Upon arrival you, Tosha Jackson, Operator, assisted me with the visit. The Secretary of State website was checked on August 11, 2025, and Tosha’s Tiny Tots was not listed. If you decide to sell your business, then you must notify me, Farran Rhyne, your consultant, at least thirty (30) days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location, or inherited. You had no updates to report. On July 30, 2025, the following allegation was received: There are allegations of violations of child care requirements. The allegations were regarding program records, children’s records, developmentally appropriate activities, sanitation and health, off premise activities and transportation, supervision, capacity, and medication. The allegations were discussed with you. You had an opportunity to ask questions, state perceptions of the situation and provide pertinent information in response to the allegation. Upon arrival, one (1) child, one (1) year of age was present. At 10:04am, the arrival/drop-off process was observed for one (1) child, two (2) years of age. A walk through was completed. You and the children were observed during diapering changing routines, handwashing, developmentally appropriate activities, lunch, and naptime. Daily sign-in/out records, arrival and departure procedures, fire drill logs, incident reports, EPR plan, activity plan, parent acknowledgement forms regarding operational policies, family engagement activities and plan, diaper changing procedures, screen time activities, biting policy, medication policy and permission forms, and capacity were reviewed. You stated you do not provide transportation. You stated the parent transports the child to attend off premise and family engagement activities. Based on the walk through, records reviewed and your interview, the allegations for: “There are allegations of violations of child care requirements regarding program records” was unsubstantiated. “There are allegations of violations of child care requirements regarding children’s records” was unsubstantiated. “There are allegations of violations of child care requirements regarding developmentally appropriate activities” was unsubstantiated. “There are allegations of violations of child care requirements regarding sanitation/health” was unsubstantiated. “There are allegations of violations of child care requirements regarding off premise activities and transportation” was unsubstantiated. “There are allegations of violations of child care requirements regarding supervision” was unsubstantiated. “There are allegations of violations of child care requirements regarding capacity” was unsubstantiated. “There are allegations of violations of child care requirements regarding medication” was unsubstantiated. “There are allegations of violations of child care requirements regarding general safety regarding fire drills” was substantiated. The following violations were observed: Violation Number Comment Rule 1853 The operator did not conduct a monthly fire drill. The last fire drill was completed on June 6, 2025. A fire drill was due to be completed by July 6, 2025. .1719(a)(15) & .1721( e)(2) Technical Assistance: Supervision Children must be adequately supervised at all times in a family child care home. Adequate supervision means that: (1) For pre-school age children, the family child care home operator must be positioned in the indoor and outdoor environment to maximize his or her ability to hear and see the children at all times and render immediate assistance; (2) For school-age children, the operator must be positioned in the indoor and outdoor environment to maximize his or her ability to hear or see the children at all times and render immediate assistance; (3) The operator must interact with the children while moving about the indoor or outdoor area; and (4) For children of all ages: (A) the operator must know where each child is located and be aware of children's activities at all times; (B) the operator must provide supervision according to the individual age, needs, and capabilities of each child; (C) all of the conditions in this Paragraph must apply except when emergencies necessitate that adequate supervision is impossible. Written documentation of emergencies stating the date, time, and reason must be maintained and available for review by Division representatives upon request; and (D) for children who are sleeping or napping, the operator must not be required to visually supervise them, but must be able to hear and respond without delay to them. Children must not sleep or nap in a room with a closed door between the children and the operator. The operator must be on the same level of the home where children are sleeping or napping. I suggested you review this rule annually. I also suggested you continue to implement your process to ensure all children are accounted for at all times throughout the day. Sanitation/Health To assure the health of children through proper sanitation, the family child care home operator must have sanitary toilet, diaper changing, and hand washing facilities as follows: (1) diaper changing areas must be separate from food preparation areas, (2) toileting areas must have toilet tissue available