Upon arrival, You, T. Battle, was present and available to assist with today’s visit. You were made aware of the purpose of this visit and were given the opportunity to provide additional information. I conducted observations in all rooms used to care for enrolled children. Staff/child ratio, group size, supervision, use of licensed space, space capacity, license restrictions were monitored. The license and emergency care plan were posted. ALLEGATIONS: The allegations are as follows: There is a concern of inadequate nurture and care. Twenty-six (26) children were observed in care from ages 2 months old to three years old. Children were observed resting during naptime, personal care routines, and participating in gross-motor activities in the outdoor learning environment. Children were eating the following for snack: crackers, cheese, grape juice. Teachers were observed interacting with children in a nurturing and positive manner. The following violation was documented during today’s visit: Violation Number Comment Rule 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. The teacher in room number two grabs the child’s hand lifts the child up to the standing position from sitting, the child begins to cry, sits back down, the teacher walks away, and then comes back to the child lifts the child up again from the hand and continues to hold the child up by the hand as the child is pulling away from the teacher crying. They were in the process of leaving the classroom to go outside. G.S. 110-91(10) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. The violation(s) documented must be corrected immediately. On or before July 9, 2026. I must receive a written, dated, and signed compliance letter that describes accurately and in detail how and when the violations were corrected. The center's compliance history was reviewed with the operator. The program’s compliance history was 100% as of June 24, 2026. STAFF INTERVIEWS: Observations were completed in all the classrooms, camera footage reviewed, and applicable staff were interviewed today. ALLEGATION ONE(1): There is a concern of nurture and care. An incident report was received on June 19, 2026, from T. Battle. Ms. Battle was notified by a parent on June 3, 2026, that her child was fussier than usual and seemed to not want to move her arm. Ms. Battle stated she told the parent that the child had been holding her arm funny on Tuesday. The parent notified Ms. Battle that she ended up taking her child to the emergency room and she was told her child’s elbow was dislocated (nursemaid elbow). Ms. Battle had a staff meeting on Friday, June 5, 2026, and discussed the possible incident. She asked if any of the staff noticed the child had been crying, the staff said yes, she was crying, but that was not unusual behavior. During the staff meeting, Ms. Battle reviewed information received from the parent about how to prevent and care for a child with nursemaid elbow. She stressed the importance of not lifting a child from the hand, but from under the arm and trunk area of the body. Ms. Battle reviewed the cameras and could not see anything that would cause her to believe the child was pulled or lifted up incorrectly by the arm. It was consistently stated; the child had been fussy that day, but it was not unusual behavior. I spoke to two staff members that had been in the classroom that day during nap time. The child was crying and one teacher patted her on the back to try and calm her down. The other teacher came in to help sooth the crying child. Eventually the child fell asleep. Both teachers stated this was not unusual behavior. I could not talk to the teacher who had been assigned to room number two (2). Ms. Battle stated the teacher who was assigned to room number two (the room where toddler children are cared for) had resigned because of breaking the facility’s confidentiality policy. Ms. Battle was in the process of determining if she was going to terminate the teacher when the teacher resigned. T. Battle provided me with camera footage from June 3, 2026. At 3:27pm the teacher grabs the child’s hand lifts the child up to the standing position from sitting, the child begins to cry, sits back down, the teacher walks away, and then comes back to the child; lifts the child up again from the hand and continues to hold the child up by the hand as the child is pulling away from the teacher crying. They were in the process of leaving the classroom to go outside. FINDINGS: Based on the information received and the video tape footage, this allegation was found to be confirmed. TECHNICAL ASSISTANCE/CONSULTATION: Childcare licensing requirements are established to ensure a safe and healthy childcare environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with the applicable laws and rules; always whether they have been monitored or specifically discussed with you in the past. The best way for you to ensure that you are meeting all requirements is to periodically review the childcare laws and rules on the Division of Child Development and Early Education’s website. NURTURE AND CARE: Nursemaid’s elbow is a common childhood injury where the forearm bone partially slips out of the elbow's ligament. It typically occurs in toddlers and preschoolers (ages 1 to 