L. Wimbush, lead teacher, was present and assisted with the visit. Currently, this center operates with a Five-Star License issued March 21, 2019, earning seven (7) points in the Education Component, six (6) points in the Program Component and one (1) Quality point. The last Annual Compliance visit at this center was completed May 14, 2025. The posted sanitation inspection was completed April 30, 2025 earning a “Superior” rating. The last fire inspection was completed May 1, 2025 and the facility was approved for daytime care only. Children were observed engaging in circle time, activity center play, outdoor play and handwashing/toileting routines. Interactions between teachers and children were observed to be nurturing in nature. The following violations of child care requirements were documented. Violation Number Comment Rule 707 Equipment and furnishings not meeting the requirements outlined in child care .0601(b) and (c) were not removed or made inaccessible. I observed a non-working toilet in space #3 and does not have a tank lid. .0601(d) 841 Medications including prescription and non-prescription items were not stored in a locked cabinet or other locked container. I observed adult Tylenol cold & flu and Tylenol tablets in a bag hung on the back of the entrance door for space #2. 15A NCAC 18A .2820(d) 1323 Each child was not immunized as per Article 6 of Chapter 130A and an immunization record was not on file before or within 30 days after admission. A child enrolled on 9/10/25 has an immunization record dated 8/29/23. 10A NCAC 09 .0302(d)(2) The violations documented above must be corrected immediately. A signed and dated letter of compliance can be mailed or emailed to me and must be received by April 1, 2026. If mailing, you must submit two (2) signed and dated copies. My mailing and email addresses are noted at the bottom. The letter of compliance must detail how you plan to maintain compliance in the future in addition to how it was corrected. Please be aware any written information you submit regarding the correction of the violation is legal documentation. Therefore, it is important that all submitted information is accurate and truthful. If it is determined that submitted information was inaccurate or willfully falsified, an Administrative Action, including Revocation of the facility’s license could be issued. COMPLIANCE HISTORY Prior to today’s visit your compliance history was 91% over an eighteen (18) month period. FACILITY PROFILE This facility is owned by Franklin-Vance-Warren Opportunity, Inc. The corporation is listed as current/active in the North Carolina Secretary of State corporation’s database and is required to remain so. I reviewed contact information for the owner and the facility with you, L. Wimbush, and you verified the current information listed with DCDEE remains correct. QRIS RATED LICENSE ASSESSMENT I left a copy of the Application for Assessment for a Rated License for Centers, Head Start Staff/Child Ratio, Request to Use Accreditation and Head Start for D. Floyd, administrator, to complete and sign. D. Floyd is the only legal designee listed at this time. These forms must be submitted to me in order to complete the star rated license process. This program is eligible for a five (5) star rated license based on Pathway 3-Head Start Accreditation. The effective date will begin once the completed forms are submitted and violations are corrected. I also emailed the Quality Initiatives form for you to review. Should any of these extra quality items apply to this program please submit this form, as well as documentation to verify, along with the previously discussed forms. Please contact me if you have any questions. NC PRE-K This program operates two (2) NC Pre-K classrooms per the NC Pre-K Plan website. NC Pre-K requirements were monitored today. The program operates from 8am to 2:30pm. Starfall Education Foundation as the curriculum, per the NC Pre-k Plan website, to create activity plans. Current staff is listed on the NC Pre-K Plan website for this program and meet requirements. This program uses ASQ-III the developmental screening tool, however the NC Pre-K Plan websites list the screening tool as Brigance Head Start. Please update the NC Pre-K or use the screening tool documented in the plan. This program uses Teaching Strategies GOLD as the continued formative assessments. Both the developmental screening and formative assessment were completed within the required time frame. CHILDREN RECORDS I monitored ten (10) percent of the records for enrolled children and a violation was observed. A child enrolled on 9/10/25 has an immunization record on file dated 8/29/23. The child is specified on the Children’s Records form a copy of which was left with you. Rules required that children have their immunization record on file prior to or no more than thirty (30) days after their enrollment. STAFF RECORDS I monitored ten (10) percent, or more, of staff files and the files monitored were in compliance. STORAGE OF HAZARDOUS ITEMS & MEDICATION While monitoring space #2 I observed a backpack hanging on the back of the entrance door. There were four (4) tablets of adult Tylenol Cold & Flu and four (4) tablets of Tylenol stored in the mesh side pocket of that backpack. Child Care Rules require that all medication, not