This complaint visit was conducted in conjunction with an annual compliance with rated license assessment visit. Limited monitoring of child care requirements occurred during today’s visit. There are three classrooms operating at this location. There are forty-three children enrolled and thirty-nine children, ages 3-5, were present today. Indoor spaces are arranged into activity areas that include but are not limited to language, blocks, art, math, science, sensory, dramatic play, and manipulatives. A variety of age-appropriate learning materials were observed in each classroom. Daily schedules and activity plans were available for each group of children. Attendance for each classroom was accurately completed. Upon arrival, all of NC PreK children were preparing to go eat lunch in the school cafeteria. Children completed bathroom and handwashing routines prior to going to the cafeteria for lunch. Lunch consisted of pancakes and omelets or chicken sandwich, apples, strawberries, corn, carrots, and milk. After returning from lunch, children observed nap/rest time. Children were resting on appropriately spaced covered mats with blankets, lights were off, and soft music played making classroom comfortable for sleeping/resting. All children were appropriately supervised. Staff/child ratios were in compliance. Staff in all classrooms were observed interacting with children in a positive and nurturing manner. The allegations of this report were discussed with Stacie Poulin, Executive Director for Pender County School Preschool program, and NC PreK staff at this facility. You were each given the opportunity to state your perceptions of the allegations and to share any pertinent information. Prior to receiving this complaint, Principal, Kathryn Bates and Ms. Poulin contacted me after they received an email from a parent with similar sanitation concerns in regard to the allegation. Ms. Bates responded to the concerns via email and a copy of that email and response was received and reviewed during today’s visit. Ms. Bates was not present during today’s visit; she was on leave. There are concerns that sanitation guidelines are not being followed. Ms. Poulin stated sanitation requirements are being met. Facility has a cleaning schedule for staff. Staff stated all toys, materials, and furnishings were cleaned, sanitized, and disinfected appropriately. Toys are cleaned as required; mouth toys are immediately removed from play and cleaned daily. All floors are swept and mopped at the end of the day. School custodians clean daily and conduct daily walk throughs to ensure sanitation and cleaning practices are being met. All classrooms used with the children were visited today. All environments were clean, orderly and safe for children in care. I observed nap/rest time, and each child had a covered mat with blanket appropriately spaced. Hazardous products were appropriately stored. There were no sanitation issues observed. The last sanitation inspection was conducted by Pender County Environmental Health on August 18, 2025, and the facility received a superior classification with no demerits. All staff interviewed today stated they have not observed any concerns regarding the cleanliness of the facility and sanitation requirements are being met. Based on my observations, the information you shared by staff, and my investigation, this allegation is unconfirmed. Facility must clean, sanitize and provide a healthy environment for children as well as staff. A clean, healthy, and safe environment is one of your most important responsibilities as a child care provider and contributes to an enabling environment for nurturing care. It creates a safe environment for the children and educators. All floors, floor coverings, walls, ceilings, doors, windows, bathrooms, and any space used by child care children must be kept clean, sanitized, and in good repair. Clean surfaces also help prevent the spread of illness, which is common in an early childhood setting. Regular handwashing is one of the best ways to remove germs, avoid getting sick, and prevent the spread of germs to others. Whether you are at home, at work, traveling, or out in the community, handwashing with soap and water can protect you and your family. Remind everyone to wash their hands often, especially after using the toilet and before preparing or eating food. Shared toys in childcare centers should be cleaned often with a disinfectant because many viruses can live on objects for a few days During my investigation, some staff shared that they have had a recent case of lice and pinworms. NC PreK staff do daily checks of children’s heads for lice. Ms. Poulin stated that children with lice are immediately sent home and proof of treatment is required for preschoolers to return to school. The school nurse was contacted about the pinworm issue and tracked it to ensure proper treatment was given during the course of this sickness. During the course of the pinworm treatment and tracking, NC PreK staff closed sensory table, sand and water table, and a separate bathroom was used for child with pinworm issue. School nurse was involved with the child and family of any children diagnosed with head lice, pinworms, or any other sickness/illness. Facility does have policies regarding health regulations and communicable disease; these policies were received and reviewed during this visit. The policy addresses head lice - “Head lice, until completion of first treatment. If live lice are verified by the nurse, the