5) after a sudden pull on the arm, causing immediate pain and refusal to move the arm. Please remember when lifting a child, it is always best practice to lift the child from the trunk of the body. Never lift a child by the hand. ADMINISTRATIVE ACTION: Based on current applicable NC Child Care rules, based on the substantiation of an allegation listed above, some type of administrative action could be imposed. T. Battle, Administrator, was present and available to assist with today’s visit. Your program currently operates with a four-star license issued on September 21, 2021, earning 5 points in the education component, 6 points in the program standards component and 1 quality point for having a child care administrator that has at least 10 years of documented child care administration work experience in a licensed program. The last annual compliance visit was conducted on September 19, 2023. The sanitation inspection was completed on March 5, 2024” classification “5” demerits. The fire inspection was completed on June 14, 2023, and the center was approved for daytime care only. The license was posted, and the restrictions were in compliance. Twenty-two (22) children from ages zero (0) to five (5) were present during the visit. A walk-through of the facility was completed today, all indoor and outdoor areas were monitored. I observed children in both the indoor and outdoor learning environments and found supervision and staff/child ratios to be in compliance. Children throughout the facility were participating in group time, free play in activity areas, transitions and personal care routines. The caregivers were interacting and meeting the developmental needs for each of the children. The children were observed eating Canadian bacon, whole wheat bread, peas, pineapple, and milk. Any violations of the child care requirements observed today were discussed with you and documented in the visit summary report and reviewed with you at the conclusion of the visit. Ten percent (10%) or more of existing staff files were monitored and one (1) new staff file was reviewed. B. Hewlin’s first day of employment was April 24, 2024. Ms. Hewlin had signed documentation of the Shaken Baby Head Trauma policy on file; however, it was dated April 25, 2024. Please remember the Shaken Baby Head Trauma policy must be reviewed and signed prior to working with children. This was corrected during the visit. MEDICATION: In room number two (#2) there was a tube of Desitin Diaper cream that expired in July 2024. Please remember to send home medication that has expired. You may want to put in the corner on your permission to administer topical ointments forms the expiration date, so teacher can remember to discard. RMINDERS: DCDEE WORKS: Please continue to keep your Staff and Training worksheets up to date. Update the worksheets when changes are made, such as hiring new staff, additional coursework, and completed training. If the education information is not in the “WORKS” system when the star-rated license is reassessed it could affect the points in Education Standards. START RATED LICENSE/QUALITY IMPROVEMENT RATING SYSTEM (QRIS) UPDATE: The Governor signed 12 bills on July 8, 2024. Including the Adjustments to the Appropriations Act (SB 357) which includes the $67.5 million for reduced compensation payments for first two quarters of FY 24-25 and the DHHS Agency Bill (Senate Bill 425) which includes the QRIS provisions: • QRIS modernization (3 new pathways to stars) is now approved (SB 425). • Hold harmless has been extended until the new QRIS is implemented (SB 425). Providers in Cohort 1 are not required to go any further with a rated license assessment unless they want to, and providers in Cohort 2 do not need to start their preparation year unless they want to. • SB 425 does mean that programs currently accredited through the approved accrediting bodies can move to a 3- or 5-star license if they are not already at this star level. Providers will need to submit a request to their consultant and provide a copy of their accreditation certificate for processing. • SB 425 also requires that we move to the ERS-3 versions for ECCERS. ITERS and FCCERS, effective February 1, 2025. Self-paced online training modules regarding the new assessments will be available in September 2024. • SB 357 provides $67.5 million dollars to continue a reduced level of funding for the compensation portion only of the Child Care Stabilization Grant. Funding is designated for the first two quarters of FY 2024-25 and provides only about 75% of funding needed to maintain compensation payment amounts provided through ARPA funding which ended June 30, 2024. DCDEE will continue to utilize the NC FAST Stabilization Grant portal to distribute funds. CLEAN WATER FOR CAROLINA KIDS: We discussed the Clean Water for Carolina Kids program and what that means for you as a child care center. According to the Clean Water for Us Kids website you lasted tested your water for lead on December 18, 2023. According to the Clean Water for Us Kids website: The Clean Classrooms for Carolina Kids™ team determined that SMILES R' US CHILD CARE was exempt from the lead-based paint assessment requirements. The facility provided the appropriate documentation to show all buildings