The last visit was conducted on 1/9/25. Upon arrival, I was greeted by Heather Koonts, Administrative Assistant. I stated the purpose of my visit and Mrs. Koonts accompanied me on a walk-through of the facility until Mrs. Parker, Director could join me. There were 77 children present today ranging in age from 0-5 years old. Infants were observed crawling on soft climbing structures, and playing with toys on the floor. One infant was observed lying in the crib on his back as he was waking up from a nap. Children ages 1 -5 were observed playing on the playground, transitioning inside from the playground and washing their hands. A sanitation visit was conducted on 12/4/24. Required items were posted in the classroom. There was one item of non-compliance monitored today and the corresponding violation was cited. Violation Number Comment Rule 873 Center staff did not follow the EMC plan. The persons that are listed to determine the care needed on the EMC plan did not make the decision regarding a child's care. The teacher Linda S. made the determination. 10A NCAC 09.0802(a) Violation(s) documented above must be corrected immediately. A signed and dated letter of compliance must be emailed to me by 5/22/25, describing how and when the violation(s) were corrected and how compliance will be maintained in the future. Please remember your letter should include facility name, facility ID#, and original signature. The letter can be emailed to cherissa.alston@dhhs.nc.gov. During the visit we discussed an incident that occurred at the facility regarding a child's allergy. You sent me an incident report within the required time frame. We reviewed and discussed the medical action plan, emergency medical care plan and action taken to prevent reoccurrence. You have a plan in place for reducing the chance of exposure to known allergens. Your health care nurse S. Mason has also previously reviewed these items with you. I suggested contacting Ms. Mason again for training for staff on reading and understanding the plan, EPI-pen training if needed. I also suggested considering making your facility a nut-free facility and Ms. Mason suggested nut-free spaces if you wanted to continue serving in spaces with no known allergies. Susan Parker, the administrator, accompanied me during a walk through the facility. During the visit, I discussed the allegations with Ms. Parker and additional staff members. Limited monitoring of child care requirements occurred during today’s visit. The following violations were confirmed during today’s visit. Violation Number Comment Rule 303 Children were not adequately supervised at all times. A staff member failed to provide adequate supervision of children at all times, was on the cell phone for extended periods of time, walked into the hallway and turned her back to the children. The staff member was also not promptly aware of a child's activities when a child walked around the classroom eating food, dropped the food on the floor, picked it up, and then ate it. .1801(a)(1-5) 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. The staff member failed to attend to multiple one-year-old children in a nurturing and appropriate manner on multiple occasions when they moved children abruptly by the upper arms, clapped at children and spoke in a visibly angry manner, snatched food and toys from their hands, held children by their arms while pushing and pulling children to move them, and clapped aggressively in a child’s face, causing the child to cry and then poked the child in the neck multiple times in an aggressive manner, because the child would not stop crying. G.S. 110-91(10) 904 Child was handled roughly. A staff member picked up a one-year-old child by the child's head, to move the child to another location, to manage the child's behavior. A staff member grabbed the child by the arm in a forceful manner, shook the child's hand over a trashcan, in the attempt to physically remove food from the child's hand. The staff member hit the same one-year-old’s arm when the child attempted to take a coat off the table and also grabbed the child by the jacket collar to make the child stand up. .1803(a)(1) 1810 There was a substantiation of child maltreatment. The Division substantiated child maltreatment based on a staff member handling children in a rough manner and failing to attend to multiple one-year-old children in a positive, nurturing, and appropriate manner. GS 110-105.6(a) Violations must be corrected immediately. This facility operates under G.S. 110-106 with a Notice of Compliance effective September 13, 2019. Upon my arrival, I was greeted by Susan Parker, Director. Ms. Parker completed a walkthrough of the facility with me and assisted me with the required documentation. Sixty-six children were present today. I observed the preschool children engaged in free choice play in activity centers. Infants and toddler-age children were observed playing with available toys and the caregivers were providing routine care. A satisfactory fire inspection was completed January 17, 2024, and the facility was approved for day time care only. A copy of the fire inspection is attached to the 2024 visit. A sanitation inspection was conducted on December 4, 2024 and the facility received a Superior classification. Fire and emergency drills were documented and current. Playground inspections were not documented for October and November. There was one item of non-compliance observed during today’s visit. The corresponding violation was