Jennifer Linhardt, Licensing Supervisor, accompanied me on the visit today. I also provided you with copies of Attempted Visit Summaries dated 1/29/2026, 1/30/2026, and 2/12/2026. You signed the copies of each visit summary, and I provided you with a copy. Today’s Observations – The administrator and lead teacher were present, but no children had arrived due to the Presidents Day Holiday. The following violations documented during the 1/6/2026 visit were monitored for compliance during this visit: #1044: Five-year Criminal Background Check - not completed for C. Perry; expired on 9/15/25; completed per information available on ABCMS portal on 2/10/2026; verified to be in compliance #1321: Children’s Medical Report – missing for SW; enrolled 9/25/25; stated to be corrected in compliance letter received on 1/20/26; observed in file and verified to be in compliance #1323: Documentation of Immunizations – missing for SW; enrolled 9/25/25; stated to be corrected in compliance letter received on 1/20/26; observed in file and verified to be in compliance #1757: Qualifying Letter – not available for C. On January 29, 2026, the operator denied the child care consultant access to center to complete a follow-up visit to verify correction of violations documented during an Annual Compliance visit on January 6, 2026. GS 110-105 1301 Center did not maintain a record of daily attendance. Documentation of daily attendance was not available for January 2026. GS 110-91(9) * Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violations documented may impact the compliance history score. The violations documented must be corrected immediately. On or before 3/2/2026, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. Modlin, operator, did not allow me, Marjorie White, Child Care Consultant, inside the center to complete a follow-up visit to verify correction of violations documented during an Annual Compliance visit from 1/6/2026. I arrived at Precious Gifts Child Development Center at approximately 12:55 pm. I rang the door bell and waited. I could hear your voice and the voices of children. Knowing that the you might be alone and needed to bring the children to the door with you, I waited for about sixty seconds before ringing the door bell a second time and then a third time. After there was no response, I called your cell phone. You answered, and I explained the reason for my visit. You stated that C. Perry was not there and had not been working since 1/21/2026. I informed you that because you were open and had children present, I still needed to complete the visit. You told me that you were not feeling well and had called the parents to pick up the children. You asked me to come back the next day. I explained that because I was here and there were children present, I needed to complete the visit. You again stated that you were not feeling well and I could come back the next day. I told you I would discuss it with my supervisor. You stated that you would be contacting Ms. Linhardt also. After speaking with my supervisor, she stated that I could do a quick Attempted visit summary to determine how many children were present and then return another day to do the Follow-up visit. I again rang the doorbell, called you and explained that I still needed to come in a complete a quick Attempted visit summary for you to sign. It would take no more than ten minutes. You stated that you were putting the children down for a nap and could not leave them. You again stated that you were not feeling well, and I could come back another day. I asked, “Are you denying me entrance to your center?” You stated, “No, but you need to come back another day.” I offered to walk around the building and knock on the direct exit to the toddler classroom so that you would not have to leave the classroom or bring the children to the front door. You again said that you were not feeling well and had called the parents to pick up their children. I again asked, “Are you going to open the door so I can do a quick Attempted Visit to verify the number of children and for you to sign?” You replied, “No.” I said, “Good-bye,” and went to my car, called my supervisor and left the premises. Today you stated that you were sick and could not speak with me. Describe in your compliance letter how you will allow access to your child care consultant or any other representative of the state on future visits. #1301: Daily Attendance – Maintaining accurate attendance records documents when children are present and may be needed to verify subsidy payments, staff/child ratios or permit capacity, or be used for court issues. You were not able to provide documentation of attendance including arrival and departure from January 22, 2026 – January 31, 2026. You stated that you had probably taken it home in your briefcase to review. Sign-in and sign-out sheets were available for February 4, 2026 – today. You are required to maintain a record of arrival and departure for children attending your facility and maintain attendance records for at least one year. For your compliance letter, state how you will ensure that attendance records are maintained and available on-site for at least one year. Also scan and email the attendance records from January 2026. Your program currently operates with a four-star license, issued 5/8/2020, earning 6 points in the education component, 4 points in the program standards component (meeting enhanced ratios and space) and 1 quality point for 75% of lead teachers and teachers have at least 10 years of documented early childhood work experience that can be verified by the Division. Your program was also monitored for compliance with implementing an approved curriculum as required for all four- and five-star licensed facilities where four-year-old