at all times, (3) all toilet fixtures must be cleanable and in good repair, (4) diapering surfaces shall be smooth, intact, nonabsorbent, and cleanable, and (5) potty chairs and diapering surfaces must be cleaned after each use. Diapers must be changed whenever they become soiled or wet. The operator must gather all diapering supplies before placing a child on the diapering surface, and place soiled diapers in a covered, leak proof container which is emptied and cleaned daily. The family child care home operator must wash his/her hands as follows: (1) prior to caring for children each day, before and after handling food and feeding the children, (2) before and after diapering each child, and (3) after toileting or handling bodily fluids. The family child care home operator must ensure that children wash their hands as follows: (1) upon arrival at the home each day, (2) after diapering the child, (3) before and after the child is fed, and (4) toileting or handling bodily fluids. Handwashing procedures must include: (1) using liquid soap and water, (2) rubbing hands vigorously with soap and water for 15 seconds, (3) washing all surfaces of the hands, to include the backs of hands, palms, wrists, under fingernails and between fingers, (4) rinsing well for 10 seconds, (5) drying hands with a paper towel or other hand drying device, and (6) turning off faucet with a paper towel or other method without recontaminating hands. I suggested you reach out to Tara Knight, Child Care Consultant with the Gaston County Department of Health and Human Services, at 704.913.3129, to request technical assistance and training regarding handwashing, diapering and sanitation. I also suggested you review these requirements to ensure proper sanitation/health requirements are followed. Off-Premises Activities/Transportation I reviewed with you the requirements for off-premises activities and transportation. You stated you do not currently provide transportation. You asked questions regarding adding transportation to your license. I discussed with you the required information you need to email me to review prior to conducting an announced visit to inspect your transportation vehicle. As a reminder, I must monitor your transportation vehicle before you transport children. Children’s Records I reviewed with you the requirements to maintain the records for each enrolled child. I suggested that you create a one-page acknowledgement form for parents to sign off on all policies at enrollment, including the child’s name, date of enrollment, parent’s signature, and the date of the parents’ signature. Keep this documentation on file for review for each child enrolled. I also suggested that you utilize the Children’s File Checklist to assist you with ensuring parental acknowledgements for all policies are included and on file for review. Developmentally Appropriate Activities The family child care home operator must provide developmentally appropriate activities as planned on a written schedule and activity plan. When screen time is provided on any electronic media device with a visual display, it must be offered to stimulate a developmental domain in accordance with the North Carolina Foundations for Early Learning and Development as referenced in this Section, limited to a maximum of 30 minutes per day and no more than a total of two and a half hours per week per child, and documented on a cumulative log or activity plan, and must be available for review by the Division. When needed to complete homework assignments, screen time for school-age children may exceed 30 minutes. Screen time is prohibited for children under the age of three years, and you must offer alternate activities for children under the age of three years. I suggested you continue with using your current processes to provide daily developmentally appropriate activities to all children in care. Medication A parent may give standing authorization for up to six months to administer prescription or over-the-counter medication to a child, when needed, for chronic medical conditions, such as asthma, and for allergic reactions. A parent may give standing authorization for up to 12 months to apply over-the-counter, topical ointments, topical teething ointment or gel, insect repellents, lotions, creams, fluoridated toothpaste, and powders, such as sunscreen, diapering creams, baby lotion, and baby powder, to a child, when needed. I suggested that Permission to Administer Medication Forms be kept with the medication. Program Records I reviewed with you the requirements for program records as related to operational policies, arrival/departure procedures, and daily attendance. I shared with you the FCCH Program Requirement Checklist document that is available on the DCDEE website at https://ncchildcare.ncdhhs.gov/Portals/0/documents/pdf/P/Program_Requirement_Checklist_FCCH.pdf?ver=cbjx2qD4Br30JITFaaU5QQ%3d%3d. I suggested you use this checklist to track and maintain your program records. Capacity Your program operates with a four (4) star rated license issued on January 12, 2024, earning seven (7) points in staff education, two (2) points in program standards, and one (1) quality point. The permit restrictions were