J. Frank, Director, assisted me with today’s visit. Your program currently operates with a four-star license, issued September 24, 2024. The center's compliance history was reviewed with the operator. The program’s compliance history was ninety-one percent as of March 30, 2026. The NC Secretary of State website was reviewed on March 30, 2026, and Angel’s Above Childcare Center, LLC was listed as current- active. The license was posted, and the restrictions were in compliance. Two groups of child were observed in the indoor and outdoor environments. Children enrolled in space #2 were engaged in play with vinyl blocks as the teacher sat with the children, assisting them in counting the blocks as they build structures. In space #4, children engaged in indoor free play with dramatic play materials, blocks, and counting bears. The groups transitioned to outdoor play on stationary structures and ride on toys. A fire drill was completed during the visit. Files for new staff were reviewed. Fire and sanitation inspections remain current. The violations are as follows: Violation Number Comment Rule 805 Fire drills were not practiced monthly and/or the drill record was incomplete. Documentation of a fire drill was not on file for March 2026. .0604(t); .0302(d)(5) 859 Monthly playground inspections were not completed and/or they were not completed by an individual trained in playground safety requirements. Documentation of a March 2026 playground inspection was not of file for review. .0605(q) 1867 The depth of the loose surfacing was not based on critical height of the equipment. Mulch under the stationary rainbow climber measured one inch in depth. .0605(k)(1-4) Comments Section - Child care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. The violation(s) documented must be corrected immediately. On or before April 16, 2026, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. Please be aware any information submitted by you is considered legal documentation. If it is determined the information provided in the letter is not true, this may be considered falsification of information. If sufficient information is not received by the due date, a follow-up visit may be completed. Having protective surfacing under and around playground equipment can reduce the risk of serious injury. A new rainbow climber has been recently installed over a layer of mulch. I reminded you that equipment with a critical height of 5 feet or less shall have 6 inches of loose surface materials. You stated that there was more mulch, but the children have been playing in it and moving it to different areas of the playground. You reported that you will have the structure removed until you can get the proper containment boarder and surfacing. Submit photos of the correction with your compliance letter. Fire Drill- A fire drill was not recorded for March 2026. You stated that you forgot to do one. A fire drill was completed during the visit and recorded on the log. We discussed completing drills at various times of the month. During today’s visit you set a repeating digital reminder for the monthly fire drill. Having both written and digital reminders can be helpful for tracking and reminding you to complete the required drills. Playground Inspection- Proper maintenance is a key factor when trying to ensure a safe play environment for children. A playground inspection was not on file for March 2026. You stated you forgot to document it as you had completed the inspection on March 31, 2026. We discussed documenting the inspection when it happens. Take the form outside with you as you are doing the inspection and mark it as you go. Upon returning to the building, you can file it immediately to prevent it from becoming misplaced. Consultation: Pathways to the Stars-Today we reviewed your progress toward transitioning to a pathway. You reported that you are pursuing the Program Assessment pathway. You began your three-month self-study in January and have been working with the local QUEST consultant. Additionally, you stated you are considering an outreach assessment to better prepare. We reviewed the education standards. Remember the education level is determined by what is reflected on the DCDEE WORKS status letter. You have staff that do not have a WORKS account. Work with staff on creating an account and submitting the required documents for evaluation by May 1, 2026. Based on what you shared with me, there are staff that will need to complete CEUs or the competency evaluation to qualify for the desired star level. Begin working with staff to determine the course of action and assist them with getting started. The Continuous Quality Improvement Plan and Family and Community Engagement forms were reviewed during the visit. Individual Continuous Quality Improvement and Professional Development plans are still being developed. You plan to submit your Rated License Application by June 2026. Staff/Family Communication-Today you share with me that you are working on building better communication between staff and families and working together on children’s goals. We discussed ways to communicate, verbal or in writing, communication styles, and whys to share the goals you are working on with children. Consider having one-on-one conversations with families and training with staff. Or a combined training with both staff and families. ABCMS Provider Portal- You have completed the ABCMS Provider Portal training, but the process