deemed lifesaving, must be kept in locked storage. Locked storage ensures that children have no access to said medication which can lead to physical injury should they access and use it incorrectly. INDOOR EQUIPMENT & FURNISHINGS I observed a non-functioning toilet in space #3. It also did not have a lid to its tank. The lead teacher informed me that she was told parts have been ordered to repair the toilet. There is a functioning toilet in that space as the bathroom holds two (2). TECHNICAL ASSISTANCE & REMINDERS Technical assistance discussed related to monitoring cardboard blocks for signs of disrepair such as holes or tears. Should this type of wear be observed the time should be replaced. Continue to remind staff that all personal bags, such as purses, should be kept in locked storage. Items not locked in storage are considered a part of the children’s environment and may be monitored by myself. Often people keep items in personal bags that are required to be locked when the program is in operation such as over-the-counter medication, lighters, aerosol products, etc. Diaper wipes have a “Keep out of Reach of Children” warning printed on them. While these items are used in operating programs they must be stored at least five (5) feet above the ground when not in use per Child Care Rules. Please be reminded that items discussed as technical assistance may warrant a violation if observed out of compliance. Ensure that all staff development plans, evaluations, reviews, etc. are dated the day they are completed. This is the only way I can verify it was done within the required time frame. Child care licensing requirements are established to ensure a safe and healthy child care environment. It is your responsibility to maintain compliance with all applicable laws and rules. Observed interactions were nurturing in nature between teachers and children. The following violations of child care requirements were documented. Violation Number Comment Rule 125 Daily records of arrival and departure times for children at the center were not maintained as children arrive and depart and/or were not made available for review. There were several missing arrival/departure times for the month of May in spaces #2 and #3. 10A NCAC 09 .0302(d)(4) 849 Leftover medicines were not returned to the parent after the course of treatment was completed, after authorization was withdrawn or after authorization had expired and/or medication was not discarded within 72 hours of completion of treatment or withdrawal of authorization. The epi pen stored in space #3 for an enrolled child expired March 31, 2025. .0803(12) 1824 The trained staff did not review the EPR Plan annually or when information in the plan changed to ensure all information was current. The date of the last review or revision of the EPR Plan is noted as June 27, 2023. .0607(e) The violations documented above must be corrected immediately. STAFF RECORDS I monitored ten (10) percent, or more, of staff files and the files monitored were in compliance. Continue to ensure that if/when substitute staff are utilized that they have a file on-site for review or carry their staff file with them to each location. If staff working at a site do not have files available to review during the visit then a violation will be documented. MEDICATION I observed an epi pen in space #3 that expired March 2024. All medication stored on-site to administer to children must not be expired or returned to parents if expired. Continue to ensure that all aerosol products are kept in locked storage when not in use as they pose an injury risk should children have access to it. EMERGENCY PREPAREDNESS & RESPONSE PLAN I reviewed the programs EPR plan and observed that it has not been reviewed or revised since June 27, 2023. Child Care Rules require that the EPR plan be reviewed yearly, even if no changes are required. Providers must log into the risk management portal (https://rmp.nc.gov/portal/) to review the plan. If no changes are made and you do not need to print the entire plan then print the cover page, which notes date reviewed or page 28 which notes review/revision dates. You may also print both. When you review the plan change the Child Care Consultant to my name. ENVIRONMENTAL RATING SCALES You were reminded that the hold harmless state has been extended. Therefore, programs that were in cohorts 1 and 2 do not have to proceed with the Environmental Rating Scale assessments (ERS). ERS is voluntary at this time, and you will be notified when this changes. As of February 1, 2025 all the ECERS-3, ITERS-3, and FCCERS-3, also known as the "3s", will be used for all assessments. These third editions come with a spiral binding at the top, replacing the revised editions. I encourage you to go to the North Carolina Rated License Project (NCRLAP) website for more information at: https://ncrlap.org/. There are a variety of webinars and infographics available with detailed information on the changes with the 3s. TECHNICAL ASSISTANCE & REMINDERS Technical assistance discussed related to sand surfacing beneath the playground equipment. I recommend staff redistribute sand at the slide exit as this gets kicked away by children while playing. When children are enrolled in the center’s NC Pre-K program staff should keep a copy of their developmental