children are enrolled. You use Fireflies. The last annual compliance visit was conducted 1/28/2025. The sanitation inspection was completed 3/14/25 with a “Superior” classification. The last fire inspection was conducted 6/27/25 with a “Passed” rating and approved for daytime care only. The center's compliance history was reviewed with the operator. The program’s compliance history was ninety-five percent as of 1/2/26. This facility is owned as a sole proprietorship by Peggy Modlin. License information was current. I monitored the classrooms and spaces used for child care and outdoor play areas for applicable child care center requirements using the Child Care Center Requirements, effective 7/1/2025 and Item Numbers Listing, effective 4/2025. I monitored three staff records, two children’s records and all program records. Two children, one and two years of age, present in Space 3 & 4 were coloring at the table. A third child, two years of age, arrived. The parent signed her in, and the child joined the group. They went outdoors and played on the fenced playground with portable gross motor materials and dramatic play houses. When they returned indoors, they washed hands and ate lunch. After lunch they rested on linen-covered mats. Diapering occurred as needed. A preschool-age child arrived from Head Start, and four school-age children arrived from the school. Lunch was observed and consisted of chicken rice soup with toast, greens, mandarins oranges, and milk. I observed and documented the following violations during today’s visit. During the visit we completed the QRIS Conversation Template with a focus on the selected pathway. Pathway 2: Classroom and Instructional Quality Since you are electing to complete Pathway 2, we focused on those components. *We reviewed current staff education (50% of Lead Teaches and 50% of Other Educators) to determine the facility’s expected star level based on education currently available in Works is 5 Stars. Any staff person who will be evaluated as part of the Lead Teachers or Other Educators needs to register for a Works account and submit original, official transcripts or update their current Works account and submit new education. *We reviewed the Family and Community Engagement Plan, including the Foundational Practices and Optional Practices. This will be completed annually. The operator will create a QRIS notebook to collect documentation of the practices including pictures, flyers, newsletters, emails, etc. *We walked through the Individual and Facility Continuous Quality Improvement (CQI) forms (individual and center). Each staff member will complete an Individual CQI annually. (This will also count as their Professional Development Plan!) The administrator will also complete the Facility CQI Plan to create an overall goal for the center. Maintain these in your staff files and include a copy in the QRIS notebook. We reviewed the list of approved curriculums and formative assessments. You currently use Fireflies (now Lillio) and will look at the curriculum for your younger children. The administrator and lead teachers will need to provide verification that they have received training on the selected curriculum and formative assessment tool. We discussed options for five hours of additional training (on-going training or CEUs) or coaching/mentoring for the administrator and lead teacher. Because Abuse and Neglect registries are also checked, it helps to ensure that children are protected from physical, mental, and sexual abuse. Performing diligent background screenings also protects the child care facility against future legal challenges. Cheryl Perry works as a lead teacher in Space 3 & 4. Her qualification letter dated 9/15/2020 expired on 9/15/2025. A five-year criminal background check was not completed, and a current qualifying letter was not available. Ms. Perry needs to complete and pay for a new on-line application in the ABCMS Applicant Portal and print the paperwork needed for fingerprints. Take the paperwork to your county’s fingerprinting agency to have fingerprints sent electronically to the SBI. In one of two children’s files reviewed, a child’s medical report completed by the child’s physician and documentation of immunizations for a child (SW) enrolled on 9/25/25 was not available. You stated that you have been requesting these documents since enrollment. Inform the child’s parent/guardian that the medical report and immunizations are required and if not received by 1/20/20/2026, the child may no longer attend. Use Children’s File Checklist to verify you have received all required enrollment documents. QRIS (Quality Rating Improvement System) Technical Assistance: P. Modlin, Owner/Administrator, and I discussed the facility’s plan for completing a rated license assessment using the new QRIS rules found in Section .3200 of the NC Child Care Rules. All information on the QRIS rated license assessments and documents will be posted at https://ncchildcare.ncdhhs.gov/Provider/Licensing/Star-Rated-License/QRIS-Modernization and will also be provided through emails and Raise NC newsletters. During the visit we completed the QRIS Conversation Template with a focus on the selected pathway. Pathway 2: Classroom and Instructional Quality Since you are electing to complete Pathway 2, we focused on those components. *We reviewed current staff education (50% of Lead Teaches and 50% of Other Educators) to determine the facility’s expected star level based on education currently available in Works is 5 Stars. Consultation: Age-Appropriate Activities – You are currently grouping children 2 years of age and up to school age together in one classroom due to a shortage of qualified staff. Having this wide range of ages can make it difficult to complete group