in compliance including: daytime care, 2nd shift, overnight, serves no more than two (2) infants under one (1) year of age, and maximum of five (5) 5 preschool children at any time. You stated you have three (3) children enrolled. Two (2) children were present during the visit. I suggested you maintain a process to ensure capacity and permit restrictions as outlined on your license. General Safety I reviewed with you the requirements for program records as related to fire and emergency drills, and EPR Plan. The family child care home operator must complete and maintain documentation that monthly fire drills are practiced. The documentation must include the date each drill is held, the time of day, the length of time taken to evacuate the home, and the operator's signature. Emergency drills, a lockdown drill or a shelter-in-place drill, must be completed at least every three months. Documentation of lockdown or shelter-in-place drills giving the date each drill is held, the time of day, the length of time taken to get into designated locations and the signature of the person who conducted the drill must be available for review. The family child care home operator must review the Emergency Preparedness and Response Plan annually, or when information in the plan changes, to ensure all information is current. I suggested you place a reminder on your calendar to alert you to complete time-sensitive tasks. Your last annual compliance visit was conducted on July 24, 2023. Upon arrival you, Tosha Jackson, assisted me with the visit. Tiffani Sims, Child Care Consultant, accompanied me on the visit. The North Carolina Secretary of State website was viewed on July 2, 2024, and Tosha’s Tiny Tots was not listed. If you decide to sell your business, then you must notify me at least thirty (30) days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location, or inherited. You had no updates to report. The FCCH and Centers Located in a Residence Operator’s Statements of Responsibility form and the Verification of Required Information for Operator and Additional Caregivers form were completed and signed during today’s visit. Your signature on these forms served as verification the information provided was accurate. Your program operates with a four (4) star rated license issued on January 12, 2024, earning seven (7) points in staff education, two (2) points in program standards, and one (1) quality point. The permit restrictions were in compliance including: daytime care, 2nd shift, overnight, serves no more than two infants under one year of age, and maximum of 5 preschool children at any time. You stated you have six (6) children enrolled. Three (3) children were present during the visit. I observed the children during free play indoors, handwashing routine and lunch. You stated you have one (1) child enrolled on 2nd shift, and no children enrolled on 3rd shift. A walk-through was completed. All indoor and outdoor spaces used by children in care were monitored. A checklist was used to note the requirements I monitored. Inspections/Drills: The last monthly fire drill was completed on July 2, 2024 at 9:00am. The fire extinguisher was fully charged and is located in the kitchen on top of the refrigerator. The last emergency drill was a Shelter-in-Place completed on July 3, 2024 at 10:00am. The last outdoor inspection was completed on July 5, 2024. Files Reviewed: Two (2) children’s files were reviewed. Your file was reviewed. Your Criminal Background Check Qualifying letter was reviewed and was in compliance. The following violations were observed: Violation Number Comment Rule 2048 Products that are labeled “keep out of reach of children” with an additional warning(s) on the label, were not kept in locked storage while children were in care. One (1) bottle of Therabreath Mouthwash and one (1) container of Zep Disinfecting Towels, both with the label “keep out of reach of children” and additional warnings, were observed in the unlocked cabinet located in the bathroom used by children enrolled. 10A NCAC 09 .1719(a)(7) Technical Assistance regarding the violations observed: Storage of Hazardous Products I suggested that you complete a daily safety check before children arrive daily for care. I discussed with you that hazardous products with warning labels “keep out of reach of children” must be kept in locked storage. During the visit you placed the hazardous products in locked storage to correct the violation. Consultation: -Lead Testing: I reviewed with you the new child care rule for lead testing that went into effect on January 1, 2024. I also discussed with you that I had checked the Clean Water for Kids website and that your program has completed the lead water testing, and your program is in progress for lead based paint and asbestos testing. Reminders & Resources: -All licensed child care programs must register by May 1, 2024, at www.cleanwaterforUSkids.org/carolina and watch one of the pre-enrollment webinars. Family Child Care Homes have until January 1, 2025, to complete the required lead testing. -You must complete on-going health and safety trainings every five years. -Two unannounced compliance monitoring visits will be completed