Upon arrival, Lauren Maglio, director, assisted me with Today’s visit. CURRENT LICENSE STATUS: The program operates with a two-star rated license issued on 6/3/25. ANNUAL INSPECTIONS: The last sanitation inspection was completed on 11/12/25. The last fire inspection was completed on 6/20/25. The last outdoor play area inspection was completed on 5/29/26. The last fire drill was conducted on 5/29/26. The last lock down/shelter-in-place drill was completed on 3/16/26. The EPR plan was updated on 7/24/25. The last annual compliance visit was conducted on 12/16/25. The NC Secretary of State's website was reviewed on 6/22/26 and was listed as active- current. During today's visit, I observed all approved indoor and outdoor spaces and found them to be accessible, safe, and appropriate for the children in care. Upon arrival, the children were engaged in a variety of activities, including outdoor play, circle time, and learning center activities. In the 0–24-month classroom, the infants were participating in floor play activities, while one child was resting comfortably during nap time. Children appeared content and appropriately supervised throughout the observation period. ITEMS MONITORED: A partial monitoring of applicable child care requirements was conducted, monitoring Supervision, Staff Child Ratio, CPR/First Aid, Special Training, Storage of Hazardous Substances, Storage of Medication, Adequate Approved/Space, Staff Records, Program Records, License Posted, and Permit Restrictions. During today’s visit, three (3) newly added staff files were reviewed to verify that required documentation was present, complete, current, and maintained according to program requirements. The following violations of the Child Care Requirements were observed and documented during today’s visit: Violation Number Comment Rule 106 Operator has not scheduled and obtained a fire inspection within 12 months of the previous inspection. Operator did not submit the original approved report to DCDEE within one week of the inspection visit on a form provided by the Division. The facility's last completed fire inspection was conducted on June 20, 2025. 10A NCAC 09 .0304(a) 428 A current activity plan was not posted for each group of children for reference. A current activity plan was not posted. GS 110-91(12); .0508(a) 847 Parent's medication authorization did not include required information. One application did not include the date for approval. 10A NCAC 09 .0803(4)(6-9) 1874 The Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy was not reviewed with new staff prior to providing care with children and/or a signed acknowledgement with all the required information was not maintained in the staff person's file. One staff file did not have a sign shaken baby policy. .0608(d)(1-4) Please submit a corrective action letter for the above violations. While the Division allows you time to explain how you have corrected violations when they are documented, it is expected that you will correct all violations immediately. I is a good idea for the office manager to contact the local fire inspector when the annual inspection is due to make sure that it has been scheduled before the inspection expires. The approved fire inspection report must be submitted to the Division of Child Development and Early Education within one week of the inspection. The children's furniture in Space 136 is beginning to show signs of wear and tear along the edges of one of the chairs. As a suggestion, you may consider using a vinyl adhesive covering to temporarily protect the worn areas until the chair can be repaired, recovered, or replaced. This would help maintain the condition of the furniture and prevent further deterioration. CONSULTATION AND RESOURCES: ABCMS PROVIDER PORTAL Child care providers can now view and manage their facility’s staff roster through the ABCMS Provider Portal. Please note that you are required to add new employees within five days of their hire date and update your roster by adding or removing applicants as needed. FACILITY LEAD H2O, LEAD-BASED PAINT, ASBESTOS TESTING Child care facilities are now required to meet rule requirements (NC 10A NCAC 41C.1001-1007, NC 154A NCAC 18A.2816). Clean Classrooms for Carolina Kids are designed to ensure facilities meet all requirements to test lead and asbestos hazards in buildings. You can check your status at https://data.cleanwaterforuskids.org/data/north-carolina. HEALTH AND SAFETY Training in all the required health and safety topics must be completed every 5 years. A visit was conducted on 1/28/26 with a report of allegations of violations of child care rule. Allegations related to sanitation and health were unsubstantiated during this visit and the allegation related to staff child ratios remained open pending further violations. Upon arrival, I was greeted by the center director, Lauren Maglio. We conducted a general walk through to check staff child ratios. It was rest time, so most of the children were resting on their cots during today's visit. All ratios met licensing requirements during today’s visit. COMPLAINT STATUS During the visit conducted on 1/22/26 I received Face to Name Transition Sheets and staff payroll records for January 19 – 23, 2026. Based on a review of the records and staff interviews, I was able to determine that on 1/21/26 a classroom enrolling one-year-old children had 14 children present, with two staff members, for portions of the day. Therefore, the allegation regarding staff child ratios is SUBSTANTIATED. Records for other days were reviewed, but the information provided did not clearly indicate how many children and staff were present throughout the day. The center would like to reduce their staff child ratios to the minimum requirements. With their current 4 points in programs standards, enhanced ratios are required. However, we discussed today that they could reduce their current program standards points to 3 without changing their current 2-star rated license. This would allow them to choose either enhanced space or enhanced ratios. Lauren stated that she would like to change the program standard points to 3 and have the option of maintaining basic staff child ratios. Limited monitoring of child care requirements was conducted during today’s visit. The following violation