family is encouraged to pick up the child and begin treatment at home. Child should be brought to school the following day by the parent, and the nurse will check the head. Proof of treatment (combing, empty over the counter lice remedy box, doctor note, etc.) must be evident before the child can return to the classroom.” The policy did not address pinworms specifically but did address communicable diseases – “If a child had a reportable communicable disease, a physician’s note stating that the child is no longer contagious and may return to school is required.” Ms. Poulin stated child may be allowed to return to school without a doctor’s note at the discretion of the school nurse. Staff members stated child continued to attend NC PreK as child received treatment/care for pinworms and school nurse was greatly involved throughout the treatment of the pinworm issues. Staff members also stated that school nurse informed them that they could not notify other parents with children enrolled at the facility of the lice and pinworm issue. Therefore, parents were not informed of a communicable disease that could affect their child and household. A violation will be cited as parents should have been immediately notified. Staff and parents are required to notify center if their child is diagnosed with a communicable disease so that arrangements can be made to notify other staff and families whose child(ren) may have been exposed. You have an obligation to be transparent with the parents/guardians of the children you serve regarding communicable diseases. Best practice would be to notify all parents of confirmed cases of communicable diseases. Reassure parents of the situation and measures being taken to prevent the spread of communicable diseases throughout the facility. You are alerting all staff and families of the issue so they can be aware. During today’s visit, Ms. Poulin created parent notification letters for lice and pinworms and distributed them to the teachers in each classroom to ensure all parents get a copy of the information today. The notification letters for lice and pinworms were reviewed and a copy received during the visit. There was one violation documented today. Violation must be corrected immediately. Continued compliance with applicable child care rules is required at all times. Violation Number Comment Rule 875 The center did not follow all procedures to prevent the spread of communicable diseases described in 15A NCAC 18A .2800. The NC PreK program did not inform parents of communicable diseases that could affect their child and household. 10A NCAC 09 .0804(b)(1) For your facility to remain in compliance with NC Child Care Requirements, violations must be corrected immediately. On or before April 1, 2026, I must receive a written, dated, and signed compliance letter that describes accurately and in detail how and when the violation was corrected as well as how compliance will be maintained in the future. A time frame is established to allow you time for submitting your compliance letter. Name of Operation: SOUTH TOPSAIL ELEMENTARY PRESCHOOL Facility ID: 71000250 Consultant: TAMMY ROSS Operation Type: Center Case Number: Visit Date: 1/9/2026 Number Present: 35 Completed Date: 1/9/2026 Age: From 3 To 5 Total Minutes: 75 Time In: 11:30 AM Time Out: 12:45 PM Time In: Time Out: List to Use: Center Type Of Visit: Routine Unannounced Announced/Unannounced: Unannounced The purpose of today’s visit was to monitor your program for compliance with applicable child care requirements pertinent to a routine unannounced visit. This facility currently operates with a Five Star license issued February 24, 2022, earning 7 points in Staff Education, 7 points in Program Standards, and a Quality Point by meeting an Education Option. Restrictions on the permit include: an age range of 3- 5 with a first shift capacity of 36, meets enhanced ratios minus one, and meets enhanced space. Pender County Schools operate this program. The last annual compliance visit was conducted on April 15, 2025. As of January 7, 2026, the facility’s compliance history is 97%. %. Child Care programs are expected to always achieve and maintain compliance and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. Sanitation Inspection – 08/18/2025 - 0 Demerits – Superior Fire Inspection – 09/11/ 2025 – PASS All areas, indoors and outdoors, used by the children were monitored. There are three classrooms operating at this location. There are forty-one children enrolled and thirty-five children, ages 3-5, were present today. Accurate attendance sheets were observed in the classrooms. Upon arrival, all of NC PreK children were observed outdoors playing in the approved fenced area. They were observed running, playing on climb structure, riding trikes, and playing in the sand. While outside, I observed three out of six caregivers on their cell phones. Cell phone distract caregivers from adequately supervising the children in their care. Caregivers’ focus and attention should be on the children. Therefore, moving forward, if cell phone are being used in any manner, it will be documented as a supervision violation. When caregivers and children returned inside, they completed personal hygiene routines and prepared to go to the cafeteria for lunch. Lunch consisted of pepperoni pizza or cheese pizza, birthday cake applesauce, bananas, fresh red peppers, broccoli, and milk. After returning from lunch, children observed nap/rest time. Daily schedules were available for each group