You, April Icard, Lead Teacher, assisted me with today’s visit. I completed your last annual compliance visit on May 2, 2024. Today, I reviewed with you the facility information found in our system. You stated there are no changes to the facility phone number, fax number, email address, or mailing address. You requested that I add a web address to the database information which I added today. I reviewed the restrictions, capacity, and age range on your permit and observed these being maintained today. Your program’s compliance history was 95% as of April 3, 2025, and was reviewed with you today. Your program currently operates with a five-star license, issued on February 29, 2024 earning seven points in staff education, seven points in program standards, and one quality point for 75% of lead teachers having an BA/BS or higher in early childhood education or child development. Your last sanitation inspection was dated January 7, 2025, with a Superior classification and zero demerits. I verified that you completed the process for new lead water testing required to be completed every three years. Today, I verified that the test results dated April 26, 2024 indicated that your facility’s drinking water source was within the required limits. I verified that you have not enrolled for the lead-based paint testing and the asbestos testing as required. Please enroll for these tests by May 31, 2025. Your last fire inspection on file was dated October 29, 2024 and was received in my office on November 14, 2024 as a six month inspection. I completed a walk-through of the facility today. I monitored the indoor and outdoor licensed spaces. Children were participating in a whole group activity, playing in activity areas, transitioning from activity areas to story-time ballet, participating in story-time ballet, transitioning from indoors to outdoor play, playing outdoors, transitioning from outdoors to indoors, washing hands, participating in a whole group music and movement activity with screen-time, eating lunch, preparing for nap, and napping. A current menu was posted, documented appropriate nutritious snacks and meals, showed a variety of foods, and complied with Meal Patterns for Children in Child Care Programs. Meals were prepared in the school cafeteria and served in the classroom. Cold food was stored in a residential refrigerator in the classroom at a temperature of 40 degrees Fahrenheit. Milk was stored in a milk cooler in the cafeteria. Today’s lunch included cheese pizza, potato wedges, cherry applesauce, and unflavored milk. I monitored hazardous product storage, medication storage, medication administration, general safety, and discipline practices. I monitored program records, child record files, staff record files. I monitored health and safety requirements. I monitored NC Pre-K requirements during today’s visit. The Administrator, who is the Director of Elementary Education, Federal Programs, and CTE for Hickory Public Schools, does not serve as the Lead Teacher or Assistant Teacher in the classroom. You use “The Creative Curriculum Developmental Continuum for Ages 3 – 5, 2001” as the Formative Assessment tool, DIAL-4 as the developmental screening tool, and Creative Curriculum as your approved curriculum. Your family engagement component includes formal and informal parent-teacher conferences, classroom visits and options for parents and families to participate in classroom activities, parent education, opportunities for involvement in decision making about the early childhood program, and opportunities to participate in activities outside the regular school day. You call or text the parent on the day of absence. After three days of any child’s absence, you as the legal designee contact the contracting agency so they can contact the parent and inquire about the reason for the absence. Children enrolled in NC Pre-K attend your program from 8:00am to 3:00pm. NC Pre-K staff work from 7:30am to 3:30pm. Your NC Pre-K program follows the Hickory Public Schools calendar for the 2024 – 2025 school year. I monitored supervision of children, staff-child ratios and group sizes, approved space use, space capacities, and permit restrictions. I completed the “Annual Compliance Monitoring Checklist for Child Care Centers” during today’s visit. I observed and cited the following violation during today's visit: Violation Number Comment Rule 1867 The depth of the loose surfacing was not based on critical height of the equipment. The mulch under and around the swings measured between one to ten inches prior to the children playing on the outdoor play area. .0605(k)(1-4) TECHNICAL ASSISTANCE Per child care rule 10A NCAC 09 .0605(k)(1-4), the depth of the loose surface material under and around stationary equipment and swings should be based on critical height of the equipment. Today, the mulch under and around the swings measured between one to ten inches prior to the children playing on the outdoor play area. I believe there is a sufficient amount of mulch surfacing that could be moved around to maintain the required depth of six inches. To maintain compliance with this child care requirement, I suggested you rake the mulch from the high spots around the swings that measured more than six inches to the low spots under the swings that measured one to six inches. CONSULTATION 1. As discussed today, your facility has not been enrolled for the lead-based paint testing and the asbestos testing as required. Please enroll for these tests by May 31, 2025. 