    Name of Operation: CLEVELAND CHILD CARE AND DEVELOPMENT CENTER Facility ID: 51000647 Consultant: BECKY JACKSON Operation Type: Center Case Number: 0326-016L Visit Date: 3/5/2026 Number Present: 127 Completed Date: 3/5/2026 Age: From 0 To 5 Total Minutes: 90 Time In: 10:30 AM Time Out: 12:00 PM Time In: Time Out: List to Use: Center Type Of Visit: Complaint Visit Announced/Unannounced: Unannounced The purpose of today's unannounced visit was to investigate allegations of non-compliance with child care requirements received by the Division of Child Development and Early Education (DCDEE) on March 3, 2026. The allegations were as follows: There is a concern that the facility failed to report an incident. There is a concern that children’s diapers were not changed as required. There is a concern that children are not in a safe indoor environment. Upon arrival to the facility I was greeted by the owner representative and Administrator. Both were notified of the purpose of the visit. Limited monitoring of the child care requirements occurred during today’s visit. I was accompanied as I completed a general walk-through of the indoor environment which consisted of 11 classrooms. A total of 127 children were present.The children were observed playing outdoors, transitioning from outdoors to group time, conducting personal care routines (toileting and hand washing) having group singing and reading time, and transitioning into lunch. The infants in care were observed playing on the floor, in bouncers and swings, and interacting with the caregivers. The allegations were shared with you and you were given an opportunity to provide information. In addition, I spoke with classroom staff members during the visit to obtain additional information. The following was determined based on observations made and information provided: Allegation regarding an unreported incident: Administration and staff were interviewed regarding incident reporting procedures and when an incident report is required. They provided appropriate responses regarding when an incident must be documented, how and when parents are notified, and when the Division must be notified of an incident. No staff stated they were aware of an unreported incident. Administrative staff stated they had not been made aware of any incidents they had not received an incident report to document. Administrative staff also stated they had not been notified by a parent or guardian of any incident that has not been reported. I observed the facility’s incident log and observed a random selection of incident reports. All met the child care requirements. Based on information received and observations made, this report is not confirmed. Allegation regarding diaper changing: Staff stated that a named staff member relieved a second named staff member for lunch break while the children were napping, toward the end of naptime. The named staff member was not the typical staff member who relieved breaks and was not familiar with the schedule and routine of the classroom, including changing diapers after the children wake from nap. The second staff member stated when she came back to the classroom from her lunch break the children were up and not been changed. It was determined that the children had been up approximately 30 minutes before the first diaper changes began. As children’s diapers were not changed whenever they were soiled or wet, this report is being confirmed, and a violation regarding diaper changing requirements is being documented. Allegation regarding safe indoor environment: Staff stated they are aware of a confrontation between two staff members which occurred in a classroom where children one year of age received care. The children were recently up off their mats from nap and were milling about the classroom. A named staff member came back from break and determined that the children’s diapers had not been changed when the children had gotten up. She stated in a firm, loud tone that the second staff member knew the children needed to be changed, and to “Get Out” of the classroom so she could begin to change the diapers. Staff stated that no inappropriate language was used during the confrontation. Staff also stated the children did not appear to notice the exchange, as they remained focused on play and not observing the staff. The administrative staff stated they had discussed the incident with the involved staff and had determined that while the confrontation had been inappropriate, it did not raise to the level of being a hazard or of being an unsafe environment. Staff in surrounding classrooms stated they had heard about the confrontation after the fact; however they did not hear the confrontation occurring. Based on information received, this report is unconfirmed. The following violation was documented today: Violation Number Comment Rule 401 Diapers were not changed whenever they were soiled or wet and/or were changed on a shift basis. It was determined that children's diapers were not changed when they became soiled or wet. 10A NCAC 09 .0806(a) All violations must be corrected immediately. Please send me a compliance letter (written statement) describing how and when the above violations were corrected. The compliance letter must be received no later than March 19, 2026. The compliance letter may be sent to me via email. Contact me if you have questions regarding correction of the violations documented during today’s visit, pertaining to your compliance letter, or if you will not be able to meet the two week timeframe for submission of your compliance letter. If you are unable to correct all violations within the specified timeframe please submit a request for an extension as soon as you determine you will not meet the imposed timeframe. This request should include a specific plan to correct the remaining violations and any time frames needed. This request will need to be approved by DCDEE management. Additionally, DCDEE may also issue an administrative action following a complaint visit during which allegations are confirmed. If it is determined that an administrative action is warranted, you will be notified by mail. Until a determination is made, visits will continue to monitor compliance. Child care licensing requirements are established to ensure a safe and healthy child care environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your program. