You, Martha Pegues, Owner/Operator, assisted me with today’s visit. I conducted last annual compliance visit on May 23, 2024. We reviewed the facility input form to ensure that there were no changes to your facility information. You stated there were no changes to the facility information. We reviewed the facility permit to ensure that there were no changes to your facility’s operation. The facility is owned/operated by Martha J Pegues. As the owner/operator, you are required by Child Care Rule .0102 (19) to reside in the home where the license is issued and according to General Statute 110-91(8) to be the full-time caregiver to the children enrolled at the family child care home. You stated you live in the home and are the person working full-time to care for the children enrolled at your family child care home. We reviewed the restrictions on your family child care home license as well as the capacity, shifts of care, and the age range of the children served at your facility. You stated that you did not have any questions regarding the information reviewed with you regarding your license. Your program’s compliance history was 99% as of November 18, 2024 and was reviewed with you today. Your program currently operates with a five-star license, issued on August 18, 2017, earning seven points in staff education, six points program standards, and one quality point for having obtained an Infant/Toddler Certificate. You stated you use The Creative Curriculum for Family Child Care as the required curriculum used with four-year and five-year-old children. You stated the five children ranging in age from two-years to four-years attending on first shift during today’s visit were the only children you had enrolled in your family child care home. You stated you had no infants enrolled and no children enrolled on second shift or third shift at this time. I verified that you have completed the initial lead water testing required to be completed by January 2025 and will need to be completed every three years thereafter. Your initial lead water test results dated February 29, 2024 indicated that your water is within acceptable ranges. I verified that you have started the lead-based paint and asbestos testing and are waiting for on-site results. I visited each indoor space today. Your designated child care room was set up in activity areas including areas for art, blocks, books, manipulatives, dramatic play. Children were participating in routine care activities, eating snack, participating in teacher directed whole-group music and language activities, and playing in the designated child care space of your home. I observed food stored in cabinets, on a cart, and a residential refrigerator in your kitchen at a temperature of 34 degrees Fahrenheit. I monitored hazardous product storage, medication storage and medication administration, general safety, fire safety, and sanitation. I reviewed program records including fire drills, emergency drills, Emergency Preparedness and Response (EPR) Plan, emergency medical care plan, outdoor safety inspections, incident log, arrival and departure time records, and attendance records. I reviewed your staff record file. I was able to verify that you had completed Recognizing and Responding to Suspicions of Child Maltreatment training, had documentation of valid and current First Aid and CPR training certification, and had documentation of current ITS-SIDS certification. I was also able to verify that you had completed your five-year renewal of your Health and Safety Training topics from March 16, 2021 through August 5, 2024. The Criminal Background Check (CBC) qualification letter for you, M Pegues, owner/operator, expired on October 7, 2024. You stated you had been attempting to contact the CBC Unit and had been attempting to submit your application for a five-year recheck since early October 2024. You shared email documentation that documented that your contacts with the CBC Unit had occurred from early October 2024 through November 21, 2024. You stated and I was able to verify that your application with through the ABCMS portal was in process as of November 21, 2024. You stated you needed to have your fingerprints taken and submitted electronically to complete the recheck application process. You stated the CBC Unit told you that you needed to complete the recheck application process first before your family members that reside in the home could complete the recheck application process. The CBC qualification letter for R Pegues and A Pegues, family members residing in the home, expired on October 16, 2024 and October 17, 2024. You stated you would complete the recheck application process for your family members as soon as you received your CBC qualification recheck letter. I monitored health & safety requirements. I monitored your written operational policies and procedures during a routine unannounced visit on January 18, 2024. You stated you had made no changes to your written policies since January 2024. I monitored supervision, licensed capacity, designated space use, and permit restrictions. The following violations were observed and cited during today’s visit: Violation Number Comment Rule 930 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years from the date of issuance). The Criminal Background Check qualification letters required for five year rechecks for the owner/operator and two family members residing in the home had expired on October 7, 2024, October 16, 2024, and October 17, 2024. G.S. 110-90.2 & .2703(n) & (o) 1922 Plastic bags, toys, and toy parts small enough to be swallowed, including but not limited to materials that can be easily torn apart such as foam rubber and styrofoam, were accessible to children under the age of three. One pack of pull-ups in opened shrink-wrap plastic and one opened plastic refill bag of diaper wipes were stored in an unlocked diaper changing table in the bottom shelf below five feet. .1719(a)(18) TECHNICAL ASSISTANCE 1. Per child care rule 10A NCAC 09 .1719(a)(18), plastic bags, toys, and toy parts small enough to be swallowed, including but not limited to materials that can be easily torn apart such as foam rubber and styrofoam, should be made inaccessible to children under the age of three. Plastic bags should be stored inaccessible to children above five feet or in a locked cabinet, closet, or drawer. Grocery bags, opened shrink wrapped or bagged products, diapers or pull-ups in opened plastic shrink wrap, opened diaper wipe refill packets, used and unused trash bags, used zip-loc bags, and opened teacher supply materials are considered plastic bags. Today, I observed one pack of pull-ups in opened shrink-wrap plastic and one opened plastic refill bag of diaper wipes stored in an unlocked diaper changing table in the bottom shelf below five feet. You moved these two plastic items to the shelf above five feet in the bathroom used by the children. To maintain compliance with this child care requirement, I suggest you remember to store these plastic items on the shelf above five feet in the bathroom used by the children. 