of children. Activity plans were observed posted in each classroom. A variety of age-appropriate learning materials were observed in each classroom. Caregivers and children interacted in a positive and appropriate manner. The Public-School Off-site Records Verification forms for transportation and staff records were completed and available for review. Children’s files were not monitored today. However, ensure The Public-School Off-sit Verification form for children’s records is complete and on file for review for your annual compliance visit. There have been two new staff members hired since your last annual compliance visit; files for new staff were reviewed today. NC Pre-K Site Monitoring The NC Pre-K requirements in Section .3000 of the Child Care Rules were monitored for compliance today. Staff-child ratios and maximum group sizes required in Child Care Rule 10A NCAC 09 .3009 were verified in compliance. Children in this program attend from 7:20am to 1:50pm, meeting the instructional day requirement of 6.5 hours. This NC Pre-K program uses Creative Curriculum, Brigance Developmental screening, and Teaching Strategies Gold for their ongoing assessments. Developmental screenings and health assessments including vision, hearing, and dental screenings were on file for all NC Pre-K children’s files reviewed. Evidence of on-going assessments was observed in children’s files and on the Teaching Strategies GOLD website. The NC Pre-K Site Monitoring Tool for 2025-2026 was signed by Stacie Poulin, Preschool Program Executive Director for Pender County Schools, during an on-site visit October 14, 2025. It was noted that all requirements were in compliance. During today's visit child care requirements monitored for compliance included supervision, staff/child ratio, CPR and First Aid, Criminal Record Checks, storage of hazardous substances and medications, approved space, posting of the license, and other applicable requirements. There were two violations observed today. Violations must be corrected immediately. Continued compliance with applicable child care requirements is required. Violation Number Comment Rule 1792 Staff did not model appropriate eating behaviors by consuming food or beverages that meet the nutritional requirements specified in the Meal Patterns for Children in Child Care Programs in the presence of children in care. I observed a bottle of Ginger Ale and Gatorade (Orange) on top of a cabinet in space #1. .0901(i) 1898 Staff did not complete the health and safety training within one year of employment. Staff member who has been employed since September 2024 did not have verification of completion of required trainings on file. .1102(a) Childcare licensing requirements are established to ensure a safe and healthy childcare environment. Therefore, it is important for you to be knowledgeable of and periodically review all the licensing requirements that apply to your type of program. It is your responsibility to always maintain compliance with all the applicable laws and rules whether they have been monitored or specifically discussed with you in the past. Comments regarding violations cited Health & Safety Training -All staff members, except one, who have been employed for at least one year and have completed Health and Safety training as outlined in Child Care Rule 10A NCAC 09 .1102. A staff member, who was hired in September 2024, does not have verification of these required trainings being completed. New staff are in the process of completing these required trainings. This information must be maintained on file. Health and Safety training must be renewed every five years. Completing, refreshing, and updating the required Health and Safety Training increases your awareness and knowledge regarding child development and safety. I observed a bottle of Ginger Ale and Gatorade (Orange) on top of a cabinet in space #1. Staff must model appropriate eating behaviors at all times by consuming food or beverages that meet the nutritional requirements specified in the Meal Patterns for Children in Child Care Programs in the presence of children in care. Technical Assistance: Staff/child ratios of 1:10 must be maintained at all times, including when lining up for lunch in the hallway. All items, including baby wipes, that have keep out of reach of children on the label should be stored at least 5ft above floor level. For child care facilities that are Head Start grantee sites, the pathway to a Five Star Rated License is based on the Head Start educational and programmatic requirements that are comparable to or exceed NC QRIS requirements. Licensed child care facilities that are Head Start grantee sites may transition to this pathway by completing the Request for Accreditation and Head Start Licensure Pathway form. They were observed running, playing on climb structure, riding trikes, and playing in the sand. While outside, I observed three out of six caregivers on their cell phones. Cell phone distract caregivers from adequately supervising the children in their care. Caregivers’ focus and attention should be on the children. Therefore, moving forward, if cell phone are being used in any manner, it will be documented as a supervision violation. When caregivers and children returned inside, they completed personal hygiene routines and prepared to go to the cafeteria for lunch. Lunch consisted of pepperoni pizza or cheese pizza, birthday cake applesauce, bananas, fresh red peppers, broccoli, and milk. After returning from lunch, children