I was accompanied by Ashley Blake, registered environmental health program specialist. Upon our arrival, we were greeted by the assistant director, C. Tassielli. The administrator, N. Pittman, arrived a short time later. Limited monitoring of the child care requirements occurred during today’s visit. The license was posted. We were accompanied by Ms. Pittman as we completed a general walk-through of the indoor areas. A total of 112 children were present. The children were observed during naptime and completing routine care tasks. During today’s visit the facility’s cleaning and sanitizing practices, hand washing practices, diapering procedures, health policies, exclusion procedures and communication with families were reviewed due to a reported exposure to Norovirus/E.coli. Environmental Health provided guidance regarding infection control measures, cleaning and disinfection procedures, and recommendations to reduce the spread of illness within the facility. The following violations were observed, documented and technical assistance regarding maintaining compliance was offered. Violation Number Comment Rule 410 Each child did not have an opportunity to be outdoors daily, if weather conditions permitted. A teacher reported that in the classroom designated for one year old children did not go outside this week. GS 110-91(2);.0508(c) 608 Children did not wash their hands upon arrival at the center, after each visit to the toilet, before eating, before and after water activity play, after outside play, and after handling animals or animal cages. An infant's hands were not washed prior to a bottle feeding. 15A NCAC 18A .2803(c) 812 Electrical outlets and power strips, not in use, which were located in space used by children did not have safety outlets or were not covered with safety plugs unless located behind furniture or equipment that cannot be moved by a child. In two classrooms, electrical outlets were not covered with safety plugs. 10A NCAC 09 .0604(c) 875 The center did not follow all procedures to prevent the spread of communicable diseases described in 15A NCAC 18A .2800. Following a confirmed case of norovirus and E. coli, fifty three (53) children and staff have been excluded from care or work due to symptoms of diarrhea and vomiting. 10A NCAC 09 .0804(b)(1) 876 The center did not separate from others those children who became ill or who were suspected of being ill with a communicable disease or condition that would exclude them from care. The administrator, N. Pittman was present and assisted with today’s visit. I monitored the indoor and outdoor environments for compliance with child care requirements. Staff/child ratios, supervision, use of space and capacity were monitored for compliance. The permit, sanitation, evacuation, safe arrival and departure procedures, first aid chart, menus, activity plan, daily schedule, staff/child ratios, emergency medical care plan, emergency telephone numbers and a summary of NC Child Care Law were all posted at the time of the visit. The storage of medication and hazardous products was also monitored for compliance. Ten new staff members had been hired since your June 11, 2025 routine unannounced visit. The ten new staff files, and a sample of existing staff files were reviewed and the Staff and Training worksheets were reviewed. A sample of children's records were reviewed, and the worksheet was completed. The last fire drill was documented as conducted on 7-3-25 at 2:30 pm with an evacuation time of one minute and six seconds. The last outdoor inspection was documented as conducted 7-21-25. A lockdown drill was documented as conducted on 7-21-25 at 11:45 am. An approved fire inspection was last completed on 9-5-25. A sanitation inspection was last completed on 6-16-25 with zero demerits and a superior classification. The corporation status of Premier NC Garner, LLC was verified as current and active during today's visit using the Secretary of State's website. During the visit, the children were observed playing outside, participating in routines and eating lunch. For lunch the children had marinated meatballs, mashed potatoes, bananas and milk. A four star child care center license with four points in education, five points in program standards and one quality point was issued to you on 6-4-22. Child Care Consultant, Tanya Herring accompanied me on today’s visit. Upon our arrival we were greeted by Director N. Pittman and Assistant Director, Kristin Antonucci. Limited monitoring of the child care requirements occurred during today's visit. The license was posted. I completed a general walk-through of the indoor play environments. Children were observed getting up from nap, eating snack and participating in teacher directed circle time activities. For a snack the children had graham crackers, orange slices and water as indicated on the menu. Some of the younger children had bananas rather than oranges slices. Staff/child ratios were maintained, and children were adequately supervised. We reviewed the complaint with both Ms. Pittman and Ms. Antonucci and both were given an opportunity to provide their perspective surrounding the allegations outlined in the report. The allegations were as follows: There is a concern that diapers are not changed as needed in the classroom for the one-year-old children. There is a concern related to sanitation and health. There is a concern of inadequate supervision in the classroom for one-year-old children. There is a concern that the posted menu for meals and snacks is not followed. There is a concern related to nutrition. There is a concern that daily activity plans are not posted or implemented. There is a concern that children are being offered screen-time on a daily basis. There is a concern that children were not attended to in a nurturing and appropriate manner or in keeping with the children’s developmental needed in the classroom for three-year-old children. The following violations were cited during today's visit: Each allegation was reviewed with you. The following information was provided, and observations were made: You stated that you use Pro Care Engage and each diaper change is entered and can be viewed by the parents at any time. Today we observed the entries for your daughter. You stated that diapers are changed on an as needed basis. Based on the information provided and on observations made during the visit, the allegation pertaining to diaper changes was not confirmed and a violation was not documented. A sanitation inspection was completed on June 27, 2024. There were three demerits and a superior classification. While visiting the classrooms today we observed sanitizer on the tables as they were being cleaned. The classrooms appeared clean today. Based on the information