2. Per General Statute 110-90.2 and 10A NCAC 09 .2703(n)&(o), prior to the expiration date of the qualification letter, the child care provider should complete and submit required forms to complete a criminal background check for themselves and for each family member sixteen years of age and older residing in the home. Each qualification letter is valid for a maximum of five years from the date of issuance. Your qualification letter expired on October 7, 2024. The qualification letter for the family members residing in your home expired on October 16, 2024 and October 17, 2024. To correct the violation of this child care requirement, you should complete the recheck application process for you and your two family members and send a copy of the three qualification letters to me by email within fifteen days (on or before December 7, 2024). With the Thanksgiving holiday season coming into play, I advised you to send me email messages to keep me in the loop with each step you take to correct this violation within in the required fifteen day timeframe. To maintain compliance with this child care requirement, I suggest you begin the recheck application process at As a resleast three months prior to the expiration date of any CBC qualification letter. CONSULTATION 1. Keep all outdoor equipment free of standing water. 2. Keep walls, doors, doorframes, and light switches wiped clean routinely. 3. Based on the ages and attention spans of the children enrolled, you may want to consider a shorter amount of time for teacher-directed language activities. I suggest you limit your teacher-directed language activity to one book. Then, allow those children that want to choose activity areas for play to leave the group while those children that want to engage in longer teacher-directed language activities such as reading individually selected books may remain with you to read to them. 4. As a result of tropical storm Helene and a declared natural disaster in Western North Carolina, technical assistance is provided to assist the child care provider in achieving compliance. Please be reminded to add newly enrolled children to your activity plan when documenting individual activity plans. 5. Keep an eye on your inbox for the 2024 annual license fee invoice. Invoices will be emailed to the facility addresses on file by November 30, 2024. Online payments will be due by December 31, 2024. Per North Carolina General Statute § 110-90(1a), licensed child care facilities are assessed an annual license fee. The amount of your annual license fee is based on the licensed capacity printed on your license as of October 1, 2024. It is not based on the number of children enrolled at your facility. Annual license fees do not apply to state- or public school-operated child care facilities, or to religious-sponsored facilities operating under a Notice of Compliance. On Friday, July 12, 2024, DCDEE sent a “Raise North Carolina” email blast announcing the signing of Senate Bill 425. The email contained a section entitled, “Quality Rating Improvement System (QRIS) Modernization” which provided updated information regarding the Rated License Reassessment process and approved extended stabilization grant funding. What does all this mean for child care in general? 1. The new QRIS Modifications and additional pathways will be added to law which included moving to the use of the updated Environmental Rating Scale (ERS-3 versions) for ECCERS. ITERS and FCCERS, effective February 1, 2025. DCDEE and the NC Child Care Commission have already begun the rulemaking process to add the rule language to child care requirements. This process with take several months. 2. Hold Harmless provisions have been extended. Star rated license reassessments are postponed until the QRIS rulemaking process has been completed. Providers in any Cohort may voluntarily request a star rated license reassessment if they wish. Star rated license assessments are still required for new child care programs. 3. A pathway for child care programs currently accredited through the approved accrediting bodies may now move to a 3- or 5-star license if they are not already at this star level. Providers will need to submit a request to their licensing consultant and provide a copy of their accreditation award/certificate for processing: Accreditation Licensure Request Form. What does all this mean for facilities in Cohort 1? A facility may voluntarily request to complete the star rated license reassessment at any time but will not be required to complete the star rated license reassessment process this year. What does this mean for the Environmental Rating Scales? Please be reminded that if a facility voluntarily chooses to complete the star rated license reassessment AND chooses to complete one or more Environmental Rating Scale (ERS) assessments, the ERS-revised editions will continue to be used until January 31, 2025. Any ERS assessment completed on February 1, 2025 and after will be assessed using the ERS-3 versions. If you wish to VOLUNTARILY move forward with a rated license reassessment, please reach out to me as soon as possible so plans can be made on both our calendars to ensure ease and success with completing the star rated license reassessment process in a timely manner that benefits us both. Over the next few months, I recommend you complete the following tasks and activities that will help you complete your reassessment process when the time comes: 1. Have all staff update WORKS accounts to reflect all currently completed coursework (DCDEE-WORKS). 2. Determine whether you wish to have ERS Assessments conducted. 