cited below. Violation Number Comment Rule 859 Monthly playground inspections were not completed and/or they were not completed by an individual trained in playground safety requirements. There were no documented playground inspections for October and November 2024. .0605(q) Violation(s) documented above must be corrected immediately. This center operates under G.S. 110-106 with a Notice of Compliance effective September 13, 2019. Upon my arrival, I was greeted by Susan Parker, assistant director. You, Pam Smith, the administrator for the facility, arrived during the visit. Ms. Parker and you assisted me with the required information for the visit today. A fire inspection was completed January 17, 2024. The report was marked Satisfactory and the facility was approved for day time care only. I received a copy of the fire inspection report during the visit. The most recent sanitation inspection was conducted on December 11, 2023. The facility received a classification of Superior with twelve demerits. Seventy-nine children were present today. I observed the preschool children engaged in free choice play in activity centers, eating lunch, completing handwashing and bathroom routines, and transitioning to naptime. In the classrooms for infants and toddler-age children, I observed the caregivers providing routine care while the children played with available toys. A full assessment of applicable child care requirements was conducted during today’s visit as per the attached checklist. The following violation was observed and documented. Violation Number Comment Rule 716 All stationary equipment, more than 18 inches high, was not installed over protective surfacing. The mulch under and in the fall zones around the yellow monkey bars and the orange and green playground equipment did not meet the required depth. .0605(j) In order to maintain compliance with North Carolina child care laws and rules, the above violation must be corrected immediately. A letter stating how the violation was corrected and how you plan to maintain compliance in the future must be submitted electronically to my email address by February 1, 2024. The compliance letter should contain the following information: 1. Facility Name 2. Facility ID 3. Date of the letter 4. The violation number, the date the violation was corrected, information regarding how the violation was corrected and how you plan to maintain compliance with the item number in the future. 5. Outdoor Mats for Surfacing We discussed that the mats at the base of the new slides on the playground equipment can be used to help as cushioning material if they have been certified by the manufacturer to be shock-absorbing protective material in accordance with the American Society for Testing and Materials (ASTM) Standard F 1292. Supervision in the Outdoor Play areas While monitoring the new playground equipment we reviewed that adequate supervision requires staff to be positioned in the outdoor environment to maximize their ability to hear or see the children at all times and render assistance when needed by the child. Staff must also interact with the children while moving about the outdoor area. I told you that some programs have removed staff seating in the outdoor area to encourage their staff to move around and actively supervise children. New Child Care Sanitation Rules The NC Children’s Environmental Health has re-adopted child care sanitation rules effective July 1, 2023. This center operates under G.S. 110-106 with a Notice of Compliance effective September 13, 2019. Upon my arrival, I was greeted by Nancy Simpson, the director of the center. Ms. Simpson assisted me with gathering information, she accompanied me on a walk-through of the center and playgrounds. During the walk-through I documented attendance and observed children. Sixty children were present today. I observed children playing in classrooms, routines being completed and children outside playing. Classrooms were neat and organized. The most recent sanitation inspection was conducted on June 23, 2023, and the center received a superior rating. A partial assessment of applicable child care requirements was conducted during today’s visit. I reviewed the files of new staff hired since the last Annual Compliance Visit conducted on January 24, 2023. I observed two violations of child care rules during the visit. Violation Number Comment Rule 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. Two staff did not have a certification of completion for First Aid on file. .1102(c) 1049 All staff did not successfully complete certification in CPR training appropriate to the age of the children in care. Verification of staff completion of the CPR course from an approved training organization was not in the staff file. Two staff members did not have a certification of completion for CPR on file. .1102(d) In order to maintain compliance with North Carolina child care laws and rules, the above violations must be corrected immediately. Please send me a correction letter by email stating how the violations were corrected and how you plan to maintain compliance in the future. It must be submitted to me by September 13, 2023. New Child Care Sanitation Rules Children’s Environmental Health has set up virtual trainings for child care center operators on the newly readopted child care sanitation rules. I sent out the link in an email. You were given the opportunity to ask questions regarding interpretation and implementation of child care requirements.
