete a CPR course as referenced in Rule.1702(b)(2) CPR training was not renewed on or before the expiration of the certification. Both caregivers at the FCCH did not complete the in- person training of CPR/First Aiding training, both only did the online course for the training. .1703(a)(3) Comment: The violations documented must be corrected immediately. A signed and dated letter of compliance must be emailed to me at ericka.bailey@dhhs.nc.gov on or before October 7, 2025. The compliance letter should contain the following information: 1. Facility Name 2. Facility ID 3. Date of the letter 4. The violation numbers. The date each violation was corrected. How the violation was corrected. 5. Signature of the person preparing the letter If I do not receive your letter by October 7, 2025 /or if you do not address all violations, a return visit to your program will be made to monitor for compliance of violations and to obtain your compliance letter. Violation Number Comment Rule 1101 Operator or other transportation provider did not have written permission from each child's parents or guardian to transport the child. The operator transports four children from the public school, the written permission was not current and accurate. .1723(5) 1103 For each child being transported, the operator or other transportation provider did not have identifying information, including the child's name, photograph, emergency contact information, and a copy of the emergency medical care information form required by Rule .1721(a )(3) in the vehicle whenever children were transported. An identifying photograph for four children was not in the vehicle whenever the children were transported. .1723(13) The violations documented must be corrected immediately. A signed and dated letter of compliance must be emailed to me at sharon.y.williams@dhhs.nc.gov on or before October 17, 2024. The compliance letter should contain the following information: 1. Facility Name 2. Facility ID 3. Date of the letter 4. The violation numbers. The date each violation was corrected. How the violation was corrected. 5. Signature of the person preparing the letter. TA: Today I provided technical assistance on the following: 10A NCAC 09 .1723 TRANSPORTATION REQUIREMENTS To assure the safety of children whenever they are transported, the operator, or any other transportation provider, shall: 5) have written permission from a parent to transport his or her child and notify the parent when and where the child is to be transported, and the name of the transportation provider. Parents may give standing permission, valid for up to 12 months, for transport of children to and from the home (13) have identifying information in the vehicle about each child being transported, including the child's name, photograph, emergency contact information, and a copy of the emergency medical care information form required by Rule .1721(a)(3) of this Section; Transporting children in child care settings is a high-risk activity. There is always the potential for problems to occur whenever children are transported. Obtaining written permission from parents allows the provider to prioritize the child's safety and take necessary precautions. This written consent ensures parents are fully informed about the potential risks involved in transporting their child, as well as the planned activity and destination. Having documented parental consent also protects the child care provider from potential legal issues if an incident occurs during transportation. To further enhance safety, including a photograph of each child with their emergency information will enable easier identification in case of an emergency. Attaching these photos to the car safety seats used by each child can also help quickly identify them in the event of an accident. Thank you for your cooperation during today’s visit. During today’s visit, I discussed the allegations with Mr. and Mrs. Kelly, owner. You were given an opportunity to respond to each concern. There are concerns regarding capacity. Limited monitoring of child care requirements occurred during today’s visit. I monitored supervision, capacity, adequate/approved space, and general license requirements. I reviewed attendance sheets for the months of July 2024 and August 2024. Today six preschool age children were present. I conducted a walk-through of the indoor areas used by the children. The children were engaged in activities with Mrs. Kelly. Findings: Allegation regarding capacity: Today there six preschool age children (0 to 3 years old) were present. Based on my observations today and the review of the attendance sheets and other records, the allegation regarding capacity was confirmed and substantiated. There were two violation of child requirements cited during today’s visit. A follow-up visit will be conducted. Violation Number Comment Rule 102 Number of preschool children exceeded five children, including the provider's own preschool children. On today August 28, 2024, a total of 6 preschool-aged children (0-3 years old) were present at one time. However, one child later left, resulting in 5 children remaining. Based on information received and a review of other records, 6 preschool age children were present at one time the week on August 12, 2024. GS 110-91(7)(b) 921 Operator did not maintain accurate daily attendance records including documentation of arrival and departure for all children in care, including the operator's own preschool children. During the week of August 12, 2024, child was present but not documented in the attendance records. This was determined based on statements from staff and a review of other documentation. .1721(e)(6) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent.
