You, Ashley McKenzie, Assistant Director/Legal Designee, assisted me with today’s visit. Your program currently operates with a three (3) star license issued November 18, 2021. The permit restrictions were in compliance including First Shift (daytime care), meets enhanced ratios, and bldg 1 capacity-91, bldg 2 capacity. The Secretary of State website was checked on April 22, 2026, and your business, Eagles Nest Learning Group, LLC, was active and in good standing. If any changes to the corporation need to be made or you decide to sell your business, then you must notify me at least thirty days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location, or inherited. The last sanitation inspection was conducted on December 17, 2025. A “superior” classification was issued with two (2) demerits noted on the grade card. The last fire inspection was conducted on March 17, 2026. The most recent fire drill was conducted on March 11, 2026, the most recent emergency drill was conducted on January 15, 2026, and the most recent playground inspection was conducted on April 14, 2026. You received the results of your most recent lead water testing showing no levels of lead above the allowed amount, on April 1, 2024. Per the facility data on the Clean Classrooms for Carolina Kids website, your facility is exempt from lead-based paint and asbestos testing. A walk-through of the facility was completed today and all indoor and outdoor areas were monitored. I observed children in the indoor and outdoor learning environment. Children throughout the facility were participating in routines, outdoor play, group time, lunch, napt, and free play during the visit. Limited monitoring of staff files was conducted for the purpose of reviewing training regarding CPR/First Aid, EPR, Playground Safety, ITS-SIDS, Special Training, and Criminal Background Checks. Three (3) new staff members were hired since the last visit. The following violation was observed/documented during the visit: Violation Number Comment Rule 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. One (1) aerosol can of Sanis Micro Metered Air Freshener, one (1) bottle of Air Purpose Peppermint Sage All Purpose Cleaner, and one (1) container of Disinfex Disinfecting Wipes, all with multiple warnings and all accessible to children, were on the shelf the bathroom used by children between Space #4 and Space #5. .2820(b) You must maintain at least 75% Compliance History for each 18-month period as required by G.S. 110-90(4) (c). Prior to today's visit, your program maintained a compliance history of 92%. Please note any violations cited during future visits will negatively impact your compliance history. Repeated violations or violations left unresolved may lead to an administrative action. Technical assistance was provided on the following: 1. All hazardous items with multiple warnings and items in aerosol containers must be kept in locked storage. Items labeled “keep out of reach of children” with no other warnings may be stored five (5) feet off the ground. I suggested you have staff members check the classrooms thoroughly each morning, prior to children arriving, to ensure all items are stored properly. I also suggested you review this information with all staff members to ensure they can understand which items need to be locked based on warning labels. The hazardous products were placed in a locked closet in Space #4 during the visit. All hazardous products will be kept in the locked closet or other locked storage. Consultation We discussed the QRIS Modernization and the Pathway to the Stars. We reviewed all three (3) pathways, as well as the Family and Community Engagement Standards. I encouraged you to visit the QRIS Modernization website to review information regarding the changes to the rated license process. In Space #1, one (1) infant, eight (8) months of age, had a visual sleep check conducted on November 20, 2025, at 2:00pm and not again until 2:20pm. In Space #1, one (1) infant, ten (10) months of age, had a visual sleep check conducted on November 4, 2025, at 12:50pm and not again until 1:10pm, on November 12, 2025, at 1:20pm and not again until 1:45pm, and on November 21, 2025, at 12:30pm and not again until 1:10pm. 10A NCAC 09 .0606(a) 1123 All vehicles used to transport children were not free of hazards. On the van used to transport children, the upholstery was torn, exposing foam on the seat of the left seat on the back row, on the left armrest on the left seat on the second row, and on the left armrest of the middle seat on the first row. 10A NCAC 09 .1002(a) 1311 Emergency medical care information was not on file in the center on the child's first day of attendance and/or was not updated as changes occurred or at least annually for each child. The most recent update of emergency information on file for one (1) child, enrolled on August 21, 2023, was completed on August 14, 2023. .0802(c) The violations documented must be corrected immediately. On or before December 8, 2025, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected, and how compliance will be maintained in the future. Include the violation item number, statement of compliance, date of the visit, and license ID number in the letter. Please be aware any information submitted by you is considered legal documentation. If it is determined the information provided in the letter is not true, it may be considered falsification of information. If sufficient information is not received by the due date, an unannounced follow-up visit may be conducted. I suggested you review the facility’s safe sleep policy with all staff members that work in the room for infants and at least annually thereafter, to ensure the policy is followed at all times. Additionally, I suggested you contact Tara Knight, Child Care Health Consultant with the Gaston County Department of Health and Human Services at 704.913.3129 to request additional technical assistance regarding safe sleep. 2. Vehicles used to transport children enrolled in child care centers must be free of hazards such as, but not limited to, torn upholstery that allows children to remove the interior padding, broken windows, holes in the floor or roof, or tire treads of less than 2/32 of an inch. I suggested that you remind any staff member who drives the vehicle used to transport children that a check of the vehicle should be conducted daily to ensure it is in good repair before using the vehicle to transport children. I also suggested you add chair covers to the torn seats or contact your auto repair shop to have the seats repaired. 