annually. - Child care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to maintain at least a 75% compliance history for each 18-month period. Your last annual compliance visit was conducted on August 4, 2022. You, Tosha Jackson, assisted me today. Health and safety requirements were also monitored. Your program currently operates with a four-star license issued on December 10, 2019. The restrictions listed on your license include daytime and overnight, maximum of 5 preschool children at any time, and serves no more than two infants under age one. You stated you have seven (7) children enrolled and three (3) children were present when I arrived. I observed the children during indoor free play, lunch, group time/singing, handwashing, routines, and nap/rest. Three (3) children’s files were reviewed. A walkthrough of the spaces used by children in care was conducted. The outdoor area was monitored. A checklist was used to note the requirements I monitored today. NC Secretary of State: I viewed the North Carolina Secretary of State’s website and Tosha’s Tiny Tots was not listed. You stated you had no updates to report. The following violations were observed, reviewed, documented, and corrected during the visit. Violation Number Comment Rule 705 All medicines, including refrigerated and unrefrigerated, were not kept in locked storage. One (1) container of Metamucil was stored on the countertop to the left of the stove in the kitchen. .1719(a)(5) 706 Corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, and products under pressure in an aerosol dispenser and any substance that may be hazardous to a child if ingested, inhaled, or handled were not kept in locked storage when children were in care. Under the sink in the bathroom used by children enrolled, one (1) aerosol can of Complete Home Disinfecting Spray and four (4) bulbs of Glade plug-ins were stored in the unlocked cabinet. .1719 (a)(7) 1922 Plastic bags, toys, and toy parts small enough to be swallowed, including but not limited to materials that can be easily torn apart such as foam rubber and styrofoam, were accessible to children under the age of three. In the space/classroom used by children enrolled, one (1) plastic bag filled with pull-ups and one (1) plastic bag containing baby wipes was stored in an unlocked fourth drawer in the hard plastic six drawer unit. The pull-up bag and baby wipes bag listed multiple warnings in addition to "keep out of reach of children." Two (2) children, one year of age were observed in this space. .1719(a)(18) Compliance History: The facility’s compliance history prior to today’s visit was viewed. The program’s compliance history was one hundred percent (100%) as of July 23, 2023. Child care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. Technical Assistance Regarding Violations Documented and Corrected During the Visit: • I reminded you that items stored in plastic material must be kept inaccessible to children under three (3) years of age. I suggested that you either remove the pull-ups from the plastic bag or store the pull-ups in the plastic wrapper at least five (5) feet from ground level. You corrected this violation by removing the pull-ups from the plastic bag and placing the pull-ups in the drawer. • I reminded you that aerosol cans containing disinfectants and Glade scented plug-in bulbs contain hazardous liquids and must be kept in locked storage. You corrected the violation with the hazardous items stored under the sink in the bathroom by placing the items in the bathroom closet and locking the closet door. • I reminded you that any personal medications must be kept in locked storage. This includes prescription and non-prescription/over-the-counter medications. You removed the Metamucil from the countertop next to the stove in the kitchen and placed it behind a locked door in the hallway. Consultation: • You currently have chicken wire covering your outdoor air conditioning unit. I encouraged you to either place fencing around the outdoor unit or use an alternate material that has smaller holes so that items cannot fall through and access the fan blades. We discussed using a mesh screen over the top and placing the chicken wire over the screen and then securing the chicken wire around the unit. • I suggested that you complete the lead test for water that was offered. Let me know if I need to send you the news blast that was emailed. Rated License Status: • We discussed beginning the three-month self-assessment on August 1, 2023. We discussed potential options and ideas for completing the self-assessment. I will need this documentation prior to reissuing your star rated license. As discussed, please email me your three-month self-assessment on November 1, 2023, so that I can complete the requirements for your family child care home license. Please let me know if you have any questions regarding the process. If you have any education that has not been processed, I suggested that you send your official transcripts in for evaluation. Once, I receive your self-assessment, I will complete the rated license and you will receive the license from the Raleigh office. You will need to post the license in a prominent place once it is received.