observed nap/rest time. When they returned inside, they completed personal hygiene routines and prepared to go to the cafeteria for lunch. Lunch consisted of tacos or cheese pizza, cut up grape tomatoes, cantaloupe, applesauce, birthday cake, and milk. After returning from lunch and children observed nap/rest time. Each child laid down on their covered mats with blankets, lights were dimmed in the classrooms and soft music played as caregivers sat with children and rubbed their backs or helped them with their blankets. The last annual compliance visit was conducted on April 18, 2024. As of today, the facility’s compliance history is 99%. Sanitation Inspection – 09/09/2024 – 0 Demerits – Superior Fire Inspection – 09/10/2024 – PASS All areas, indoors and outdoors, used by the children were monitored. There are two classrooms operating at this location. There are twenty-eight children enrolled and all children, ages 3-5, were present today. Accurate attendance sheets were observed in the classrooms. Grace Moore, Education Coordinator, was present during this visit and assisting with children in space 103. Upon arrival, both classes of NC PreK children were observed completing bathroom and handwashing routines and lining up to go outdoors to play in approved fenced area. Children were observed playing outdoors. The outdoor space had a variety of gross motor equipment including stationary equipment, swings, tricycles, and other materials/equipment. Daily schedules were available for each group of children. Activity plans were observed posted in each classroom. A variety of age-appropriate learning materials were observed in each classroom. All children were appropriately supervised. Staff in all classrooms were observed interacting with children in a positive and nurturing manner. During today's visit child care requirements monitored for compliance included supervision, staff/child ratio, CPR and First Aid, Criminal Record Checks, storage of hazardous substances and medications, approved space, posting of the license, and other applicable requirements. Health & Safety Training - Staff members who have been employed for at least one year have completed Health and Safety training as outlined in Child Care Rule 10A NCAC 09 .1102. New staff must complete these trainings within the first year of employment. Ensure this information is maintained on file. Health and Safety training must be renewed every five years. Completing, refreshing, and updating the required Health and Safety Training increases your awareness and knowledge regarding child development and safety. A new staff member has been hired since your last visit. Files for new staff member was monitored today. There were two violations observed today. All violations must be corrected immediately. Continued compliance with applicable child care requirements is required. Violation Number Comment Rule 811 Potentially hazardous items including but not limited to power tools, nails, chemicals, propane stoves, lawn mowers, gasoline, or kerosene were not stored in locked areas, removed from the premises, or made inaccessible to children. In space 103,hand sanitizer was located on a low shelf accessible to children. .0604(a) 1874 The Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy was not reviewed with new staff prior to providing care with children or a signed acknowledgement with all the required information was not maintained in the staff person's file. This information was incomplete for new staff member working in space 103. .0608(d)(1-4) In order for your facility to remain in compliance with NC Child Care Requirements, violations must be corrected immediately. A signed and dated letter of compliance must be received October 28, 2024, describing how each violation was corrected and how compliance will be maintained in the future. A time frame is established to allow you time for submitting your compliance letter. This timeframe is not intended to be used as a guide for correcting violations, as they should be corrected immediately. Box 278, Jacksonville, NC 28541 Comments regarding violations documented All new employees should sign a verification form that the Shaken Baby Head Trauma Policy has been reviewed, discussed, and received prior to caring for children ages 0 to 5. Child care rules require that all facilities serving children under the age of five years old develop and adopt a Prevention of Shaken Baby and Abusive Head Trauma policy. All staff and parents of children under the age of 5 must sign a statement acknowledging that the policy has been reviewed with them, and the statements must be kept on file. All hazardous products should be kept in locked storage and any product labeled, “keep out of reach of children,” must be stored at least 5 feet above floor level and inaccessible to children at all times. Make sure you are checking your environments, indoors and outdoors, on a daily basis to ensure all hazardous items are stored properly. In space 103, A spray bottle of hand sanitizer was located on the side pocket of a lunch/snack bag; the bag was on a shelf. The label on the hand sanitizer read, “keep out of the reach of children.” The shelf holds toys for children to play with and is accessible to all the children in the classroom area. Please review child care rules regarding storage and accessibility of potentially hazardous items. Hazardous cleaning supplies, including those kept under pressure in an aerosol can, as well as medications, must be kept in locked