was observed and documented during today’s visit. Violation Number Comment Rule 301 Minimum staff/child ratios and group sizes for the number and ages of children in care were not met. On 1/21/26 there were 14 one-year-old children present with 2 teachers for portions of time throughout the day. GS 110-91(7);.0713(a-d) The center was compliant with staff child ratios during today’s visit. Therefore, the violation documented today is marked as corrected during today’s visit. COMPLIANCE HISTORY Prior to today’s visit the program’s compliance history was 96%. TECHNICAL ASSISTANCE . G.S. 110-91(7)a 1. was amended last year to permit an increase in the maximum group size for infants and toddlers. This means, if there is a sufficient amount of space, as outlined in child care rule .1401(f), for 15, 18, or 20 children, they can increase their group size. Prior to increasing their group size, the center will need to send the consultant notice that they are increasing their group size. Quinlynn Newman, interim director, accompanied me during a walk-through of the facility. During the visit, I discussed the allegations with Ms. Newman. Limited monitoring of child care requirements occurred during today’s visit. The following violations were observed and/or confirmed during today’s visit. Violation Number Comment Rule 807 A safe indoor and outdoor environment was not provided for the children. On February 25, 2025, a staff member left a one-year-old child unattended on a changing table for a short period time. 10A NCAC 09 .0601(a) 910 Children were disciplined by leaving them alone in a room separated from staff. On February 25, 2025, a staff member left a one-year-old child in the classroom closet for an undetermined length of time. .1803(a)(2) Violations must be corrected immediately. Within one week, 4/3/25, you must submit documentation of the corrections you made and your plan to maintain compliance with the identified child care requirements to me at Amber Telfair, Investigations Consultant, amber.telfair@dhhs.nc.gov. The temporary time period license was issued on 12/2/24 and expires on 6/2/25. Upon arrival, I was greeted by the assistant director, Tiffany Scherbing. The director was on vacation this week and did not inform me of her absence beforehand. Mrs. Scherbing toured me through the center. We discussed the monitoring items for today's visit. We observed the center playgrounds and conducted observation of the seven classrooms open for children during today's visit. We concluded the visit by meeting to review this report and resource materials. Preschool-aged children were observed washing their hands, listening to stories, eating lunch, singing songs, playing outside, resting, waking, and departing. The infants and toddlers were observed washing their hands, being held for bottle feedings, freely playing with the available toys, listening to story, eating lunch, and departing. . The Children’s Records form was completed during this visit. The Staff Training Worksheets were completed during this visit. The assistant director attest that all children’s file and facility/program records are current and contain all the required information. Sixty-seven children were present during this visit. The center had the following items posted/located in a prominent place in the center for parents and available for me to review: --the center's license --a Safe Arrival and Departure Procedure --Summary of the NC Child Care Law posted The most recent fire drill was conducted on 1/10/25. The most recent outdoor inspection was conducted on 1/13/25. The first emergency drill was conducted on 1/10/25. The sanitation inspection was conducted on 12/20/24. The facility received a superior classification with 2 demerits. The director completed the Emergency Preparedness and Response training on 10/8/24 and must submit the Emergency Plan before 3/2/25. The Plan must also be reviewed with all staff once it is completed. The center does not provide aquatic activities; thus, those requirements were not monitored during this visit. The following violations were observed during this visit: Violation Number Comment Rule 526 Menus for all meals and snacks were not current or posted where easily seen by parents and cook. The weekly center menu that was posted for reference in visible locations was not dated during this visit. 10A NCAC 09 .0901(b) 1031 Documentation of staff's education, training, and experience was not on file. Seven staff members did not have documentation on file of their education or experience. Refer to the Staff Training Worksheets for details. .0302(d)(1)(B) 1045 New staff, who had contact with children, did not receive at least 16 hrs. orientation within first 6 weeks. Eleven staff members did not have documentation of completing the new hire orientation requirements within their first two or six weeks of employment. Refer to the Staff Training Worksheet for details. .1101(a) 1065 Child care providers scheduled to work in the infant room, did not complete ITS-SIDS training within two months of employment or did not complete the training every three years. Child care administrators did not complete the ITS-SIDS training within 90 days of employment and every three years thereafter. One lead teacher assigned to the infant classroom who was employed on 12/2/24 did not have documentation of completing the ITS SIDS training on file during this visit. .1102(f) 1874 The Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy was not reviewed with new staff prior to providing care with children and/or a signed acknowledgement with all the required information was not maintained in the staff person's file. Three staff members hired on 1/2/25, 1/6/25, and 1/13/25 did not have a signed Shaken Baby Abusive Head Trauma policy on file during this visit. .0608(d)(1-4) 1890 Each staff member did not have the required medical report, proof of tuberculosis test or screening and/or completed health questionnaire in a medical file, maintained separately from the staff member's individual personnel file. One staff member hired on 1/2/25 did not have documentation of completing a medical report, tb test, or health questionnaire on file during this visit. .0701(d) The violations documented during today's assessment were reviewed with the