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the childcare law and rules. I explained that you have access to the on-line version of the Child Care Rule Book, as well as a hard copy of the rules. I recommended that you visit the Division of Child Development's website on a regular basis to find out what's new in childcare. You could also find any needed Child Care forms by going on the web site and clicking on the "Provider" tab and then clicking on the "Provider Documents" tab. I monitored the indoor and outdoor environments for compliance with child care requirements. Staff/child ratios, supervision, use of space and capacity were monitored for compliance. The permit, sanitation, evacuation, safe arrival and departure procedures, no smoking signage, first aid chart, menus, activity plan, daily schedule, staff/child ratios, emergency medical care plan, emergency telephone numbers and a summary of NC Child Care Law were all posted at the time of the visit. The storage of medication and hazardous products was also monitored for compliance. A sample of children's records were reviewed during the visit. No new staff members had been hired since your last visit. A percentage of existing staff files were reviewed today. The last fire drill was documented as conducted on 12-11-25 at 9:20 am with an evacuation time of fifty four seconds. The last outdoor inspection was documented as conducted on 12-11-25. A shelter in place drill was documented as conducted on 12-12-25. An approved fire inspection was completed on 3-12-25. A sanitation inspection was last completed on 12-15-25 with four demerits and a superior classification. The corporation status of Cleveland Child Care & Development Center, Inc. was verified as current and active during the visit using the Secretary of State's website. The children were observed during circle time, playing outside, and in free play. Lunch during the visit consisted of Salisbury steak, mashed potatoes, carrots, roll and milk. A five star child care center with seven points in education, six points in program standards and one quality point was issued to you on 7-30-19 Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. GS 110-91(12); .0508(a) You attended the Director's Meeting held by DCDEE on 10-7-25 during which the new child care requirements in section .3200 pertaining to two through five stars were reviewed. I reviewed the pathways with you and you stated that you were not certain at this time which pathway would be selected. We briefly reviewed the requirements for Family and Community Engagement and the Continuous Quality Improvement (CQI) for the facility and each individual staff member. These forms can all be found on the DCDEE website, under QRIS Modernization on the What's New tab. I encouraged you to become familiar with these forms and to share the individual CQI form with the staff members. As we discussed, should you choose the programmatic pathway that includes the Environment Rating Scales, each classroom will need to complete a three month self study using the Infant Toddler Environment Rating Scale 3rd Edition or the Early Childhood Environment Rating Scale 3rd Edition. You can find more information about the self study process, along with the necessary forms, on the North Carolina Rated License Assessment Project website (NCRLAP.org). I recommended that you have all staff members review their information in the WORKS database to determine if the information is up to date. If not, they will need to submit new official transcripts to the Workforce Unit. Please have them contact this until directly for questions pertaining to the their WORKS account. As we discussed, the goal will be for you to apply for a new rated license between today's visit and July, 2026. All application documents, including the ERS Request form, can be found on the DCDEE website. Computer generated documentation was completed during the visit and reviewed with you. A copy was provided for you today. Child Care Consultant, Kareema King accompanied me on today’s visit. I monitored the indoor and outdoor environments for compliance with child care requirements. Staff/child ratios, supervision, use of space and capacity were monitored for compliance. The permit, sanitation, evacuation, safe arrival and departure procedures, first aid chart, menus, daily schedules, activity plans, summary of NC Child Care Law and staff/child ratios were posted at the time of the visit. The storage of medication and hazardous products was also monitored for compliance. No new staff were hired since the last annual compliance visit. A sample of files for existing staff was reviewed and the information on the worksheet was verified. A sample of children's records was reviewed during the visit and the worksheet was completed. A fire drill was documented as conducted on 1-29-24 at 9:10. A lockdown drill was documented as completed on 1-19-24. An outdoor inspection was documented as completed on 1-29-24. An approved fire inspection was last completed on 3-10-23. A sanitation inspection was last completed on 11-22-23 with seven demerits and a superior classification. During the visit, the children were observed playing in the classrooms and participating in routines. The corporation status of Cleveland Child Care & Development Center, Inc. was verified as current and active during today's visit using the Secretary of State's website. A five star license with four points in education, two points in program and one quality point was issued to you on 2-11-20. Based on information provided and on observations made, you continue to meet the requirements previously met to obtain such a license. Violation Number Comment Rule 1756 Enhanced staff/child ratios and group sizes were not met. In the classrooms for the three year old children (space 7 and space 8) there were 15 three and four year old children present with one caregiver. 10A NCAC 09 .2818 1790 A statement acknowledging the parental decision to opt out of the supplemental food provided by the center was not signed by the parent and/or maintained on file at the center. A signed opt out form was not available for three children who opt out of supplemental food provided by the center. .0901(d) 1834 Application did not have a medical action plan attached for any child with health care needs such as allergies, asthma, or other chronic conditions that require specialized health services. A medical action plan was not available for one child with an allergy. .0801(b) ****Child care licensing requirements are established to ensure a safe and healthy child care environment. As I visited space 7 and (spaces for three year old children) today there were 15 three year old children with one caregiver. Enhanced staff/child ratios for three year old children is 10 children per one caregiver. Violations pertaining to staff/child ratio are particularly serious as they directly impact the safety of the children while in your care and must be corrected immediately. Please send me a written statement describing how and when the above violations were corrected. The written statement must be received no later than 2-14-24. Please note that if your letter is mailed, a handwritten signature is required. As an alternative, compliance letters can now be submitted via email. I recommend emailing your letter to reduce the time needed to ensure my receipt of your information; however, if you do not have access to email, please ensure that your letter is mailed in a timely fashion and that you allow for any possible delays in the mail service.