2. As discussed today, since this facility was newly licensed in 2023, this facility is not held harmless under the hold harmless provision and should therefore maintain the star-rated license requirements as a 5-Star facility. The lead teacher and teacher newly assigned to this facility in August 2024 did not change the staff education points earned by this facility in February 2024. No concerns were observed regarding this facility’s program standards. The facility continues to qualify for the quality point. This facility continues to earn seven points in staff education, seven points in program standards, and one quality point for 75% of lead teachers having an BA/BS or higher in early childhood education or child development and therefore maintains a 5-Star rated license. 3. The NC Summary of Child Care Law brochure and poster were both updated in February 2025 and are available on the DCDEE website at https://ncchildcare.ncdhhs.gov/Provider/Provider-Documents-and-Forms. Today, I observed the February 2025 version of the NC Summary of Child Care Law poster posted in a prominent location in the classroom. Please begin to include and use the February 2025 version of the NC Summary of Child Care Law brochure in your enrollment packet. 4. As stated in G.S. 110-90.2 & .2703(r), child care operators have five business days to notify the Division of any new child care providers working who were hired or moved into the child care facility. The process of notifying the Division has changed and is now captured in ABCMS. This change has been in effect since February 2024. The compliance of this rule will be monitored during your next visit. No action is needed on your part if you have already completed the ABCMS Provider Portal training and are currently using the ABCMS Provider Portal to update information regarding new hires or FCCH residents. Be sure this information is updated in ABCMS on an ongoing basis as staff members are hired and terminated and as FCCH residents move in or reach sixteen years of age. If you are not already using the ABCMS Provider Portal to update information regarding new hires or FCCH residents, you will need both an Individual NCID and a Business NCID. You will need an email address for your Individual NCID and a different email address for your Business NCID account. Once you have created your Business NCID, complete the ABCMS Provider Portal training in Moodle at https://www.dcdee.moodle.nc.gov/course/view.php?id=119. Once the training has been completed and access has been given to you, you must verify your facility roster to ensure current staff or current FCCH residents are noted on the roster. This information should be updated in ABCMS in an ongoing basis as staff members are hired and when their employment is terminated and as FCCH residents change or reach sixteen years of age. These actions satisfy the requirement to notify the Division within five business days of new child care providers working who were hired or moved into the child care facility. Please note, the hard copy of the Change of Information form will no longer be needed or accepted. The new QRIS Modernization Plan known as “Pathways to Success” is being added to law which included moving to the use of the updated Environmental Rating Scale (ERS-3 versions) for FCCERS, effective February 1, 2025. Hold Harmless provisions have been extended. Star rated license reassessments are postponed until the QRIS rulemaking process has been completed. Star rated license assessments are still required for new child care programs. A pathway for child care programs currently accredited through the approved accrediting bodies may now move to a 3- or 5-star license if they are not already at this star level. Providers need to submit a request to their licensing consultant and provide a copy of their accreditation award/certificate for processing: Accreditation Licensure Request Form. Please be reminded any ERS assessment completed on February 1, 2025 and after will be assessed using the ERS-3 versions. 6. I observed the facility’s temporary license, NC Summary of Child Care Law poster, Classroom Staff to Child Ratio chart, safe arrival and departure procedures, emergency medical care plan, evacuation plan, daily schedule, activity plan, and emergency phone numbers posted in a prominent area in the classroom. I observed the last monthly fire drill documented on the Fire Drill Log dated November 30, 2023. I observed the last monthly playground inspection dated November 29, 2023. I observed the last emergency drill documented on the Emergency Drill Log was a shelter-in-place drill dated October 19, 2023. I observed your most recent sanitation inspection was completed on October 2, 2023, with a superior rating and zero demerits. I observed your most recent fire inspection was completed on June 15, 2023. I observed the current and posted menu documented appropriate