is not complete. Today, we discussed submitting the Power Form and gaining access to the portal and connecting all staff. You were able to submit the Power Form during the visit. Please be reminded that you need to update the portal within five days of bringing on new staff and dismissing staff. Required Water, Lead Paint, and Asbestos Testing - The Clean Classrooms for Carolina Kids website reflects the following information about your center’s required three-year water testing and one-time lead paint testing, and asbestos testing: Three-year Water Testing – Last completed on 6/5/25 Lead Paint Testing – Enrollment Started Asbestos Testing – Enrollment Started Please log into Clean Classrooms for Carolina Kids to complete the required testing. J. Frank, director, assisted me with the visit. Your program currently operates with a three-star license, issued 9/24/24, earning 1 points in the education component, 5 points in the program standards component (meeting enhanced ratio) and 1 quality point the programmatic option of staff benefits package and infrastructure of parent involvement. The last annual compliance visit was conducted 8/26/24. The sanitation inspection was completed 6/17/25 with a “Superior” classification. The last fire inspection was conducted 7/31/25 and your facility was approved for daytime care only. The center's compliance history was reviewed with the operator. The program’s compliance history was eighty nine percent as of 7/29/25. The NC Secretary of State website was reviewed on 7/29/25 and Angel’s Above Childcare Center, LLC was listed as current-active. We reviewed your facility contact information listed on the Division of Child Development and Early Education (DCDEE) website and facility email address was updated during the visit. Contact me if you need to make any changes to your contact information, e.g., phone numbers, mailing address. Three groups of children were observed today in the indoor learning spaces. Children enrolled in space #2 transitions, including washing their hands and moving to free play and group time. Children enrolled in space #4 completed personal care routines before joining the teacher at the table. Children recited addition facts and had morning group, including reviewing numbers and colors. In space #5, children used child made clocks to display the time the teacher wrote on the board. Staff were observed moving about the spaces, talking with the children, redirecting them as assisting them with teacher-lead and child-lead activities. Proper handwashing techniques were observed. Lunch was observed and consisted of fish sticks, corn, pineapples, cantaloupe, bread, and milk. The following violation was documented. Violation Number Comment Rule 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. One bottle of Mulch Glue was stored on the back porch used by children to access the outdoor play spaces. .2820(b) Compliance Verification: One violation was documented and corrected during the visit. No further action is required at this time. Technical Assistance: Storage of Hazardous Items- Intentional planning of the environment ensures a safe environment to prevent and reduce injuries and promotes all areas of a child's development. All chemicals with warning of keep out of the reach of children, must be in locked storage. You reported the Mulch Glue was left on the porch after closing hours yesterday for the landscapers to use today during when they serviced the center. Thank you for moving the chemicals to locked storage. Carefully plan for things that occur outside normal operations. This may require additional communication and planning with service providers or the installation of an outdoor locking storage container. Corrective Action Plan: Stipulation #1-The child care operator shall maintain compliance at all times with all applicable child care requirements including, but not limited to, Child Care Rule 10A NCAC 09 .1803(a)(1) regarding discipline. One violation was documented and corrected during today’s visit. Stipulation #2- Within one (1) week after the Notice is received, Jacquelyne Frank, administrator, shall contact Chantale Sherman, Healthy Social Behavior Specialist, Martin-Pitt Partnership for Children, to arrange for the training, Behavioral Intervention Strategies. Today you reported that you contact Ms. Sherman on March 5, 2025. The Behavioral Intervention Strategies training was completed on April 7, 2025. Stipulation #3- Within one (1) week after the required training in Stipulation #2 is completed, Ms. Frank shall revise the facility’s discipline policy and procedures to incorporate strategies learned in the training. Revised discipline policy and procedures were submitted today during the visit. Additional clarifying information is needed regarding the procedures for staff reporting of inappropriate discipline, care or treatment of children and staff notification to administration of concerns. Revised policy and procedures were submitted on May 16, 2025. You were notified that the revised policy and procedures met the stipulation on June 17, 2025. Notification was given to parents on 6/17/25 and parent signature collection was completed on 7/7/25. You reported that you usually track due dates on a digital calendar that sends reminders but was unsure if the reminder for the ITS-SIDS training was set. First Aid/CPR Training-First Aid and CPR certification is essential for handling emergencies, including