were built after 1978 and no lead-based paint was used in order to meet the building age exemption criteria per 10A NCAC 41C.1004. No additional action is required by the facility. According to the Clean Water for Us Kids website: The Clean Classrooms for Carolina Kids™ team determined that SMILES R' US CHILD CARE was exempt from asbestos inspection requirements. The facility provided the appropriate documentation to show all buildings were built after 1988 to meet the building age exemption criteria per 10A NCAC 41C .1003. START RATED LICENSE/QUALITY IMPROVEMENT RATING SYSTEM (QRIS) UPDATE: The Governor signed 12 bills on July 8, 2024. Including the Adjustments to the Appropriations Act (SB 357) which includes the $67.5 million for reduced compensation payments for first two quarters of FY 24-25 and the DHHS Agency Bill (Senate Bill 425) which includes the QRIS provisions: • QRIS modernization (3 new pathways to stars) is now approved (SB 425). • Hold harmless has been extended until the new QRIS is implemented (SB 425). Providers in Cohort 1 are not required to go any further with a rated license assessment unless they want to, and providers in Cohort 2 do not need to start their preparation year unless they want to. • SB 425 does mean that programs currently accredited through the approved accrediting bodies can move to a 3- or 5-star license if they are not already at this star level. Providers will need to submit a request to their consultant and provide a copy of their accreditation certificate for processing. • SB 425 also requires that we move to the ERS-3 versions for ECCERS. ITERS and FCCERS, effective February 1, 2025. Self-paced online training modules regarding the new assessments will be available in September 2024. • SB 357 provides $67.5 million dollars to continue a reduced level of funding for the compensation portion only of the Child Care Stabilization Grant. Funding is designated for the first two quarters of FY 2024-25 and provides only about 75% of funding needed to maintain compensation payment amounts provided through ARPA funding which ended June 30, 2024. DCDEE will continue to utilize the NC FAST Stabilization Grant portal to distribute funds. Lunch consisted of bologna, peas, pineapples, bread, and milk. Currently this program operates with a Four-Star License earning five points in education, six points in program standards and one quality point for the child care administrator has at least 10 years of documented child care administration work experience in a licensed program. The last sanitation inspection was completed on March 5, 2024, earning a superior classification. The last fire inspection was completed on June 14, 2023, and the center was approved for daytime care. The last annual compliance visit was completed on September 19, 2023. Staff talked to children about their meals during lunch time. Children were encouraged to try foods on their plates. After lunch, the children laid down for a nap while music played softly in the background. SAFE ENVIRONMENT: I notified you the art easel was broken, and staples were exposed. We discussed repairing the art easel to remove the potential hazard identified. It was suggested you ask staff to conduct a scan of the playground daily prior to allowing children access to identify hazards. If identified the hazards should be removed or repaired immediately if applicable. Be reminded you are responsible for ensuring a safe environment is always provided for children in care. HAND WASHING: After diaper changing, one child was placed down for floor play with other children with washing hands. I informed the caregiver; children’s hands must be washed after diaper changing. The caregiver explained she wiped the child’s hands with a wipe. I explained wiping the hands is a step that is done prior to placing the clean diaper on the child; however, at the end of the diaper changing process, children’s hands must be washed with soap and water. The caregiver immediately washed the child’s hands. PROVIDER ACCESS to the BACKGROUND CHECK MANAGEMENT SYSTEM: DCDEE launched the Provider Portal for ABCMS on February 1, 2024. T. Battle, Administrator assisted with the visit. This center currently operates with a four-star license, earning five points in the education component, six points in the program standard component and 1 quality point for the administrator having at least 10 years of documented child care administrative work experience in a licensed program. The last annual compliance visit was completed on September 21, 2022. The last sanitation inspection was completed on March 14, 2023, with a “Superior” classification. The last fire inspection was completed on June 14, 2023, and the center was approved for daytime care only. Nineteen children were in care today. Children were engaged in free choice play with developmentally age-appropriate materials/toys, outdoor play, completing diapering, toileting and hand washing routines, participating in story time, and eating breakfast. Breakfast consisted of toast with grape jelly, pineapples, and milk. The center’s compliance history score was reviewed with the operator. The program’s compliance history was (95%) as of September 18, 2023. The following violations were documented today.