time and other activities. Younger children have a much shorter attention span and need to be allowed to move and play. The older children can focus longer and can benefit from longer group time as you prepare them for kindergarten. When doing group time, consider having a provider to work with the younger children while the older children have free play time. You can then switch and have the older children have group time while the younger children have free play. This allows you to offer age-appropriate activities for each group to best help them grow their skills. This will also help to reduce behavior issues by reducing the size of the group each provider is supervising. We also discussed using small boxes of crayons to make it easier for children to use and share. Having 1 box for every 2 children makes it easy for children to reach the crayons without having to pull a box shared by all the children at the table. It can also help children focus on coloring and not playing in a big box of crayons. Younger children could have one of each primary color in their box and the older children could have more options. This helps with teaching colors to the younger children and expands the creativity of the older children. Nutrition - Nutritious foods should be offered throughout the day to ensure children are getting the nourishment and energy they need to learn, grow and be healthy. Using the Meal Patterns Guide, review your meal selections and ensure you have all components for each meal. Consider posting a copy of the Meal Patterns Guide in your kitchen to serve as a reference as you are planning your menu. You can print a copy of the Meal Patterns Guide by going to the Division’s website, www.ncchildcare.nc.gov, under Provider and Provider Documents. Even if you do not participate in the food program, Child Care Rule 10A NCAC 09.0901 requires meals and snacks served to children in a child care center to comply with the meal patterns for children in child care. Having this wide range of ages can make it difficult to complete group time and other activities. Younger children have a much shorter attention span and need to be allowed to move and play. The older children can focus longer and can benefit from longer group time as you prepare them for kindergarten. When doing group time, consider having a provider to work with the younger children while the older children have free play time. You can then switch and have the older children have group time while the younger children have free play. This allows you to offer age-appropriate activities for each group to best help them grow their skills. This will also help to reduce behavior issues by reducing the size of the group each provider is supervising. We also discussed using small boxes of crayons to make it easier for children to use and share. Having 1 box for every 2 children makes it easy for children to reach the crayons without having to pull a box shared by all the children at the table. It can also help children focus on coloring and not playing in a big box of crayons. Younger children could have one of each primary color in their box and the older children could have more options. This helps with teaching colors to the younger children and expands the creativity of the older children. Nutrition - Nutritious foods should be offered throughout the day to ensure children are getting the nourishment and energy they need to learn, grow and be healthy. Using the Meal Patterns Guide, review your meal selections and ensure you have all components for each meal. Consider posting a copy of the Meal Patterns Guide in your kitchen to serve as a reference as you are planning your menu. Additional Information: Playground – You stated that the town came out and laid water pipes to provide water to the laundry business at the other end of the building unit. During your Christmas break, the town put a heater near the pipes to keep them from freezing during the recent cold weather. Your facility will be in Cohort 2 which means your preparation year will be 7/1/24-6/30/25 and your reassessment year will be 7/1/25-6/30/26. The children were encouraged to call out the color of the items on the page. After circle time the children prepared to go outside. There is a fenced playground in front of the building. The children were observed to play with balls and ride on push cars. Lunch was observed and consisted of turkey and cheese, whole wheat crackers, salad, mandarin oranges, and milk. After lunch the children rested on linen covered cots. Corporation Status: The NC Secretary of State website was reviewed on 2/7/23 and it was discovered that a corporation had been formed under the name of Precious Gifts Child Dev. Center effective 8/23/13, with Peggy Modlin listed as the only member. The corporation is current and active. The facility was licensed on 9/20/13 under a sole proprietor license. You stated that you do not remember applying to create a corporation. The information on the Secretary of State’s website links this corporation to your facilities current address. You must provide additional information and documentation as to whether you or the corporation currently own the business. This documentation must be submitted to me by no later than 2/15/24. Later, the provider read them a book about bats. Lunch was observed and consisted of pizza with extra cheese and pepperoni, oranges, green salad with ranch dressing, and milk. Remember that children, at this age, learn by feeling, moving, and experiencing the materials. As they play, staff should add to their play by naming items, colors, shapes, and sounds. This helps to build vocabulary. Children should also be encouraged to have conversations with the provider to help them put their thoughts into words.