3. Request technical assistance with your child care consultant and local partners. 4. Participate in local CCR&R and NCPC quality related training/workshops (CCRR Information). 5. Reach out to your local Community College to discuss educational opportunities. 6. Review NCRLAP website ERS resources (www.NCRLAP.org). 7. Review ERS requirements and think carefully about the current characteristics and practices in your program and classrooms. COMPLIANCE PLAN: No compliance documentation is needed for violation item number 1922 corrected during today’s visit. I documented in the visit summary the corrective actions taken today to correct this violation. All violations cited and not corrected today must be corrected immediately. Please submit a written, signed, and dated statement to me at the email/address below detailing the steps taken to correct each violation. 1) Your compliance letter must include the following: 1. The name of your center 2. The center’s ID number 3. The date you write the letter 4. Address each violation stating how you corrected the violation and are now in compliance. 5. You, Martha Pegues, Owner/Operator, assisted me with today’s visit. I conducted last annual compliance visit on May 23, 2024. We reviewed the facility input form to ensure that there were no changes to your facility information. You stated there were no changes to the facility information. We reviewed the facility permit to ensure that there were no changes to your facility’s operation. The facility is owned/operated by Martha J Pegues. As the owner/operator, you are required by Child Care Rule .0102 (19) to reside in the home where the license is issued and according to General Statute 110-91(8) to be the full-time caregiver to the children enrolled at the family child care home. You stated you live in the home and are the person working full-time to care for the children enrolled at your family child care home. We reviewed the restrictions on your family child care home license as well as the capacity, shifts of care, and the age range of the children served at your facility. You stated that you did not have any questions regarding the information reviewed with you regarding your license. Your program’s compliance history was 99% as of November 18, 2024 and was reviewed with you today. Your program currently operates with a five-star license, issued on August 18, 2017, earning seven points in staff education, six points program standards, and one quality point for having obtained an Infant/Toddler Certificate. You stated you use The Creative Curriculum for Family Child Care as the required curriculum used with four-year and five-year-old children. You stated the five children ranging in age from two-years to four-years attending on first shift during today’s visit were the only children you had enrolled in your family child care home. You stated you had no infants enrolled and no children enrolled on second shift or third shift at this time. I verified that you have completed the initial lead water testing required to be completed by January 2025 and will need to be completed every three years thereafter. Your initial lead water test results dated February 29, 2024 indicated that your water is within acceptable ranges. I verified that you have started the lead-based paint and asbestos testing and are waiting for on-site results. I visited each indoor space today. Your designated child care room was set up in activity areas including areas for art, blocks, books, manipulatives, dramatic play. Children were participating in routine care activities, eating snack, participating in teacher directed whole-group music and language activities, and playing in the designated child care space of your home. I observed food stored in cabinets, on a cart, and a residential refrigerator in your kitchen at a temperature of 34 degrees Fahrenheit. I monitored hazardous product storage, medication storage and medication administration, general safety, fire safety, and sanitation. I reviewed program records including fire drills, emergency drills, Emergency Preparedness and Response (EPR) Plan, emergency medical care plan, outdoor safety inspections, incident log, arrival and departure time records, and attendance records. I reviewed your staff record file. I was able to verify that you had completed Recognizing and Responding to Suspicions of Child Maltreatment training, had documentation of valid and current First Aid and CPR training certification, and had documentation of current ITS-SIDS certification. I was also able to verify that you had completed your five-year renewal of your Health and Safety Training topics from March 16, 2021 through August 5, 2024. The Criminal Background Check (CBC) qualification letter for you, M Pegues, owner/operator, expired on October 7, 2024. You stated you had been attempting to contact the CBC Unit and had been attempting to submit your application for a five-year recheck since early October 2024. You shared email documentation that documented that your contacts with the CBC Unit had occurred from early October 2024 through November 21, 2024. You stated and I was able to verify that your application with through the ABCMS portal was in process as of November 21, 2024. You stated you needed to have your fingerprints taken and submitted electronically to complete the recheck application process. You stated the CBC Unit told you that you needed to complete the recheck application process first before your family members that reside in the home could complete the recheck application process. The CBC qualification letter for R Pegues and A Pegues, family members residing in the home, expired on October 16, 2024 and October 17, 2024. You stated you would complete the recheck application process for your family members as soon as you received your CBC qualification recheck letter. I monitored health & safety requirements. I monitored your written operational policies and procedures during a routine unannounced visit on January 18, 2024. You stated you had made no changes to your written policies since January 2024. I monitored supervision, licensed capacity, designated space use, and permit restrictions. The following violations were observed and cited during today’s visit: Violation Number Comment Rule 930 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years from the date of issuance). The