assistant director and must be corrected IMMEDIATELY. Evidence of correction must be sent to me no later than 2/11/25. Compliance verification must be a dated and signed letter that includes statements addressing how and when the violations were corrected. Please include the facility's name and ID number on the letter of compliance. The letter may be emailed to angela.algerwalker@dhhs.nc.gov. If you email the compliance letter, you must include a signature block, which contains your name, position, facility name, and facility ID number. An example is: Jane Doe, Administrator AAA Child Care ID # 12345678 COMPLIANCE HISTORY When you receive your Child Care License from the State of NC, you are agreeing to comply at all times with the Law, Rules and Requirements pertaining to and governing Child Care in NC. It is your responsibility to read, learn, and maintain all Child Care Requirements that apply to your licensed facility. It is also your responsibility to ask Division staff questions for clarification of requirements you do not understand and to monitor your staff to ensure that all requirements are maintained at all times. TECHNICAL ASSISTANCE AND CONSULTATION The following items were discussed prior to today' visit. 1) Please refer to the Staff and Training Worksheets to continue to keep all staff members current with their upcoming due dates for CPR/First Aid training, ITS-SIDS training, child maltreatment training, and health and safety training requirements. 2) Please refer to the What’s New Section of the DCDEE website for the new rules and other updates. 3) Please use the ECERS Third edition in preparing for rating scale assessments. 4) Emergency Preparedness and Response - It is important to consider how to prepare for and respond to emergency or natural disaster situations and develop written plans accordingly. You are required to have procedures in place to address natural disasters that are relevant to your location (such as tornados, flash floods, and hurricanes) and all hazards/disasters that could occur in any location including acts of violence, bioterrorism/terrorism, exposure to hazardous agents, facility damage, fire, missing child, power outage, and other situations that may require evacuation, lock-down, or shelter-in-place. The procedures must be updated and reviewed annually. The only way to prepare for disasters is to consider various worst case or unique scenarios, and to develop contingency plans. By brainstorming and thinking through a variety of “what if...” situations and developing records, protocols/procedures, and checklists, facilities will be better able to respond to an unusual emergency or disaster situation. EPR training is required to be completed within one year of licensure. 5) Staff Records – Maintaining accurate documentation in your center is critical in demonstrating compliance with the child care rules and to ensuring that your staff meet the requirements to provide a healthy and safe environment for the children in their care. Prior to employment documentation of a completed medical report and a negative tb test result or screening must be provided to you. Utilizing the staff file checklist attached to your files will help you to meet and maintain compliance when hiring staff. 6) Recognizing and Responding to Suspicions of Maltreatment: Child care staff are expected to be well informed about child abuse and neglect issues and adequately trained to prevent and recognize potential maltreatment. All staff are required to complete the training within 90 days of hire. The training may be accessed via the DCDEE website at www.ncchildcare.nc.gov. Recognizing and Responding to Suspicions of Child Maltreatment is also available on Prevent Child Abuse NC website, www.preventchildabusenc.org, free of charge, and counts toward Health and Safety Training. 7) NITTO - The Birth-to-Three Quality Initiative and DCDEE are offering a New Infant Toddler Teacher Orientation (NITTO). * Free online format; birth-to-three classroom; Understand your value as a birth-to-three teacher and ways to care for young children, with 14 credit hours upon completion; * Comprehensive training completed in 7 weeks; * Practical knowledge that you can apply in a classroom for yourself while caring for our youngest. Find the course at dcdee.moodle.nc.gov. Individuals will need to have an NCID to access the Moodle site. RATED LICENSE APPLICATION INFORMATION Once you have achieved a full six (6) months of operation, your program will be eligible for a Voluntary Enhanced Rated License. The award of this Rated License will occur at the end of the 6-month Temporary License Time Period. The following information will need to be completed to begin the program's Rated License Assessment: 1) The "Application for Assessment for a Rated License" and the “Request For Rated License Assessment Review” form were submitted during this visit. 2) Please go to the NCRLAP website, www.ncrlap.org, to learn more about the Environmental Rating Scale Process and the third edition of the ECERS and ITERS. 3) Please ensure that all new staff member’s education information is current in the W.O.R.K.S. database. Each staff member must register in the WORKS system as soon as they are hired at this location. Education evaluations can take some time to process so beginning the process early will help to ensure we have the accurate information needed when it is time to complete the rated license assessment before the end of the temporary time period. You may also want to consider having staff members complete the Early Educator Certification process (www.ncicdp.org) to assist in getting higher education evaluations completed if their degree is not in early childhood education. 4) Begin thinking about which Quality Point Option you will select. We reviewed a list of the Quality Options you can meet at your center. There are both Educational Options and Programmatic Options. Regardless of the total number of Quality Options that are in place, the center can only be awarded one additional point towards your Rated License Assessment. Once you select a Quality Option, it must remain in effect at the center until a new Quality Option has been assessed. All staff are required to complete this free online training within ninety (90) days of hire.