3. Emergency medical care information must be on file for each child. That information must include: (1) the name, address, and telephone number of the parent or other person to be contacted in case of an emergency; (2) the responsible party's choice of health care professional; (3) any chronic illness and any medication taken for that illness; and (4) any other information that has a direct bearing on ensuring safe medical treatment for the child. This emergency medical care information must be on file in the center on the child's first day of attendance and must be updated as changes occur and at least annually. I suggested you create a schedule to have all families update emergency information regularly to ensure the information is updated at least annually as required. I also suggested you immediately place documentation in children’s files when you receive them to ensure they are not misplaced and are available for review at all times. I suggested you review the facility’s safe sleep policy with all staff members that work in the room for infants and at least annually thereafter, to ensure the policy is followed at all times. Additionally, I suggested you contact Tara Knight, Child Care Health Consultant with the Gaston County Department of Health and Human Services at 704.913.3129 to request additional technical assistance regarding safe sleep. 2. Vehicles used to transport children enrolled in child care centers must be free of hazards such as, but not limited to, torn upholstery that allows children to remove the interior padding, broken windows, holes in the floor or roof, or tire treads of less than 2/32 of an inch. I suggested that you remind any staff member who drives the vehicle used to transport children that a check of the vehicle should be conducted daily to ensure it is in good repair before using the vehicle to transport children. I also suggested you add chair covers to the torn seats or contact your auto repair shop to have the seats repaired. 3. Emergency medical care information must be on file for each child. That information must include: (1) the name, address, and telephone number of the parent or other person to be contacted in case of an emergency; (2) the responsible party's choice of health care professional; (3) any chronic illness and any medication taken for that illness; and (4) any other information that has a direct bearing on ensuring safe medical treatment for the child. This emergency medical care information must be on file in the center on the child's first day of attendance and must be updated as changes occur and at least annually. I suggested you create a schedule to have all families update emergency information regularly to ensure the information is updated at least annually as required. I also suggested you immediately place documentation in children’s files when you receive them to ensure they are not misplaced and are available for review at all times. You placed the prescription medication in a locked box during the visit and stated the prescription medication was not being used at this time and that you would send it home with the child’s parent. You also locked the refrigerator used to store staff medication during the visit. I reminded you that any prescription medication, including staff medication, must remain locked at all times. 2. Emergency medical care information must be on file for each child. The last playground inspection was completed on December 22, 2023. The last fire drill was completed on December 22, 2023. A complete walkthrough of licensed indoor and outdoor spaces was conducted. A checklist was used to note the requirements I monitored today. Files Reviewed: Children’s files, program files, and staff files were monitored today. Seven (7) children's files were reviewed during today’s visit. One (1) staff file was reviewed, and two (2) new staff files were reviewed today. I discussed the Staff and Training Worksheet and the Children’s Record form with you today. Both forms were completed and verified during the visit. The following violations were observed during the visit today. I discussed these violations with you in detail at the end of the visit. Violation Number Comment Rule 106 Operator has not scheduled and obtained a fire inspection within 12 months of the previous inspection. Operator did not submit the original approved report to DCDEE within one week of the inspection visit on a form provided by the Division. The current fire inspection available for review was dated August 30, 2023. The previous fire inspection was conducted on June 30, 2022. The fire inspection was not submitted to DCDEE within one week of the inspection. The fire inspection report was emailed to the DCDEE Child Care Consultant on September 13, 2023. 10A NCAC 09 .0304(a) The following Technical Assistance regarding the violations observed during today’s visit was provided: Fire Inspection Reports: As a reminder, fire inspection reports are required annually and must be completed before the last date of when the last fire inspection was conducted. I suggested contacting the Fire Marshall’s office at least four to six weeks prior from when the last fire inspection was completed to get on their calendar to ensure the fire inspection report does not exceed the one-year date. Also, fire inspections must be submitted to DCDEE within one week of the completed fire inspection. Compliance History: You must maintain at least 75% Compliance History for each 18-month period as required. Prior to today’s visit your compliance history was eighty-eight percent (88%). Please note any violations cited during future visits will negatively impact your compliance history. Repeated violations or violations left unresolved may lead to a recommended administrative action. Compliance Letter: You must correct the violations found during today's visit immediately. Please send me a letter verifying compliance by January 26, 2024. Please include in that letter each item number and explain in detail how you corrected each violation and what plan will be implemented to prevent these violations from occurring again. Based on Child Care Rule 10A NCAC 09 Section .2200, the Division of Child Development may take administrative action against the license and/or impose civil penalties based on the failure of the operator to correct any documented violations within the established time period. Eagles Nest Child Development Center is in cohort #3 for resuming the star rated license reassessment. Your child care program’s prep year will begin on July 1, 2025, through June 30, 2026.