nutritious snacks and meals, showed a variety of foods, and complied with Meal Patterns for Children in Child Care Programs. I observed meals prepared in the school cafeteria and served in the classroom. I observed breakfast served which included a doughnut, pineapple juice, and milk. I observed lunch served which included mandarin orange chicken, brown rice, glazed carrots, tangerine sorbet, and unflavored 1% milk. I observed and cited no violations related to nutritional requirements In the classroom, I observed water bottles and lunch bags stored in a full-size refrigerator at a temperature of 36 degrees Fahrenheit. I observed water bottles and lunch items labeled with the name of the child and dated with a current date for service. I observed and cited no violations related to food storage. I completed a walk-through of the indoor and outdoor environment to monitor safety. I observed and cited one violation. I observed the children eating breakfast, completing bathroom routines, transitioning to a whole-group activity, participating in a whole-group lesson, transitioning to outdoor play, participating in free choice play inside, and eating lunch. I observed activity areas available to the children with sufficient materials and child-sized furniture. I observed art, books, manipulatives, blocks, dramatic play, science, music, listening, light table, lego table, playdough, dollhouse and accessories, math, sand and water play, and writing activity areas accessible to the children. I observed a maximum group size of no more than eighteen children maintained. You stated you have time outside the instructional day to participate in professional development, scheduling, and planning. You stated you use Teaching Strategies as your developmental screening tool and formative assessment tool. You stated you use Creative Curriculum as your approved curriculum and the NC Foundation for Early Childhood Education as your curriculum resource. You stated you have documentation of communication with parents regarding children’s attendance and participation in classroom activities. You stated you call parents and contact them through the Class DoJo app when three consecutive absences occur. You stated children enrolled in your classroom attend from 8:10 a.m. to 2:50 p.m. You stated your classroom follows the 2023 – 2024 school calendar for Hickory Public Schools. I observed and cited no violations related to NC Pre-K requirements. We discussed the rated license process and how you will earn points towards a star rated license at the end of your temporary license that expires on February 28, 2024: Program Standards - The points earned will be determined by your score earned on the ECERS-R environmental rating scale as well as enhanced ratios and space. You completed the Application for Assessment for a Two Component Star Rated License form and the Rated License Request review form on October 16, 2023. The Environmental Rating Scale (ERS) assessment will be requested as soon as I receive your compliance letter documenting correction of violations cited during today’s visit. Education Standards - The points earned will be determined by the education of your Administrator and classroom staff. Prior to today’s visit, I verified that all staff have their current education in WORKS. Today, I verified the licensed child care work experience for all staff members. Quality Point – You completed the Quality Point Form on October 16, 2023 requesting to use the Educational Option: 75% of lead teachers have a BA/BS or higher in early childhood education or child development. Today, I verified your program qualifies for this quality point. Your facility will earn one quality point based on this educational option. The following violations were observed today: Violation Number Comment Rule 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. Per sanitation rule 15A NCAC 18A.2820(b), all cleaning supplies and items with “Keep out of the reach children” labels with additional warnings such as poison control contact numbers or first aid procedures should be stored in a locked cabinet, drawer, or closet. 3. Per child care rule 10A NCAC 09 .0605(k)(1-4), the loose surfacing on outdoor play areas should be at least six inches deep under and within the fall zones of installed equipment including composite pieces and swings. To maintain compliance with this child care requirement, I suggest you rake the loose mulch available from outside the fall zones to fill the low areas within the fall zones. I also suggested you use a tiller to fluff the compacted mulch and then rake it to the fall zones. 