Criminal Background Check qualification letters required for five year rechecks for the owner/operator and two family members residing in the home had expired on October 7, 2024, October 16, 2024, and October 17, 2024. One pack of pull-ups in opened shrink-wrap plastic and one opened plastic refill bag of diaper wipes were stored in an unlocked diaper changing table in the bottom shelf below five feet. .1719(a)(18) TECHNICAL ASSISTANCE 1. Per child care rule 10A NCAC 09 .1719(a)(18), plastic bags, toys, and toy parts small enough to be swallowed, including but not limited to materials that can be easily torn apart such as foam rubber and styrofoam, should be made inaccessible to children under the age of three. Plastic bags should be stored inaccessible to children above five feet or in a locked cabinet, closet, or drawer. Grocery bags, opened shrink wrapped or bagged products, diapers or pull-ups in opened plastic shrink wrap, opened diaper wipe refill packets, used and unused trash bags, used zip-loc bags, and opened teacher supply materials are considered plastic bags. Today, I observed one pack of pull-ups in opened shrink-wrap plastic and one opened plastic refill bag of diaper wipes stored in an unlocked diaper changing table in the bottom shelf below five feet. You moved these two plastic items to the shelf above five feet in the bathroom used by the children. To maintain compliance with this child care requirement, I suggest you remember to store these plastic items on the shelf above five feet in the bathroom used by the children. 2. Per General Statute 110-90.2 and 10A NCAC 09 .2703(n)&(o), prior to the expiration date of the qualification letter, the child care provider should complete and submit required forms to complete a criminal background check for themselves and for each family member sixteen years of age and older residing in the home. Then, allow those children that want to choose activity areas for play to leave the group while those children that want to engage in longer teacher-directed language activities such as reading individually selected books may remain with you to read to them. 4. I look forward to helping you through this rated license reassessment process 4 Items to include in a vehicle binder for each vehicle for DCDEE review: • Daily Transportation Roster (with accurate information documented daily) • Blanket permissions slips for routine transportation • Copy of each child’s application with the child’s picture attached • List of allergies or special health considerations and any medical action plans which would need to be followed • Copy of each staff person’s emergency info/health questionaries’ with staff picture attached • List of emergency telephone numbers: facility, administrator, owner etc. • Copy of current vehicle inspection • Copy of current vehicle insurance • Copy of current vehicle registration • Copy of each driver’s license for all designated drivers, including class C commercial driver’s license with a passenger endorsement if required (please see above) • Copy of DOT # (Department of Transportation Number) if the vehicle is designed for 9+ passengers including the driver (please see above) 5 Child Care Rule reminders for transportation: • First aid kit (secured in the vehicle) • Fire extinguisher (secured in the vehicle) • No smoking sign posted and visible in the vehicle • The vehicle must be in good repair and free of hazards (includes tire tread) • No children are left in the vehicle unattended by an adult • Children need to be loaded and unloaded in areas safe from traffic • Cell/mobile or two-way device needs to be available in the event of an emergency • Staff cannot be on the phone using their cell or two-way devices when there is no emergency and/or when the vehicle is moving (calls and use of mobile devices need to be made when the vehicle is parked and in a safe location) COMPLIANCE PLAN: All violations cited must be corrected immediately. Please submit written, signed, and dated compliance documentation to me at the email/address below detailing the steps taken to correct each violation. Your compliance documentation must include the following: 1) A compliance letter including the following: 1. The name of your facility 2. The ID number of your facility 3. The date you write the letter 4. A corrective action statement for each violation stating how you corrected the violation and are now in compliance. 5. A compliance plan statement for each violation stating how you plan to ensure that you will not have that violation again. 6. Your signature 2) Supporting documentation including the following: Please send supporting documentation such as training certificates, CBC letters, acknowledgement statements, and photographs for me to use to verify compliance. Please DO NOT send staff or child medical documents or documentation for verification as this is a violation of HIPPA protocol. If needed I will verify these documents at the next monitoring visit. I must receive your compliance letter no later than February 1, 2024. Please be aware any information submitted by you is legal documentation. If you state in your compliance letter that corrections have been made when they have not, it will be considered falsification of information. If you cannot meet the requirements by this date you shall contact me with a timeline of the corrections. In some cases, this timeline may be extended. Failure to correct the violations and send the written statement by the due date listed above may result in an unannounced follow-up visit being conducted or an administrative action may be recommended. Based on Child Care Rule 10A NCAC 09 Section .2200, the Division of Child Development and Early Education may take administrative action against the license and/or impose civil penalties based on the failure of the operator to correct any documented violations within the established time period. Child care programs are required to maintain compliance with all applicable child care rules and regulations at all times. North Carolina General Statute 110-90(4)(d) requires all child care facilities to maintain a compliance history of at least seventy-five percent (75%) for the past eighteen (18) months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action against the facility's license. Any violations cited during a visit may affect your score.