screening and formative assessment (Teaching Strategies GOLD) on site for review during visits. The developmental screening tool observed was ASQ-3 however it notes that Brigance Head Start Screen in the NC Pre K Plan website. When parents submit the Medication Administration Permission form please review so any missing information can be completed by the parent. The Clean Water for Carolina Kids program has expanded to the Clean Classrooms for Carolina Kids program. This is a legislatively mandated effort to address lead and asbestos hazards in North Carolina public schools, licensed child care centers, and licensed family child care homes. Rules 10A NCAC 41C .1001 through .1007 require all programs to be free of lead and asbestos hazards. Currently operating child care facilities are required to identify if there’s lead in paint and asbestos once unless the consultant notes a concern during a visit and refers the program to environmental health. After reviewing the website, I noted that this facility has completed the lead paint and asbestos testing, and no hazards were identified. The program also completed a second round of lead water testing and is not due again until July 2027. Child care licensing requirements are established to ensure a safe and healthy child care environment. It is your responsibility to maintain compliance with all applicable laws and rules. L. Wimbush, lead teacher, was present and assisted with the visit. Currently, this center operates with a Five-Star License issued March 21, 2019, earning seven (7) points in the Education Component, six (6) points in the Program Component and one (1) Quality point. The last Annual Compliance visit at this center was completed May 29, 2024. The posted sanitation inspection was completed April 25, 2024, earning a “Superior” rating. The last fire inspection was completed May 22, 2024, and the facility was approved for daytime care only. Children were observed waking from nap, completing toileting and handwashing routines, as well as having snack. Teacher interactions with children were positive and nurturing in nature. The following violation of child care requirements was documented. Violation Number Comment Rule 847 Parent's medication authorization did not include required information. STAFF/CHILD INTERACTIONS & TECHNICAL ASSISTANCE Current activity plans and schedules were posted in each classroom. I observed a variety of age-appropriate materials available for the children to use and for implementing the lesson plan. The current theme is “Clothes Investigation.” In space #2 as the children put their blankets and cots away from nap time the teacher reminded them to fold their blankets. She stated, “Remember, we worked on folding clothes today and you can fold your blanket.” This is an example of an activity that works on multiple developmental domains. Children use fine and gross motor skills to fold and learn how to take care of their environment without assistance which builds social-emotional and cognitive skills. The children confirmed they remembered, and some stated they were folding their blankets. Upon my arrival children were napping safely in each space. During the visit children woke from nap and began putting their cots, as well as completing toileting and handwashing routines. I also observed children having snack, which consisted of cheddar Chex mix and grape juice. Technical assistance given related to redistributing the sand surfacing beneath the large equipment periodically. Often surfacing at slide exits gets kicked away and needs to be replenished to ensure it maintains a required depth of at least six (6) inches. I also recommend that staff be reminded that all purses and personal belongings should be kept in locked storage. If a purse or personal bag contains items that should be kept in locked storage like over the counter medication, lighters, cleaning products, etc. it could result in the injury of a child and/or a violation. Anything in the space is considered a part of the children’s environment and may be monitored by a child care consultant. Technical assistance also discussed regarding having teachers of other staff review each classrooms sign in/out sheet to ensure that parents are signing children out as they are picked up. Remember, staff may also sign children in and out of the program as long as an adult documents the time the child arrived or left and notes either their name or initials. These items could result in future violations if not kept in compliance with Child Care Rules. MEDICATION There is a child enrolled in space #2 that has cetirizine medication on-site for allergic reactions. While there is a current medical action plan on file for the child there is no medication administration permission form available. This form is required as written documentation that the parent gave their permission for staff of the facility to give the child the medication when needed. This should be submitted at the same as the medication to ensure they are always available. STAFF RECORDS You noted that no new staff have been hired since the Annual Compliance visit completed May 29, 2024. Therefore, no staff records were monitored. REMINDERS The Clean Water for Carolina Kids program has expanded to the Clean Classrooms for Carolina Kids program.