4. Per NC General Statute 110-91(1), each child should have a health assessment and immunization record on file within 30 days of the child’s first day of attendance. Documentation of the health examine, immunizations, and all screenings should be in each child’s record file within 30 days of the child’s enrollment date. Acceptable forms of documentation for the health examine include the Children’s Medical Report located on the DCDEE website or the kindergarten health assessment form. Acceptable forms of documentation for the screenings would include a health care wellness visit summary from a vision specialist, hearing specialist, dentist, or the child’s health care provider stating a vision, hearing, and/or dental screening was completed, a signed and dated statement from a school nurse or child care health consultant, or the kindergarten health assessment form. To maintain compliance with this child care requirement, I advised you to examine the received document to be sure a vision, hearing, and dental screening was completed. If the child was uncooperative, the health care professional conducting the screening may document that on the form. If you accept the kindergarten health assessment form as documentation of the health examine, you still need to require the parent to complete Part A of the Children’s Medical Report and staple the two documents together. I advised you to be cautious when accepting the kindergarten health assessment form because it does not have a section for dental screening and therefore, a dental screening would be required from another health care professional such as a dentist or school nurse. I suggest you give each parent a copy of the Children’s Medical Report document in the enrollment packet. When a health assessment or immunization record is not received within 2 weeks of the child’s enrollment, I further suggest you send the parent a reminder requesting the health assessment be completed. As discussed today, I suggest you keep documentation of any and all contact and requests you make with the parent. If the parent has a doctor’s appointment scheduled after the 30-day deadline, I suggest you require the parent bring you documentation from the doctor to verify the appointment has been made. 5. Per child care rule 10A NCAC 09 .1804(c), each parent should be given a copy of the discipline policy and should sign and date an acknowledgement statement stating they have received a copy of the discipline policy. This acknowledgement statement should include the child’s date of enrollment. To maintain compliance with this child care requirement, I suggested you review the discipline policy acknowledgement statement in each child’s file and make sure the enrollment date has been recorded. 6. Per child care rule 10A NCAC 09 .0608(b), each parent should be given a copy of the facility’s Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy and should sign and date an acknowledgement statement stating they have received a copy of this policy. I reminded you that programs with less than a three-star license will not be eligible to receive subsidy funding. 2. You must maintain at least a 75% or higher Compliance History to be eligible to apply for a star-rated child care license. Your Compliance History will continue to build over an 18-month period. The compliance history is based on violations that are cited during visits to your center. If you have an acceptable compliance history at the end of your six-month temporary license you will be eligible to apply for a rated license. You must maintain at least a 75% or higher compliance history to maintain your star license. If your center's compliance history drops below 75% you may receive an administrative action. 3. When a new staff member starts working at a facility and gives the administrator a CBC qualification letter that was previously completed while working at another facility, but is still current, the administrator must send a Change of Information form for that new staff member to the CBC unit. You, Amber Jenkins, Lead Teacher, assisted me with today’s visit. Kimberly Crane, Child Care Consultant, accompanied and assisted me on today’s visit. Currently, this center operates with a temporary license issued on August 28, 2023, with the following restrictions: Daytime care only. A walkthrough of the indoor and outdoor environment was completed. The children were observed participating in free choice play inside, completing bathroom routines, and transitioning to outdoor play. Supervision, staff/child ratios, permit restrictions, group size, capacity, adequate and approved space, and hazardous product storage were monitored as in compliance during today’s visit. The center's temporary license, NC child care law summary, staff/child ratio chart, safe arrival and departure procedures, emergency medical care plan, evacuation plan, daily schedule, and emergency phone numbers were prominently posted. The last monthly fire drill was completed on September 28, 2023, at 8:42am. The last monthly playground inspection was completed on September 29, 2023. An emergency drill should be completed every three months and documented on the Emergency Drill Log. You have until the end of November 2023 to complete an emergency drill. The sanitation inspection was completed on October 2, 2023, and you received a superior rating and zero demerits. The last fire inspection was completed on June 15, 2023. Three staff files were monitored. Three children’s files were monitored. The menu documented appropriate nutritious snacks and meals, showed a variety of foods, and complied with Meal Patterns for Children in Child Care Programs. The NC Pre-K requirements in section .3000 of the childcare rules were monitored for compliance. The program uses Creative Curriculum