choking and injuries. All staff are required to recertify at least every two years. You stated you thought she had taken the training during a training session that another staff had completed the training. You stated you had the contact information for a trainer and would be reaching out following the visit. Today we discussed your tracking method. Review staff files and the staff and training worksheet at least monthly to ensure required documents are on file and trainings/certifications are obtained in a timely manner. Addition Comments: Access to Files-Having access to records, even in the absence of management, is critical to the ensuring the health and safety of children, compliance with child care rule, and keeps the daily operations running smoothly. The designated staff member, (Assistant Director, a lead teacher, etc), should know where to find key documents, such as program records, emergency contact information, children’s records including medical details/medical care needs, and emergency procedures. Quick access to these records is essential in urgent situations and also helps staff provide consistent care, meet each child’s needs, and follow required child care rules. Based on the information provided regarding concerns that inappropriate discipline was used, I completed classroom observations and interviewed the administrator. Video footage was requested but was not available at the time of the visit. It was reported that during the week of December 9th-13th at departure time, a child, two years of age, was playing in the parking lot, ran in front of the van, and was not responding to being called to come back. In response, the administrator ran after the child and “forcefully” grabbed the child by the shoulders and guided them back to the van door to be loaded. Fire Inspection-Operator shall schedule and obtain a fire inspection within 12 months of the center's previous fire inspection. Your last fire inspection was on July 24, 2023. You stated that you thought the fire inspection was due in September. During the visit you called the fire marshal to schedule an inspection. Set a reminder to contact notify the local fire inspector at least 30 days prior to the expiration of the center's annual fire inspection. Submit original of the approved annual fire inspection report to the Division within one week of the inspection visit on the form provided by the Division. Menu Substitutions: Planning the menu in advance and posting the current menu, to include any substitutions, is essential in providing a variety of foods for proper nutrition. Although noted food substitutions were of comparable food value; however, the substitutions were not recorded on the menu. According to the posted menu, breakfast was noted as Honey Kix cereal, mandarin oranges, and milk however the children were served English muffins, apple slices, and milk. Prior to any meal or snack being served, the posted menu must be reviewed for accuracy of items served and if comparable changes occur, then make sure those changes are noted on the posted menu(s). Health and Safety Trainings- Each staff member must complete the Health and safety trainings within the first year of employment and every five years thereafter. The trainings must cover all the required topics. Staff employed on 8/4/23 did not complete all the required trainings. You stated that the training was accidently missed. Please have the staff complete the Administration of medication, with standards for parental consent training and submit the certificate with your compliance letter. Activity plans for all children must meet the following minimum licensing requirements: *Include activities daily to stimulate the following 5 developmental domains, as listed in your NC Foundations for Early Learning and Development book: (social &emotional development, health & physical development, approaches to play and learning, language development/communication, and cognitive development). *Include a daily gross motor activity which may occur indoors or outdoors. *Reflect at least 4 activities daily (one of which is gross motor), one of which is offered outdoors, weather permitting. A self-paced Recognizing and Responding to Suspicions of Child Maltreatment training is available at no charge on the Prevent Child Abuse NC website www.preventchildabusenc.org. Orientation- Effective employee orientation makes employees aware of company policies and expectations, handles essential paperwork, and answers any questions or concerns they may have before they transition into their new positions. Documentation of orientation was not on file for staff employed on 8/4/23. You stated the orientation was completed but was not documented on the orientation log. Documents any orientation sessions on the orientation log as it is completed to keep current and accurate records. Discipline policy- The facilities discipline policy shares with parents how challenging behaviors will be handled in the facility. Upon review of the policy, parents must sign the policy that includes the child’s name and date of enrollment. Two of the five children’s files reviewed did not have discipline policies that included the child’s enrollment date. When receiving documents form the family, be sure to review them to make sure they are complete and accurate. Reminders: A new July 2023 New Rule/Rule Amendments Overview module has been added to the Child Care Rules Training on DCDEE Moodle.