provided and on observations made during the visit, the allegation pertaining to sanitation and health was not confirmed and a violation was not documented. In the Toddler 2 classroom there were twelve (12) children enrolled and six (6) children present with one teacher. We observed the teachers in the classrooms for the toddlers and the teachers throughout the facility being attentive to the needs of the children. You stated today that all staff members are required to keep their cell phones locked in the closet in the classroom during the day while they are responsible for a group of children. Based on the information provided and on observations made during the visit, the allegation pertaining to inadequate supervision was not confirmed and a violation was not documented. Today we observed a current menu posted in the area by the front door where the parents enter the building and a menu in the kitchen and in each classroom. We observed the children eating snack today in several classrooms. The snack they were eating was what was indicated on the menu. We also observed the July menu today. There were a variety of foods listed on the menu and the menu met Meals Patterns for Children in Child Care. You stated today that the information regarding what each child eats is logged into Pro Care Engage so the parents know not only what was served but also how much their child ate. You stated today that you have recently changed your menu to add more fresh and fresh frozen items. Based on the information provided and on observations made during the visit, the allegations pertaining to the posted menu not being followed and nutrition was not confirmed, and a violation was not documented. An activity plan and daily schedule was posted in each classroom today. The activity plans were current and based on observations during the walk through of the classrooms today, it appeared that they were being followed. You stated today that the children play outside for an hour in the morning and an hour in the afternoon as the weather permits. You stated that they go outside everyday, but depending on the weather the time might be broken up into shorter increments of time. You stated today that the older children (3-5) are allowed to have screen time for 30 minutes per day, but they usually choose not to have it because they do not want to have to log it in the screen time log. Based on the information provided and on observations made during the visit, the allegations pertaining to activity plans not being posted or implemented and children being offered screen time on a daily basis was not confirmed and a violation was not documented. Today we observed all of the teachers being attentive to the needs of the children. All of the children seemed happy and relaxed in the classroom for the three year old children and throughout the facility. We did not hear any teachers being loud or talking ugly or inappropriately to the children. Based on the information provided and on observations made during the visit, the allegations pertaining to children not being attended to in a nurturing and appropriate manner or in keeping with the children’s developmental needs in the classroom for the three year old children was not confirmed and a violation was not documented. The emergency medical care plan was not posted. 10A NCAC 09 .0802(a) 1791 The child care provider did not provide the required beverage(s). In the refrigerator there was reduced fat (2%) milk rather than low fat (1%) or skim milk. .0901(e)(1-7) Today you served the younger children bananas, but oranges were listed on the menu. I did not document a violation because you stated that the parents were informed through Pro Care Engage as to what was served and what the child ate. Today you had a menu posted in each classroom and one by the entrance and one in the kitchen. I suggested today that you take the menus out of the classrooms and leave the one in the central location by the entrance and in the kitchen because when substitutions are made to the menu you must make the changes on each menu prior to serving the food. You are not required to post a menu in each classroom and if you removed them it lessen the chance of you overlooking one when substitutions are made. Today you stated that you plan to add a column to the menu for notes such as what might be served to the younger children when they cannot eat what is listed on the menu. A violation was documented today because you did not have any low fat or skim milk. You had 2% milk which is reduced fat not low fat as required by child care rule. Today I reminded you that if your policies do not explain your outdoor play policy and expectations that you need to add it and make the parents aware of it when they enroll their child. I reminded you today that if you choose to allow the children (three years of age and older) to participate in screen time it must be educational, it must be logged and it cannot be for more than thirty minutes per day. Child care licensing requirements are established to ensure a safe and healthy child care environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your program. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the childcare law and rules. I explained that you have access to the on-line version of the Child Care Rule Book, as well as a hard copy of the rules. I recommended that you visit the Division of Child Development's website (www.ncchildcare.nc.gov) on a regular basis to find out what's new in childcare. You could also find any needed Child Care forms by going on the web site and clicking on the "Provider" tab and then clicking on the "Provider Documents" tab. The permit, sanitation, evacuation, safe arrival and departure procedures, first aid chart, menus, daily schedules, activity plans, summary of NC Child Care Law and staff/child ratios were posted at the time of the visit. The storage of medication and hazardous products was also monitored for compliance. Eleven new staff members’ files and files for a percentage of existing staff were reviewed and the information on the Staff and Training Worksheet was verified. A sample of children's records were reviewed during the visit and the worksheets were completed. The last outdoor inspection was documented as conducted on 11-8-23. A fire drill was documented as conducted on 10-19-23 at 10:45am with an evacuation time of sixty seconds. A lockdown drill was documented as conducted on 10-23-23 at 10:00 am. An approved fire inspection was completed on 11-28-22. A sanitation inspection was last completed on 6-14-23 with eight demerits and a superior classification. The children were observed preparing for lunch and eating lunch which consisted of spaghetti with meat sauce, peas, apples and milk.