and Teaching Strategies. The lead teacher has documentation of communication with parents regarding children’s attendance and participation in classroom activities. The classroom operates from 8:10 a.m. to 2:50 p.m. We discussed the rated license process and how you will earn points towards a star rated license at the end of your temporary license that expires on February 28, 2024. Program Standards-The points earned will be determined by your score earned on the ECERS-R environmental rating scale as well as enhanced ratios and space. You completed the Application for Assessment for a Two Component Star Rated License form and the Rated License Request review form. The Environmental Rating Scale (ERS) assessment will be requested at the beginning of December 2023. You may request assistance to prepare for the assessments from your local Partnership for Children. You can also access resources at www.ncrlap.org. Education Standards-The points earned will be determined by the education of your Administrator and classroom staff. All staff must have their current education in WORKS. Quality Point-You may earn one additional point by meeting an enhanced requirement listed on the Quality Point options list provided to you today. Please send me what quality point you would like to meet in order for it to be verified and approved. I reminded you that programs with less than a three-star license will not be eligible to receive subsidy funding. The following violations were observed today: Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. The posted activity plan was not dated. GS 110-91(12); .0508(a) 533 Breast milk, formula and other bottled beverages including sippy cups, sent from child's home were not fully prepared, dated, and labeled for the appropriate child. One child had a water bottle from home that was not labeled with the child's name or dated. 15A NCAC 18A .2804(d) Technical assistance was given in the following areas: Item#0533-Check all food and drinks sent from home to ensure that they are labeled with the child’s name and today’s date. Item#428-Ensure that the activity plan is dated so that it can be verified as current. Consultation for the ECERS-R assessment: 1. Allow bleach water to sit on surfaces at least two minutes before wiping off or using the surface. 2. Ensure that children wash hands upon arrival, before and after water play, after messy art/play dough play, after coming in from outside, before eating, after toileting/diapering and after coughing/sneezing, etc. 3. Ensure that learning centers are accessible a substantial portion of the day and that your daily schedule reflects it. Areas that must made available for a minimum of 2hrs and 10 minutes to meet the “Substantial Portion of the Day” requirement are: Fine Motor Art Blocks Dramatic Play Nature/Science/Exploration Math/Numbers Books 4. Ensure that children go outside every day weather permitting. 5. Ensure that your block centers are protected from foot traffic, large enough for three children to build a sizeable structure and enough blocks for three children to build. 6. Ensure that books and materials are in good repair and no books depict violent images (guns, swords, teeth bearing). 7. Ensure that the majority of direction/redirection is positive instead of negative. 8. Ensure that staff member's pocket books are stored in locked storage since they almost always contain medications or lotions that must be inaccessible to children. Consultation was provided in the following areas: You must maintain at least a 75% or higher Compliance History to be eligible to apply for a child care license. Your Compliance History will continue to build over an 18-month period. The compliance history is based on violations that are cited during visits to your center. If you have an acceptable compliance history at the end of your six-month temporary license you will be eligible to apply for a rated license. You must maintain at least a 75% or higher compliance history to maintain your star license. If your center's compliance history drops below 75% you may receive an administrative action. Health and Safety Training must be completed by all staff within one year of employment unless the staff member has completed all health and safety training within one year of employment at your facility. Recognizing and Responding to Child Maltreatment training must be completed by all staff within 90 days of employment. CPR and First Aid training must be completed by all staff within 90 days of employment. Ensure that CPR and First Aid training is taken in-person, by an approved trainer and training agency, as well as the type of training is Pediatric or Infant/Child CPR and First Aid training. New staff must have a current criminal background check, medical exam, and TB test or TB screening completed prior to employment. Federal law requires that an employer keep all medical information confidential and in separate medical files. Any staff medical statements, any proof of tuberculosis test or screening, and any completed health questionnaires must be included in a staff member's medical file, which must be maintained separately from that staff member's individual personnel file.