storage. The definition of locked storage requires that the lock be unlocked with some type of device such as a key or combination. Regular childproofing locks do not meet this requirement. Ensure that all cleaning supplies and other items labeled “Keep out of reach of children” are kept inaccessible while children are in care. Reminders: Staff/child ratios must be maintained at all times, including when staff member forgets something and needs to go back to the classroom. In those instances, staff member should take a group of children with them in order to maintain correct ratios. Ensure staff members, including substitute caregivers, understand the importance of maintaining staff/child ratios and the rules regarding staff/child ratios as they are different from how the public school operates. Maintaining staff/child ratios and maximum group sizes is essential to the health and safety of children. Ensure a complete file is available for substitutes. I suggest you refer to the substitute staff file checklist to ensure all required information is complete for substitute staff members as some items must be on-site and other items may be maintained off site. Long-term substitute staff should be included on on-site verification forms. Child care licensing requirements are established to ensure a safe and healthy child care environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all the applicable laws and rules always whether they have been monitored or specifically discussed with you in the past. The best way for you to make sure that you meet all requirements is to periodically review the child care law and rules. Rated License Reassessment Information - Your facility’s three-year rated license reassessment is due to be completed in February 2025. There are no longer any cohorts. The “hold harmless” state of rated license reassessments has been extended until the new Quality Rating Improvement System standards are put in place. This means that you may not be required to have a reassessment according to timelines discussed previously, however you may request one voluntarily. Today I encouraged you to review information about the new standards as it becomes available and to plan on training your additional caregivers on new assessment tools if you are still interested in Environment Rating Scales assessments. The new tools are the “3” versions, and I will share more information about training opportunities as they become available. Starting on February 1, 2025, the ECERS-3, ITERS-3, and FCCERS-3—also known as the "3s"—will be used for DCDEE environment rating scale assessments. The DCDEE and the North Carolina Rated License Assessment Project (NCRLAP) are collaboratively working on preparations for the transition to the third editions. These third editions come with a spiral binding at the top, replacing the current revised editions. Visit the NCRLAP’s website for more information about updated resources, credit hour trainings, and outreach assessment opportunities to help you become familiar with these tools. For official environment rating scale assessments for a NC Star Rated License, the NCRLAP will use the Revised editions until February 1, 2025. Ensure all information and education has been submitted to DCDEE WORKS as you hire new staff or as staff complete additional coursework. Keep in mind, it is expected that compliance with Education standards is maintained at all times, so you must ensure you monitor staff qualifications and percentages in advance of your upcoming reassessment. May 1, 2024, was the initial deadline to enroll your facility in the Clean Classrooms for Carolina Kids program to identify and eliminate exposure to lead and asbestos hazards in building infrastructure. Facilities that have not yet enrolled should complete the process by November 1, 2024. This program is an expansion of Clean Water for Carolina Kids, which previously tested all child care centers in the state for lead in water at drinking and food preparation taps. As this is a legislatively mandated effort, facilities are required to meet rule requirements to have tap water tested every three years(centers) and to have inspections for lead paint and asbestos if applicable. Evaluate Hazards - The program will ship your facility a water sample kit and may coordinate an on-site visit by a professional to assess lead-based paint and asbestos hazards, if needed. 4. Receive Results – Receive your results, recommendations, and water mitigation support, if needed. 5. Request Reimbursement - If you choose to conduct lead-based paint or asbestos mitigation, you can request reimbursement from NC DHHS. Criminal Background Check Information - DCDEE launched the Provider Portal for ABCMS on February 1, 2024. This access will allow providers to see applicants that associate themselves with their facility and allow them to “hire” the applicant to their roster, see the real-time background check status of staff/household members, and run a printable report of the staff roster to assist with compliance visits. To gain access to the Provider Portal complete the ABCMS Child Care Provider Portal Training on DCDEE's Moodle. The training consists of watching a short video then taking a test about the video. A certificate will be issued upon successful completion of the test. Email the certificate along with your full name, position, and Facility ID to DCDEE_ABCMS_Provider@dhhs.nc.gov to get access to the portal. Access will then be granted within 2 business days.
